			 expressly provided, whenever in this Act an amendment or repeal is expressed in
			 terms of an amendment to or repeal of a section or other provision, the
			 reference shall be considered to be made to a section or other provision of the
			 Coral Reef Conservation Act of 2000 (16 U.S.C. 6401 et seq.).</text>
		</section><title commented="no" id="H91B100C7EEAF4F1AAC5EA0DB68ECA2B8" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Amendments to the Coral Reef Conservation
			 Act </header>
			<section commented="no" display-inline="no-display-inline" id="H13B377F1DF384CF7A430E252364DDFFF" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Expansion of Coral Reef Conservation
			 Program</header>
				<subsection commented="no" display-inline="no-display-inline" id="H068BE5C9EF3448A99B1828570BBD00C0"><enum>(a)</enum><header display-inline="yes-display-inline">Project diversity</header><text display-inline="yes-display-inline">Section 204(d) (16 U.S.C. 6403(d)) is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HC010836A2EA640C2915D5DD5F8E15476"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading by striking
			 <quote><header-in-text level="subsection" style="OLC">Geographic and
			 Biological</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Project</header-in-text></quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FB187A77BA84E29B497503A199C2049"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (3) and inserting the
			 following:</text>

				community-based local action strategies) that address emerging priorities or
				threats, including international and territorial priorities, or threats

				Reef Task Force; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H68AE11635B2A43498122342541C34639"><enum>(B)</enum><text display-inline="yes-display-inline">other appropriate projects, as determined
				by the Administrator, including monitoring and assessment, research, pollution
				reduction, education, and technical
				support.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H911B0B11FBDC46689C934E24BA67545A"><enum>(b)</enum><header display-inline="yes-display-inline">Approval criteria</header><text display-inline="yes-display-inline">Section 204(g) (16 U.S.C. 6403(g)) is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H86B747C47AD94E46BA5399DAECE9CCC8"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> after the
			 semicolon in paragraph (9);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40B35B95DAD34740A78590E09441D7D6"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (10); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDDAF8BB93B4549DA94C36008EF7BD49A"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the
			 following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="H84F462DAFEE84CD385C13A5810094791"><enum>(10)</enum><text display-inline="yes-display-inline">promoting activities designed to minimize
				the likelihood of vessel impacts on coral reefs, particularly those areas
				identified under section 210(b), including the promotion of ecologically sound
				navigation and anchorages near coral reefs; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0602BFD1CB149F89206105E6890290B"><enum>(11)</enum><text display-inline="yes-display-inline">promoting and assisting entities to work
				with local communities, and all appropriate governmental and nongovernmental
				organizations, to support community-based planning and management initiatives
				for the protection of coral reef
				ecosystems.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H4ABEF38828244A278D507FD585C6DDF8" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Emergency response</header><text display-inline="no-display-inline">Section 206 (16 U.S.C. 6405) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF7645F31A47D4C35B38F6CD37AD7FC9E" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H7B14C9342E074EEB930D0E4FB9B322FD" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Emergency response actions</header>
						<subsection commented="no" display-inline="no-display-inline" id="H754E305F376F4B49985E909204D1F4FB"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may undertake or
				authorize action necessary—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HFA8FC71D7076419E99304E74631511BD"><enum>(1)</enum><text display-inline="yes-display-inline">to minimize the destruction of or injury to
				a coral reef, or loss of an ecosystem function of a coral reef, from—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H1582236D8C2A4DD88C9563DF5757B3FD"><enum>(A)</enum><text display-inline="yes-display-inline">vessel impacts, derelict fishing gear,
				vessel anchors, and anchor chains; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H21A3B6D2D15248218DA1C9D8255DF50B"><enum>(B)</enum><text display-inline="yes-display-inline">from unforeseen or disaster-related
				circumstances as a result of human activities; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3291780AC2AA4EDAB0BFE150F98CDFB1"><enum>(2)</enum><text display-inline="yes-display-inline">to stabilize, repair, recover, or restore a
				coral reef that is destroyed or injured, or that has incurred the loss of an
				ecosystem function, as described in paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H23BC7C1CA201443EA0798A25D1EBED24"><enum>(b)</enum><header display-inline="yes-display-inline">Vessel removal; stabilization</header><text display-inline="yes-display-inline">Action authorized by subsection (a)
				includes vessel removal and emergency stabilization of the vessel or any
				impacted coral reef.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H62C9738A0FA3415B855183C305B748A2"><enum>(c)</enum><header display-inline="yes-display-inline">Partnering with other Federal and State
				agencies</header><text display-inline="yes-display-inline">When possible,
				action by the Administrator under this section should—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H33A2F87E8DAE4C80A6664001194A079C"><enum>(1)</enum><text display-inline="yes-display-inline">be conducted in partnership with other
				government agencies as appropriate, including—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H315692DF48CA41979DCEC924856937D0"><enum>(A)</enum><text display-inline="yes-display-inline">the Coast Guard, the Federal Emergency
				Management Agency, the Army Corps of Engineers, the Environmental Protection
				Agency, and the Department of the Interior; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H698242DB5B004E7DB32FB7ABA0F07A45"><enum>(B)</enum><text display-inline="yes-display-inline">agencies of States; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7C55D0186BD4ECE84B8E7F7D97509CC"><enum>(2)</enum><text display-inline="yes-display-inline">leverage resources of other
