		<official-title display="yes">To amend the Lacey Act Amendments of 1981
		  to treat nonhuman primates as prohibited wildlife species under that Act, to
		  make corrections in the provisions relating to captive wildlife offenses under
		  that Act, and for other purposes.</official-title>

		<section id="HC5BD5F5840B544A79A41A8D1CB3428AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Captive Primate Safety
			 Act</short-title></quote>.</text>
		</section><section id="HAD3D7DDA152540789A6026B6834219F5"><enum>2.</enum><header>Addition of
			 nonhuman primates to definition of prohibited wildlife species</header><text display-inline="no-display-inline">Section 2(g) of the Lacey Act Amendments of
			 1981 (16 U.S.C. 3371(g)) is amended by inserting before the period at the end
			 <quote>or any nonhuman primate</quote>.</text>
		</section><section id="H5CDE77B31BDA48A6B03376FCF9AA7FEE"><enum>3.</enum><header>Captive wildlife
			 amendments</header>
			<subsection id="HFFC972B45A4045AABBC294282C1709F5"><enum>(a)</enum><header>Prohibited
			 Acts</header><text>Section 3 of the Lacey Act Amendments of 1981 (16 U.S.C.
			 3372) is amended—</text>
				<paragraph id="H43303F509F494E46A2A20AFC358C2E2F"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H6546189774C34D1C82154A2AF25B86E1"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="HB3392A0F2EB9472F890081950653FE7A"><enum>(i)</enum><text>in
			 subparagraph (A), by inserting <quote>or</quote> after the semicolon;</text>
						</clause><clause id="HA3969C87F46C41EAA8704E77D4CDC91B"><enum>(ii)</enum><text>in
			 subparagraph (B)(iii), by striking <quote>; or</quote> and inserting a
			 semicolon; and</text>
						</clause><clause id="HAF7FB77187DA443C984C4B183B58A601"><enum>(iii)</enum><text>by
			 striking subparagraph (C); and</text>
						</clause></subparagraph><subparagraph id="H014B0EA9E26D414E9B27B2A8610FBC8B"><enum>(B)</enum><text>in paragraph (4),
			 by inserting <quote>or subsection (e)</quote> before the period; and</text>
					</subparagraph></paragraph><paragraph id="HF99C5778C20D4A449C0D537D7E76E5F2"><enum>(2)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="HD44D0D65B6C845D1B4F4C2F194669ACE"><enum>(A)</enum><text>by redesignating
			 paragraphs (2), (3), (4), and (5) as paragraphs (3), (4), (5), and (6)
			 respectively;</text>
					</subparagraph><subparagraph id="HCE9BE94B1B164B18BD19F4D0F363AB11"><enum>(B)</enum><text>by striking
			 <quote>(e)</quote> and all that follows through <quote>Subsection (a)(2)(C)
			 does not apply</quote> in paragraph (1) and inserting the following:</text>
						<quoted-block id="HCF5B33980B8447929B25C39C946B362D" style="OLC">
							<subsection id="HB00594AEC0F44383B06A6A5FA5D16AF7"><enum>(e)</enum><header>Captive Wildlife
				Offense</header>
								<paragraph id="H256150CE656D43719AD9C63222622797"><enum>(1)</enum><header>In
				general</header><text>It is unlawful for any person to import, export,
				transport, sell, receive, acquire, or purchase in interstate or foreign
				commerce any live animal of any prohibited wildlife species.</text>
								</paragraph><paragraph id="H45A19EF0A27B4736AB9579C251BF6A60"><enum>(2)</enum><header>Limitation on
				application</header><text>This subsection—</text>
									<subparagraph id="HD8B8589992BA48BBA29ABE00DA356736"><enum>(A)</enum><text>does not apply to
				a person transporting a nonhuman primate to or from a veterinarian who is
				licensed to practice veterinary medicine within the United States, solely for
				the purpose of providing veterinary care to the nonhuman primate, if—</text>
										<clause id="H55A1DC9B45F04C1DA2EB4792ED53036A"><enum>(i)</enum><text>the person
				transporting the nonhuman primate carries written documentation issued by the
				veterinarian, including the appointment date and location;</text>
										</clause><clause id="H54AF9A2AC22848D69F92C5A5939C85AB"><enum>(ii)</enum><text>the nonhuman
