		  Federal Meat Inspection Act, the Poultry Products Inspection Act, and the Egg
		  Products Inspection Act to improve the safety of food, meat, and poultry

		<section display-inline="no-display-inline" id="HEDE9D80CB20540BDA63427B5A393E5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tracing and Recalling Agricultural
			 Contamination Everywhere Act of 2009</short-title></quote> or
			 <quote><short-title>TRACE Act of
			 2009</short-title></quote>.</text>
		</section><section id="HB7CBFC0FE2724A008D81A9EAAA66C848"><enum>2.</enum><header>Traceability of
			 food</header><text display-inline="no-display-inline">The Federal Food, Drug,
			 and Cosmetic Act (21 U.S.C. 301 et seq.) is amended—</text>
			<paragraph id="HC9A910842DD04D70ABB1F53FBF4F11AD"><enum>(1)</enum><text>in section 301, by
			 inserting at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H108342047D7F4647AF00817E57ADBB70" style="OLC">
					<subsection id="HE0AC332F4D034EF2BFCCF20085DE02F3"><enum>(oo)</enum><text>The failure to
				comply with any requirement of section 414A (relating to the traceability of
				food).</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3D3FC31FDB2E4E4182AED6D9A9F623A6"><enum>(2)</enum><text>in chapter IV, by
			 inserting after section 414 the following:</text>
				<quoted-block id="H5DF01A208F3D442B81DBBA0E6ECA9DD" style="OLC">
					<section id="HD8FA0F50812642DBABF37A83B6CE65F"><enum>414A.</enum><header>Traceability of
				food</header>
						<subsection id="HFB5E1610A4CE4A19B9FEFB426FC058FB"><enum>(a)</enum><header>Establishment of
				system</header><text>Not later than 1 year after the date of the enactment of
				this section, the Secretary shall establish a traceability system described in
				subsection (b) for all stages of manufacturing, processing, packaging, and
				distribution of food.</text>
						</subsection><subsection id="H8A42F6AFE51A443385056D22029D1D70"><enum>(b)</enum><header>Description of
				system</header><text display-inline="yes-display-inline">The traceability
				system required by subsection (a) shall require each article of food shipped in
				interstate commerce to be identified in a manner that enables the Secretary to
				retrieve the history, use, and location of the article through a recordkeeping
				and audit system or registered identification.</text>
						</subsection><subsection id="HC5929970B20B45248D122F4516448E00"><enum>(c)</enum><header>Records</header>
							<paragraph id="HDA5B553D6A0D4DC4BFE9E6DB7409F7C"><enum>(1)</enum><header>In
				general</header><text>The Secretary may require that each person, firm, and
				corporation required to identify an article of food pursuant to subsection (b)
				maintain accurate records, as prescribed by the Secretary, regarding the
				purchase, sale, and identification of the article.</text>
							</paragraph><paragraph id="HCB8DAF3DFEC0482780289B00A6C1BF9"><enum>(2)</enum><header>Access</header><text>Each
				person, firm, and corporation described in paragraph (1) shall, at all
				reasonable times, on notice by a duly authorized representative of the
				Secretary, allow the representative to access to each place of business of the
				person, firm, or corporation to examine and copy the records described in
				paragraph (1).</text>
							</paragraph><paragraph id="HB9C8C54849104BB0BEECB7F0CD79D422"><enum>(3)</enum><header>Duration</header><text>Each
				person, firm, and corporation described in paragraph (1) shall maintain records
				required to be maintained under this subsection for such period of time as the
				Secretary prescribes.</text>
							</paragraph></subsection><subsection id="H3C279F8324B54A91AD8944BF39BE0840"><enum>(d)</enum><header>False
				information</header><text>No person, firm, or corporation shall falsify or
				misrepresent to any other person, firm, or corporation, or to the Secretary,
				any information as to any location at which any article of food was
				held.</text>
						</subsection><subsection id="H67C846BCE0544058A01F491BE643FD00"><enum>(e)</enum><header>Alteration or
				destruction of records</header><text>No person, firm, or corporation shall,
				without authorization from the Secretary, alter, detach, or destroy any records
				or other means of identification prescribed by the Secretary for use in
				determining the location at which any article of food was
				held.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H56EFD983D5754BB3A8D994F9D0225677"><enum>3.</enum><header>Traceability of
			 livestock</header><text display-inline="no-display-inline">Title I of the
			 Federal Meat Inspection Act (21 U.S.C. 601 et seq.) is amended by adding at the
			 end the following:</text>