				agencies.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H017454A7EFC840BFA10AA0F72CD6C5A2"><enum>(d)</enum><header display-inline="yes-display-inline">Emergency response assistance by other
				Federal and State agencies</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H91DA4986951247AEA2EAB26130C30030"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The head of any other Federal or State
				agency may assist the Administrator in emergency response actions under this
				section, using funds available for operations of the agency concerned.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0CA7D69DF104560AFB957B1C487AACA"><enum>(2)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">The Administrator, subject to the
				availability of appropriations, may reimburse a Federal or State agency for
				assistance provided under paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD1F1A73F124A4C87B6749D6D135CF240"><enum>(e)</enum><header display-inline="yes-display-inline">Liability for costs and damages to coral
				reefs</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H4AF796B9CF7F4821815CD632C28B3AE3"><enum>(1)</enum><header display-inline="yes-display-inline">Treatment of coral reefs under National
				Marine Sanctuaries Act</header><text display-inline="yes-display-inline">For
				purposes of the provisions set forth in paragraph (2), and subject to paragraph
				(5), each of the terms <term>sanctuary resources</term>, <term>resource</term>,
				<term>sanctuary resource managed under law or regulations for that
				sanctuary</term>, <term>national marine sanctuary</term>, <term>sanctuary
				resources of the national marine sanctuary</term>, and <term>sanctuary
				resources of other national marine sanctuaries</term> is deemed to include any
				coral reef that is subject to the jurisdiction of the United States or any
				State, without regard to whether such coral reef is located in a national
				marine sanctuary.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H607ED47519B543C182B447F92C4B8C45"><enum>(2)</enum><header display-inline="yes-display-inline">Applicable provisions of National Marine
				Sanctuaries Act</header><text display-inline="yes-display-inline">The
				provisions referred to in paragraph (1) are the following provisions of the
				National Marine Sanctuaries Act:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H8105DF66DF3241049815085BA860EDF6"><enum>(A)</enum><text display-inline="yes-display-inline">Paragraphs (6) and (7) of section 302 (16
				U.S.C. 1432).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18503B57C66A428F9D3543D50E1B67F7"><enum>(B)</enum><text display-inline="yes-display-inline">Paragraphs (1), (2), (3), and (4) of
				section 306 (16 U.S.C. 1436).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H28451290DE0B4509B345CFE8A3D37B31"><enum>(C)</enum><text display-inline="yes-display-inline">Section 307 (16 U.S.C. 1437).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H013F912913B148A2AAB6B7B0A9A03264"><enum>(D)</enum><text display-inline="yes-display-inline">Section 312 (16 U.S.C. 1443).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD3A41DDFFAF4C9DB12F56DCB441446F"><enum>(3)</enum><header display-inline="yes-display-inline">Exemptions</header><text display-inline="yes-display-inline">The destruction, loss, or injury of a coral
				reef or any component thereof is not unlawful if it was—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H922DEC9A5E5C4F4EBF2C9E7144ABA6BD"><enum>(A)</enum><text display-inline="yes-display-inline">caused by the use of fishing gear in a
				manner that is not prohibited under the Magnuson-Stevens Fishery Conservation
				and Management Act (16 U.S.C. 1801 et seq.) or other Federal or State law;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D5B567C98E34B99834628161F8631F1"><enum>(B)</enum><text display-inline="yes-display-inline">caused by an activity that is authorized by
				Federal or State law, including any lawful discharge from a vessel of
				graywater, cooling water, engine exhaust, ballast water, or sewage from a
				marine sanitation device, unless the destruction, loss, or injury is a result
				of a vessel grounding, a vessel scraping, anchor damage, or excavation that is
				not authorized by a Federal or State permit;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H643F7A6D05954E8F8CF08299353CB9E4"><enum>(C)</enum><text display-inline="yes-display-inline">the necessary result of bona fide marine
				scientific research (including marine scientific research activities approved
				by Federal, State, or local permits), other than—</text>
									<clause commented="no" display-inline="no-display-inline" id="H35232F25F6CB4614B0CBFFAD92C5B4D5"><enum>(i)</enum><text display-inline="yes-display-inline">sampling or collecting; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HD83F0626091945A3A89D10E0AFEC124D"><enum>(ii)</enum><text display-inline="yes-display-inline">destruction, loss, or injury that is a
				result of a vessel grounding, a vessel scraping, anchor damage, or excavation
				that is not authorized by a Federal or State permit; or</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H63A810AB352146BBAFAFC1A9FB49AD8D"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HCDDDA2DF248742909F1E611146865C9E"><enum>(i)</enum><text display-inline="yes-display-inline">caused by a Federal Government agency
				in―</text>
										<subclause commented="no" display-inline="no-display-inline" id="H37530977092244B2BBE5DBAB70B338D4"><enum>(I)</enum><text display-inline="yes-display-inline">an emergency that posed an unacceptable
				threat to human health or safety or to the marine environment;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HDA1E82E034194BF284E433E818DEDA9E"><enum>(II)</enum><text display-inline="yes-display-inline">an emergency that posed a threat to
				national security; or</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H146E8038590448E1B209180E6690328A"><enum>(III)</enum><text display-inline="yes-display-inline">an activity necessary for law enforcement
				purposes or search and rescue; and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H156FF9ECA45A46C295D43283497029FD"><enum>(ii)</enum><text display-inline="yes-display-inline">could not be avoided.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A2F575C1FB14B3D8C2D050F7D300E88"><enum>(4)</enum><header display-inline="yes-display-inline">Clarification of liability</header><text display-inline="yes-display-inline">A person is not liable under this
				subsection if that person establishes that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H645365FBA221496093A7CFD1CE09EF14"><enum>(A)</enum><text display-inline="yes-display-inline">the destruction or loss of, or injury to,
				the coral reef or coral reef ecosystem was caused solely by an act of God, an
				act of war, or an act of omission of a third party, and the person acted with