				primate is transported in a secure enclosure appropriate for that species of
				primate;</text>
										</clause><clause id="HD11E343073F449D8BF36D39897387102"><enum>(iii)</enum><text>the nonhuman
				primate has no contact with any other animals or members of the public, other
				than the veterinarian and other authorized medical personnel providing
				veterinary care; and</text>
										</clause><clause id="H61A1A62637964F68A11FEB7860F08E32"><enum>(iv)</enum><text>such
				transportation and provision of veterinary care is in accordance with all
				otherwise applicable State and local laws, regulations, permits, and health
				certificates;</text>
										</clause></subparagraph><subparagraph id="HE102D1AEA709418290429ACC836519E4"><enum>(B)</enum><text>does not apply to
				a person transporting a nonhuman primate to a legally designated caregiver for
				the nonhuman primate as a result of the death of the preceding owner of the
				nonhuman primate, if—</text>
										<clause id="H00E6508F37144D9E988827F8EFBC0DF9"><enum>(i)</enum><text>the person
				transporting the nonhuman primate is carrying legal documentation to support
				the need for transporting the nonhuman primate to the legally designated
				caregiver;</text>
										</clause><clause id="HC5CF9819622E4D389AB3E8D159C8F542"><enum>(ii)</enum><text>the nonhuman
				primate is transported in a secure enclosure appropriate for the
				species;</text>
										</clause><clause id="H29ED1E6B46FD47C7A18EE7B11C766ABD"><enum>(iii)</enum><text>the nonhuman
				primate has no contact with any other animals or members of the public while
				being transported to the legally designated caregiver; and</text>
										</clause><clause id="H12F259970FD14EDAB8B17B4E05E40486"><enum>(iv)</enum><text>all applicable
				State and local restrictions on such transport, and all applicable State and
				local requirements for permits or health certificates, are complied
				with;</text>
										</clause></subparagraph><subparagraph id="H79592D76B2564944A7228995EB9359B5"><enum>(C)</enum><text>does not apply to
				a person transporting a nonhuman primate solely for the purpose of assisting an
				individual who is permanently disabled with a severe mobility impairment,
				if—</text>
										<clause id="HAA72EBD07F3E48A6A58461C3197EC16E"><enum>(i)</enum><text>the nonhuman
				primate is a single animal of the genus Cebus;</text>
										</clause><clause id="HE532C4697BAF4BEE9B7371A5DF75E87D"><enum>(ii)</enum><text>the nonhuman
				primate was obtained from, and trained at, a licensed nonprofit organization
				described in section 501(c)(3) of the Internal Revenue Code of 1986 the
				nonprofit tax status of which was obtained—</text>
											<subclause id="HE15F0560D6B0432CA84ECB4B100DFF52"><enum>(I)</enum><text>before July 18,
				2008; and</text>
											</subclause><subclause id="H77704217249F4916A1B7C09163FED982"><enum>(II)</enum><text>on the basis that
				the mission of the organization is to improve the quality of life of severely
				mobility-impaired individuals;</text>
											</subclause></clause><clause id="H712D2F1AE166462BA794675E4A4252DF"><enum>(iii)</enum><text>the person
				transporting the nonhuman primate is a specially trained employee or agent of a
				nonprofit organization described in clause (ii) that is transporting the
				nonhuman primate to or from a designated individual who is permanently disabled
				with a severe mobility impairment, or to or from a licensed foster care home
				providing specialty training of the nonhuman primate solely for purposes of
				assisting an individual who is permanently disabled with severe mobility
				impairment;</text>
										</clause><clause id="H9754E86D0CC24923904A381B2C36D393"><enum>(iv)</enum><text>the person
				transporting the nonhuman primate carries documentation from the applicable
