		<section id="HB692FE18A54E4B9DAA2F7DFC14CD66BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cluster-Based Economy Enhancement Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H7A9C3885547A4254BED08581105521A9"><enum>2.</enum><header>Grants for
			 cluster-based economic development</header>
			<subsection id="HFCBD094B45384AC5A5E001CBDD8EC10"><enum>(a)</enum><header>In
			 general</header><text>Title II of the Public Works and Economic Development Act
			 of 1965 (42 U.S.C. 3141 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0E8EF5F5101D459E8CDBD2FF8FD20031" style="OLC">
					<section id="H3ED5B76AE12A4FC8A5E074DB01C6CE4D"><enum>219.</enum><header>Grants for
				cluster-based economic development</header>
						<subsection id="HD104990F94884B879417F5A8ED2E0096"><enum>(a)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<paragraph id="H4F21EBEB83034C7B007777E559C5F4A9"><enum>(1)</enum><header>Cluster</header><text>The
				term <term>cluster</term> means a geographic concentration of business entities
				that—</text>
								<subparagraph id="H3BEED2436DB54536A6004D6C7B471EEA"><enum>(A)</enum><text>are in competing,
				complementary, or interdependent firms and industries;</text>
								</subparagraph><subparagraph id="HFC7B045B9DD3452586174F5721321CAD"><enum>(B)</enum><text>do business with
				one another; and</text>
								</subparagraph><subparagraph id="H0C940DF91CCA4F4AAD15F9B08DED9870"><enum>(C)</enum><text>have common needs
				for talent, technology, and infrastructure.</text>
								</subparagraph></paragraph><paragraph id="HAAAE791937704E0AA454262B47BD41C3"><enum>(2)</enum><header>Eligible
				applicant</header><text>The term <term>eligible applicant</term> means—</text>
								<subparagraph id="H6E05623501B2477A9B51C5CD8CFD5ED4"><enum>(A)</enum><text>a State or local
				government;</text>
								</subparagraph><subparagraph id="HBA43B03B28764FB39DB2CE8043BC01D9"><enum>(B)</enum><text>an institution of
				higher education; or</text>
								</subparagraph><subparagraph id="H0282B9716CAC49659EFEAEACD218BB4B"><enum>(C)</enum><text>a nonprofit
				economic development organization.</text>
								</subparagraph></paragraph><paragraph id="H0D9F3B89EC274938B5603400946F59F0"><enum>(3)</enum><header>Region</header><text display-inline="yes-display-inline">The term <term>region</term> means an area
				that on the date of submission of an application for a grant under this
				section, meets 1 or more of the criteria described in section 301(a),
				and—</text>
								<subparagraph id="HC575B016B0604401BACAFFE8D012B72"><enum>(A)</enum><text>is determined by
				the Secretary to qualify for a grant under this section; or</text>
								</subparagraph><subparagraph id="H0930F1C8AA21495D82DAE45291EAB00"><enum>(B)</enum><text display-inline="yes-display-inline">has been designated by the Consolidated
				Farm and Rural Development Act and the Food, Conservation, and Energy Act of
				2008, as an area in which a regional development commission has been
				established, including:</text>
									<clause id="HC66E7942D39A4BD1BBFDFD18277111D5"><enum>(i)</enum><header>The Delta
				Region</header><text display-inline="yes-display-inline">The term <quote>Delta
				Region</quote> means the region defined in section 382A(2) of the Consolidated
				Farm and Rural Development Act (7 U.S.C. 2009aa(2)).</text>
									</clause><clause id="H4158D26BE81040D3878900B375CD1B4E"><enum>(ii)</enum><header>The Northern
				Great Plains Region</header><text display-inline="yes-display-inline">The term
				<quote>Northern Great Plains Region</quote> means the region defined in section
				383A(4) of the Consolidated Farm and Rural Development Act (7 U.S.C.
				2009bb(4)).</text>
									</clause><clause id="H2162B4E776D24A3F922021179BD9139"><enum>(iii)</enum><header>The Southeast
				Crescent Region</header><text display-inline="yes-display-inline">The term
				<quote>Southeast Crescent Region</quote> means the region defined in section
				15731 of title 40, United States Code (as amended by the Food, Conservation,
				and Energy Act of 2008 (Public Law 110–234)).</text>
									</clause><clause id="H9F39F50C77F64019AF1000AA46F860AF"><enum>(iv)</enum><header>The Southwest
				Border Region</header><text display-inline="yes-display-inline">The term
				<quote>Southwest Border Region</quote> means the region defined in section
				15732 of title 40, United States Code (as amended by the Food, Conservation,
				and Energy Act of 2008 (Public Law 110–234)).</text>
									</clause><clause id="H48777F07D6EF4EBDB3F3C3F74AF66C9"><enum>(v)</enum><header>The Northern
				Border Region</header><text display-inline="yes-display-inline">The term
				<quote>Northern Border Region</quote> means the region defined in section 15733
				of title 40, United States Code (as amended by the Food, Conservation, and
				Energy Act of 2008 (Public Law 110–234)).</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HADFE1F0B395F496095250048B370AE72"><enum>(b)</enum><header>Grants</header><text>On
				the application of an eligible applicant, the Secretary may make a
				grant—</text>
							<paragraph id="H5A8A006BF6D041C3A3F905DDBAA3D62"><enum>(1)</enum><text display-inline="yes-display-inline">to assess the potential for the development
				of clusters and the enhancement of existing clusters;</text>
							</paragraph><paragraph id="H6463C4BCDABA4EA997A206ADA1D2DFD7"><enum>(2)</enum><text display-inline="yes-display-inline">to establish cluster development programs
				in a region; and</text>
							</paragraph><paragraph id="HE5F5F6CA024A4554BCA5F37C9241F780"><enum>(3)</enum><text>to promote cluster
				development programs in a region and support the staff who operate such
				programs.</text>
							</paragraph></subsection><subsection id="HE79F82EC81114029B132787069433B52"><enum>(c)</enum><header>Cost
				sharing</header>
							<paragraph id="H508D4B620A644DCAB4F2BD79D5B9382"><enum>(1)</enum><header>In
				general</header><text>The Federal share of the cost of a project carried out
				using funds made available under this section shall be 50 percent.</text>
							</paragraph><paragraph id="H288D035C4F9344BE85D277A509C6488B"><enum>(2)</enum><header>In-kind
				contributions</header><text>Not more than 50 percent of the non-Federal share
				of the cost of a project carried out using funds made available under this
				section may be provided through in-kind contributions.</text>
							</paragraph><paragraph id="HCE9CCA8950DC4AA79FD31C29C987A1F5"><enum>(3)</enum><header>Inapplicability
				of certain section</header><text>Section 204 shall not apply to this section.</text>
							</paragraph></subsection><subsection id="H94D2AD8BD9464C26AFE93300D469E0A0"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section $50,000,000, to remain available until
				expended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF6548316242D4B0989833B6F055DF4C6"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents contained in section 1(b) of the
			 Public Works and Economic Development Act of 1965 (42 U.S.C. 3121 note) is
			 amended by inserting after the item relating to section 218 the
			 following:</text>
