		<official-title>To amend title 17, United States Code, with respect to
		  works connected to certain funding agreements.</official-title>

		<section id="H5211635889D84C319550AA550B69D8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair Copyright in Research Works
			 Act</short-title></quote>.</text>
		</section><section id="H91E361D17A704BAFA1D31B8B9FA2440"><enum>2.</enum><header>Limitations on
			 Federal Government regarding extrinsic works</header>
			<subsection id="HCE6029CE20CE4E2B9961B7FFACD318C5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 201 of title
			 17, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA7C0713B4D9547D3B634E0613E96E9E5" style="OLC">
					<subsection id="H7902CBBFF12441CD00A2439CAD804924"><enum>(f)</enum><header>Limitations on
				the Federal Government</header>
						<paragraph id="HA2E2BC977F8C4F71AF3BC1CDDEEE377D"><enum>(1)</enum><header>Limitations
				regarding funding agreements</header><text display-inline="yes-display-inline">No Federal agency may, in connection with a
				funding agreement—</text>
							<subparagraph id="H7473A8082080471F9E42B2FB2294224F"><enum>(A)</enum><text>impose or cause
				the imposition of any term or condition that—</text>
								<clause id="H8184D664416247FBACA35BB2149BF6F0"><enum>(i)</enum><text>requires the
				transfer or license to or for a Federal agency of—</text>
									<subclause id="HBB8EAC48AD484AF7A54F83A2F98ED76B"><enum>(I)</enum><text>any right provided
				under paragraph (3), (4), or (5) of section 106 in an extrinsic work; or</text>
									</subclause><subclause id="H3E4F09980C27472DB0BF743F28473C00"><enum>(II)</enum><text display-inline="yes-display-inline">any right provided under paragraph (1) or
				(2) of section 106 in an extrinsic work, to the extent that, solely for
				purposes of this subsection, such right involves the availability to the public
				of that work; or</text>
									</subclause></clause><clause id="HF3915D48E28D49AE88E5A79011B37F24"><enum>(ii)</enum><text>requires the
				absence or abandonment of any right described in subclause (I) or (II) of
				clause (i) in an extrinsic work;</text>
								</clause></subparagraph><subparagraph id="H4DA9FC20A1C6472ABC8CC440B77091C1"><enum>(B)</enum><text display-inline="yes-display-inline">impose or cause the imposition of, as a
				condition of a funding agreement, the waiver of, or assent to, any prohibition
				under subparagraph (A); or</text>
							</subparagraph><subparagraph id="H8EEBB25F5CB347A4B6776FEEFDF7CEB7"><enum>(C)</enum><text>assert any rights
				under this title in material developed under any funding agreement that
				restrain or limit the acquisition or exercise of rights under this title in an
				extrinsic work.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">Any term,
				condition, or assertion prohibited under subparagraph (A), (B), or (C) shall be
				given no effect under this title or otherwise.</continuation-text></paragraph><paragraph commented="no" id="HB07FFEF1E4864926A16F455D79F2CB8D"><enum>(2)</enum><header>Construction</header>
							<subparagraph id="H8A0DF0A137994D9AA4A4C8453932CA31"><enum>(A)</enum><header>Certain other
				rights not limited</header><text>Nothing in paragraph (1)(A)(i)(II) shall be
				construed to limit the rights provided to the copyright owner under paragraphs
				(1) and (2) of section 106.</text>
							</subparagraph><subparagraph id="H5F2496E4FBA84FB1B2196507DD5DF01D"><enum>(B)</enum><header>No new copyright
				protection created</header><text display-inline="yes-display-inline">Nothing in
				this subsection provides copyright protection to any subject matter that is not
				protected under section 102.</text>
							</subparagraph></paragraph><paragraph id="HE3B1598B6FC64A48AB69A636ADDF775B"><enum>(3)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="HF50957E7F2B64A41A6DAEB4308A499F9"><enum>(A)</enum><header>Extrinsic
				work</header><text display-inline="yes-display-inline">The term
				<quote>extrinsic work</quote> means any work, other than a work of the United
				States Government, that is based upon, derived from, or related to, a funding
				agreement and—</text>
								<clause commented="no" id="HB6829673414C47C2AF6595024458FC85"><enum>(i)</enum><text>is also funded in
				substantial part by one or more other entities, other than a Federal agency,
				that are not a party to the funding agreement or acting on behalf of such a
				party; or</text>
								</clause><clause commented="no" id="HA7AA26E1A3E74F11A77FFA97FC95C2A7"><enum>(ii)</enum><text display-inline="yes-display-inline">represents, reflects, or results from a
				meaningful added value or process contributed by one or more other entities,
				other than a Federal agency, that are not a party to the funding agreement or
				acting on behalf of such a party.</text>
								</clause></subparagraph><subparagraph id="HEDA92C26C3534B63B29B3EEDCCAC50D9"><enum>(B)</enum><header>Federal
				agency</header><text display-inline="yes-display-inline">The term
				<quote>Federal agency</quote> means any department, agency, or instrumentality
				of the United States Government.</text>
							</subparagraph><subparagraph id="H03166C2973B1478998645FF2DA0E407"><enum>(C)</enum><header>Funding
				agreement</header><text>The term <quote>funding agreement</quote> means any
				contract, grant, or other agreement entered into between a Federal agency and
				any person under which funds are provided by a Federal agency, in whole or in
				part, for the performance of experimental, developmental, or research
				activities.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4DAAB625EA3D4156B07C6175F1B87EF6"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) applies to any funding agreement that is
			 entered into on or after the date of the enactment of this Act.</text>
			</subsection><subsection id="H5973C24E3B9A4AD2BAC18800BB4EA600"><enum>(c)</enum><header>Report to
			 congressional committees</header><text display-inline="yes-display-inline">Not
			 later than the date that is 5 years after the date of the enactment of this
			 Act, the Register of Copyrights shall, after consulting with the Comptroller
			 General and with Federal agencies that provide funding under funding agreements
			 and with publishers in the private sector, review and submit to the appropriate
			 congressional committees a report on the Register’s views on section 201(f) of
			 title 17, United States Code, as added by subsection (a) of this section,
			 taking into account the development of and access to extrinsic works and
			 materials developed under funding agreements, including the role played by
			 publishers in the private sector and others.</text>
			</subsection><subsection id="HFCDCAC76E13D49C2874E72DE21D742E9"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H14C9048DCA774779A3DC42EF6EB838DF"><enum>(1)</enum><header>Extrinsic work;
			 Federal agency; funding agreement</header><text>The terms <quote>extrinsic
			 work</quote>, <quote>Federal agency</quote>, and <quote>funding
			 agreement</quote> have the meanings given those terms in section 201(f)(3) of
			 title 17, United States Code, as added by subsection (a) of this
			 section.</text>
				</paragraph><paragraph id="HC19FEEF4F7954E039FA367B7EEFF68B"><enum>(2)</enum><header>Appropriate
			 congressional committees</header><text display-inline="yes-display-inline">The
			 term <quote>appropriate congressional committees</quote> means the Committee on
			 the Judiciary and the Committee on Appropriations of the House of
			 Representatives and the Committee on the Judiciary and the Committee on
			 Appropriations of the Senate.</text>
				</paragraph></subsection></section></legis-body>
