		<section display-inline="no-display-inline" id="H9EE2A37DE7F94D3D8215233825B96BF0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe And Fair Enforcement and Recall
			 for Meat, Poultry, and Food Act </short-title> of 2009</quote> or
			 <quote><short-title>SAFER Meat, Poultry, and Food Act of
			 2009</short-title></quote>.</text>
		</section><section id="HE6434A75740B4D40BB00F283E8DA2C06"><enum>2.</enum><header>Food safety
			 enforcement for meat and meat food products</header>
			<subsection id="H6F80DC0A7B6E4948A315C5B9EDF5D800"><enum>(a)</enum><header>In
			 general</header><text>The Federal Meat Inspection Act (21 U.S.C. 601 et seq.)
			 is amended—</text>
				<paragraph id="HAAFB42EA1063449AA465361900FB73CE"><enum>(1)</enum><text>by redesignating
			 section 411 (21 U.S.C. 680) as section 414; and</text>
				</paragraph><paragraph id="H26B82F5D832F4D5D872DBEE3E73C54"><enum>(2)</enum><text>by
			 inserting after section 410 (21 U.S.C. 679a) the following:</text>
					<quoted-block id="H05A2F98CB54249648349865BCFE8C583" style="OLC">
						<section id="H2FE0E766E9FD4917BE17E51FA8549120"><enum>411.</enum><header>Notification,
				nondistribution, and recall of adulterated or misbranded articles</header>
							<subsection id="HEFF683E8654A4362BC06D9C24F04704F"><enum>(a)</enum><header>Notification to
				secretary of violation</header>
								<paragraph id="H086D915B23584BA4A4F9CBD78BE9B57"><enum>(1)</enum><header>In
				general</header><text>A person (other than a household consumer) that has
				reason to believe that any carcass, part of a carcass, meat, or meat food
				product of cattle, sheep, swine, goats, horses, mules, or other equines
				(referred to in this section as an <quote>article</quote>) transported, stored,
				distributed, or otherwise handled by the person is adulterated or misbranded
				shall, as soon as practicable, notify the Secretary of the identity and
				location of the article.</text>
								</paragraph><paragraph id="H4BC13168ECF340F88E9C5688F084525"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
								</paragraph></subsection><subsection id="H8E85902454AE4118B353346BC01E3255"><enum>(b)</enum><header>Recall and
				consumer notification</header>
								<paragraph id="HB89EC3C4E03F488F892884007ECBADA5"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
									<subparagraph id="H7351122F32B44992AB5BB07CA46694D0"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
									</subparagraph><subparagraph id="HD9CC6DB67C0A4301A46E92BA1DBCB3F8"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
									</subparagraph><subparagraph id="H694A5DADC8664AF394CFA8DFB757F4BC"><enum>(C)</enum><text>to recall the
				article;</text>
									</subparagraph><subparagraph id="H15DCB5A3604D47CBB2FD989190D863A4"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
									</subparagraph><subparagraph id="H2B4ECE01079D4ABABBCE257DD3E71D5E"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
									</subparagraph></paragraph><paragraph id="H266BB74B78D64845A84EEAC1E8360985"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
									<subparagraph id="HED38DB60E3FF4A369379D1F7C9FF004F"><enum>(A)</enum><text>shall require the
				person—</text>
										<clause id="H290D553A106C4A92ABF3A0009F912D78"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
										</clause><clause id="H0BD11F89D0AF4D8B8B298000E122D63D"><enum>(ii)</enum><text>to immediately
				make the notification described in paragraph (1)(B); and</text>
										</clause></subparagraph><subparagraph id="H91A2ECB6E4264D36ACBB81B3F83A9D2"><enum>(B)</enum><text>may take control or
				possession of the article.</text>
									</subparagraph></paragraph><paragraph id="H0A877AAEA0D34F9BB63F196E5EA26D62"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text>The Secretary shall, as the
				Secretary determines to be necessary, provide notice of the finding of the
				Secretary under paragraph (1) to consumers to which the article was, or may
				have been, distributed and to appropriate State and local public health
				officials.</text>
								</paragraph><paragraph id="HA71A2CFE2E36453298C8672FE89FEDB4"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(B) shall cease immediately distribution of the
				article.</text>
								</paragraph><paragraph id="HD6563C1FF0354D6192DDC8EB919C844D"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
									<subparagraph id="H6FBA40A2CEB6475398297B3400AD21E5"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
									</subparagraph><subparagraph id="H62BA8F4237E343A3BCD8B56483F57C60"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
									</subparagraph></paragraph></subsection><subsection id="HC6A388CE2D3A49239B1CEC9EBFFB218B"><enum>(c)</enum><header>Informal
				hearings on orders</header>
								<paragraph id="HB30B06368C084DFAAA9C121FC92BFC5"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
									<subparagraph id="H1CB345309A194EEE93706C78004FC5A4"><enum>(A)</enum><text>the actions
				required by the order; and</text>
									</subparagraph><subparagraph id="HCFC3B297C22046AFB7AC56B3AD8C745D"><enum>(B)</enum><text>any reasons why
				the article that is the subject of the order should not be recalled.</text>
									</subparagraph></paragraph><paragraph id="H7FDF6E63BEFB4EB1A6AF042D726260F0"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>
								</paragraph></subsection><subsection id="H34FF6A78A6074255990050B9A66C009D"><enum>(d)</enum><header>Post-hearing
				recall orders</header>
								<paragraph id="HAB06D87FE7594292B3670322012551F2"><enum>(1)</enum><header>Amendment of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that there is a reasonable
				probability that human consumption of the article that is the subject of an
				order under subsection (b) presents a threat to public health, the Secretary
				may, as the Secretary determines to be necessary—</text>
									<subparagraph id="H29D9CC851EE042749E14B7FA8B1FBED"><enum>(A)</enum><text>amend the order
				under subsection (b)—</text>
										<clause id="H0FDAB44A9B3D431D929363A3F1B7F02B"><enum>(i)</enum><text>to
				require recall of the article or other appropriate action; and</text>
