		<official-title>To greatly enhance the Nation’s environmental, energy,
		  economic, and national security by terminating long-standing Federal
		  prohibitions on the domestic production of abundant offshore supplies of oil
		  and natural gas, and for other purposes.</official-title>

	<legis-body id="HEA2071C3606A40FEBA5C2F9B2241D7B2" style="OLC">
		<section display-inline="no-display-inline" id="H041D0F9530F04539B9914E745845D552" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Maximize Offshore Resource Exploration
			 Act of 2009</short-title></quote> or the <quote><short-title>MORE Act of 2009</short-title></quote> .</text>
		</section><section id="H425C0591A82645D8832389420000CC22"><enum>2.</enum><header>Termination of
			 prohibitions on expenditures for, and withdrawals from, offshore oil and gas
			 leasing</header>
			<subsection id="H50D3B32DAB4D424998BE0063DA4D6C9B"><enum>(a)</enum><header>Prohibitions on
			 expenditures</header><text display-inline="yes-display-inline">All provisions
			 of Federal law that prohibit the expenditure of appropriated funds to conduct
			 oil and natural gas leasing and preleasing activities for any area of the Outer
			 Continental Shelf shall have no force or effect with respect to such
			 activities.</text>
			</subsection><subsection id="H9D859ADE0B9B4904BDD326FD9DFB0026"><enum>(b)</enum><header>Revocation
			 withdrawals</header><text>All withdrawals of Federal submerged lands of the
			 Outer Continental Shelf from leasing, including withdrawals by the President
			 under the authority of section 12(a) of the Outer Continental Shelf Lands Act
			 (43 U.S.C. 1341(a)), are hereby revoked and are no longer in effect with
			 respect to the leasing of areas for exploration for, and development and
			 production of, oil and natural gas.</text>
			</subsection></section><section id="H42657FD31639486BB59DDFE4F6E39271"><enum>3.</enum><header>Outer Continental
			 Shelf oil and natural gas leasing program</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (43
			 U.S.C. 1331 et seq.) is amended by inserting after section 9 the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H57A132D989E14B2EA9399C7D7F285412" style="OLC">
				<section id="H17E8FA4E0D794B7881BC1356D0EBCEE7"><enum>10.</enum><header>State approval
				requirement with respect to oil and natural gas leasing</header>
					<subsection id="H9CBEADCCD03D4B468FFA103F0702DE5"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may not
				issue any lease authorizing exploration for, or development of, oil and natural
				gas in any area of the Outer Continental Shelf that is located within 25 miles
				of the coastline of a State unless the State has enacted a law approving of the
				issuance of such leases by the Secretary.</text>
					</subsection><subsection id="HD297B09863274BC7A4EA5C493FBB85F8"><enum>(b)</enum><header>State approval
				permanent</header><text>Repeal of such a law by a State shall have no effect
				for purposes of subsection (a).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB5E238DBB967495CA50075DE8FA78DD8"><enum>4.</enum><header>Sharing of
			 revenues</header>
			<subsection id="H18953FDCB008411C917CEEB939EDA0E3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8(g) of the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1337(g)) is amended—</text>
				<paragraph id="H4816A1A268BD44C89D8DB65E6960C141"><enum>(1)</enum><text>in paragraph (2)
			 by striking <quote>Notwithstanding</quote> and inserting <quote>Except as
			 provided in paragraph (6), and notwithstanding</quote>;</text>
				</paragraph><paragraph id="HF10B67EB69F5409AA11BD753FEEA78FF"><enum>(2)</enum><text>by redesignating
			 paragraphs (6) and (7) as paragraphs (7) and (8); and</text>
				</paragraph><paragraph id="HACC1B39307EE41159B669B17C82993E2"><enum>(3)</enum><text>by inserting after
			 paragraph (5) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H035A8C1EA0A348C19D47993CA6861EB1" style="OLC">
						<paragraph id="H6CBB537E14B6442AA6EBB98F7C5B9E"><enum>(6)</enum><header>Royalties under
				qualified oil and gas leases</header>
							<subparagraph id="HF9369FCCDBE041FB81B69E4805BB5667"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), of amounts
				received by the United States as royalties under any qualified oil and gas
				lease on submerged lands that are located within the seaward boundaries of a
				State established under section 4(a)(2)(A)—</text>
								<clause id="HB5303B1C33D54032A0EFAA1FC3B11FD"><enum>(i)</enum><text display-inline="yes-display-inline">12.5 percent shall be deposited in the
				general fund of the Treasury;</text>
								</clause><clause id="H8D72E9CA3E4541028B1C1FAA770044FC"><enum>(ii)</enum><text>12.5 percent
				shall be deposited in the Renewable Energy Reserve established by section 5 of
				the <short-title>MORE Act of 2009</short-title>;
				and</text>
								</clause><clause id="H5F03C86CB31F483E836BD140ECBC79B9"><enum>(iii)</enum><text>75 percent shall
				be paid to the States that are producing States with respect to those submerged
				lands.</text>
								</clause></subparagraph><subparagraph id="HFDB6239FEF454366819F18A99D31D414"><enum>(B)</enum><header>Lease tracts
