		<section commented="no" display-inline="no-display-inline" id="HA2DF60605B0C4FED8C3E20C4F3217471" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commission on Financial Crisis
			 Accountability Act of 2009</short-title></quote>.</text>
		</section><section id="HA7A0715BABD44E28871AC30A58AAC5F3"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established a commission to be
			 known as the <quote>Commission on Financial Crisis Accountability</quote>
			 (hereafter in this Act referred to as the <quote>Commission</quote>).</text>
		</section><section id="H385975F7BB8F40E0B12D670A3CD2CBFC"><enum>3.</enum><header>Duties</header>
			<subsection id="H212191496AEA4950947A62DFB97E8ABA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commission shall
			 conduct a study of the financial system in the United States. In conducting
			 such study, the Commission shall examine the current financial crisis, its
			 causes and its impact on the Federal deficit and tax revenues,
			 including—</text>
				<paragraph id="HA4E8E83B29BB4272AB328BE8CBCE429B"><enum>(1)</enum><text display-inline="yes-display-inline">regulation and transparency,</text>
				</paragraph><paragraph id="HA668854211DA410183D6E6090055E2E7"><enum>(2)</enum><text>fraud and
			 abuse,</text>
				</paragraph><paragraph id="HDE188A6809BE4677AC50F7C22855700"><enum>(3)</enum><text>the fairness and
			 equity of the tax treatments of financial products and arrangements, and</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HE5F19ADC237743819079002C675E321E"><enum>(4)</enum><text>the role of any
			 and all participants in the financial services industry that the Commission
			 deems necessary, including—</text>
					<subparagraph id="H173CBC7FCE2F4F8BAC11E11EFBA9870"><enum>(A)</enum><text>government
			 agencies, including the Department of Housing and Urban Development, Department
			 of Treasury, the Securities and Exchange Commission, and any other agency the
			 Commission considers necessary,</text>
					</subparagraph><subparagraph id="H6F65FDB72FAC49BA876F3F427D9FBBDB"><enum>(B)</enum><text display-inline="yes-display-inline">government-sponsored entities, including
			 the Federal National Mortgage Association and the Federal Home Loan Mortgage
			 Corporation,</text>
					</subparagraph><subparagraph id="H763C9636B67B4883A6D665C4BA24CD78"><enum>(C)</enum><text>the Board of
			 Governors of the Federal Reserve System, and its banks and leadership,</text>
					</subparagraph><subparagraph id="H9782FA5581754C02809E6F6E2759483E"><enum>(D)</enum><text display-inline="yes-display-inline">the executive, legislative and judicial
			 branches of government,</text>
					</subparagraph><subparagraph id="HB92ED33622A3464CA56FECB738FD2DA2"><enum>(E)</enum><text>credit rating
			 agencies, and</text>
					</subparagraph><subparagraph id="HA0582E0123474B6D92B0D9CBAB00E51"><enum>(F)</enum><text>the Federal Deposit
			 Insurance Corporation and the Commodities Futures Trading Corporation.</text>
					</subparagraph></paragraph></subsection><subsection id="HA3CBC592B347450B9244B0A80CCD01A9"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Commission shall prepare a report to
			 the Congress on its findings pursuant to the study conducted under subsection
			 (a). Such report shall include a detailed statement of the findings,
			 conclusions, and recommendations of the Commission and shall address the
			 following:</text>
				<paragraph id="HEAEC878C1F34416E94B9E45900F722AC"><enum>(1)</enum><text>The causes of the
			 current financial crisis and how this kind of crisis can be avoided in the
			 future.</text>
				</paragraph><paragraph id="HB55D5C29910F462C0048608D19D20701"><enum>(2)</enum><text>The stage the
			 current financial crisis is in and what can be expected in subsequent
			 stages.</text>
				</paragraph><paragraph id="H88270AA130FC45B9969765B6680015A0"><enum>(3)</enum><text>The impact of the
			 current financial crisis on Federal revenues.</text>
				</paragraph><paragraph id="HB31E060794144A8DB75C63565BEC78FE"><enum>(4)</enum><text>The extent to
			 which the financial regulatory structure should be restructured.</text>
				</paragraph><paragraph id="H13BD16AA453F44C3B0AB82642B2DC0E7"><enum>(5)</enum><text>The tax treatment
			 of financial products and arrangements and how to make them more fair and
			 equitable.</text>
				</paragraph></subsection><subsection id="H08AD9F0C349D465B9D6151B67E15D83A"><enum>(c)</enum><header>Shareholder Bill
			 of Rights</header><text>The Commission shall also make recommendations for
			 investors bill of rights, which shall include necessary protections, as
