		<official-title>To amend the Public Health Service Act to provide for
		  human embryonic stem cell research, to direct the National Institutes of Health
		  to issue guidelines for such stem cell research, and for other

		<section id="H5A9F537812244D4A00F2B45DF0B5DE29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stem Cell Research Improvement Act of
			 2009</short-title></quote>.</text>
		</section><section id="H5D59DDFA89324879A3BB469BCFD2F778"><enum>2.</enum><header>Human embryonic
			 stem cell research</header><text display-inline="no-display-inline">Part H of
			 title IV of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name> (42 U.S.C. 289 et seq.) is amended by inserting after section
			 498C the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE84F73E12C3C4D9F9E26D75C69E57600" style="OLC">
				<section id="HE9CBD430E7F248239F304D130623D361"><enum>498D.</enum><header>Human
				embryonic stem cell research</header>
					<subsection id="HB81F35D98E4943FDAB7226D23BD896BD"><enum>(a)</enum><header>In
				General</header><text>Notwithstanding any other provision of law (including any
				regulation or guidance), the Secretary shall conduct and support research that
				utilizes human embryonic stem cells (regardless of the date on which the stem
				cells were derived from a human embryo).</text>
					</subsection><subsection id="H4250D2A83F3D43958BDBD325B7B0DBC1"><enum>(b)</enum><header>Ethical
				Requirements</header><text>Human embryonic stem cells shall be eligible for use
				in any research conducted or supported by the Secretary if the cells meet each
				of the following:</text>
						<paragraph id="H18698C1ABBC547CA9158373937B66BD6"><enum>(1)</enum><text>The stem cells
				were derived from human embryos that have been donated from in vitro
				fertilization clinics, were created for the purposes of fertility treatment,
				and were in excess of the clinical need of the individuals seeking such
				treatment.</text>
						</paragraph><paragraph id="HF1EF240451AD4D08B20058C7F022F2FC"><enum>(2)</enum><text>Prior to the
				consideration of embryo donation and through consultation with the individuals
				seeking fertility treatment, it was determined that the embryos would never be
				implanted in a woman and would otherwise be discarded.</text>
						</paragraph><paragraph id="H5068DDCDCD3B424BB0D3BBE7003BE4D5"><enum>(3)</enum><text>The individuals
				seeking fertility treatment donated the embryos with written informed consent
				and without receiving any financial or other inducements to make the
				donation.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H04EB98A6294B49C7BFBCF27D53D490B8"><enum>3.</enum><header>Guidelines on
			 research involving human stem cells</header><text display-inline="no-display-inline">Part H of title IV of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 289 et seq.) is further amended by inserting after section 498D, as inserted by
			 this Act, the following:</text>
			<quoted-block act-name="Public Health Service Act" id="H6DCA6430EFF4477CA033D7C67E54CEA5" style="OLC">
				<section id="HC361A72F44B040A987007B0669D0716C"><enum>498E.</enum><header>Guidelines on
				research involving human stem cells</header>
					<subsection id="H49B470C122B640F784E128EADD704E4E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 90
				days after the date of the enactment of this section, the Director of
				NIH—</text>
						<paragraph id="H7B2AABEA80DD49DA9E94ACC234C65F51"><enum>(1)</enum><text>shall issue
				guidelines on research involving human embryonic stem cells; and</text>
						</paragraph><paragraph id="H6E5FD2116A424531B0F3B9FD00C800A7"><enum>(2)</enum><text>may issue
				guidelines on research involving other human stem cells, as determined to be
				scientifically warranted by the Director of NIH.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="HA0B3E56852F843B48186BE81E8F9D23F"><enum>(b)</enum><header>Updates</header>
						<paragraph id="HEA6359659B214A1AA6007C141B76E769"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				<internal-xref idref="H07D8709C378B48B393A600B2467321DA" legis-path="498E.(b)(2)">paragraph (2)</internal-xref>, the Director of NIH
				shall review and, as appropriate, update the guidelines issued under paragraphs
				(1) and (2) of subsection (a) when the Director determines that such updates
				are scientifically warranted. The Director of NIH may determine the extent to
				which such an update applies to ongoing National Institutes of Health