				nonprofit organization that includes the name of the designated individual
				referred to in clause (iii);</text>
										</clause><clause id="HC12F60DC4625406BABBA6F32164D3E36"><enum>(v)</enum><text>the nonhuman
				primate is transported in a secure enclosure that is appropriate for that
				species;</text>
										</clause><clause id="H8407196357214B649F41B0DD831A6175"><enum>(vi)</enum><text>the nonhuman
				primate has no contact with any animal or member of the public, other than the
				designated individual referred to in clause (iii); and</text>
										</clause><clause id="H328FE72A42DA46BE804E48DC354F2FA4"><enum>(vii)</enum><text>the
				transportation of the nonhuman primate is in compliance with—</text>
											<subclause id="H28AC9D9E590A40E99447CCAE84B59503"><enum>(I)</enum><text>all applicable
				State and local restrictions regarding the transport; and</text>
											</subclause><subclause id="H2E47B94884DB43DDA9B5877B3D79118C"><enum>(II)</enum><text>all applicable
				State and local requirements regarding permits or health certificates;
				and</text>
											</subclause></clause></subparagraph><subparagraph id="H64C2BB9660114B81ADD8CD63ED4D1851"><enum>(D)</enum><text>does not
				apply</text>
									</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H1F91D422C2BB43359A62DD0A89B63C38"><enum>(C)</enum><text>in paragraph (2)
			 (as redesignated by subparagraph (A))—</text>
						<clause id="H63C7CDB0DF044D44A2CFD88D43559594"><enum>(i)</enum><text>by
			 striking <quote>a</quote> before <quote>prohibited</quote> and inserting
			 <quote>any</quote>;</text>
						</clause><clause id="H77CBDF69ADC24E90B5D5B964FD6F4F56"><enum>(ii)</enum><text>by
			 striking <quote>(3)</quote> and inserting <quote>(4)</quote>; and</text>
						</clause><clause id="H615B67299CB24368914DB297C0789633"><enum>(iii)</enum><text>by
			 striking <quote>(2)</quote> and inserting <quote>(3)</quote>;</text>
						</clause></subparagraph><subparagraph id="H5895DD19FC434F8E82D956C120C9F09A"><enum>(D)</enum><text>in paragraph (3)
			 (as redesignated by subparagraph (A))—</text>
						<clause id="H9E083C505B0A4BC197D79423A39E4476"><enum>(i)</enum><text>in
			 subparagraph (C)—</text>
							<subclause id="HB85EC9FCF24C4799A0B89044902561B6"><enum>(I)</enum><text>in clauses (ii)
			 and (iii), by striking <quote>animals listed in section 2(g)</quote> each place
			 it appears and inserting <quote>prohibited wildlife species</quote>; and</text>
							</subclause><subclause id="H0EE28CCA6D204CF580E89643E18EFE71"><enum>(II)</enum><text>in clause (iv),
			 by striking <quote>animals</quote> and inserting <quote>prohibited wildlife
			 species</quote>; and</text>
							</subclause></clause><clause id="HD0F14B82FB484ABB9037473EB4D9B97B"><enum>(ii)</enum><text>in
			 subparagraph (D), by striking <quote>animal</quote> each place it appears and
			 inserting <quote>prohibited wildlife species</quote>;</text>
						</clause></subparagraph><subparagraph id="H85E3493BE5D64788892F46C06114E775"><enum>(E)</enum><text>in paragraph (4)
			 (as redesignated by subparagraph (A)), by striking <quote>(2)</quote> and
			 inserting <quote>(3)</quote>; and</text>
					</subparagraph><subparagraph id="H58D5ED59B3794BD9A813AC665B87BEEF"><enum>(F)</enum><text>in paragraph (6)
			 (as redesignated by subparagraph (A))—</text>
						<clause id="H3B46897EEF214B6883C8E1C2131CBD9B"><enum>(i)</enum><text>by
			 striking <quote>subsection (a)(2)(C)</quote> and inserting <quote>this
			 subsection</quote>; and</text>
						</clause><clause id="HDB94EC6FA87A4F39852FB690FCB1B372"><enum>(ii)</enum><text>by
			 striking <quote>2004 through 2008</quote> and inserting <quote>2010 through
			 2014</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HB6B21D4B09A943378837CB2F1602F1B8"><enum>(b)</enum><header>Civil
			 Penalties</header><text>Section 4(a) of the Lacey Act Amendments of 1981 (16