										</clause><clause id="HBDE5F3EF844D4F6689477732FF9641FD"><enum>(ii)</enum><text>to specify a
				timetable during which the recall shall occur;</text>
										</clause></subparagraph><subparagraph id="H2BB84A80A7054894A42FBC5B7F20C271"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall;</text>
									</subparagraph><subparagraph id="HEB3665AA5FAD44B5A9E1087456CAF36F"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed; or</text>
									</subparagraph><subparagraph id="H07DE5F423ED84F75971F36A3747883F3"><enum>(D)</enum><text>take any
				combination of actions described in subparagraphs (A) through (C).</text>
									</subparagraph></paragraph><paragraph id="H0000B930F320407CBB6B2F4D33E910BD"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that adequate grounds do not
				exist to continue the actions required by the order, the Secretary shall vacate
				the order.</text>
								</paragraph></subsection><subsection id="HD6282BDB2BBC4680ADC943425D686008"><enum>(e)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be available.</text>
							</subsection></section><section id="H8F7581D1C09141AB00B9696500876C15"><enum>412.</enum><header>Refusal or
				withdrawal of inspection of establishments</header>
							<subsection id="HA8240FB8542046B4812933E118ADD613"><enum>(a)</enum><header>In
				general</header><text>The Secretary may, for such period, or indefinitely, as
				the Secretary considers necessary to carry out this Act, refuse to provide or
				withdraw inspection under title I with respect to an establishment if the
				Secretary determines, after opportunity for a hearing on the record is provided
				to the applicant for, or recipient of, inspection, that the applicant or
				recipient, or any person responsibly connected with the applicant or recipient
				(within the meaning of section 401), has committed a willful violation or
				repeated violations of this Act (including a regulation promulgated under this
				Act).</text>
							</subsection><subsection id="HCE98941EB48D43998673FD608023C01F"><enum>(b)</enum><header>Denial or
				suspension of inspection pending hearing</header><text>The Secretary may deny
				or suspend inspection under title I, pending opportunity for an expedited
				hearing, with respect to an action under subsection (a), if the Secretary
				determines that the denial or suspension is in the public interest to protect
				the health or welfare of consumers or to ensure the effective performance of an
				official duty under this Act.</text>
							</subsection><subsection id="H197AC615981D475CBAB600D19B83D758"><enum>(c)</enum><header>Judicial
				review</header>
								<paragraph id="HB2D268B2738847C9AF43B619967E5BA3"><enum>(1)</enum><header>In
				general</header><text>A determination and order of the Secretary with respect
				to the refusal or withdrawal of inspection under this section shall be final
				unless, not later than 30 days after the effective date of the order, the
				affected applicant for, or recipient of, inspection—</text>
									<subparagraph id="H7C8F57B85E774ED8ACC5C6133424C728"><enum>(A)</enum><text>files a petition
				for judicial review of the order; and</text>
									</subparagraph><subparagraph id="H4E2BCEBC4E97465A90F2600F7A167F0"><enum>(B)</enum><text>simultaneously
				sends a copy of the petition by certified mail to the Secretary.</text>
									</subparagraph></paragraph><paragraph id="HE83539F3FC7047CBB1FB0053EE76300"><enum>(2)</enum><header>Refusal or
				withdrawal of inspection pending review</header><text>Inspection shall be
				refused or withdrawn as of the effective date of the order pending any judicial
				review of the order unless the Secretary directs otherwise.</text>
								</paragraph><paragraph id="H11A07FEACA0C4F469747AF229CC88673"><enum>(3)</enum><header>Venue;
				record</header><text>Judicial review of the order shall be—</text>
									<subparagraph id="HD0A4E44C5D8D4654B6005C9CFE002E58"><enum>(A)</enum><text>in—</text>
										<clause id="H72ECEEE5E7DD4BCFA35884A0C00EE00"><enum>(i)</enum><text>the
				United States court of appeals for the circuit in which the applicant for, or
				recipient of, inspection resides or has its principal place of business;
				or</text>
										</clause><clause id="H57B39E38B12C45EFAC5E6859F0B8D2C3"><enum>(ii)</enum><text>the United States
				Court of Appeals for the District of Columbia Circuit; and</text>
										</clause></subparagraph><subparagraph id="HE22AECBBBE8249C8BE112BAFB39C005F"><enum>(B)</enum><text>on the record on
				which the determination and order are based.</text>
									</subparagraph></paragraph></subsection><subsection id="H649C46658CAE4D09864533E6D6E49411"><enum>(d)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be available.</text>
							</subsection></section><section id="HFBEDCEE53F6444D1A100E609AA7D8937"><enum>413.</enum><header>Civil
				Penalties</header>
							<subsection id="HE844DA0D45F1449BA579188B65A2E495"><enum>(a)</enum><header>In
				general</header>
								<paragraph id="H6AB69F871EA14A3C83F9CFFF00DDA14"><enum>(1)</enum><header>Assessment</header><text>The
				Secretary may assess against a person that violates this Act (including a
				regulation promulgated or order issued under this Act) a civil penalty for each
				violation of not more than $100,000.</text>
								</paragraph><paragraph id="H099960291D2E47DE9C043EA7D182DC00"><enum>(2)</enum><header>Separate
				offenses</header><text>Each violation and each day during which the violation
				continues shall be considered to be a separate offense.</text>
								</paragraph><paragraph id="HDAE38A66538746C69935DE1E6CE30202"><enum>(3)</enum><header>Notice and
				opportunity for hearing</header><text>The Secretary shall not assess a civil
				penalty under this section against a person unless the person is given notice
				and opportunity for a hearing on the record before the Secretary in accordance
				with sections 554 and 556 of title 5, United States Code.</text>
								</paragraph><paragraph id="HC896E3B8971C4A91AD5D7750935474B3"><enum>(4)</enum><header>Determination of
				civil penalty amount</header><text>The amount of a civil penalty under this
				section—</text>