				due care;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF25AEA3AF55C417D9D72D8C5FC4870B8"><enum>(B)</enum><text display-inline="yes-display-inline">the destruction, loss, or injury was caused
				by an activity authorized by Federal or State law; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1DFC647B13454DDB9C1987DA4A78C251"><enum>(C)</enum><text display-inline="yes-display-inline">the destruction, loss, or injury was
				negligible.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H942DF88CDCE64DB1BF121423E601C741"><enum>(5)</enum><header display-inline="yes-display-inline">State consent required</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H510C6F4F6713405584B3B7E9B7597F63"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This subsection shall not apply to any
				coral reef that is subject to the jurisdiction of a State unless the Governor
				of that State notifies the Secretary that the State consents to that
				application.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3DB6A6B3E1F4C549F18FEEFF1BF24C0"><enum>(B)</enum><header display-inline="yes-display-inline">Revocation of consent</header><text display-inline="yes-display-inline">The governor of a State may revoke consent
				under subparagraph (A) by notifying the Secretary of such revocation.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC2DE70619CBF435B9AD74779D96E1A1A"><enum>(6)</enum><header display-inline="yes-display-inline">Consistency with international laws and
				treaties</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="HE3A19D38580F4B798D2D5C0B701C2967"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any action taken under the authority of
				this subsection must be consistent with otherwise applicable international laws
				and treaties.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE95FE2C605924A849E490FBAF50550DB"><enum>(B)</enum><header display-inline="yes-display-inline">Actions authorized with respect to
				vessels</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A), actions authorized under this subsection include vessel
				removal, and emergency re-stabilization of a vessel and any coral reef that is
				impacted by a vessel.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H900A045976004D57A887E5C0C4EF62D5"><enum>(7)</enum><header display-inline="yes-display-inline">Liability under other
				provisions</header><text display-inline="yes-display-inline">Nothing in this
				title shall alter the liability of any person under any other provision of
				law.</text>
							</paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>

				dissemination of environmental data and information through full and open
				access and exchange to the greatest extent possible, including in electronic
				format on the Internet;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02328EFC32FA487D86F86C7035CFA36C"><enum>(3)</enum><text display-inline="yes-display-inline">develop standards, protocols and procedures
				for sharing Federal data with State and local government programs and the
				private sector or academia; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32A69BE8DA8A4535BFD0381E1BB22CAE"><enum>(4)</enum><text display-inline="yes-display-inline">develop metadata standards for coral reef
				ecosystems in accordance with Federal Geographic Data Committee
				guidelines.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB81599A00FB445DBB184FD23BF6761B0" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="no-display-inline">Section 208 (16 U.S.C. 6407) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H4D06D53B305648A2A611ACE7C94248F7" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H40D6E37A1EF8469CB4A29CC95EA0B8B1" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="no-display-inline">Not later than March 1, 2010, and every 5
				years thereafter, the Administrator shall submit to the Committee on Commerce,
				Science, and Transportation of the Senate and the Committee on Natural
				Resources of the House of Representatives a report describing all activities
				undertaken to implement the strategy, including—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HD74A4928782E4B758CF31DE105FCCD48"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the funds obligated by
				each participating Federal agency to advance coral reef conservation during
				each fiscal year of the 5-fiscal-year period preceding the fiscal year in which
				the report is submitted;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EE36EAFFD8A4B3DB86A7CDA487CCCF4"><enum>(2)</enum><text display-inline="yes-display-inline">a description of Federal interagency and
				cooperative efforts with States and non-governmental partner organizations to
				prevent or address overharvesting, coastal runoff, or other anthropogenic
				impacts on coral reef ecosystems, including projects undertaken with the
				Department of the Interior, the Department of Agriculture, the Environmental
				Protection Agency, and the Army Corps of Engineers;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H60388BE278D54B00A46B508157E12898"><enum>(3)</enum><text display-inline="yes-display-inline">a summary of the information contained in
				the vessel grounding inventory established under section 210, including
				additional authorization or funding, needed for response and removal of such
				vessels;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBAFCF068F0AE49FE97681A6A9AC5BBBF"><enum>(4)</enum><text display-inline="yes-display-inline">a description of Federal disaster response
				actions taken pursuant to the National Response Plan to address damage to coral
				reefs and coral reef ecosystems; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C5A3723421F4241AC25D613D229E546"><enum>(5)</enum><text display-inline="yes-display-inline">an assessment of the condition of United
				States coral reefs, accomplishments under this Act, and the effectiveness of
				management actions to address threats to coral reefs, including actions taken
				to address large-scale threats to coral reef ecosystems related to climate
				change.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="HE8672C6F745340AA89235483C4ACBA3E" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Fund; grants; grounding inventory;
			 coordination</header><text display-inline="no-display-inline">The Act (16
			 U.S.C. 6401 et seq.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1925B7131207415C92A9FF7224B8687E"><enum>(1)</enum><text display-inline="yes-display-inline">in section 205(a) (16 U.S.C. 6404(a)), by
			 striking <quote>organization solely</quote> and all that follows and inserting
			 “organization—</text>
					<quoted-block display-inline="no-display-inline" id="H86B585D86EE54A35B44AF6951BBFB5F0" style="OLC">

							<subsection commented="no" display-inline="no-display-inline" id="H325EBC8D725244CBB92AE2E5BAD2353D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may make grants to