				within 25 miles of the coastline</header><text display-inline="yes-display-inline">Of amounts received by the United States as
				royalties under any qualified oil and gas lease on submerged lands that are
				located within 25 miles of the coastline of a State and within the seaward
				boundaries of a State established under section 4(a)(2)(A)—</text>
								<clause id="HD60B49EDD7B94E0B9B08893F1F09F3BC"><enum>(i)</enum><text display-inline="yes-display-inline">5 percent shall be deposited in the general
				fund of the Treasury;</text>
								</clause><clause display-inline="no-display-inline" id="H87B13763B2F149C384776FAE52F0D370"><enum>(ii)</enum><text>5 percent shall
				be deposited in the Renewable Energy Reserve established by section 5 of the
				<short-title>MORE Act of 2009</short-title>; and</text>
								</clause><clause id="H94F8547F2C94448F8293F24138C79FA0"><enum>(iii)</enum><text>90 percent shall
				be paid to the States that are producing States with respect to those submerged
				lands.</text>
								</clause></subparagraph><subparagraph id="HF5BEB64103E1486C8E59B47AD99887B"><enum>(C)</enum><header>Leased tract that
				lies partially within the seaward boundaries of a State</header><text>In the
				case of a leased tract that lies partially within the seaward boundaries of a
				State, the amounts of royalties from such tract that are subject to
				subparagraph (A) or (B), as applicable, with respect to such State shall be a
				percentage of the total amounts of royalties from such tract that is equivalent
				to the total percentage of surface acreage of the tract that lies within such
				seaward boundaries.</text>
							</subparagraph><subparagraph id="HF30EF51A63D34C3AAA0430347F263525"><enum>(D)</enum><header>Definitions</header><text>In
				this paragraph:</text>
								<clause id="H99C30AEEAC694522BAED03C67D2DE66"><enum>(i)</enum><header>Adjacent
				State</header><text display-inline="yes-display-inline">The term <term>adjacent
				State</term> means, with respect to any program, plan, lease sale, leased tract
				or other activity, proposed, conducted, or approved pursuant to the provisions
				of this Act, any State the laws of which are declared, pursuant to section
				4(a)(2), to be the law of the United States for the portion of the Outer
				Continental Shelf on which such program, plan, lease sale, leased tract, or
				activity appertains or is, or is proposed to be, conducted.</text>
								</clause><clause id="HB5688E84EEAD4459B94600A64FF3551"><enum>(ii)</enum><header>Adjacent
				zone</header><text>The term <term>adjacent zone</term> means, with respect to
				any program, plan, lease sale, leased tract, or other activity, proposed,
				conducted, or approved pursuant to the provisions of this Act, the portion of
				the Outer Continental Shelf for which the laws of a particular adjacent State
				are declared, pursuant to section 4(a)(2), to be the law of the United
				States.</text>
								</clause><clause id="H976600B3973D44ACB2C9AE2200E82B5C"><enum>(iii)</enum><header>Producing
				State</header><text>The term <term>producing State</term> means an Adjacent
				State having an adjacent zone containing leased tracts from which are derived
				royalties under a lease under this Act.</text>
								</clause><clause id="HB270B2377BE1486E83126C311E4FEFAD"><enum>(iv)</enum><header>State</header><text>The
				term <term>State</term> includes Puerto Rico and the other territories of the
				United States.</text>
								</clause><clause id="HD806136E5A4E4EE4B94B003926B4462"><enum>(v)</enum><header>qualified oil and
				gas lease</header><text>The term <term>qualified oil and gas lease</term> means
				a lease under this Act granted after the date of the enactment of the
				<short-title>Maximize Offshore Resource Exploration Act of
				2009</short-title> that authorizes development and production of oil and
				natural gas and associated condensate.</text>
								</clause></subparagraph><subparagraph id="HAF1329DA9A1D44DE9BFBBA07987EDA9F"><enum>(E)</enum><header>Application</header><text display-inline="yes-display-inline">This paragraph shall apply to royalties
				received by the United States after September 30,
				2009.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H384EC0544604432D0095C557F2B8B00"><enum>(b)</enum><header>Establishment of
			 State seaward boundaries</header><text>Section 4(a)(2)(A) of the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1333(a)(2)(A)) is amended in the first
			 sentence by striking <quote>, and the President</quote> and all that follows
			 through the end of the sentence and inserting the following: <quote>. Such
			 extended lines are deemed to be as indicated on the maps for each Outer
			 Continental Shelf region entitled <quote>Alaska OCS Region State Adjacent Zone
			 and OCS Planning Areas</quote>, <quote>Pacific OCS Region State Adjacent Zones
			 and OCS Planning Areas</quote>, <quote>Gulf of Mexico OCS Region State Adjacent
			 Zones and OCS Planning Areas</quote>, and <quote>Atlantic OCS Region State
			 Adjacent Zones and OCS Planning Areas</quote>, all of which are dated September
			 2005 and on file in the Office of the Director, Minerals Management Service.