									<subparagraph id="H77F12F07DF4B406E907FE867C35D7652"><enum>(A)</enum><text>shall be assessed
				by the Secretary by written order, taking into account—</text>
										<clause id="H7A55AA034EBE47B88D59EC02EB69044B"><enum>(i)</enum><text>the gravity of the
				violation;</text>
										</clause><clause id="H1679E37E7AEB412FA461F5241537E4E9"><enum>(ii)</enum><text>the degree of
				culpability of the person;</text>
										</clause><clause id="H68EE7B9D01C7476D9587AEC6C966A5FC"><enum>(iii)</enum><text>the size and
				type of the business of the person; and</text>
										</clause><clause id="HB20B435627684F66AC67843E4B604703"><enum>(iv)</enum><text>any history of
				prior offenses by the person under this Act; and</text>
										</clause></subparagraph><subparagraph id="HFEF0FE9EEAE64198847539FFFF35BDF9"><enum>(B)</enum><text>shall be reviewed
				only in accordance with subsection (b).</text>
									</subparagraph></paragraph></subsection><subsection id="H077013B9F4E74EA28443A01338FBF805"><enum>(b)</enum><header>Judicial
				review</header>
								<paragraph id="H20A45D1970C741B18419AD71071F6705"><enum>(1)</enum><header>In
				general</header><text>An order assessing a civil penalty against a person under
				subsection (a) shall be final unless the person—</text>
									<subparagraph id="H8A34B31C33CA4DD0B1B03955BF9C8058"><enum>(A)</enum><text>not later than 30
				days after the effective date of the order, files a petition for judicial
				review of the order in—</text>
										<clause id="HAF235F36047143B4AD009824B416EF34"><enum>(i)</enum><text>the United States
				court of appeals for the circuit in which the person resides or has its
				principal place of business; or</text>
										</clause><clause id="HA538514E55ED4AE1BC9EADB2045DCB00"><enum>(ii)</enum><text>the United States
				Court of Appeals for the District of Columbia Circuit; and</text>
										</clause></subparagraph><subparagraph id="HD9E98A39136648FD00FAB7E1DCB168E7"><enum>(B)</enum><text>simultaneously
				sends a copy of the petition by certified mail to the Secretary.</text>
									</subparagraph></paragraph><paragraph id="HB9D91A3E33DE4D7EA014B3D95924FE8D"><enum>(2)</enum><header>Filing of copy
				of record</header><text>The Secretary shall promptly file in the court a
				certified copy of the record on which the order was issued.</text>
								</paragraph></subsection><subsection id="HEE966EE8FA8A4CF6A5EB26DED10099D8"><enum>(c)</enum><header>Collection
				actions for failure To pay assessment</header>
								<paragraph id="HD2ED5A2D906546AB95DEAD66DBE9ACD2"><enum>(1)</enum><header>Referral to
				Attorney General</header><text>If a person fails to pay a civil penalty
				assessed under subsection (a) after the order assessing the civil penalty has
				become a final order, or after the court of appeals has entered final judgment
				in favor of the Secretary, the Secretary shall refer the matter to the Attorney
				General.</text>
								</paragraph><paragraph id="H0D2DBA6C56034E49B873337187936FE8"><enum>(2)</enum><header>Action by
				Attorney General</header><text>The Attorney General shall bring a civil action
				to recover the amount of the civil penalty in United States district
				court.</text>
								</paragraph><paragraph id="H88D9438A45CD45E082B0D2C41E95A03B"><enum>(3)</enum><header>Scope of
				review</header><text>In a civil action under paragraph (2), the validity and
				appropriateness of the order of the Secretary assessing the civil penalty shall
				not be subject to review.</text>
								</paragraph></subsection><subsection id="H6210E68AC55448FA00545E70BE312065"><enum>(d)</enum><header>Refusal or
				withdrawal of inspection pending payment</header><text>If a person fails to pay
				the amount of a civil penalty after the order assessing the civil penalty has
				become a final order, the Secretary may refuse to provide or withdraw
				inspection under title I of the person until the civil penalty is paid or until
				the Secretary directs otherwise.</text>
							</subsection><subsection id="H10A8F7DC915C4666A8EB45E82DBD6864"><enum>(e)</enum><header>Penalties in
				lieu of other actions</header><text>Nothing in this Act requires the Secretary
				to report for prosecution, or for the commencement of an action, any violation
				of this Act in any case in which the Secretary believes that the public
				interest will be adequately served by the assessment of a civil penalty under
				this section.</text>
							</subsection><subsection id="HA849DDBB47204DC4B194E73500A27812"><enum>(f)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be
				available.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA7D46C3518C14A11B11D77F05374878E"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H44DCE00E2C7E44F3AB1F52C805BE6090"><enum>(1)</enum><text>Section 1 of the
			 Federal Meat Inspection Act (21 U.S.C. 601) is amended by adding at the end the
			 following:</text>
					<quoted-block id="H2466CC5AF2E04EFFA441221506697427" style="OLC">
						<subsection id="H671DA2F80E1E46A4A5ADB0C9F95F47A1"><enum>(x)</enum><header>Person</header><text>The
				term <quote>person</quote> means any individual, partnership, corporation,
				association, or other business
				unit.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1C0A5AE0FD9643D3006581C2B3AF2167"><enum>(2)</enum><text>The Federal Meat
			 Inspection Act (21 U.S.C. 601 et seq.) is amended—</text>
					<subparagraph id="H75F57645CB76410695B16F241D111DDE"><enum>(A)</enum><text>by striking
			 <quote>person, firm, or corporation</quote> each place it appears and inserting
			 <quote>person</quote>;</text>
					</subparagraph><subparagraph id="H7A62E1FD87864E6DA709BB55194323B2"><enum>(B)</enum><text>by striking
			 <quote>persons, firms, and corporations</quote> each place it appears and
			 inserting <quote>persons</quote>; and</text>
					</subparagraph><subparagraph id="HD663A8D5798E42E5A8474095BAB300F1"><enum>(C)</enum><text>by striking
			 <quote>persons, firms, or corporations</quote> each place it appears and
			 inserting <quote>persons</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H8D447E2B13744F1B8D7300AE306829F6"><enum>3.</enum><header>Food safety