				entities that are eligible to receive grants under section 204(c) to provide
				additional funds to such entities to work with local communities and through
				appropriate Federal and State entities to prepare and implement plans for the
				increased protection of coral reef areas identified by the community and
				scientific experts as high priorities for focused attention. The plans
				shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HF729CED7393748AD8C6DD70E940D0B18"><enum>(1)</enum><text display-inline="yes-display-inline">support attainment of one or more of the
				criteria described in section 204(g);</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB1AB8CE97174D86AAC4617EA3EB140F"><enum>(2)</enum><text display-inline="yes-display-inline">be developed at the community level;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H29B23E5F45AD4C19B0ACE4219474A24B"><enum>(3)</enum><text display-inline="yes-display-inline">utilize where applicable watershed-based or
				ecosystem-based approaches;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD6439420CD24A428AE0D019BB019403"><enum>(4)</enum><text display-inline="yes-display-inline">provide for coordination with Federal and
				State experts and managers;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7F3042F49F64E2A9B4809F855449A4F"><enum>(5)</enum><text display-inline="yes-display-inline">build upon local approaches or models,
				including traditional or island-based resource management concepts; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28C02042E2364E79A99063D40B9E5923"><enum>(6)</enum><text display-inline="yes-display-inline">complement local action strategies or
				regional plans for coral reef conservation.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF8C6053282D14A128544BBFE441665AC"><enum>(b)</enum><header display-inline="yes-display-inline">Terms and conditions</header><text display-inline="yes-display-inline">The provisions of subsections (b), (d),
				(f), and (h) of section 204 apply to grants under subsection (a), except that,
				for the purpose of applying section 204(b)(1) to grants under this section,
				<quote>75 percent</quote> shall be substituted for <quote>50
				percent</quote>.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="HADD30482167B4D7A83C6D5E2277DAC75" section-type="subsequent-section"><enum>210.</enum><header display-inline="yes-display-inline">Vessel grounding inventory</header>
							<subsection commented="no" display-inline="no-display-inline" id="HBB8BFF15C67D439D96F68E6F1980AE99"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in coordination with
				other Federal agencies, may maintain an inventory of all vessel grounding
				incidents involving coral reefs, including a description of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HB149006E9759488AB61E05E09961513C"><enum>(1)</enum><text display-inline="yes-display-inline">the impacts to such resources;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2BB54B27930E420DAC0C7BEC94636E1C"><enum>(2)</enum><text display-inline="yes-display-inline">vessel and ownership information, if
				available;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD1DA9D1A97A241FB9CB84647E8A431C2"><enum>(3)</enum><text display-inline="yes-display-inline">the estimated cost of removal, mitigation,
				or restoration;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4DF56E9F8893469499C40829E4868218"><enum>(4)</enum><text display-inline="yes-display-inline">the response action taken by the owner, the
				Administrator, the Commandant of the Coast Guard, or other Federal or State
				agency representatives;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04B40F7796184EC99A2012A2A8628370"><enum>(5)</enum><text display-inline="yes-display-inline">the status of the response action,
				including the dates of vessel removal and mitigation or restoration and any
				actions taken to prevent future grounding incidents; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H028ADFFAF1D04F48B71E374061840421"><enum>(6)</enum><text display-inline="yes-display-inline">recommendations for additional navigational
				aids or other mechanisms for preventing future grounding incidents.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFA873EA756D343EE94CC877C150C0E80"><enum>(b)</enum><header display-inline="yes-display-inline">Identification of at-risk
				reefs</header><text display-inline="yes-display-inline">The Administrator
				may—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HF15BD6D8CF124A7FA38F7017FE4AACE5"><enum>(1)</enum><text display-inline="yes-display-inline">use information from any inventory
				maintained under subsection (a) or any other available information source to
				identify all coral reef areas that have a high incidence of vessel impacts,
				including groundings and anchor damage;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H59ED99D60FCE43829D122842CEFA8F4F"><enum>(2)</enum><text display-inline="yes-display-inline">identify appropriate measures, including
				action by other agencies, to reduce the likelihood of such impacts; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5FFF6C9D82F4568A8A242D30A3DB241"><enum>(3)</enum><text display-inline="yes-display-inline">develop a strategy and timetable to
				implement such measures, including cooperative actions with other Government
				agencies and non-governmental partners.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HA4277FF919EC4C8BB6B5CBDA643049CE" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline">Regional, State, and territorial
				coordination</header>
							<subsection commented="no" display-inline="no-display-inline" id="H041E3405986A4F7DB31B285F3C6EE18E"><enum>(a)</enum><header display-inline="yes-display-inline">Regional Coordination</header><text display-inline="yes-display-inline">The Secretary and other Federal members of
				the United States Coral Reef Task Force shall work in coordination and
				collaboration with other Federal agencies and States to implement the
				strategies developed under section 203, including regional and local
				strategies, to address multiple threats to coral reefs and coral reef
				ecosystems such as coastal runoff, vessel impacts, and overharvesting.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H1EAD77E7DB0A45F99836FB80E62D16A3"><enum>(b)</enum><header display-inline="yes-display-inline">Response and Restoration
				Activities</header><text display-inline="yes-display-inline">The Secretary
				shall enter into written agreements with any States in which coral reefs are
				located regarding the manner in which response and restoration activities will
				be conducted within the affected State’s waters. Nothing in this subsection
				shall be construed to limit Federal response and restoration activity authority
