		<section id="H8F7F42DBDBFD434E008B12EAFA6E8D9F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nellis Dunes National Off-Highway
			 Vehicle Recreation Area Act of 2009</short-title></quote>.</text>
		</section><section id="H43540A35AA3E4D7CAC606CC3212BFED3"><enum>2.</enum><header>Conveyance of
			 property to Clark County, Nevada</header>
			<subsection id="H677A50222E9A4C7EB917DE476646D9E"><enum>(a)</enum><header>Conveyance</header><text>As
			 soon as practicable after the date of enactment of this Act, the Secretary of
			 the Interior shall convey to Clark County, Nevada, subject to valid existing
			 rights, for no consideration, all right, title, and interest of the United
			 States in and to the land described in subsection (b).</text>
			</subsection><subsection id="HE061F72873274423BD9500006B72C907"><enum>(b)</enum><header>Map</header><text>The
			 land to be conveyed under subsection (a) is the approximately 1,150 acres of
			 land as depicted on the map titled <quote>Clark County OHV Recreation
			 Park</quote> and dated July 2008.</text>
			</subsection><subsection id="H6A563A6200FA4E598DBA013FCFBDD896"><enum>(c)</enum><header>Use of
			 land</header>
				<paragraph id="H8C93B5E2C15B4F2E829CBFD55B3B5717"><enum>(1)</enum><header>In
			 general</header><text>The parcels of land conveyed under subsection (a)—</text>
					<subparagraph id="H1A7713853272427DA6FCAB7D7E4400D3"><enum>(A)</enum><text>shall be used by
			 Clark County—</text>
						<clause id="H8D56E94C07F748A895739CC17500CAB3"><enum>(i)</enum><text>to
			 provide a suitable location for the establishment of a centralized off road
			 vehicle recreation park in Clark County, Nevada;</text>
						</clause><clause id="H110E8FAFC77C4378B44E877500DEFA42"><enum>(ii)</enum><text>to
			 provide the public with opportunities for off road vehicle recreation including
			 a location for races, competitive events, training and other commercial support
			 services; and</text>
						</clause><clause id="H6581748779F742E2A587A113A89AF95"><enum>(iii)</enum><text>to
			 provide a designated area and facilities that will discourage unauthorized use
			 of off-highway vehicles in areas that have been identified as environmentally
			 sensitive lands by the Federal, State, and Clark County agencies; and</text>
						</clause></subparagraph><subparagraph id="HAFEE899F4A2B477CA700518E55B8B608"><enum>(B)</enum><text>shall not be
			 disposed of by the county.</text>
					</subparagraph></paragraph><paragraph id="HF5E3E93AD0E64E3DBF53AFBBA4E6C300"><enum>(2)</enum><header>Reversion</header><text>If
			 Clark County ceases to use any parcel for the purposes described in subsection
			 (a)—</text>
					<subparagraph id="HCEBB1BE203654730AADB287EA9E2B4CD"><enum>(A)</enum><text>title to the
			 parcel shall revert to the United States, at the option of the United States;
			 and</text>
					</subparagraph><subparagraph id="H53F7E3D1A52E4074007610C6159259E5"><enum>(B)</enum><text>Clark County,
			 Nevada, shall be responsible for any reclamation necessary to revert the parcel
			 to the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="H17CE26B24EA1458A00E544CF01C7E681"><enum>(d)</enum><header>Additional terms
			 and conditions</header><text>The Secretary of the Interior may require such
			 additional terms and conditions in connection with the conveyance as the
			 Secretary considers appropriate to protect the interests of the United
			 States.</text>
			</subsection><subsection id="HFDBC29F9B7044FEEB02BFB2724A67DF1"><enum>(e)</enum><header>Easement</header><text>The
			 United States hereby reserves a right of flight for the passage of aircraft in
			 the airspace above the surface of the lands conveyed to Clark County identified
			 under this section together with the right to cause in such air space such
			 noise, vibration, smoke, and other effects as may be inherent in operation of
			 aircraft landing at or taking off from Nellis Air Force Base, Nevada.</text>
			</subsection></section><section id="HF0BD652B267A472A9FF5A7AD5360F1F3"><enum>3.</enum><header>Special
			 designation of the Nellis Dunes National Off-Highway Vehicle Recreation Area in
			 Clark County, Nevada</header>
			<subsection id="H80CC700C982B499B9C00306E9B7CB200"><enum>(a)</enum><header>In
			 general</header><text>The area commonly known and managed as Nellis Dunes in
			 the Bureau of Land Management Resource Management Plan shall be designated the
			 <quote>Nellis Dunes National Off-Highway Vehicle Recreation
			 Area</quote>.</text>
			</subsection><subsection id="H02D815E7743A4A0CB8B0D8DDBD117A7"><enum>(b)</enum><header>Management
			 plan</header><text>The Bureau of Land Management may develop a special
			 management plan for the area to enhance the safe off-highway vehicle recreation
			 use.</text>
			</subsection></section><section id="H0D893D58C0BB47BCAA143D6C34F2D2F7"><enum>4.</enum><header>Transfer of
			 administrative jurisdiction to Nellis Air Force Base</header>
			<subsection id="H273DC757B51D4602B472FFF00046307"><enum>(a)</enum><header>In
			 general</header><text>Administrative jurisdiction over the parcel of land
			 identified on the map referred to in subsection (b) is transferred from the
			 Bureau of Land Management to the Department of the Air Force for the use of
			 Nellis Air Force Base.</text>
			</subsection><subsection id="HCBF7ABF30E264B17BD301886E6C685AC"><enum>(b)</enum><header>Description of
			 land</header><text>The land referred to in subsection (a) is the land
			 administered by the Bureau of Land Management and generally depicted on the map
			 titled <quote>Nellis Air Force Base Additions August 2008</quote>.</text>
			</subsection><subsection id="HEBDE01C060284F898575BDB2D0FD99BE"><enum>(c)</enum><header>Use of
			 land</header><text>The parcel of land described in subsection (b) shall be used
			 by Air Force for the enlargement and protection of Nellis Air Force
			 Base.</text>