			 determined by the Commission, to prevent shareholders from being deprived of
			 their rights and their savings.</text>
			</subsection></section><section id="H87064694647747FCBA93247A08FA7863"><enum>4.</enum><header>Membership</header>
			<subsection id="HCFFA3213F85E4DD98AF910F15D31C481"><enum>(a)</enum><header>Number and
			 Appointment</header><text>The Commission shall be composed of 10 members
			 appointed as follows:</text>
				<paragraph id="H1F9B48F6D91741FABDF96D23CB00B61A"><enum>(1)</enum><text>3
			 members shall be appointed by the majority leader of the Senate.</text>
				</paragraph><paragraph id="HECC9A8637CA0480AA74ED99031BDD922"><enum>(2)</enum><text>3
			 members shall be appointed by the Speaker of the House of
			 Representatives.</text>
				</paragraph><paragraph id="HCDDB7675DBE741A9A51F85D2B2A1F2D5"><enum>(3)</enum><text>2
			 members shall be appointed by the minority leader of the Senate.</text>
				</paragraph><paragraph id="HB4372ECE841F49ECAC30199EE263AE1C"><enum>(4)</enum><text>2
			 members shall be appointed by the minority leader of the House of
			 Representatives.</text>
				</paragraph></subsection><subsection id="HDDFC03A4EB694C658671A7CBE482F70E"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">The members shall have knowledge and
			 expertise in matters to be studied by the Commission, except that the members
			 shall not have a conflict of interest with any matter the Commission is
			 required to review under section 3.</text>
			</subsection><subsection id="H6400A664584F442EB32484EAB7B74827"><enum>(c)</enum><header>Terms</header><text>Members
			 shall be appointed for the life of the Commission.</text>
			</subsection><subsection id="H25F0BED4FC804C28933DCF85A27F373A"><enum>(d)</enum><header>Vacancies</header><text>Any
			 vacancy in the Commission shall be filled in the same manner as the original
			 appointment.</text>
			</subsection><subsection id="H785053233A7C4A8CB59E4781E881D9E8"><enum>(e)</enum><header>Chair</header><text>The
			 Chair of the Commission shall be designated by the Speaker of the House of
			 Representatives, after consulting with the majority leader of the Senate and
			 the minority leaders of the House of Representatives and the Senate.</text>
			</subsection><subsection id="H7ACFA5B35E20450CBEFDD5B173682BE2"><enum>(f)</enum><header>Deadline for
			 Appointment</header><text>The appointments of the members of the Commission
			 shall be made no later than 30 days after the date of enactment of this
			 Act.</text>
			</subsection><subsection id="H3710C098E84E4384AB1C4AEC9DA3A5E6"><enum>(g)</enum><header>Basic
			 Pay</header>
				<paragraph id="H435E3E3E03E04E018E302C181F6D3A99"><enum>(1)</enum><header>Rates of
			 pay</header><text>Except as provided in paragraph (2), members shall each be
			 paid at a rate not to exceed the rate of basic pay for level IV of the
			 Executive Schedule for each day (including travel time) during which they are
			 engaged in the actual performance of duties vested in the Commission.</text>
				</paragraph><paragraph id="H9E8675F75332433AB7AC40C134176A94"><enum>(2)</enum><header>Prohibition of
			 compensation of federal employees</header><text>Members of the Commission who
			 are full-time officers or employees of the United States may not receive
			 additional pay, allowances, or benefits by reason of their service on the
			 Commission.</text>
				</paragraph></subsection><subsection id="H09A622CA7FEE4D58B036B0BA2839B8CF"><enum>(h)</enum><header>Travel
			 Expenses</header><text>Each member shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with applicable provisions under
			 subchapter I of chapter 57 of title 5, United States Code.</text>
			</subsection><subsection id="H539F288EF3E64696AD0F95CDF216113D"><enum>(i)</enum><header>Retired
			 Annuitants</header><text>A member of the Commission who is an annuitant
			 otherwise covered by section 8344 or section 8468 of title 5, United States
			 Code, shall not be subject to the provisions of that section with respect to
			 membership on the Commission by reason of membership on the Commission.</text>
			</subsection><subsection id="HAF2082DD02D3482D9113D58BE552F3B2"><enum>(j)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number may hold hearings.</text>
			</subsection><subsection id="HD59BBE97263C40CAA9F8A73E49E58941"><enum>(k)</enum><header>Meetings</header>
				<paragraph id="H853364B1204F41AF8676F7BE6D46C3C9"><enum>(1)</enum><header>First
			 meeting</header><text>The Commission shall hold its first meeting on a date
			 designated by the Speaker of the House of Representatives which is not later
