<legis-type>A BILL</legis-type> 
<official-title>To amend the Family and Medical Leave Act of 1993 and title 5, United States Code, to allow employees to take, as additional leave, parental involvement leave to participate in or attend their children’s and grandchildren’s educational and extracurricular activities, and to clarify that leave may be taken for routine family medical needs and to assist elderly relatives, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HFC78B09F0AB7478EA51B87B7D64ABF4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family and Medical Leave Enhancement Act of 2009</short-title></quote>.</text> </section> 
<section id="H6EB333655E4D42669085B4F89D610809"><enum>2.</enum><header>Eligible employee</header><text display-inline="no-display-inline">Section 101(2)(B)(ii) of the Family and Medical Leave Act of 1993 (29 U.S.C. 2611(2)(B)(ii)) is amended by striking <quote>less than 50</quote> each place it appears and inserting <quote>fewer than 25</quote>.</text> </section> 
<section id="H6BBCD32F06944ECCAEBC625842E4F5E8"><enum>3.</enum><header>Entitlement to additional leave under the FMLA for parental involvement and family wellness</header> 
<subsection id="HAB5EFF6CDC5845E999245FE961D42B37"><enum>(a)</enum><header>Leave requirement</header><text>Section 102(a) of the Family and Medical Leave Act of 1993 (29 U.S.C. 2612(a)) is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="HEB458C72A58F4EDCAE83D0169D007200"> 
<paragraph id="H0D940251C5F84A5B8F3580A00C477A7"><enum>(5)</enum><header>Entitlement to additional leave for parental involvement and family wellness</header> 
<subparagraph id="HCE733F67E1A3453897F7984122E402B"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B) and section 103(g), an eligible employee shall be entitled to leave under this paragraph to—</text> 
<clause id="H4EB9795564A042128CB49651BAD3006C"><enum>(i)</enum><text>participate in or attend an activity that is sponsored by a school or community organization and relates to a program of the school or organization that is attended by a son or daughter or a grandchild of the employee; or</text></clause> 
<clause id="H9C066537467C446D95D23F65BAD8FFBB"><enum>(ii)</enum><text display-inline="yes-display-inline">meet routine family medical care needs, including for medical and dental appointments of the employee or a son, daughter, spouse, or grandchild of the employee, or to attend to the care needs of elderly individuals who are related to the eligible employee, including visits to nursing homes and group homes.</text> </clause></subparagraph> 
<subparagraph id="H18F9B7DA96FE41E1003B2545BF9C6372"><enum>(B)</enum><header>Limitations</header> 
<clause id="H04DC0B89E150458AABC2EFED957EAF3C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible employee is entitled to—</text> 
<subclause id="H7EC89AB6805C4E9C8B58700035BE0923"><enum>(I)</enum><text>not to exceed 4 hours of leave under this paragraph during any 30-day period; and</text> </subclause> 
<subclause id="HD40AFBD44B754903A779F337DA00E89"><enum>(II)</enum><text>not to exceed 24 hours of leave under this paragraph during any 12-month period.</text> </subclause></clause> 
<clause id="HA19F1949F09F467AB2B0CA89E3E1CD27"><enum>(ii)</enum><header>Coordination rule</header><text>Leave under this paragraph shall be in addition to any leave provided under any other paragraph of this subsection.</text> </clause></subparagraph> 
<subparagraph id="HE66BA6CA8C22410D98C4ECA03F7C3838"><enum>(C)</enum><header>Definitions</header><text>As used in this paragraph:</text> 
<clause id="HAC5D6A86DEC54A338B8E5B2708A30079"><enum>(i)</enum><header>School</header><text>The term <term>school</term> means an elementary school or secondary school (as such terms are defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (20 U.S.C. 7801)), a Head Start program assisted under the <act-name parsable-cite="HSA">Head Start Act</act-name> (42 U.S.C. 9831 et seq.), or a child care facility.</text> </clause> 
<clause id="H4894F363988A43E6A2ECB9F5EBBD78"><enum>(ii)</enum><header>Community organization</header><text>The term <term>community organization</term> means a private nonprofit organization that is representative of a community or a significant segment of a community and provides activities for individuals described in subparagraph (A) or (B) of section 101(12), such as a scouting or sports organization.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H489C0AC6BDFF4AB9BBC93EE1E754E81D"><enum>(b)</enum><header>Schedule</header><text>Section 102(b)(1) of such Act (29 U.S.C. 2612(b)(1)) is amended by inserting after the third sentence the following new sentence: <quote>Leave under subsection (a)(5) may be taken intermittently or on a reduced leave schedule.</quote>.</text> </subsection> 
<subsection id="H98C4BE55832340B6ABD40086E4A95EC2"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2) of such Act (29 U.S.C. 2612(d)(2)) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H1FDA8C44F07449EB001DC135562C6972" style="USC"> 