			 enforcement for poultry and poultry food products</header><text display-inline="no-display-inline">The Poultry Products Inspection Act (21
			 U.S.C. 451 et seq.) is amended—</text>
			<paragraph id="H79C1FEA5308D450782F5EC3DEC8153FC"><enum>(1)</enum><text>in the first
			 sentence of section 5(c)(1) (21 U.S.C. 454(c)(1))—</text>
				<subparagraph id="H9B0583786C2E44F9AD4258DF4C19DD81"><enum>(A)</enum><text>by striking
			 <quote>, by thirty days prior to the expiration of two years after enactment of
			 the Wholesome Poultry Products Act,</quote>; and</text>
				</subparagraph><subparagraph id="HF658E825C8A6402E84C2CA8CE374C1BD"><enum>(B)</enum><text>by striking
			 <quote>sections 1–4, 6–10, and 12–22 of this Act</quote> and inserting
			 <quote>sections 1 through 4, 6 through 10, 12 through 22, and 31 through
			 33</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H5B2FE59DD1E54EE3BD8C008946051CD1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HA7A70FB030984F6EA2EFCEEFFB6E99B3" style="OLC">
					<section id="HC62FB613E29C48B8AE46B081E1CD2836"><enum>31.</enum><header>Notification,
				nondistribution, and recall of adulterated or misbranded articles</header>
						<subsection id="H06FFEA1B5E9149EEA4B2F3C7D6564857"><enum>(a)</enum><header>Notification to
				secretary of violation</header>
							<paragraph id="HE0830D0B16294497A6E849033B910390"><enum>(1)</enum><header>In
				general</header><text>A person (other than a household consumer) that has
				reason to believe that any poultry or poultry product (referred to in this
				section as an <quote>article</quote>) transported, stored, distributed, or
				otherwise handled by the person is adulterated or misbranded shall, as soon as
				practicable, notify the Secretary of the identity and location of the
				article.</text>
							</paragraph><paragraph id="H038520426D5F488A8465114894E23883"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
							</paragraph></subsection><subsection id="HEFEB954F79344B5AAB1536D9D400D1C5"><enum>(b)</enum><header>Recall and
				consumer notification</header>
							<paragraph id="H5957D626EFE948CDAC9B55D50071CB38"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
								<subparagraph id="H3B57981790464060830017D6ECD48CD4"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
								</subparagraph><subparagraph id="H34ACB75CE0E8472097AD97E9E0F1E5E3"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
								</subparagraph><subparagraph id="H6EDDBF3061EB4220A07EC505808DF9D5"><enum>(C)</enum><text>to recall the
				article;</text>
								</subparagraph><subparagraph id="H5013E509EEED499FA00034A1D9A8BD34"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
								</subparagraph><subparagraph id="H50E41DE13365453BA0562B0038324FA4"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HFEAB9ACDF0FE4515A0437EF4AA004DF8"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
								<subparagraph id="H72D118036EF4478FB7E064CC00042981"><enum>(A)</enum><text>shall require the
				person—</text>
									<clause id="HE8D8442793194C1AA942B32EFB783DDA"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
									</clause><clause id="H97DD68A191D04D90A5CD2C8805C8EE4"><enum>(ii)</enum><text>to
				immediately make the notification described in paragraph (1)(B); and</text>
									</clause></subparagraph><subparagraph id="H5FD98A9EA27042CB009CDB87993FF79"><enum>(B)</enum><text>may take control or
				possession of the article.</text>
								</subparagraph></paragraph><paragraph id="HFE97D45EFF4F4DFC988EF73655414C7F"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text display-inline="yes-display-inline">The Secretary shall, as the Secretary
				determines to be necessary, provide notice of the finding of the Secretary
				under paragraph (1) to consumers to which the article was, or may have been,
				distributed and to appropriate State and local health officials.</text>
							</paragraph><paragraph id="H2CE0F26F603740709F894504AB8620A7"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(B) shall cease immediately distribution of the
				article.</text>
							</paragraph><paragraph id="H7D27BA7A284F48739DC8481C21422B96"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
								<subparagraph id="HB4B88FB676ED4B6D82A8C67B67DF1619"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
								</subparagraph><subparagraph id="H74B2D91D67914FA48CC3346700435900"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
								</subparagraph></paragraph></subsection><subsection id="H0378709A45014D82BD51EA40CAF186"><enum>(c)</enum><header>Informal hearings
				on orders</header>
							<paragraph id="HDD8F9949F1D3474DB219EB777EEF007F"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
								<subparagraph id="H510EE4D3C3B647ECA9A7CB8F3C5BBBBF"><enum>(A)</enum><text>the actions
				required by the order; and</text>
								</subparagraph><subparagraph id="HE084392E93FF472000D829A88559AC1B"><enum>(B)</enum><text>any reasons why
				the article that is the subject of the order should not be recalled.</text>
								</subparagraph></paragraph><paragraph id="H40584DE22EC146F58E27F9E3C0A9CC46"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>
							</paragraph></subsection><subsection id="H6B45F30A740746C3807052FE4DD20282"><enum>(d)</enum><header>Post-hearing
				recall orders</header>
							<paragraph id="H9F8B92259A294400800067FA7CB300C7"><enum>(1)</enum><header>Amendment of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that there is a reasonable
				probability that human consumption of the article that is the subject of an
				order under subsection (b) presents a threat to public health, the Secretary
				may, as the Secretary determines to be necessary—</text>
								<subparagraph id="HBF41DE84EE7D4EA7009DC7A06563F912"><enum>(A)</enum><text>amend the order
				under subsection (b)—</text>
									<clause id="H5C6F003C25034A4EB91FD13400FB3F6D"><enum>(i)</enum><text>to
				require recall of the article or other appropriate action; and</text>
									</clause><clause id="HC7BFFCAF461C462F88A074B7EC30C588"><enum>(ii)</enum><text>to specify a
				timetable during which the recall shall occur;</text>