				<section id="HA05101805BC24ECDB3B3B9EC3C4F2358"><enum>26.</enum><header>Traceability of
				livestock, meat, and meat products</header>
					<subsection id="H1D11EC3CB16040E382C9ACCCD63C0728"><enum>(a)</enum><header>Definition of
				traceability</header><text>In this section, the term
				<quote>traceability</quote> means the ability to retrieve the history, use, and
				location of an article through a recordkeeping and audit system or registered
				identification.</text>
					</subsection><subsection id="H6C3ED2F7C1184A41ABE0A956275671D2"><enum>(b)</enum><header>Requirements</header>
						<paragraph id="H6D3184ED5D80409D8400AC6127336900"><enum>(1)</enum><header>In
				general</header><text>Cattle, sheep, swine, goats, and horses, mules, and other
				equines presented for slaughter for human food purposes, and the carcasses or
				parts of carcasses and the meat and meat food products of those animals,
				shipped in interstate commerce shall be identified in a manner that enables the
				Secretary to trace—</text>
							<subparagraph id="H2F640B0BBA2449B1AD88C70364A2768"><enum>(A)</enum><text>each animal to any
				premises or other location at which the animal was held at any time before
				slaughter; and</text>
							</subparagraph><subparagraph id="HB556D471ED6D4F45A1AC02007088D51"><enum>(B)</enum><text>each carcass or
				part of a carcass and meat and meat food product of such animals forward from
				slaughter through processing and distribution to the ultimate consumer.</text>
							</subparagraph></paragraph><paragraph id="H6B4BCE19409A435EA0CF842200DC823D"><enum>(2)</enum><header>Traceability
				system</header><text>Not later than 1 year after the date of the enactment of
				this section, the Secretary shall establish a traceability system for all
				stages of production, processing, and distribution of meat and meat food
				products that are produced through the slaughter of animals described in
				paragraph (1).</text>
						</paragraph></subsection><subsection id="H8CC20A140C704E980052BBF061021E94"><enum>(c)</enum><header>Prohibition or
				restriction on entry</header><text>The Secretary may prohibit or restrict entry
				into any slaughtering establishment inspected under this Act of any cattle,
				sheep, swine, goats, or horses, mules, or other equines not identified as
				prescribed by the Secretary under subsection (b).</text>
					</subsection><subsection id="H33E72F28E7D04186ACB00278DC98511"><enum>(d)</enum><header>Records</header>
						<paragraph id="HF115A37823E240C98937CC8F059E4631"><enum>(1)</enum><header>In
				general</header><text>The Secretary may require that each person, firm, and
				corporation required to identify livestock pursuant to subsection (b) maintain
				accurate records, as prescribed by the Secretary, regarding the purchase, sale,
				and identification of the livestock.</text>
						</paragraph><paragraph id="H2EF8525653FD40D09774C5A8C91A6A1"><enum>(2)</enum><header>Access</header><text>Each
				person, firm, and corporation described in paragraph (1) shall, at all
				reasonable times, on notice by a duly authorized representative of the
				Secretary, allow the representative to access to each place of business of the
				person, firm, or corporation to examine and copy the records described in
				paragraph (1).</text>
						</paragraph><paragraph id="H65E1107EBF3544A7ADE06259D45358F9"><enum>(3)</enum><header>Duration</header><text>Each
				person, firm, and corporation described in paragraph (1) shall maintain records
				required to be maintained under this subsection for such period of time as the
				Secretary prescribes.</text>
						</paragraph></subsection><subsection id="HAD8BAACC66524B7592F02455B657CF0"><enum>(e)</enum><header>False
				information</header><text>No person, firm, or corporation shall falsify or
				misrepresent to any other person, firm, or corporation, or to the Secretary,
				any information as to any premises at which any cattle, sheep, swine, goats,
				horses, mules, or other equines, or carcasses thereof, were held.</text>
					</subsection><subsection id="H02331A89AA12456CA16C435E0946B9C2"><enum>(f)</enum><header>Alteration or
				destruction of records</header><text>No person, firm, or corporation shall,
				without authorization from the Secretary, alter, detach, or destroy any records
				or other means of identification prescribed by the Secretary for use in
				determining the premises at which were held any cattle, sheep, swine, goats,
				horses, mules, or other equines, or the carcasses thereof.</text>
					</subsection><subsection id="HA219321CB952431E904CB2D2CEF9A07E"><enum>(g)</enum><header>Relation to
				country of origin labeling</header><text display-inline="yes-display-inline">Nothing contained in this section prevents
				or interferes with implementation of the country of origin labeling
				requirements of subtitle D of the Agricultural Marketing Act of 1946 (7 U.S.C.
				1638 et
				seq.).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H238F60EDE1524D35BB34C3D5C0CEF900"><enum>4.</enum><header>Traceability of
			 poultry</header><text display-inline="no-display-inline">The Poultry Products
			 Inspection Act is amended by inserting after section 23 (21 U.S.C. 467e) the
			 following:</text>

