		<official-title>To amend title 11 of the United States Code to provide
		  protection for medical debt homeowners, to restore bankruptcy protections for
		  individuals experiencing economic distress as caregivers to ill or disabled
		  family members, and to exempt from means testing debtors whose financial
		  problems were caused by serious medical problems.</official-title>

		<section commented="no" id="H9A6CB41F69634344BC99FEC89531878F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medical Bankruptcy Fairness
			 Act</short-title></quote>.</text>
		</section><section id="H2C502EDF64B343018017D1374227B8D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 of title 11, the United States
			 Code, is amended—</text>
			<paragraph id="HB439557E84B0422700BD1E267E007065"><enum>(1)</enum><text>by inserting after
			 paragraph (39A) the following:</text>
				<quoted-block id="HECF4361172F745EAAB65A1FC3C9EB56E" style="OLC">
					<paragraph id="H8F9355D92C614228A0F5642017EE22CD"><enum>(39B)</enum><text display-inline="yes-display-inline">the term <quote>medically distressed
				debtor</quote> means a debtor who, in any consecutive 12-month period during
				the 3 years before the date of the filing of the petition—</text>
						<subparagraph id="H306AB0BC64794CD985E48C4D8F96932D"><enum>(A)</enum><text display-inline="yes-display-inline">incurred or paid medical expenses for the
				debtor or a dependent of the debtor that were not paid by any third party payor
				and were in excess of the lesser of—</text>
							<clause id="H67024E76BA0B401A00D8DFCC34CD0474"><enum>(i)</enum><text>25
				percent of the debtor’s household income for such 12-month period; or</text>
							</clause><clause id="HDF09AA958445459BA82301CAE96CB81"><enum>(ii)</enum><text display-inline="yes-display-inline">$10,000.</text>
							</clause></subparagraph><subparagraph id="HA0F1B7747CB0406BA64756DF7278FBE5"><enum>(B)</enum><text>was a member of a
				household in which 1 or more members (including the debtor) lost all or
				substantially all of the member’s employment or business income for 4 or more
				weeks during such 12-month period due to a medical problem of a member of the
				household or a dependent of the debtor; or</text>
						</subparagraph><subparagraph id="H6AC9A83461E741BDA72800F39CD8FF71"><enum>(C)</enum><text>was a member of a
				household in which 1 or more members (including the debtor) lost all or
				substantially all of the member’s alimony or support income for 4 or more weeks
				during such 12-month period due to a medical problem of a person obligated to
				pay alimony or
				support.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H8C6B1FC443954E53A4C4F40913F890EB"><enum>3.</enum><header>Exemptions</header>
			<subsection id="HB1E782BA8A2541CA8C91BB7BE2F7004D"><enum>(a)</enum><header>Exempt
			 property</header><text>Section 522 of title 11, the United States Code, is
			 amended by adding at the end the following:</text>
				<quoted-block id="H73E1F7A446F14BEB9300241C5880F91" style="OLC">
					<subsection id="HC195955AC125405EA8D3916A8B3FCA5"><enum>(r)</enum><text display-inline="yes-display-inline">For a debtor who is a medically distressed
				debtor, if the debtor elects to exempt property—</text>
						<paragraph id="HCF5ABD5885B9464CB7FE49F0052F9C5"><enum>(1)</enum><text>listed in
				subsection (b)(2), then in lieu of the exemption provided under subsection
				(d)(1), the debtor may elect to exempt the debtor’s aggregate interest, not to
				exceed $250,000 in value, in real property or personal property that the debtor
				or a dependent of the debtor uses as a residence, in a cooperative that owns
				property that the debtor or a dependent of the debtor uses as a residence, or
				in a burial plot for the debtor or a <italic>dependent</italic> of the debtor;
				or</text>
						</paragraph><paragraph id="H719AECA320C54E9281938E9C7B11DA2D"><enum>(2)</enum><text>listed in
				subsection (b)(3), then if the exemption provided under applicable law
				specifically for such property is for less than $250,000 in value, the debtor
				may elect in lieu of such exemption to exempt the debtor’s aggregate interest,
				not to exceed $250,000 in value, in any such real or personal property,
				cooperative, or burial
				plot.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H720BE06385D84088BEDC5DE44C119BA6"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Sections 104(b)(1) and 104(b)(2) of title 11, the
			 United States Code, are amended by inserting immediately after
			 <quote>522(q),</quote><quote>522(r),</quote>.</text>
			</subsection></section><section id="H6B5D1FB0B3A443C5A006370046792ECC"><enum>4.</enum><header>Dismissal of a
			 case or conversion to a case under chapter 11 or 13</header><text display-inline="no-display-inline">Section 707(b) of title 11, the United
			 States Code, is amended by adding at the end the following:</text>
			<quoted-block id="HA963498C60684EA6AF9BD6E1B4D7AA48" style="OLC">
				<paragraph id="HE5455A2CBBAF433EA543D21010C80493"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7CEB57239BA64B619EAF033CB990EF"><enum>(A)</enum><text>No judge, United States
				trustee (or bankruptcy administrator, if any), trustee, or other party in
				interest may file a motion under paragraph (2) if the debtor is a medically
				distressed debtor or an economically distressed caregiver.</text>
					</subparagraph><subparagraph id="H4DCB2BA104D846268788A246FA3C3D55" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In
				this paragraph, the term <quote>economically distressed caregiver</quote> means
				a caregiver who, within 3 years before the date of the filing of the
				petition—</text>
						<clause id="HEAC26A0DF8CF49CB8C5FCB6BE909FD6"><enum>(i)</enum><text>experienced a downgrade in
				employment status that correlates to a reduction in wages, work hours, business
				income or results in unemployment, to care for a relative for not less than 30
				days; or</text>
						</clause><clause id="HCF99487999C444458547417D16B3E023"><enum>(ii)</enum><text display-inline="yes-display-inline">in any consecutive 12-month period, has
				incurred or paid medical expenses on behalf of a relative that were not paid by
				any third party payor and were in excess of the lesser of—</text>
							<subclause id="H9C296FC5539B49F783338EB994B1D252"><enum>(I)</enum><text>25 percent of the debtor’s household
				income for such 12-month period; or</text>
							</subclause><subclause id="H61C8AD7065284AFB86CC16F8B385C7D6"><enum>(II)</enum><text display-inline="yes-display-inline">$10,000.</text>
							</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H5DD03026520B4459ADE2EA95CAB7D900"><enum>5.</enum><header>Effective date;
			 application of amendments</header>
			<subsection id="HD36F6B762EC045599B6D88C53B30642"><enum>(a)</enum><header>Effective
			 date</header><text>Except as provided in subsection (b), this Act and the
			 amendments made by this Act shall take effect on the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="HAA6A47E326CD40D185C3D3DE04297500"><enum>(b)</enum><header>Application of
			 amendments</header><text>The amendments made by this Act shall apply only with
			 respect to cases commenced under title 11 of the United States Code on or after
			 the date of the enactment of this Act.</text>