				conducted- or supported-research.</text>
						</paragraph><paragraph id="H07D8709C378B48B393A600B2467321DA"><enum>(2)</enum><header>Frequency of
				updates</header><text display-inline="yes-display-inline">The first update
				required under paragraph (1), with respect to guidelines issued under paragraph
				(1) or (2) of subsection (a), shall be made not later than the last day of the
				three-year period beginning on the date such respective guidelines are issued
				and each subsequent update to such respective guidelines shall be made not
				later than the last day of each subsequent three-year period.</text>
						</paragraph></subsection><subsection id="H2AC8725803004CAFAF1B7BF5F29B7CAB"><enum>(c)</enum><header>Consideration of
				other guidelines</header><text>In developing and updating the guidelines under
				this section, the Director of NIH shall, as appropriate, take into
				consideration guidelines on human stem cell research developed by nationally
				and internationally recognized scientific organizations.</text>
					</subsection><subsection id="H72796691E62848BB8B29E086F12DFDB8"><enum>(d)</enum><header>Application of
				guidelines to research</header>
						<paragraph id="HF96088D17B3246C0A3A3774BBB94EE19"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), research that is conducted or
				supported by the National Institutes of Health on or after the effective date
				of the applicable guidelines under
				<internal-xref idref="H49B470C122B640F784E128EADD704E4E" legis-path="498E.(a)">subsection (a)</internal-xref> shall comply with such
				guidelines.</text>
						</paragraph><paragraph commented="no" id="HA3F4E04F5DFA4E1F8D03C8F771C5AE8E"><enum>(2)</enum><header>Exception for
				cells derived before the effective date of the guidelines</header><text display-inline="yes-display-inline">The Director of NIH shall determine the
				extent to which the guidelines under this section shall apply to research
				described in
				<internal-xref idref="HF96088D17B3246C0A3A3774BBB94EE19" legis-path="498E.(d)(1)">paragraph (1)</internal-xref> that uses human stem
				cells derived before the effective date of such guidelines.</text>
						</paragraph></subsection><subsection id="H2FE633BAFC514CFDB0F7D522B3BA9481"><enum>(e)</enum><header>Public
				disclosure</header><text>The Director of NIH shall publish the guidelines
				issued and updated under this section on the public website of the National
				Institutes of
				Health.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE722D2CDF32A4A4BBBC49CBD88428059"><enum>4.</enum><header>Reporting
			 requirements</header><text display-inline="no-display-inline">Section 403(a)(5)
			 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42
			 U.S.C. 283(a)(5)) is amended—</text>
			<paragraph display-inline="no-display-inline" id="HCE9574AA9B714BD18283E9A1C572B58E"><enum>(1)</enum><text>by redesignating
			 subparagraph (L) as (M); and</text>
			</paragraph><paragraph id="H516FE74A9E6E463EAAB2BA1954603B32"><enum>(2)</enum><text>by inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HE9317CB64FBA4C13A979FE4FE3D61D" style="OLC">
					<subparagraph id="H4423855CA40D49C9A7DE5452BA309590"><enum>(L)</enum><text display-inline="yes-display-inline">Human stem
				cells.</text>
					</subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1CB1D7D352394D058B67863660FCF369"><enum>5.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that—</text>
			<paragraph id="H9D37548693D940D180789ED6B3031FBE"><enum>(1)</enum><text display-inline="yes-display-inline">in developing, updating, and implementing
			 the guidelines under section 498E of the Public Health Service Act, as added by
			 section 3, the Director of the National Institutes of Health should consult
			 with the Commissioner of Food and Drugs;</text>
			</paragraph><paragraph id="H2480E546FCC347FB9813341B26A400FB"><enum>(2)</enum><text>any research using
			 human stem cells, irrespective of whether such research is federally funded,
			 should comply with the guidelines under section 498E; and</text>
			</paragraph><paragraph commented="no" id="H2782E55605084B2491AAEF1F68D8A174"><enum>(3)</enum><text>the Commissioner
			 of Food and Drugs should keep the Director of the National Institutes of Health
			 informed of the types of human stem cell and related research that would
			 facilitate the evaluation of the safety or effectiveness of drugs, devices, and
			 biological products.</text>
			</paragraph></section></legis-body>