									</clause></subparagraph><subparagraph id="HA4FA85D75C3E49B3B5D2BE59C308382D"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall; or</text>
								</subparagraph><subparagraph id="H3156AB04952D4C92A91D9378C700C43F"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed.</text>
								</subparagraph></paragraph><paragraph id="HB07B5B54D5CC47E38026E25E8BC75489"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that adequate grounds do not
				exist to continue the actions required by the order, the Secretary shall vacate
				the order.</text>
							</paragraph></subsection><subsection id="HE6590D1AB48840A49B6DEC25D5421234"><enum>(e)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be available.</text>
						</subsection></section><section id="H57779EE29C4B4F1E000436F5C4391BE3"><enum>32.</enum><header>Refusal or
				withdrawal of inspection of establishments</header>
						<subsection id="HC9920C7501564000AC6824D61C1E62C4"><enum>(a)</enum><header>In
				general</header><text>The Secretary may, for such period, or indefinitely, as
				the Secretary considers necessary to carry out this Act, refuse to provide or
				withdraw inspection under this Act with respect to an establishment if the
				Secretary determines, after opportunity for a hearing on the record is provided
				to the applicant for, or recipient of, inspection, that the applicant or
				recipient, or any person responsibly connected with the applicant or recipient
				(within the meaning of section 18(a)), has committed a willful violation or
				repeated violations of this Act (including a regulation promulgated under this
				Act).</text>
						</subsection><subsection id="H11AB553363104903894B3BC96BF7327"><enum>(b)</enum><header>Denial or
				suspension of inspection pending hearing</header><text>The Secretary may deny
				or suspend inspection under this Act, pending opportunity for an expedited
				hearing, with respect to an action under subsection (a), if the Secretary
				determines that the denial or suspension is in the public interest to protect
				the health or welfare of consumers or to ensure the effective performance of an
				official duty under this Act.</text>
						</subsection><subsection id="HCE7A7B7CC2914893BF19F5636CFBBBD1"><enum>(c)</enum><header>Judicial
				review</header>
							<paragraph id="H6A03B71E318D4560B8BD1CF177E4E8D1"><enum>(1)</enum><header>In
				general</header><text>A determination and order of the Secretary with respect
				to the refusal or withdrawal of inspection under this section shall be final
				unless, not later than 30 days after the effective date of the order, the
				affected applicant for, or recipient of, inspection—</text>
								<subparagraph id="H75A210245CDC4FB3AD2912C0DBD0048"><enum>(A)</enum><text>files a petition
				for judicial review of the order; and</text>
								</subparagraph><subparagraph id="HCE4E848246C944E38DDC48704B9C2924"><enum>(B)</enum><text>simultaneously
				sends a copy of the petition by certified mail to the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H9D87F89685C04AD7A871D7BF5B66C0D6"><enum>(2)</enum><header>Refusal or
				withdrawal of inspection pending review</header><text>Inspection shall be
				refused or withdrawn as of the effective date of the order pending any judicial
				review of the order unless the Secretary directs otherwise.</text>
							</paragraph><paragraph id="H9313A8375A864734BE7BAED08958886B"><enum>(3)</enum><header>Venue;
				record</header><text>Judicial review of the order shall be—</text>
								<subparagraph id="H067F681C0D0C418AA922006268FE8DF2"><enum>(A)</enum><text>in—</text>
									<clause id="HF39596A997D84ED0B27CF8AA6D09C0DF"><enum>(i)</enum><text>the United States
				court of appeals for the circuit in which the applicant for, or recipient of,
				inspection resides or has its principal place of business; or</text>
									</clause><clause id="H3C6D6A61EE7F4134AC96B920F000B1C7"><enum>(ii)</enum><text>the United States
				Court of Appeals for the District of Columbia Circuit; and</text>
									</clause></subparagraph><subparagraph id="H4F2B60AE36234CE7A754A9DC10C0AEE"><enum>(B)</enum><text>on the record on
				which the determination and order are based.</text>
								</subparagraph></paragraph></subsection><subsection id="H947F4F6AE57E4B96A0CBFDBFF27F274B"><enum>(d)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be available.</text>
						</subsection></section><section id="H9FA2B8CC5C2D481D903041A00F0C6AA"><enum>33.</enum><header>Civil
				penalties</header>
						<subsection id="H26C1CC00E6524480BFA060F9BB77B56B"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="H338B1E725D614EEA91587EA1BC4DCEEB"><enum>(1)</enum><header>Assessment</header><text>The
				Secretary may assess against a person that violates this Act (including a
				regulation promulgated or order issued under this Act) a civil penalty for each
				violation of not more than $100,000.</text>
							</paragraph><paragraph id="H1FD195C4185849988E279CB579601568"><enum>(2)</enum><header>Separate
				offenses</header><text>Each violation and each day during which the violation
				continues shall be considered to be a separate offense.</text>
							</paragraph><paragraph id="H93CFF51FBE004FFABCEB317875261FD2"><enum>(3)</enum><header>Notice and
				opportunity for hearing</header><text>The Secretary shall not assess a civil
				penalty under this section against a person unless the person is given notice
				and opportunity for a hearing on the record before the Secretary in accordance
				with sections 554 and 556 of title 5, United States Code.</text>
							</paragraph><paragraph id="HE330379396A34FDC881B32CC06E62338"><enum>(4)</enum><header>Determination of
				civil penalty amount</header><text>The amount of a civil penalty under this
				section—</text>
								<subparagraph id="H23E71615C59548EE9B6048C451472CFA"><enum>(A)</enum><text>shall be assessed
				by the Secretary by written order, taking into account—</text>
									<clause id="H40D1F06400244CA88C7D75B463C2A1AE"><enum>(i)</enum><text>the gravity of the
				violation;</text>
									</clause><clause id="H84ACA44BBF7A4007BFAC8CC4FB366179"><enum>(ii)</enum><text>the degree of
				culpability of the person;</text>