			 than 30 days after the date on which all members have been appointed.</text>
				</paragraph><paragraph id="H66941CCCC6784B6DA8A7A763C0BFD4C2"><enum>(2)</enum><header>Subsequent
			 meetings</header><text>After the first meeting, the Commission shall meet upon
			 the call of the Chair.</text>
				</paragraph></subsection></section><section id="H40359178E8A143CB98E6B539A60AEB6C"><enum>5.</enum><header>Staff of
			 Commission</header>
			<subsection id="HCC1D058204D84F7B974FEF6D5AAFBED8"><enum>(a)</enum><header>Director</header><text>The
			 Commission shall have a Director who shall be appointed by the Chair. The
			 Director shall be paid a rate not to exceed the maximum rate of basic pay for
			 GS–15 of the General Schedule.</text>
			</subsection><subsection id="H5C75F588C60B4AF297381A2AFEF6E75F"><enum>(b)</enum><header>Additional
			 Staff</header><text>In addition to the Director, the Chair may appoint and fix
			 the pay of up to 3 staff members, except that any staff member appointed under
			 this subsection shall not be paid at a rate to exceed the maximum rate of basic
			 pay for GS–15 of the General Schedule.</text>
			</subsection><subsection id="HB3EB0ACE1BB040ADBCD2EE7E285C8126"><enum>(c)</enum><header>Applicability of
			 Certain Civil Service Laws</header><text>The Director and staff of the
			 Commission may be appointed without regard to the provisions of title 5, United
			 States Code, governing appointments in the competitive service, and may be paid
			 without regard to the provisions of chapter 51 and subchapter III of chapter 53
			 of that title relating to classification and General Schedule pay rates.</text>
			</subsection><subsection id="H40B3FE82C9654E05B2DB7A74F4B1DFF3"><enum>(d)</enum><header>Staff of Federal
			 Agencies</header><text>Upon the request of the Chair of the Commission, the
			 head of any Federal department or agency may detail, without reimbursement, any
			 of the personnel of that department or agency to the Commission to assist in
			 carrying out its duties under this Act.</text>
			</subsection></section><section id="H5503157CFCAE419E89C5893F05A93DD3"><enum>6.</enum><header>Powers of
			 Commission</header>
			<subsection id="H01D5B8D406B04225ACC8B38F46ED306B"><enum>(a)</enum><header>Hearings and
			 Sessions</header><text>The Commission may, for the purpose of carrying out this
			 Act, hold hearings, sit and act at times and places, take testimony, and
			 receive evidence as the Commission considers appropriate.</text>
			</subsection><subsection id="HF4C713832599467785B1FF76211983FA"><enum>(b)</enum><header>Powers of
			 Members and Agents</header><text>Any member or agent of the Commission may, if
			 authorized by the Commission, take any action which the Commission is
			 authorized to take by this section.</text>
			</subsection><subsection id="HB43E0FABD1814A3BA2A8B61BE1DEE9F3"><enum>(c)</enum><header>Obtaining
			 Official Data</header><text>The Commission may secure directly from any agency
			 of the United States information necessary to enable it to carry out this Act.
			 Upon the request of the Chair of the Commission, the head of that department or
			 agency shall furnish that information to the Commission.</text>
			</subsection><subsection id="H19506739B04341AE82988FC15EE82635"><enum>(d)</enum><header>Mails</header><text>The
			 Commission may use the United States mails in the same manner and under the
			 same conditions as other departments and agencies of the United States.</text>
			</subsection><subsection id="H6D5D3A6227764EF1998DA4AE5B3EAF9B"><enum>(e)</enum><header>Administrative
			 Support Services</header><text>Upon the request of the Commission, the
			 Administrator of General Services shall provide to the Commission, on a
			 reimbursable basis, the administrative support services necessary for the
			 Commission to carry out its responsibilities under this Act.</text>
			</subsection></section><section id="H069142CFD0C74989904D8E2576DCA6A4"><enum>7.</enum><header>Report</header><text display-inline="no-display-inline">The Commission shall transmit the report
			 required by section 3 to the President and Congress not later than 90 days
			 after the date on which the members of the Commission are first
			 appointed.</text>
		</section><section id="H4B97E917CBD148C8A41AE716B3574BFC"><enum>8.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate 30 days after
			 the date on which the Commission submits its final report to the President and
			 Congress under section 7.</text>
		</section><section id="H7A61A44F735B4479BB8F2D44C251ED3B"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act.</text>