			 The preceding sentence shall not apply with respect to the treatment under
			 section 105 of the Gulf of Mexico Energy Security Act of 2006 (title I of
			 division C of Public Law 109–432) of qualified Outer Continental Shelf revenues
			 deposited and disbursed under subsection (a)(2) of that
			 section.</quote>.</text>
			</subsection></section><section id="H6FFE4591398C4CB688E38511007DB94"><enum>5.</enum><header>Renewable Energy
			 Reserve</header>
			<subsection id="H71FA745B065A4B01AD009291B7C30015"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For budgetary
			 purposes, there is established a separate account in the Treasury to be known
			 as the <quote>Renewable Energy Reserve</quote>.</text>
			</subsection><subsection id="HC5CBD208E75848FCB99CD5AAA2871AF"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The Renewable Energy Reserve shall consist
			 of amounts deposited into it under subparagraphs (A) and (B) of paragraph (6)
			 of section 8(g) of the Outer Continental Shelf Lands Act (43 U.S.C. 1337(g)),
			 as amended by this Act.</text>
			</subsection><subsection id="H6450B3165ECE484D814EE143A392CB92"><enum>(c)</enum><header>Use</header><text display-inline="yes-display-inline">The Renewable Energy Reserve shall be
			 available to offset the cost of legislation enacted after the date of the
			 enactment of this Act—</text>
				<paragraph id="HE30C858ACCD541CC907DC71E4F5D5100"><enum>(1)</enum><text>to accelerate the
			 use of cleaner domestic energy resources and alternative fuels;</text>
				</paragraph><paragraph id="H1CF301F7BC404356A480067ED26569BC"><enum>(2)</enum><text>to promote the
			 utilization of energy-efficient products and practices; and</text>
				</paragraph><paragraph id="HCFEC985E7DAA41D09EDB74E107E99610"><enum>(3)</enum><text display-inline="yes-display-inline">to increase research, development, and
			 deployment of clean renewable energy and efficiency technologies and job
			 training programs for those purposes.</text>
				</paragraph></subsection><subsection commented="no" id="H8DEF329C341045C4AD496DED49C14620"><enum>(d)</enum><header>Procedure for
			 Adjustments</header>
				<paragraph commented="no" id="H7CE0D07B84B54F45A9F130A4E933ED6C"><enum>(1)</enum><header>Budget committee
			 chairman</header><text>After the reporting of a bill or joint resolution, or
			 the offering of an amendment thereto or the submission of a conference report
			 thereon, providing funding for the purposes set forth in subsection (c) in
			 excess of the amounts provided for those purposes for fiscal year 2009, the
			 chairman of the Committee on the Budget of the applicable House of Congress
			 shall make the adjustments set forth in paragraph (2) for the amount of new
			 budget authority and outlays in that measure and the outlays flowing from that
			 budget authority.</text>
				</paragraph><paragraph commented="no" id="H19394466FB18456E8C407F9DB1706D18"><enum>(2)</enum><header>Matters to be
			 adjusted</header><text>The adjustments referred to in paragraph (1) are to be
			 made to—</text>
					<subparagraph commented="no" id="H1EB44311A6514F6683DD675377F203C3"><enum>(A)</enum><text>the discretionary
			 spending limits, if any, set forth in the appropriate concurrent resolution on
			 the budget;</text>
					</subparagraph><subparagraph commented="no" id="H296C01E9D0074B3C00B673BC44002E36"><enum>(B)</enum><text>the allocations
			 made pursuant to the appropriate concurrent resolution on the budget pursuant
			 to section 302(a) of Congressional Budget Act of 1974; and</text>
					</subparagraph><subparagraph commented="no" id="H4392B5535D47410EAA7609D7FA799156"><enum>(C)</enum><text>the budget
			 aggregates contained in the appropriate concurrent resolution on the budget as
			 required by section 301(a) of Congressional Budget Act of 1974.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H798CD3762EC24238BF0096E900C20300"><enum>(3)</enum><header>Amounts of
			 adjustments</header><text>The adjustments referred to in paragraphs (1) and (2)
			 shall not exceed the total of the receipts over a 10-year period, as estimated
			 by the Congressional Budget Office upon the enactment of this Act.</text>
				</paragraph></subsection></section></legis-body>