									</clause><clause id="H09BD304261D849679E7D14BCF28C972C"><enum>(iii)</enum><text>the size and
				type of the business of the person; and</text>
									</clause><clause id="HF69DA889DF214528BE7B747670C19384"><enum>(iv)</enum><text>any history of
				prior offenses by the person under this Act; and</text>
									</clause></subparagraph><subparagraph id="H3A4F48395E2A4CBE899CF28FBE8BF32"><enum>(B)</enum><text>shall be reviewed
				only in accordance with subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection id="HFE1371995AD94688AEFAA0F6118C8BB0"><enum>(b)</enum><header>Judicial
				review</header>
							<paragraph id="H6827F3B06B9E4AD68EDA745368F5BCBE"><enum>(1)</enum><header>In
				general</header><text>An order assessing a civil penalty against a person under
				subsection (a) shall be final unless the person—</text>
								<subparagraph id="HD9D332F673174EA1B94EF9C65BFB1207"><enum>(A)</enum><text>not later than 30
				days after the effective date of the order, files a petition for judicial
				review of the order in—</text>
									<clause id="H3A2CC896989E4DCCB2F0786395489700"><enum>(i)</enum><text>the United States
				court of appeals for the circuit in which the person resides or has its
				principal place of business; or</text>
									</clause><clause id="H2803A8A982E640A789B44D7BCB038C00"><enum>(ii)</enum><text>the United States
				Court of Appeals for the District of Columbia Circuit; and</text>
									</clause></subparagraph><subparagraph id="HF778D044C4F847ECBDA372C3EEEE3EBF"><enum>(B)</enum><text>simultaneously
				sends a copy of the petition by certified mail to the Secretary.</text>
								</subparagraph></paragraph><paragraph id="HB20FF6E2F96241DF9BB996B2BC78106E"><enum>(2)</enum><header>Filing of copy
				of record</header><text>The Secretary shall promptly file in the court a
				certified copy of the record on which the order was issued.</text>
							</paragraph></subsection><subsection id="HBF4E616607274F11B9060249E5C57F4C"><enum>(c)</enum><header>Collection
				actions for failure To pay assessment</header>
							<paragraph id="H95038641AA644C9DA0004FDF1BF110DE"><enum>(1)</enum><header>Referral to
				Attorney General</header><text>If a person fails to pay a civil penalty
				assessed under subsection (a) after the order assessing the civil penalty has
				become a final order, or after the court of appeals has entered final judgment
				in favor of the Secretary, the Secretary shall refer the matter to the Attorney
				General.</text>
							</paragraph><paragraph id="HD07FD7FE559349D4ACF158443C45D1E8"><enum>(2)</enum><header>Action by
				Attorney General</header><text>The Attorney General shall bring a civil action
				to recover the amount of the civil penalty in United States district
				court.</text>
							</paragraph><paragraph id="HE7A257B2636345D4A80067F8153C5E56"><enum>(3)</enum><header>Scope of
				review</header><text>In a civil action under paragraph (2), the validity and
				appropriateness of the order of the Secretary assessing the civil penalty shall
				not be subject to review.</text>
							</paragraph></subsection><subsection id="HBFBBF0EF50D944ADBD445476D71539FE"><enum>(d)</enum><header>Refusal or
				withdrawal of inspection pending payment</header><text>If a person fails to pay
				the amount of a civil penalty after the order assessing the civil penalty has
				become a final order, the Secretary may refuse to provide or withdraw
				inspection under this Act of the person until the civil penalty is paid or
				until the Secretary directs otherwise.</text>
						</subsection><subsection id="H717E796B8EAC4E5EA3C0927FCE9B5539"><enum>(e)</enum><header>Penalties in
				lieu of other actions</header><text>Nothing in this Act requires the Secretary
				to report for prosecution, or for the commencement of an action, any violation
				of this Act in any case in which the Secretary believes that the public
				interest will be adequately served by the assessment of a civil penalty under
				this section.</text>
						</subsection><subsection id="H59BE3D706B96480AAB9F35D6D2A4C37B"><enum>(f)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be
				available.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5A75BE95A82C42F88C17FEA42392D900"><enum>4.</enum><header>Notification,
			 nondistribution, and recall of adulterated or misbranded articles of
			 food</header>
			<subsection id="H340FCC0BB6E2429488CBD5F939DFBB93"><enum>(a)</enum><header>Prohibited
			 acts</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (21
			 U.S.C. 331) is amended by adding at the end the following:</text>

					<subsection id="H382037D5FDBD4C908FE707C56DBD8BCB"><enum>(oo)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0B074BBBA1934B66B8D31D9297440277"><enum>(1)</enum><text>The failure to notify
				the Secretary in violation of section 311(a).</text>
						</paragraph><paragraph id="H1D8FDEE34B454A489738004D68B40025" indent="up1"><enum>(2)</enum><text>The failure to comply with—</text>
							<subparagraph id="H531F5D46AA0846920080EB8DF066CEE7"><enum>(A)</enum><text>an order issued under section 311(b)
				following any hearing requested under section 311(c); or</text>
							</subparagraph><subparagraph id="H13B6F03866D64F93A3F6F5F4FC91ADB6"><enum>(B)</enum><text>an amended order issued under section
				311(d)(1).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC462D2013E0042F1B0A7AD14FF817B8D"><enum>(b)</enum><header>Notification,
			 nondistribution, and recall of adulterated or misbranded articles of food;
			 civil penalties relating to foods</header><text>Chapter III of the Federal
			 Food, Drug, and Cosmetic Act (21 U.S.C. 331 et seq.) is amended by adding at
			 the end the following:</text>

				secretary of violation</header>
							<paragraph id="HB0B6F42FF9744344A7FD191F158E39A"><enum>(1)</enum><header>In
				general</header><text>A person (other than a household consumer or other
				individual who is the intended consumer of an article of food) that has reason
				to believe that an article of food when introduced into or while in interstate
				commerce, or while held for sale (regardless of whether the first sale) after
				shipment in interstate commerce, is adulterated or misbranded in a manner that,