			 U.S.C. 3373(a)) is amended—</text>
				<paragraph id="H2BF9FDE2C2D14B179AC9435D9F900C8A"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>(e),</quote> after <quote>subsections (b), (d),</quote> ;
			 and</text>
				</paragraph><paragraph id="H092BD36C756948D68E53E2E853CFDA37"><enum>(2)</enum><text>in paragraph (1),
			 by inserting <quote>, (e),</quote> after <quote>subsection (d)</quote>.</text>
				</paragraph></subsection><subsection id="H10B872AE2E294ED187AD8FE4959C9B8E"><enum>(c)</enum><header>Criminal
			 Penalties</header><text>Section 4(d) of the Lacey Act Amendments of 1981 (16
			 U.S.C. 3373(d)) is amended—</text>
				<paragraph id="H331607D3A2A2406ABD882526F71EBF28"><enum>(1)</enum><text>in paragraphs
			 (1)(A) and (1)(B) and in the first sentence of paragraph (2), by inserting
			 <quote>(e),</quote> after <quote>subsections (b), (d),</quote> each place it
			 appears; and</text>
				</paragraph><paragraph id="HCB7C21A756B443FB9608D08AFF1F98A5"><enum>(2)</enum><text>in paragraph (3),
			 by inserting <quote>, (e),</quote> after <quote>subsection (d)</quote>.</text>
				</paragraph></subsection><subsection id="H144CFCC1C92C4030A779F1EC5CCC7687"><enum>(d)</enum><header>Effective Date;
			 Regulations</header>
				<paragraph id="H9484A17D2F804A188046C9FBAED339F1"><enum>(1)</enum><header>Effective
			 date</header><text>Subsections (a) through (c) shall take effect on the earlier
			 of—</text>
					<subparagraph id="HC58F683CDE8C465595750421650EBAFD"><enum>(A)</enum><text>the date of the
			 issuance of regulations under paragraph (2); or</text>
					</subparagraph><subparagraph id="HB4EA4E3E51294127B4DEE73FCA073AEC"><enum>(B)</enum><text>the expiration of
			 the period referred to in paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="HD6C1E14DA230455D9B08E8A469B2F26E"><enum>(2)</enum><header>Regulations</header><text>The
			 Secretary of the Interior shall issue regulations implementing the amendments
			 made by this section by not later than the end of the 180-day period beginning
			 on the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="H9860C032EFAE4C3B919C6EFA6C119E9A"><enum>4.</enum><header>Applicability
			 provision amendment</header><text display-inline="no-display-inline">Section 3
			 of the Captive Wildlife Safety Act (117 Stat. 2871; Public Law 108–191) is
			 amended—</text>
			<paragraph id="H8B2243A7C2B24681A68267D2761B2F3B"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>(a) <header-in-text level="subsection" style="OLC">In
			 General</header-in-text>.—Section 3</quote> and inserting <quote>Section
			 3</quote>; and</text>
			</paragraph><paragraph id="H9F91EC28F2BD45CF92A2BE3E87A0A676"><enum>(2)</enum><text>by striking
			 subsection (b).</text>
			</paragraph></section><section id="HAEC6B0F9E0DB4B7591E9EA04FF1CED96"><enum>5.</enum><header>Regulations</header><text display-inline="no-display-inline">Section 7(a) of the Lacey Act Amendments of
			 1981 (16 U.S.C. 3376(a)) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block id="HE17EA42013464217BFB61CE2D04F5E6D" style="OLC">
				<paragraph id="HAF7EC32EF8B14752B3D71D9B1D61A7FE"><enum>(3)</enum><text>The Secretary
				shall, in consultation with other relevant Federal and State agencies, issue
				regulations to implement section
				3(e).</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8B9455A32CE741F68293A80778FE830B"><enum>6.</enum><header>Authorizations of
			 appropriations for additional law enforcement personnel</header><text display-inline="no-display-inline">In addition to such other amounts as are
			 authorized to carry out the Lacey Act Amendments of 1981 (16 U.S.C. 3371 et
			 seq.), there is authorized to be appropriated to the Secretary of the Interior
			 $5,000,000 for fiscal year 2010 to hire additional law enforcement personnel of
			 the United States Fish and Wildlife Service to enforce that Act.</text>
