		<official-title>To authorize a State to transfer or consolidate funds
		  made available to such State under certain transportation, education, and job
		  training programs after the United States experiences economic growth at an
		  annual rate of less than 1 percent for 2 calendar quarters.</official-title>

		<section id="HCDFF72722D1545DDB7368C4F4163758F" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>State Temporary Economic Priority (STEP)
			 Act</short-title></quote>.</text>
		</section><section id="HD5E0EF6FEEFB46BAB9D8D6CC16407291"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to authorize a
			 State to transfer or consolidate funds made available to such State under
			 certain transportation, education, and job training programs after the United
			 States experiences economic growth at an annual rate of less than 1 percent for
			 2 calendar quarters.</text>
		</section><section id="H81CD6240C9EE4F7481B513AB004B2815"><enum>3.</enum><header>Authority to
			 transfer or consolidate certain funds</header>
			<subsection id="HE6E51C640B5C4A4B884EB23BE319C8E0"><enum>(a)</enum><header>Authority
			 available</header>
				<paragraph id="H3530A6C7D014476EA75721DE062D8566"><enum>(1)</enum><header>In
			 general</header><text>A State may transfer or consolidate funds under
			 subsections (b), (c), and (d) beginning with the calendar quarter after the
			 United States experiences economic growth at an annual rate of less than 1
			 percent for 2 calendar quarters and continuing until 18 months after the United
			 States experiences economic growth at an annual rate of 1 percent or more for 2
			 calendar quarters.</text>
				</paragraph><paragraph id="H5697569B9EBA4460AC67D10064BC3900"><enum>(2)</enum><header>Treatment of
			 transferred or consolidated funds</header><text>Funds transferred or
			 consolidated under subsections (b), (c), or (d) shall be used in accordance
			 with the statutory and regulatory requirements applicable to the program to
			 which the funds are transferred or consolidated.</text>
				</paragraph></subsection><subsection id="H8B3D75E4559D44BF000074B944768D4B"><enum>(b)</enum><header>Transportation
			 funds</header>
				<paragraph id="H6C0D1489E43A40748D695875B11D8909"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In applying
			 subsection (a), a State may transfer, in such amounts as the State determines
			 appropriate, any funds apportioned and allocated to such State from amounts
			 made available from the Highway Trust Fund (26 U.S.C. 9503 et seq.), other than
			 the Mass Transit Account, to any of the apportionments and allocations for the
			 following programs authorized by title 23, United States Code:</text>
					<subparagraph id="HD9D0BF191A7545BD8C41F20088DF026E"><enum>(A)</enum><text display-inline="yes-display-inline">The interstate maintenance program under
			 section 119.</text>
					</subparagraph><subparagraph id="H3696DBCB3A01480E848DBE4810522282"><enum>(B)</enum><text>The National
			 Highway System under section 103(b).</text>
					</subparagraph><subparagraph id="H73590494F7304C6398F42E1228CF47A1"><enum>(C)</enum><text>The surface
			 transportation program under section 133.</text>
					</subparagraph><subparagraph id="HA8A3B121CAC94ECB9B2DC6B2A018FA4C"><enum>(D)</enum><text>The highway bridge
			 replacement and rehabilitation program under section 144.</text>
					</subparagraph></paragraph><paragraph id="H935A2D36423440D296CEFFC2C8E1944"><enum>(2)</enum><header>Exempt
			 Transportation funds</header><text display-inline="yes-display-inline">The
			 funds made available for the highway safety improvement programs authorized by
			 section 148 and chapter 4 of title 23, United States Code, shall not be subject
			 to transfer or consolidation under subsection (a).</text>
				</paragraph></subsection><subsection id="HAB89A7B5315A4F3C80DF7E30002428BB"><enum>(c)</enum><header>Federal
			 education funds</header><text>In applying subsection (a), a State may, in such
			 amounts as the State determines appropriate from any funds made available to
			 such State under any formula grant programs carried out under any of the
			 following provisions of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6301 et seq.), transfer or consolidate such funds between and among such
			 programs:</text>
				<paragraph id="HB55FB7CF126E41CE89226F5B636DEF9"><enum>(1)</enum><text display-inline="yes-display-inline">Part A of title I (Improving Basic Programs
			 Operated by Local Educational Agencies).</text>
				</paragraph><paragraph id="H9ED3F2EC31F44DC0AE464EFF9724FBF8"><enum>(2)</enum><text>Subpart 1 of part
			 B of title I (Reading First).</text>
				</paragraph><paragraph id="H1F3E5230749548519CF141B6D3E51BDA"><enum>(3)</enum><text>Subpart 3 of part
			 B of title I (William F. Goodling Even Start Family Literacy Programs).</text>
				</paragraph><paragraph id="HF1B9001A2C03450EB2A5DBB278939800"><enum>(4)</enum><text>Subpart 4 of part
			 B of title I (Improving Literacy Through School Libraries).</text>

				</paragraph></subsection><subsection id="H936B175256BD46C6ADF65597F597CD7D"><enum>(d)</enum><header>Job Training
			 funds</header><text>In applying subsection (a), a State may, in such amounts as
			 the State determines appropriate from any funds made available to such State
			 under the following job training programs, transfer or consolidate such funds
			 between and among such programs:</text>
				<paragraph id="HD6837DFA67A744B0AD2FDA001693EFD"><enum>(1)</enum><text display-inline="yes-display-inline">Any formula grant program carried out under
			 the Workforce Investment Act of 1998 (29 U.S.C. 2801 et seq.).</text>
				</paragraph><paragraph id="H7BD3B54B65534C569B11CD0CDB1D86F"><enum>(2)</enum><text>Any funds made
			 available to the State under part II of subchapter B of chapter 2 of title II
			 of the Trade Act of 1974 (19 U.S.C. 2295 et seq.).</text>
				</paragraph></subsection><subsection id="H9CBA707A6A3E4BCFBE3E4197BB99B447"><enum>(e)</enum><header>Definitions</header><text>In
			 this Act—</text>
				<paragraph id="H085C5861892941C5BCC1D86F2B5476B1"><enum>(1)</enum><text display-inline="yes-display-inline">the phrase <quote>economic growth at an
			 annual rate of less than 1 percent for 2 calendar quarters</quote> means, that
			 for 2 consecutive calendar quarters, real gross domestic product, as announced
			 by Bureau of Economic Analysis of the Department of Commerce, has
			 experienced—</text>
					<subparagraph id="H14DA3677DB744FB19B2636AFAEA342EE"><enum>(A)</enum><text>an annual rate of
			 decrease for such quarters;</text>
					</subparagraph><subparagraph id="H7A078EBB016342B4BC01BA77D8B7C95"><enum>(B)</enum><text display-inline="yes-display-inline">no change in the annual rate for such
			 quarters; or</text>
					</subparagraph><subparagraph id="H25776A09161349D1B799E74BEED70053"><enum>(C)</enum><text>an increase at an
			 annual rate of less than 1 percent for such quarters; and</text>
					</subparagraph></paragraph><paragraph id="H7E76EED042884FCA8F0041DACF893252"><enum>(2)</enum><text display-inline="yes-display-inline">the phrase <quote>economic growth at an
			 annual rate of 1 percent or more for 2 calendar quarters</quote> means an
			 increase in real gross domestic product at an annual rate of 1 percent or more
			 for 2 consecutive calendar quarters, as announced by the Bureau of Economic
			 Analysis of the Department of Commerce for such quarters.</text>
				</paragraph></subsection></section></legis-body>