				if consumed, may result in illness or injury shall, as soon as practicable,
				notify the Secretary of the identity and location of the article.</text>
							</paragraph><paragraph id="H5D2BCB3C4B754D898DAE86E286B8A72E"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
							</paragraph></subsection><subsection id="H4FF89BD6930B41E200DF788DF4229812"><enum>(b)</enum><header>Recall and
				consumer notification</header>
							<paragraph id="H40C7A160438C4A95BF71818FF2EAFFC3"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article of food when introduced
				into or while in interstate commerce, or while held for sale (regardless of
				whether the first sale) after shipment in interstate commerce, is adulterated
				or misbranded in a manner that, if consumed, may result in illness or injury
				(as determined by the Secretary), the Secretary shall provide all appropriate
				persons (including the manufacturer, importer, distributor, or retailer of the
				article) with an opportunity (as determined by the Secretary)—</text>
								<subparagraph id="H770FB28FCBAD4F849084007228A84960"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
								</subparagraph><subparagraph id="HFA3288C9BEAE4AF7A8813F309521AD36"><enum>(B)</enum><text>to notify all
				persons—</text>
									<clause id="H812C0EDE57E54F6492B0D68B99556390"><enum>(i)</enum><text>that produce,
				manufacture, pack, process, prepare, treat, package, distribute, or hold the
				article, to cease immediately those activities with respect to the article;
				or</text>
									</clause><clause id="H2966B3034ACD499E916BBD33BA98F24D"><enum>(ii)</enum><text>to which the
				article has been distributed, transported, or sold, to cease immediately
				distribution of the article;</text>
									</clause></subparagraph><subparagraph id="HDBB9435B2FC5473C80353B86A3549D92"><enum>(C)</enum><text>to recall the
				article;</text>
								</subparagraph><subparagraph id="HF35DF778A3FE42A8A0039BF373A0EC2C"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed and to
				appropriate State and local health officials; or</text>
								</subparagraph><subparagraph id="H1DB37B8863DE4914A16FC0A04B0094A3"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H72759810B9514767B0F607113DDF731"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
								<subparagraph id="H6E8E96620D9B4DACBD007B12A2FFABAB"><enum>(A)</enum><text>shall require the
				person—</text>
									<clause id="HB594D8725F51457B81D7704137D823DF"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
									</clause><clause id="H3C7DBB886DBD48B2AAE67D8100232B09"><enum>(ii)</enum><text>to immediately
				make the notification described in paragraph (1)(B); and</text>
									</clause></subparagraph><subparagraph id="HFF50962B5B4E4318A8A292272379C6DA"><enum>(B)</enum><text>may take control
				or possession of the article.</text>
								</subparagraph></paragraph><paragraph id="H1B5DEC21702B449CA6B175DAED142562"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text>The Secretary shall, as the
				Secretary determines to be necessary, provide notice of the finding of the
				Secretary under paragraph (1) to consumers to which the article was, or may
				have been, distributed and to appropriate State and local health
				officials.</text>
							</paragraph></subsection><subsection id="HA6EBC343F1314A64BAAF8500735F41FB"><enum>(c)</enum><header>Hearings on
				orders</header>
							<paragraph id="H93C382A1FBB643C4BB78DA2C119920EB"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for a hearing on—</text>
								<subparagraph id="H045BD28840E8424188B7D00476272D58"><enum>(A)</enum><text>the actions
				required by the order; and</text>
								</subparagraph><subparagraph id="HCBB7AA61A9C14D3CB2B839D76FA829B5"><enum>(B)</enum><text>any reasons why
				the article of food that is the subject of the order should not be
				recalled.</text>
								</subparagraph></paragraph><paragraph id="H3B226A10B748481FADCE1D5DE9E6D6F"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>
							</paragraph></subsection><subsection id="HB9D9461D16CA47F8935903070271F61C"><enum>(d)</enum><header>Post-hearing
				recall orders</header>
							<paragraph id="HD833C432BED6494FA41CDC002DF461B1"><enum>(1)</enum><header>Amendment of
				orders</header><text>If, after providing an opportunity for a hearing under
				subsection (c), the Secretary determines that an article of food when
				introduced into or while in interstate commerce, or while held for sale
				(regardless of whether the first sale) after shipment in interstate commerce,
				is adulterated or misbranded in a manner that, if consumed, may result in
				illness or injury, the Secretary may, as the Secretary determines to be
				necessary—</text>
								<subparagraph id="H302C4FA1D7384375AA2FCA586D7DC00"><enum>(A)</enum><text>amend the order
				under subsection (b)—</text>
									<clause id="HB181DB7DE7174A57B31F237FF23F1CB5"><enum>(i)</enum><text>to
				require recall of the article or other appropriate action; and</text>
									</clause><clause id="H9DF646C5BA7740FEADEDF05734B5A5D5"><enum>(ii)</enum><text>to specify a
				timetable during which the recall shall occur;</text>
									</clause></subparagraph><subparagraph id="H6D3C57269EEA4E079478E3B79CE64FD"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall; or</text>
								</subparagraph><subparagraph id="HFA51299EAA62419494372EAB7A2A134"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed.</text>
								</subparagraph></paragraph><paragraph id="H66B9FBF915F84D2D82ACEF7D5C7E876"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for a hearing under
				subsection (c), the Secretary determines that adequate grounds do not exist to
				continue the actions required by the order, the Secretary shall vacate the
				order.</text>
							</paragraph></subsection><subsection id="H8155C0CAC5B54164892DA5EFD05C2D73"><enum>(e)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be available.</text>
						</subsection></section><section id="H1D2222B7CC294DFFA93D10E1352BC09"><enum>312.</enum><header>Civil penalties
				relating to foods</header>
