		  retired members of the uniformed services who have a service-connected
		  disability to receive both disability compensation from the Department of
		  Veterans Affairs for their disability and either retired pay by reason of their
		  years of military service or Combat-Related Special

		<section display-inline="no-display-inline" id="H15C6749A55934476816F97E6C422C0E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Retired Pay Restoration
			 Act</short-title></quote>.</text>
		</section><section id="H570E126945E9467E968DD7511EAA5B67"><enum>2.</enum><header>Eligibility for
			 payment of both retired pay and veterans’ disability compensation for certain
			 military retirees with compensable service-connected disabilities</header>
			<subsection id="H9D91EAB890A5416C888EED998896F2F1"><enum>(a)</enum><header>Extension of
			 Concurrent Receipt Authority to Retirees With Service-Connected Disabilities
			 Rated Less Than 50 Percent</header><text>Subsection (a) of section 1414 of
			 title 10, United States Code, is amended—</text>
				<paragraph id="HC0256F3D32F54BAD97511E11BF12F121"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text></quote> in the subsection heading and
			 all that follows through <quote>Subject</quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text>.—Subject</quote>; and</text>
				</paragraph><paragraph id="H795F8923605043B7002BF4B09E7205AF"><enum>(2)</enum><text>by striking
			 paragraph (2).</text>
				</paragraph></subsection><subsection id="H9E786016A5964325B0F9F2CDB7345302"><enum>(b)</enum><header>Phase-In of
			 concurrent receipt for retirees with service-connected disabilities rated as 40
			 percent or less</header><text>Subsection (c) of such section is amended—</text>
				<paragraph id="H5C8FEB41C8EA4AA8B44C059F8FCEA653"><enum>(1)</enum><text>in the matter
			 before paragraph (1), by striking <quote>subsection (a)(1)</quote> and
			 inserting <quote>subsection (a)</quote>; and</text>
				</paragraph><paragraph id="HD3292DFB1729476C92580050BCC4D8D7"><enum>(2)</enum><text>in paragraph (1),
			 by adding at the end the following new subparagraph:</text>

						<subparagraph id="HDB75B9F7763D47C59E1C621C5EB5B11F"><enum>(G)</enum><text>For a month for
				which the retiree receives veterans’ disability compensation for a disability
				rated as 40 percent or less or has a service-connected disability rated as zero
				percent,
				$0.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4F0CCF39C71946E3B681F5C8CF48AF80"><enum>(c)</enum><header>Clerical
			 amendments</header>
				<paragraph display-inline="no-display-inline" id="HAAF275B71C8645C18B84DE9198FC1C91"><enum>(1)</enum><header>Section
			 heading</header><text>The heading for such section is amended to read as
			 follows:</text>

			 sections</header><text>The item relating to such section in the table of
			 sections at the beginning of chapter 71 of such title is amended to read as
			 follows:</text>

			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2010, and shall apply to payments for months beginning on or after
			 that date.</text>
			</subsection></section><section id="HA0C9BCEC296C48F2A8950053AE008065"><enum>3.</enum><header>Coordination of
			 service eligibility for combat-related special compensation and concurrent
			 receipt</header>
			<subsection id="HC1BE910038FC40929C9062E7F26E167D"><enum>(a)</enum><header>Eligibility for
			 TERA Retirees</header><text>Subsection (c) of section 1413a of title 10, United
			 States Code, is amended by striking “entitled to retired pay who—” and all that
			 follows through the end of paragraph (1) and inserting “who—</text>
				<quoted-block id="H39AA51E4E40447EB9B99B9FEFF31F230" style="OLC">
					<paragraph id="HF008265542F447D8A61C636C63226DD5"><enum>(1)</enum><text>is entitled to
				retired pay, other than a member retired under chapter 61 of this title with
				less than 20 years of service creditable under section 1405 of this title and
				less than 20 years of service computed under section 12732 of this title;
				and</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA400758852FA407B9D614F05DACFDCE"><enum>(b)</enum><header>Amendments To
			 standardize similar provisions</header>
				<paragraph display-inline="no-display-inline" id="H5833974CF8B94499BC17F52C639898B6"><enum>(1)</enum><header>Clerical
			 amendment</header><text>The heading for paragraph (3) of section 1413a(b) of
			 such title is amended by striking <quote><header-in-text level="paragraph" style="OLC">rules</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">rule</header-in-text></quote>.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H9E09AAE5D55B4423A1AA0001CA2B9FAB"><enum>(2)</enum><header>Specification of
			 qualified retirees for concurrent receipt purposes</header><text>Section 1414
			 of such title, as amended by section 2, is amended—</text>
					<subparagraph id="HE0D8BBC165AF404C9C9962B855753528"><enum>(A)</enum><text>in subsection
			 (a)—</text>
						<clause id="H571E63016FE24A68B4A1F6BC283835D"><enum>(i)</enum><text>by
			 striking <quote>a member or</quote> and all that follows through
			 <quote>retiree’)</quote> and inserting <quote>an individual who is a qualified
			 retiree for any month</quote>; and</text>
						</clause><clause id="H645AA1853FDA488F8F49A1CF4C13D3D2"><enum>(ii)</enum><text>by
			 inserting <quote>retired pay and veterans’ disability compensation</quote>
			 after <quote>both</quote>; and</text>
						</clause></subparagraph><subparagraph id="HE213F3A9EE4B4B32AF1C59FCC1D100A1"><enum>(B)</enum><text>in subsection (e),
			 by adding at the end the following new paragraph:</text>
						<quoted-block id="HA86BEE9C252C458E96AECB13D9DF98" style="OLC">
							<paragraph id="H132046C0A2214166B11DB5A8706BC81F"><enum>(5)</enum><header>Qualified
				retiree</header><text display-inline="yes-display-inline">The term
				<quote>qualified retiree</quote> means a member or former member of the
				uniformed services who, with respect to any month—</text>
								<subparagraph id="H958B9C5B39AB41C5B513ECB36DFB451"><enum>(A)</enum><text>is entitled to
				retired pay, other than in the case of a member retired under chapter 61 of
				this title with less than 20 years of service creditable under section 1405 of
				this title and less than 20 years of service computed under section 12732 of
				this title; and</text>
								</subparagraph><subparagraph id="H31C51934BBF54E54A551A5AAF8AFEF67"><enum>(B)</enum><text>is entitled to
				veterans’ disability
				compensation.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCCCFEB1A0D814BD0B1A5EF6E10DF733C"><enum>(3)</enum><header>Disability
			 retirees</header><text>Subsection (b) of section 1414 of such title is
			 amended—</text>
					<subparagraph id="H84E35690E8DB49E9B61D812F1F715700"><enum>(A)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">Special
			 rules</header-in-text></quote> in the subsection heading and all that follows
			 through <quote>is subject to</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Special rule for chapter 61 disability
			 retirees</header-in-text>.—In the case of a qualified retiree who is retired
			 under chapter 61 of this title, the retired pay of the member is subject
			 to</quote>; and</text>
					</subparagraph><subparagraph id="H2AD88EA9EA414CA3B0390066B61B00E6"><enum>(B)</enum><text>by striking
			 paragraph (2).</text>
					</subparagraph></paragraph></subsection><subsection id="H4B47F1C89DDA4D79BD893CC17B639899"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2010, and shall apply to payments for months beginning on or after
			 that date.</text>