<subparagraph id="HAB7CC12D01DC4F56AE55A7673C4D1980"><enum>(C)</enum><header>Parental involvement leave and family wellness leave</header><text display-inline="yes-display-inline">An eligible employee may elect, or an employer may require the employee, to substitute any of the accrued paid vacation leave, personal leave, or family leave of the employee for any leave under subsection (a)(5). In addition, an eligible employee may elect, or an employer may require the employee, to substitute any of the accrued paid medical or sick leave of the employee for leave provided under clause (ii) of subsection (a)(5)(A) for any part of the leave under such clause, except that nothing in this title shall require an employer to provide paid sick leave or paid medical leave in any situation in which such employer would not normally provide any such paid leave. If the employee elects or the employer requires the substitution of accrued paid leave for leave provided under subsection (a)(5)(A), the employer shall not restrict or limit this substitution or impose any additional terms and conditions on such leave that are more stringent on the employee than the terms and conditions set forth in this Act.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HB3AC0949E82B4C2981A3EAB433B5DF84"><enum>(d)</enum><header>Notice</header><text>Section 102(e) of such Act (29 U.S.C. 2612(e)) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H5EF0B245C0A9475080F2A5EDD812A1C" style="OLC"> 
<paragraph id="H636EEA7BEDE34C41B5A3980CBF61580"><enum>(4)</enum><header>Notice relating to parental involvement and family wellness leave</header><text display-inline="yes-display-inline">In any case in which an employee requests leave under paragraph (5) of subsection (a), the employee shall—</text> 
<subparagraph id="HAEBAECAD597C4C11837474FD0059F53F"><enum>(A)</enum><text>provide the employer with not less than 7 days’ notice or as much notice as is practicable before the date the leave is to be taken, of the employee’s intention to take leave under such paragraph; and</text> </subparagraph> 
<subparagraph id="H8250BBC1C4064229AB0312667B84D34E"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of leave to be taken under subparagraph (A)(ii), make a reasonable effort to schedule the leave so as not to disrupt unduly the operations of the employer, subject to the approval of the health care provider involved (if any).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H00F1AB4C3C9B487BB3618C45A175ACAF"><enum>(f)</enum><header>Certification</header><text>Section 103 of such Act (29 U.S.C. 2613) is amended by adding at the end the following new subsection:</text>

<subsection id="HF366968DC7584C17A5AB151119F029C4"><enum>(g)</enum><header>Certification related to parental involvement and family wellness leave</header><text>An employer may require that a request for leave under section 102(a)(5) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HDC769D28024543CF99009F1C11788BEE"><enum>(g)</enum><header>Definition of grandchild</header><text>Section 101 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2611) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H5C1B351509774592BCE1DFCE50EEAFB7"><enum>(14)</enum><header>Grandchild</header><text>The term <term>grandchild</term> means a son or daughter of an employee’s son or daughter.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H7F8844E86BDF4715A0D72500206B9196" commented="no"><enum>4.</enum><header>Entitlement of Federal employees to leave for parental involvement and family wellness</header> 
<subsection id="HE7DD7F2321B249E8923EF5688F2399AE" commented="no"><enum>(a)</enum><header>Leave requirement</header><text>Section 6382(a) of title 5, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H17FCFD29DCE642E1BCCE6476F346DFE" indent="up1" commented="no"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HE223FA1D7A274C21A06EBD78D41B62B4"><enum>(A)</enum><text>Subject to subparagraph (B)(i) and section 6383(f), an employee shall be entitled to leave under this paragraph to—</text> 
<clause id="HB637C61888FF4C9BB28623E140D6162D" indent="up1" commented="no"><enum>(i)</enum><text>participate in or attend an activity that is sponsored by a school or community organization and relates to a program of the school or organization that is attended by a son or daughter or a grandchild of the employee; or</text></clause> 
<clause id="HE58FC6D5C5684D51B2F782BBAD4D387" indent="up1" commented="no"><enum>(ii)</enum><text>meet routine family medical care needs, including for medical and dental appointments of a son, daughter, spouse, or grandchild of the employee, or to attend to the care needs of elderly individuals who are related to the eligible employee, including visits to nursing homes and group homes.</text></clause></subparagraph> 
<subparagraph id="HAA3177EAB8854B9C99CE272CB510067" indent="up1" commented="no"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H9D4CE2D03D8547188D2E6C381E3FB022"><enum>(i)</enum><text>An employee is entitled to—</text> 