				before any such agreement is final.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HC0D239236D39461D9B469C4A15A2ADB7"><enum>(c)</enum><header display-inline="yes-display-inline">Cooperative Enforcement
				Agreements</header><text display-inline="yes-display-inline">All cooperative
				enforcement agreements in place between the Secretary and States affected by
				this title shall be updated to include enforcement of this title where
				appropriate.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="HA4447690A55C4D60BCCDF63D61D4D139" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">Agreements</header>
							<subsection commented="no" display-inline="no-display-inline" id="H1299791F898D4C83BEAD0B89569015FE"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Administrator may execute and perform
				such contracts, leases, grants, or cooperative agreements as may be necessary
				to carry out the purposes of this title.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H130E8C6E4D5640968F52D1D26D265700"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Under an agreement entered into under
				subsection (a), the Secretary may fulfill the terms of the agreement by
				reimbursing or providing appropriated funds to, and may receive funds or
				reimbursements from, Federal agencies, instrumentalities and laboratories;
				State and local governments; Native American tribes and organizations;
				international organizations; foreign governments; universities and research
				centers; educational institutions; nonprofit organizations; commercial
				organizations; and other public and private persons or entities, as necessary
				for purposes identified in section 202 and actions taken under subsections (a)
				through (d) of section 206.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H36BAABFDA34C4BDD9DE478B957DEE3C7"><enum>(c)</enum><header display-inline="yes-display-inline">Multiyear cooperative
				agreements</header><text display-inline="yes-display-inline">The Administrator
				may enter into multiyear cooperative agreements with the heads of other Federal
				agencies, States, local governments, academic institutions, including marine
				laboratories and coral reef institutes, and nongovernmental organizations to
				carry out the activities of the national coral reef action strategy developed
				under section 203 and to implement regional strategies developed pursuant to
				section 211.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H75D1373DAF5541BDAB8288FF93588CBF"><enum>(d)</enum><header display-inline="yes-display-inline">Use of Other Agencies’
				Resources</header><text display-inline="yes-display-inline">For purposes
				related to the conservation, preservation, protection, restoration, or
				replacement of coral reefs or coral reef ecosystems and the enforcement of this
				title, the Administrator is authorized to use, with their consent and with or
				without reimbursement, the land, services, equipment, personnel, and facilities
				of any Department, agency, or instrumentality of the United States, or of any
				State, local government, or Indian tribal government, or of any political
				subdivision thereof, or of any foreign government or international
				organization.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="HA056B0A2BD2841049751211BBF0FC1C7" section-type="subsequent-section"><enum>213.</enum><header display-inline="yes-display-inline">International Coral Reef Conservation
				Strategy</header>
							<subsection commented="no" display-inline="no-display-inline" id="H752BFFA3453E4D339BA882307E9BC607"><enum>(a)</enum><header display-inline="yes-display-inline">International Coral Reef Ecosystem
				Strategy</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H581741EA326C4F959F5139386EC20F30"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of the <short-title>Coral Reef Conservation Act
				Reauthorization and Enhancement Amendments of 2009</short-title>, the Secretary
				shall submit to the Committee on Commerce, Science, and Transportation of the
				Senate and the Committee on Natural Resources and the Committee on Foreign
				Affairs of the House of Representatives, and publish in the Federal Register,
				an international coral reef ecosystem strategy, consistent with the purposes of
				this title and the national strategy required pursuant to section 203(a). The
				Secretary shall periodically review and revise this strategy as
				necessary.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9642D7D39A3641108A01AEDCE7C400B0"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The strategy developed by the Secretary
				under paragraph (1) shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H345798BF56654034A051860BF4842F00"><enum>(A)</enum><text display-inline="yes-display-inline">identify coral reef ecosystems throughout
				the world that are of high value for United States marine resources, that
				support high-seas resources of importance to the United States such as
				fisheries, or that support other interests of the United States;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H01A191F4884E4A3F9E55130B7DCE5F94"><enum>(B)</enum><text display-inline="yes-display-inline">summarize existing activities by Federal
				agencies and entities described in subsection (b) to address the conservation
				of coral reef ecosystems identified pursuant to subparagraph (A);</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B6CBFDB07ED40B7B4B9081D8FD83354"><enum>(C)</enum><text display-inline="yes-display-inline">establish goals, objectives, and specific
				targets for conservation of priority international coral reef
				ecosystems;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDDCD89D7720B43C0B46CC2CD176A4556"><enum>(D)</enum><text display-inline="yes-display-inline">describe appropriate activities to achieve
				the goals and targets for international coral reef conservation, in particular
				those that leverage activities already conducted under this title;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H34D941FA5C1B496DB80EA6DD75E47FED"><enum>(E)</enum><text display-inline="yes-display-inline">develop a plan to coordinate implementation
				of the strategy with entities described in subsection (b) in order to leverage
				current activities under this title and other conservation efforts
				globally;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF8B3755BB9F49FF8F1ED28E3549B9E3"><enum>(F)</enum><text display-inline="yes-display-inline">identify appropriate partnerships, grants,
				or other funding and technical assistance mechanisms to carry out the strategy;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H610FD047FCB94D51AC446D8922229635"><enum>(G)</enum><text display-inline="yes-display-inline">develop criteria for prioritizing
