<section display-inline="no-display-inline" id="H7C8B2839FDA247BA81E25B8E28BC437E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Education Equality and Improvement Act of 2009</short-title></quote>.</text></section>
<section id="H7B73BE2060B243BBA558C9B75594037"><enum>2.</enum><header>Increased flexibility for rural local educational agencies</header>
<subsection id="HF7097A4C4CC0485BBC6F2E7CAE1230D5"><enum>(a)</enum><header>In General</header><text>If the Secretary of Education takes any action (whether by regulation, guidance, or otherwise) to authorize increased flexibility for any category of rural local educational agencies, the Secretary shall extend the same level of increased flexibility to all rural local educational agencies.</text></subsection>
<subsection id="HED09C93E92F243B8BEF95FA76D36D5DF"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HB419943DB0E34203B96F5CD08940A111"><enum>(1)</enum><header>Increased flexibility</header><text>The term <term>increased flexibility</term> means increased flexibility under, or facilitated compliance with, part A of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (20 U.S.C. 6311 et seq.).</text></paragraph>
<paragraph id="H2FC5FCEBE87A482F98002FDA174FCD68"><enum>(2)</enum><header>Rural local educational agency</header><text>The term <term>rural local educational agency</term> includes any local educational agency described in section 6211(b) or section 6221(b)(1) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (20 U.S.C. 7345(b), 7351(b)(1)).</text></paragraph></subsection>
<subsection id="HEE0FFD6101F64D2CB5267F7506ABE450"><enum>(c)</enum><header>Application</header><text>This section applies to any action described in subsection (a) that occurs on or after January 8, 2002 (the date of the enactment of the No Child Left Behind Act of 2001 (Public Law 107–110)).</text></subsection></section>