<subclause id="H84A73D912B9844EF00A83C0017A557D5" indent="up1" commented="no"><enum>(I)</enum><text>not to exceed 4 hours of leave under this paragraph during any 30-day period; and</text> </subclause> 
<subclause id="H72FC682E387B4E508B18A36D2C46EA94" indent="up1" commented="no"><enum>(II)</enum><text>not to exceed 24 hours of leave under this paragraph during any 12-month period.</text> </subclause></clause> 
<clause id="H6B0D88A144254F1AAA412B4432B0579E" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">Leave under this paragraph shall be in addition to any leave provided under any other paragraph of this subsection.</text> </clause></subparagraph> 
<subparagraph id="H223AE56E36AA4FD600E309006CC47C71" indent="up1" commented="no"><enum>(C)</enum><text>For the purpose of this paragraph—</text> 
<clause id="HCA5F7F0C37734453B6386C93D8066CED" commented="no"><enum>(i)</enum><text>the term <term>school</term> means an elementary school or secondary school (as such terms are defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965)</act-name>, a Head Start program assisted under the <act-name parsable-cite="HSA">Head Start Act</act-name>, and a child care facility licensed under State law; and</text> </clause> 
<clause id="H3E2F3A5754F843399F28A459CB77F995" commented="no"><enum>(ii)</enum><text>the term <term>community organization</term> means a private nonprofit organization that is representative of a community or a significant segment of a community and provides activities for individuals described in subparagraph (A) or (B) of section 6381(6), such as a scouting or sports organization.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HD5B2A85AA8F04AE88088E2F23634D4F" commented="no"><enum>(b)</enum><header>Schedule</header><text>Section 6382(b)(1) of such title is amended—</text> 
<paragraph id="HBC1DAEB0024C45FDB84D1F4DF6735E17" commented="no"><enum>(1)</enum><text>by inserting after the second sentence the following new sentence: <quote>Leave under subsection (a)(5) may be taken intermittently or on a reduced leave schedule.</quote>; and</text> </paragraph> 
<paragraph id="H5C840D7191654589AA9E1F53BC8CCA82" commented="no"><enum>(2)</enum><text>in the last sentence, by striking <quote>involved,</quote> and inserting <quote>involved (or, in the case of leave under subsection (a)(5), for purposes of any 30-day or 12-month period),</quote>.</text> </paragraph></subsection> 
<subsection id="H1743FDD96CBE440E8CE1D07E5B68ACB6" commented="no"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended—</text> 
<paragraph id="H69529B11D4E34BF1BC26D61C5BB56B8D"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after the subsection designation; and </text></paragraph> 
<paragraph id="H0DD1E7CD6CD94DC880A9BD72A2A22DD5"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H43A637EDE7E441E8A620CA1ED4008E9E" indent="up1"><enum>(2) </enum><text display-inline="yes-display-inline">An employee may elect to substitute for leave under subsection (a)(5), any of the employee’s accrued or accumulated annual or sick leave under subchapter I. If the employee elects to substitute accumulated annual or sick leave for leave provided under subsection (a)(5), the employing agency shall not restrict or limit this substitution or impose any additional terms and conditions on such leave that are more stringent on the employee than the terms and conditions set forth in this subchapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H4A958E3D6AFF437FAEE86839D78B07B7" commented="no"><enum>(d)</enum><header>Notice</header><text>Section 6382(e) of such title is amended by adding at the end the following new paragraph:</text>

<paragraph id="HED714E8626E14D0F9B26E6938155F61B" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">In any case in which an employee requests leave under paragraph (5) of subsection (a), the employee shall—</text> 
<subparagraph id="H4BD7A1980AE04AD985D623F189CC3C92" commented="no"><enum>(A)</enum><text>provide the employing agency with not less than 7 days’ notice, before the date the leave is to be taken, of the employee’s intention to take leave under such paragraph; and</text></subparagraph>

<subsection id="H83FDE095261C42399CF3FCBA0472777" commented="no"><enum>(e)</enum><header>Certification</header><text>Section 6383(f) of such title is amended by striking <quote>6382(a)(3)</quote> and inserting <quote>paragraph (3) or (5) of section 6382(a)</quote>.</text> </subsection> 
<subsection id="H3E7CBDF38E8048F9B8B46FF166D279CE" commented="no"><enum>(f)</enum><header>Definition of grandchild</header><text>Section 6381 of title 5, United States Code, is amended—</text> 
<paragraph id="H5FF471A10EAD4E1DA1B32F3339437EBA" commented="no"><enum>(1)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text> </paragraph> 
<paragraph id="H931696A657804E62BEF888651E2B5FB" commented="no"><enum>(2)</enum><text>in paragraph (11), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph>
