		<official-title>To amend the High Seas Driftnet Fishing Moratorium
		  Protection Act and the Magnuson-Stevens Fishery Conservation and Management Act
		  to improve the conservation of sharks.</official-title>

		<section id="HEF712AA84482482382E9367800DCDFB1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Shark Conservation Act of
			 2009</short-title></quote>.</text>
		</section><section id="H125AF1BE68764FC28E9696D38B800612"><enum>2.</enum><header>Amendment of High
			 Seas Driftnet Fishing Moratorium Protection Act</header><text display-inline="no-display-inline">Section 610(a) of the High Seas Driftnet
			 Fishing Moratorium Protection Act (16 U.S.C. 1826k(a)) is amended—</text>
			<paragraph id="H86D36A781CC14C22BE1B899CE6B5B23"><enum>(1)</enum><text>by
			 striking so much as precedes paragraph (1) and inserting the following:</text>
				<quoted-block id="H8295DCC92EB6402E85359B608E49F78F" style="OLC">
					<subsection id="H605BBD3983D9410AB9007EC36D423583"><enum>(a)</enum><header>Identification</header><text>The
				Secretary shall identify, and list in the report under section 607—</text>
						<paragraph id="HF01E3B7B45CE4F4F880028F06613DACC"><enum>(1)</enum><text>a nation
				if—</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H0F4635C09A95435BBA40DD217E99A3F9"><enum>(2)</enum><text>in paragraph (1)
			 by redesignating subparagraphs (A) and (B) as clauses (i) and (ii),
			 respectively;</text>
			</paragraph><paragraph id="H1C869F0AD5D548A5BD639F2F6684CFF2"><enum>(3)</enum><text>by redesignating
			 paragraphs (1) through (3) as subparagraphs (A) through (C),
			 respectively;</text>
			</paragraph><paragraph id="HE2E7B8C261324776B8709F31FDC3C898"><enum>(4)</enum><text>by moving
			 subparagraphs (A) through (C) (as so redesignated) 2 ems to the right;</text>
			</paragraph><paragraph id="H6387379C924944248CAB7856F74269EA"><enum>(5)</enum><text>in subparagraph
			 (C) (as so redesignated) by striking the period at the end and inserting
			 <quote>; and</quote>; and</text>
			</paragraph><paragraph id="H0CDAB2921C444FAEAB70C4FDE204C4DD"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HA3842531E1DE4B4DBFB33936B0DC0061" style="OLC">
					<paragraph id="H606478D02B5F4AFA99DCBA6FC7B8113D"><enum>(2)</enum><text>a nation
				if—</text>
						<subparagraph id="H364FB44A4C724A8EAC266CD955A2BAD6"><enum>(A)</enum><text>fishing vessels of
				that nation are engaged, or have been engaged during the preceding calendar
				year, in fishing activities or practices that target or incidentally catch
				sharks; and</text>
						</subparagraph><subparagraph id="H1F220F1C48B244A0AB850182D3BBDD58"><enum>(B)</enum><text>the nation has not
				adopted a regulatory program to provide for the conservation of sharks,
				including measures to prohibit removal of any of the fins of a shark (including
				the tail) and discarding the carcass of the shark at sea, that is comparable to
				that of the United States, taking into account different
				conditions.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H11A9B6926FC34C84AEFD0079C306F262"><enum>3.</enum><header>Amendment of
			 Magnuson-Stevens Fishery Conservation and Management Act</header><text display-inline="no-display-inline">Section 307(1) of Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1857(1)) is amended—</text>
			<paragraph display-inline="no-display-inline" id="HF7514E0F4A934F0EAC853B73549E9823"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subparagraph (P) to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H879E77979C1144689C21B981A377C06" style="OLC">
					<subparagraph id="HB299A65C134D40F29D7121F1AF943246"><enum>(P)</enum><clause commented="no" display-inline="yes-display-inline" id="HEC737F6351D041469B6525C391B50652"><enum>(i)</enum><text display-inline="yes-display-inline">to remove any of the fins of a shark
				(including the tail) at sea;</text>
						</clause><clause id="HA2C49F70F4374C3EA0D18DD643CBC54B" indent="up1"><enum>(ii)</enum><text>to have custody, control, or
				possession of any such fin aboard a fishing vessel unless it is naturally
				attached to the corresponding carcass;</text>
						</clause><clause id="HDC8D30FC7CA74602AD3534D9CA615F34" indent="up1"><enum>(iii)</enum><text>to transfer any such fin from one
				vessel to another vessel at sea, or to receive any such fin in such transfer,
				without the fin naturally attached to the corresponding carcass; or</text>
						</clause><clause id="H42AFF924C8B245B7A3C9E6CAB42DE21" indent="up1"><enum>(iv)</enum><text>to land any such fin that is not
				naturally attached to the corresponding carcass, or to land any shark carcass
				without such fins naturally attached;</text>
						</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="HD8028EDDDD00438EB5B4294E21CB1934"><enum>(2)</enum><text>by striking the
			 matter following subparagraph (R) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H65EAAB63FB4C4EF5992D616908DAFF30" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">For
				purposes of subparagraph (P), there shall be a rebuttable presumption that if
				any shark fin (including the tail) is found aboard a vessel, other than a
				fishing vessel, without being naturally attached to the corresponding carcass,
				such fin was transferred in violation of subparagraph (P)(iii) and that if,
				after landing, the total weight of shark fins (including the tail) landed from
				any vessel exceeds five percent of the total weight of shark carcasses landed,
				such fins were taken, held, or landed in violation of subparagraph