						<subsection id="H714313C582CB4B30BCAD0078F5A4FC6E"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="HDD103AD9203C4D59BB00633DCBE04F8C"><enum>(1)</enum><header>Assessment</header><text>The
				Secretary may assess against a person that commits an act prohibited by section
				301 with respect to an article of food a civil penalty for each such act of not
				more than—</text>
								<subparagraph id="H695E6D4F3DE548548BF8FEB94FBF9BCB"><enum>(A)</enum><text>$100,000, in the
				case of an individual; and</text>
								</subparagraph><subparagraph id="H83A3242449D64782923EA64ED867EECC"><enum>(B)</enum><text>$500,000, in the
				case of any other person.</text>
								</subparagraph></paragraph><paragraph id="HC1D883498542438F9B00A8EC3C78D9A9"><enum>(2)</enum><header>Separate
				offenses</header><text>Each prohibited act and each day during which the act
				continues shall be considered to be a separate offense.</text>
							</paragraph><paragraph id="H1CF4BDB3E7034E8DBAD6E4F02EC4F85"><enum>(3)</enum><header>Notice and
				opportunity for hearing</header><text>The Secretary shall not assess a civil
				penalty under this section against a person unless the person is given notice
				and opportunity for a hearing on the record before the Secretary in accordance
				with sections 554 and 556 of title 5, United States Code.</text>
							</paragraph><paragraph id="HAF45E1250C9844DBA9E7FD5962DA73B"><enum>(4)</enum><header>Determination of
				civil penalty amount</header><text>The amount of a civil penalty under this
				section—</text>
								<subparagraph id="H6BB704432B2843EAA4E4C76B00DBAEAA"><enum>(A)</enum><text>shall be assessed
				by the Secretary by written order, taking into account—</text>
									<clause id="HE7FAE3AF3A864BCBB006D799165FE54C"><enum>(i)</enum><text>the gravity of the
				violation;</text>
									</clause><clause id="HAE35BB56F8F0452F97AEEF8DEAFF1301"><enum>(ii)</enum><text>the degree of
				culpability of the person;</text>
									</clause><clause id="H9A97EE638FFD4B068B1063C4B583FE46"><enum>(iii)</enum><text>the size and
				type of the business of the person; and</text>
									</clause><clause id="HEAACDB624493454B8291DAC283F95971"><enum>(iv)</enum><text>any history of
				prior offenses by the person; and</text>
									</clause></subparagraph><subparagraph id="HE4E67C6E19314C58AC0003A9FC513DD2"><enum>(B)</enum><text>shall be reviewed
				only in accordance with subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection id="HB222E5D39B524488A455B8E8D1FD09"><enum>(b)</enum><header>Judicial
				review</header>
							<paragraph id="HB8E5B9B3246F4977B5BB01841B15196D"><enum>(1)</enum><header>In
				general</header><text>An order assessing a civil penalty against a person under
				subsection (a) shall be final unless the person—</text>
								<subparagraph id="H44B1EDD715B2481088605BFE06F35815"><enum>(A)</enum><text>not later than 30
				days after the effective date of the order, files a petition for judicial
				review of the order in—</text>
									<clause id="HC922DA2610C7438CA31CA2A73B1C7F02"><enum>(i)</enum><text>the United States
				court of appeals for the circuit in which the person resides or has its
				principal place of business; or</text>
									</clause><clause id="H7D3F026C14D44FE79FC59933A1FCBF89"><enum>(ii)</enum><text>the United States
				Court of Appeals for the District of Columbia Circuit; and</text>
									</clause></subparagraph><subparagraph id="H9BDFDE82C9BD4CAC96906391E7F9A7D3"><enum>(B)</enum><text>simultaneously
				sends a copy of the petition by certified mail to the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H858B6CF30C124A48940045BEB97C2715"><enum>(2)</enum><header>Filing of copy
				of record</header><text>The Secretary shall promptly file in the court a
				certified copy of the record on which the order was issued.</text>
							</paragraph><paragraph id="H3A11D510F5CB451EAAAFCB80B925EA71"><enum>(3)</enum><header>Standard of
				review</header><text>The findings of the Secretary relating to the order shall
				be set aside only if the findings are found to be unsupported by substantial
				evidence on the record as a whole.</text>
							</paragraph></subsection><subsection id="H870B3A8B297F48D8871FEAD9F064C9E6"><enum>(c)</enum><header>Collection
				actions for failure To pay assessment</header>
							<paragraph id="HA357D6F3BB8349AD9ECAB02A7B7C4A1"><enum>(1)</enum><header>Referral to
				Attorney General</header><text>If a person fails to pay a civil penalty
				assessed under subsection (a) after the order assessing the civil penalty has
				become a final order, or after the court of appeals has entered final judgment
				in favor of the Secretary, the Secretary may refer the matter to the Attorney
				General.</text>
							</paragraph><paragraph id="H72DE3871F0624868A79000BA3B88563"><enum>(2)</enum><header>Action by
				Attorney General</header><text>The Attorney General shall bring a civil action
				to recover the amount of the civil penalty in United States district
				court.</text>
							</paragraph><paragraph id="HA7D76FD4AFB142FEB497FFBA34FA94CC"><enum>(3)</enum><header>Scope of
				review</header><text>In a civil action under paragraph (2), the validity and
				appropriateness of the order of the Secretary assessing the civil penalty shall
				not be subject to review.</text>
							</paragraph></subsection><subsection id="H535A05BEEE0A4E23A41772C9E836F500"><enum>(d)</enum><header>Penalties
				deposited in treasury</header><text>All amounts collected as civil penalties
				under this section shall be deposited in the Treasury of the United
				States.</text>
						</subsection><subsection id="H7E39695D463641EF8785FDFEAFD000E0"><enum>(e)</enum><header>Penalties in
				lieu of other actions</header><text>Nothing in this Act requires the Secretary
				to report for prosecution, or for the commencement of any libel or injunction
				proceeding, any violation of this Act in any case in which the Secretary
				believes that the public interest will be adequately served by the assessment
				of a civil penalty under this section.</text>
						</subsection><subsection id="H218C8890BBD54A1489D9128579009B8B"><enum>(f)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be
				available.</text>