				partnerships under subsection (c).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC894A564A47447ADBDC7740EF5780DF7"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary
				shall consult with the Secretary of State, the Administrator of the Agency for
				International Development, the Secretary of the Interior, and other relevant
				Federal agencies, and relevant United States stakeholders, and shall take into
				account coral reef ecosystem conservation initiatives of other nations,
				international agreements, and intergovernmental and nongovernmental
				organizations so as to provide effective cooperation and efficiencies in
				international coral reef conservation. The Secretary may consult with the
				United States Coral Reef Task Force in carrying out this subsection.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H555271C903DE493BBE9E821ADF9184F8"><enum>(c)</enum><header display-inline="yes-display-inline">International Coral Reef Ecosystem
				Partnerships</header>
								<paragraph commented="no" display-inline="no-display-inline" id="HDA68B3F4A4BD4CF7880C25ED186FAA86"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may establish an
				international coral reef ecosystem partnership program to provide support,
				including funding and technical assistance, for activities that implement the
				strategy developed pursuant to subsection (a).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA356EB0948CE41E8846277D1EC74AE27"><enum>(2)</enum><header display-inline="yes-display-inline">Mechanisms</header><text display-inline="yes-display-inline">The Secretary shall provide such support
				working in collaboration with the entities described in subsection (b).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD00DEC29FE8646FE867B89B6C0426259"><enum>(3)</enum><header display-inline="yes-display-inline">Criteria for approval</header><text display-inline="yes-display-inline">The Secretary may not approve a partnership
				proposal under this section unless the partnership is consistent with the
				international coral reef conservation strategy developed pursuant to subsection
				(a), and meets the criteria specified in that strategy.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAAC7B5793F5C46D3B4837D65F24C1A8E"><enum>(d)</enum><header display-inline="yes-display-inline">Priority for certain projects conducted by
				States</header><text display-inline="yes-display-inline">In implementing this
				section, the Secretary shall give priority consideration to regional
				initiatives and projects that States are participating in with other
				nations.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H2535107DE8F2440D9566C40ADE5E5C18" section-type="subsequent-section"><enum>214.</enum><header display-inline="yes-display-inline">Permits</header>
							<subsection commented="no" display-inline="no-display-inline" id="H9A9C34111F9E4EEFACB496F777FF722E"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Administrator may, in accordance with
				this section and regulations issued under this title, issue a permit
				authorizing the conduct of bona fide research.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HBD1AD7FD85B34C239DED8FF8809ABBC0"><enum>(b)</enum><header display-inline="yes-display-inline">Exempt activities</header><text display-inline="yes-display-inline">No permit under this section is required
				for an activity that is exempt from liability under section 206(e).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H0146156D16D34211BC3F5F56D978B8C2"><enum>(c)</enum><header display-inline="yes-display-inline">Terms and Conditions</header><text display-inline="yes-display-inline">The Administrator may place any terms and
				conditions on a permit issued under this section that the Administrator deems
				reasonable.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H32126F7E062B47218E631CBAD056C98B"><enum>(d)</enum><header display-inline="yes-display-inline">Fees</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H5C4F0F6AAB8749C7BD3563D74484DA6D"><enum>(1)</enum><header display-inline="yes-display-inline">Assessment and collection</header><text display-inline="yes-display-inline">Subject to regulations issued under this
				title, the Administrator may assess and collect fees as specified in this
				subsection.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9FE0C9B0EFB4D24AD999CC61E00A8EE"><enum>(2)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">Any fee assessed shall be equal to the sum
				of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HAA47D39B8564420C9566D29A37378B71"><enum>(A)</enum><text display-inline="yes-display-inline">all costs incurred, or expected to be
				incurred, by the Administrator in processing the permit application, including
				indirect costs; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H441F506AED304EF2804ADC09419F3EB9"><enum>(B)</enum><text display-inline="yes-display-inline">if the permit is approved, all costs
				incurred, or expected to be incurred, by the Administrator as a direct result
				of the conduct of the activity for which the permit is issued.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77BC5586DFED48E7A0EA0C850250890D"><enum>(3)</enum><header display-inline="yes-display-inline">Use of fees</header><text display-inline="yes-display-inline">Amounts collected by the Administrator in
				the form of fees under this section shall be collected and available for use
				only to the extent provided in advance in appropriations Acts and may be used
				by the Administrator for issuing and administering permits under this
				section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA2F27CC881D422FBD7214C39B8F62EB"><enum>(4)</enum><header display-inline="yes-display-inline">Waiver or reduction of fees</header><text display-inline="yes-display-inline">For any fee assessed under paragraph (2) of
				this subsection, the Administrator may—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H35570D48F47D45BE8BD7D75DE721177B"><enum>(A)</enum><text display-inline="yes-display-inline">accept in-kind contributions in lieu of a
				fee; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0854AB29853499AB14BF13264C82EEE"><enum>(B)</enum><text display-inline="yes-display-inline">waive or reduce the fee.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE4E2E21F2B6C41FDBA2D17E9754ED162"><enum>(e)</enum><header display-inline="yes-display-inline">Fishing</header><text display-inline="yes-display-inline">Nothing in this section shall be considered
				to require a person to obtain a permit under this section for the conduct of
				any fishing activity that is not prohibited by this title or regulations issued
				under this title.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="H72B9A16F46B44EB39AE97E5A189971E1" section-type="subsequent-section"><enum>215.</enum><header display-inline="yes-display-inline">Regulations; application in accordance with