				<section id="HE620ED4EBC8C421282B4392FCE9D5510"><enum>23A.</enum><header>Traceability of
				poultry and poultry products</header>
					<subsection id="H46E8B557088E4C5DA965A3AB51B5CFE0"><enum>(a)</enum><header>Definition of
				traceability</header><text>In this section, the term
				<quote>traceability</quote> means the ability to retrieve the history, use, and
				location of an article through a recordkeeping and audit system or registered
				identification.</text>
					</subsection><subsection id="HDA6406768DFD4BDA9BC3265003ACAA75"><enum>(b)</enum><header>Requirements</header>
						<paragraph id="H215F35856AD94B0DA055BDC3CB00EC89"><enum>(1)</enum><header>In
				general</header><text>Poultry presented for slaughter for human food purposes
				and poultry products shipped in interstate commerce shall be identified in a
				manner that enables the Secretary to trace—</text>
							<subparagraph id="H2D9793414BCD47FAA9DD7DF48729FA88"><enum>(A)</enum><text>each animal to any
				premises or other location at which the animal was held at any time before
				slaughter; and</text>
							</subparagraph><subparagraph id="HB149A94A746A4EC2BB3D69D34382B271"><enum>(B)</enum><text>each poultry
				product forward from slaughter through processing and distribution to the
				ultimate consumer.</text>
							</subparagraph></paragraph><paragraph id="HCFD4B6E9290345559B2D6E3DC0FD2E01"><enum>(2)</enum><header>Traceability
				system</header><text>Not later than 1 year after the date of the enactment of
				this section, the Secretary shall establish a traceability system for all
				stages of production, processing, and distribution of poultry and poultry food
				products that are produced through the slaughter of animals described in
				paragraph (1).</text>
						</paragraph></subsection><subsection id="H1457BB0DDAE54EAEAADCA02058A54000"><enum>(c)</enum><header>Prohibition or
				restriction on entry</header><text>The Secretary may prohibit or restrict entry
				into any slaughtering establishment inspected under this Act of any poultry not
				identified as prescribed by the Secretary.</text>
					</subsection><subsection id="HD4E97F2343E84A9596671791BD851DBE"><enum>(d)</enum><header>Records</header>
						<paragraph id="H9ABFED6BC63D47D88B62C53F51928FE0"><enum>(1)</enum><header>In
				general</header><text>The Secretary may require that each person, firm, and
				corporation required to identify poultry pursuant to subsection (b) maintain
				accurate records, as prescribed by the Secretary, regarding the purchase, sale,
				and identification of the poultry.</text>
						</paragraph><paragraph id="H1E5235D424C8497D99AF6068EDE3E753"><enum>(2)</enum><header>Access</header><text>Each
				person, firm, and corporation described in paragraph (1) shall, at all
				reasonable times, on notice by a duly authorized representative of the
				Secretary, allow the representative to access to each place of business of the
				person, firm, or corporation to examine and copy the records described in
				paragraph (1).</text>
						</paragraph><paragraph id="HE3DF16106634436581F718CE7D9B8113"><enum>(3)</enum><header>Duration</header><text>Each
				person, firm, and corporation described in paragraph (1) shall maintain records
				required to be maintained under this subsection for such period of time as the
				Secretary prescribes.</text>
						</paragraph></subsection><subsection id="H73F81BD1DD7B475583293DC068FF5E74"><enum>(e)</enum><header>False
				information</header><text>No person, firm, or corporation shall falsify or
				misrepresent to any other person, firm, or corporation, or to the Secretary,
				any information as to any premises at which any poultry, or carcasses thereof,
				were held.</text>
					</subsection><subsection id="H426A9D02DDE4408AAB0519ED38CF9716"><enum>(f)</enum><header>Alteration or
				destruction of records</header><text>No person, firm, or corporation shall,
				without authorization from the Secretary, alter, detach, or destroy any records
				or other means of identification prescribed by the Secretary for use in
				determining the premises at which were held any poultry or the carcasses
				thereof.</text>
					</subsection><subsection id="H73242E8C7FFF4F5E8CB8321C8D10B8FE"><enum>(g)</enum><header>Relation to
				country of origin labeling</header><text display-inline="yes-display-inline">Nothing contained in this section prevents

			 egg products</header><text display-inline="no-display-inline">The Egg Products
			 Inspection Act is amended by inserting after section 18 (21 U.S.C. 1047) the
			 following:</text>

				eggs and egg products</header>
					<subsection id="H880B7E34C42649908EB0DFE072B2486B"><enum>(a)</enum><header>Establishment of
				system</header><text>Not later than 1 year after the date of the enactment of
				this section, the Secretary shall establish a traceability system described in
				subsection (b) for all stages of manufacturing, processing, packaging, and
				distribution of eggs and egg products.</text>