				international law</header>
							<subsection commented="no" display-inline="no-display-inline" id="HEC0FE8F154A246A78125EB7B4F4F7B05"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Administrator may issue such
				regulations as are necessary and appropriate to carry out the purposes of
				sections 206 and 214.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H48D1C4F2D42B498CBA92E200D52F3386"><enum>(b)</enum><header display-inline="yes-display-inline">Relationship to international
				law</header><text display-inline="yes-display-inline">This title and any
				regulations promulgated under this title shall be applied in accordance with
				international law. No restrictions shall apply to or be enforced against a
				person who is not a citizen, national, or resident alien of the United States
				(including foreign flag vessels) unless in accordance with international
				law.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="HFC324DEF15CA4470851ECA782394788F" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Clarification of definitions</header><text display-inline="no-display-inline">Section 218, as redesignated by section 105
			 of this Act (relating to definitions; 16 U.S.C. 6409), is further
			 amended—</text>

				sustainable use, and management of habitat;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H519505407B1F4A9496635BE37CC1134C"><enum>(B)</enum><text display-inline="yes-display-inline">mapping;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA12856F2CAC44A2AA3627904CD9E01CC"><enum>(C)</enum><text display-inline="yes-display-inline">monitoring of coral reef ecosystems;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE94505B80E14481C8351D0B61180A76D"><enum>(D)</enum><text display-inline="yes-display-inline">development and implementation of
				management strategies for marine protected area or networks thereof and marine
				resources consistent with the National Marine Sanctuaries Act (16 U.S.C. 1431
				et seq.) and the Magnuson-Stevens Fishery Conservation and Management Act (16
				U.S.C. 1801 et seq.);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFAE4A72D2134404B93B877B3504C42CE"><enum>(E)</enum><text display-inline="yes-display-inline">law enforcement;</text>

				</paragraph></section></title><title commented="no" id="H25E4642DA522421393927EA651A1101C" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">United States Coral Reef Task
			 Force</header>
			<section commented="no" display-inline="no-display-inline" id="H1370CCA46F714A6283BE5ACBBE852921" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">United States Coral Reef Task
			 Force</header>
				<subsection commented="no" display-inline="no-display-inline" id="HDDABDF6E5075445BAFC7450BF77EB195"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is hereby established the United
			 States Coral Reef Task Force.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H87CACD6AC75E400FAC04ED00AF23C034"><enum>(b)</enum><header display-inline="yes-display-inline">Goal</header><text display-inline="yes-display-inline">The goal of the Task Force shall be to
			 lead, coordinate, and strengthen Federal Government actions to better preserve
			 and protect coral reef ecosystems.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H31A5868D72BF4474B8D7955F101026D8"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The duties of the Task Force shall
			 be—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H966E27ACA6FD4DD7A1A38CEF99D2390D"><enum>(1)</enum><text display-inline="yes-display-inline">to coordinate, in cooperation with State
			 and local government partners, academic partners, and nongovernmental partners
			 if appropriate, activities regarding the mapping, monitoring, research,
			 conservation, mitigation, restoration of coral reefs and coral reef
			 ecosystems;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB48D5C6D9C0B407098576E2D56FE1667"><enum>(2)</enum><text display-inline="yes-display-inline">to monitor and advise regarding
			 implementation of the policy and Federal agency responsibilities set forth in
			 Executive Order 13089 and the national coral reef action strategy developed
			 under section 203 of the Coral Reef Conservation Act of 2000, as amended by
			 this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C74B814109640558D9DD9609F689C3E"><enum>(3)</enum><text display-inline="yes-display-inline">to work with the Secretary of State and the
			 Administrator of the Agency for International Development, and in coordination
			 with the other members of the Task Force, to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H4383F4C71F8D42A6A83969F160EBA4E7"><enum>(A)</enum><text display-inline="yes-display-inline">assess the United States role in
			 international trade and protection of coral species; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA861ECDA65A4E3B9A341FEB7EE98BB7"><enum>(B)</enum><text display-inline="yes-display-inline">encourage implementation of appropriate
			 strategies and actions to promote conservation and sustainable use of coral
			 reef resources worldwide.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H48050F5476234F3ABF2727438E33C18A"><enum>(d)</enum><header display-inline="yes-display-inline">Membership, generally</header><text display-inline="yes-display-inline">The Task Force shall be comprised
			 of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HB2AB82F42CCB4BE0B54BF570B2621CC2"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Commerce, acting through
			 the Administrator of the National Oceanic and Atmospheric Administration, and
			 the Secretary of the Interior, who shall be co-chairs of the Task Force;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB9E4ABCD20E4ABB9560190C12CEBB70"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator of the Agency of
			 International Development;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7C26ECEF88E454A8ADC44EFA15AE522"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14496857635748D3BD15B008040A19D2"><enum>(4)</enum><text display-inline="yes-display-inline">the Secretary of Defense;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF83BEB666B47418DA391F2DF462BFAB1"><enum>(5)</enum><text display-inline="yes-display-inline">the Secretary of the Army, acting through
			 the Corps of Engineers;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90B2CC205BEA42DFB210404C94907A4D"><enum>(6)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97864D84E1764E39BF797A01ACD8820A"><enum>(7)</enum><text display-inline="yes-display-inline">the Attorney General;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6C731F98F5B1430AB04B73A5BC2DAD48"><enum>(8)</enum><text display-inline="yes-display-inline">the Secretary of State;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8420F89D176A42C5A6E711795F6BB5A6"><enum>(9)</enum><text display-inline="yes-display-inline">the Secretary of Transportation;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBF444D594B6A47E4A831AD0DA9CBAEBD"><enum>(10)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental
			 Protection Agency;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC3B87E108E641DBA67BA7FCDF55D047"><enum>(11)</enum><text display-inline="yes-display-inline">the Administrator of the National
			 Aeronautics and Space Administration;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H75EED4F373864EE0972B9BD5648A5E95"><enum>(12)</enum><text display-inline="yes-display-inline">the Director of the National Science
			 Foundation;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H530DC5455C474411B6257C5C99D99947"><enum>(13)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the Commonwealth of the Northern Mariana Islands;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF4F1CA6E68504EC39734E46559DABCE3"><enum>(14)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the Commonwealth of Puerto Rico;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H166FE367BF5746979360FD8D3E0824AB"><enum>(15)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the State of Florida;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FAFBC6AF6D946B2A54F81E2D471E705"><enum>(16)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the State of Hawaii;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0DBC279C2155458ABFBE6A34A6890740"><enum>(17)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the Territory of Guam;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H50113E8892AB4257B09D4964E201564A"><enum>(18)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the Territory of American Samoa; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C2ADA588FB34BEB8967D38AE8964431"><enum>(19)</enum><text display-inline="yes-display-inline">the Governor, or a representative of the
			 Governor, of the Virgin Islands.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFFDD6354C476440B87F5A8B4902D5B98"><enum>(e)</enum><header display-inline="yes-display-inline">Nonvoting members</header><text display-inline="yes-display-inline">The President, or a representative of the
			 President, of each of the Freely Associated States of the Federated States of
			 Micronesia, the Republic of the Marshall Islands, and the Republic of Palau may
			 appoint a nonvoting member of the Task Force.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H56E70A82753243D9BC218CCED4372877"><enum>(f)</enum><header display-inline="yes-display-inline">Responsibilities of Federal agency
			 members</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HA579C854572F45D799CC42335740D888"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Federal agency members of the Task
			 Force shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H255BCE06AB984B50B1EAEC0C9B4811B4"><enum>(A)</enum><text display-inline="yes-display-inline">identify the actions of their agencies that
			 may affect coral reef ecosystems;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5EBD060E52EA43D4A0A04A52A682A8F0"><enum>(B)</enum><text display-inline="yes-display-inline">utilize the programs and authorities of
			 their agencies to protect and enhance the conditions of such ecosystems;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93CC66B7CCCD40DD811B10EFC91A17E9"><enum>(C)</enum><text display-inline="yes-display-inline">assist in the implementation of the
			 National Action Plan to Conserve Coral Reefs, the national coral reef action
			 strategy developed under section 203 of the Coral Reef Conservation Act of
			 2000, as amended by this Act, the local action strategies, and any other
			 coordinated efforts approved by the Task Force.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H101512CDC0CA45118D77D13244077533"><enum>(2)</enum><header display-inline="yes-display-inline">Co-chairs</header><text display-inline="yes-display-inline">In addition to their responsibilities under
			 paragraph (1), the co-chairs of the Task Force shall administer performance of
			 the functions of the Task Force and facilitate the coordination of the Federal
			 agency members of the Task Force.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H70B154E066BE40898BE01682D8234E93"><enum>(g)</enum><header display-inline="yes-display-inline">Working groups</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H8A70C27F6948426FA942F1315FAD0316"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The co-chairs of the Task Force may
			 establish working groups as necessary to meet the goals and duties of this
			 title. The Task Force may request the co-chairs to establish such a working
			 group.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H566EA03DECA247699D29E6FA25C5F17F"><enum>(2)</enum><header display-inline="yes-display-inline">Participation by nongovernmental
			 organizations</header><text display-inline="yes-display-inline">The co-chairs
			 may allow a nongovernmental organization or academic institution to participate
			 in such a working group.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6B7D4AD85DD947D8BE4D8DFB25B3D212"><enum>(h)</enum><header display-inline="yes-display-inline">FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5
			 U.S.C. App.) shall not apply to the Task Force.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H41C1500F6A6947EF98533AC2E2735807"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">The definitions in section 218 of the Coral
			 Reef Conservation Act of 2000, as amended by this Act, shall apply to this
			 section.</text>

			 definitions</header>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCC142D2BAAC04DBB88A77C1DB841233A"><enum>(b)</enum><header display-inline="yes-display-inline">Coral reef conservation assistance</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HB83F5EE9AC1B421CAC6C66A922C0EEDA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Interior may provide
			 technical assistance and, subject to the availability of appropriations,
			 financial assistance for the conservation of coral reefs.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1CBC9F1CAED84A878E381DEAAAB9B6EC"><enum>(2)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection each of the terms
			 <quote>conservation</quote> and <quote>coral reef</quote> has the meaning that
			 term has under section 218 of the Coral Reef Conservation Act of 2000 (16
			 U.S.C. 6409), amended by this Act.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H0519073D42F241AD8B58455B88D8D95A" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Clarification of definitions</header><text display-inline="no-display-inline">Section 218, as redesignated by section 105
			 of this Act (relating to definitions; 16 U.S.C. 6409), is further
