<subsection commented="no" display-inline="no-display-inline" id="H1CE6CEAE578949C8B6A661FE1943E3D9"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Federal law enforcement officer</header><text display-inline="yes-display-inline">In this section, the term <term>Federal law enforcement officer</term> includes a Federal law enforcement officer (as defined in section 115(c) of title 18, United States Code).</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HD39372006B044BDBB781319CA6860DC"><enum>(b)</enum><header display-inline="yes-display-inline">Authority To conduct investigations</header><text display-inline="yes-display-inline">Any Federal law enforcement officer shall have the authority to conduct an investigation relating to an alleged violation of this Act occurring within the jurisdiction of the United States.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB6AAD489B7814D3B9000E4A871DE91D7"><enum>(c)</enum><header display-inline="yes-display-inline">Criminal proceedings</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HA4BA06F34BEB44A5BCC457F009F1BFF"><enum>(1)</enum><header display-inline="yes-display-inline">Investigation</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H6DB2AD2669EC421FBB9E676CC37BFB9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Board may refer an alleged violation of section 1159 of title 18, United States Code, to any Federal law enforcement officer for appropriate investigation.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC2DBDA610C9047ED9E8CD8620044B43C"><enum>(B)</enum><header display-inline="yes-display-inline">Referral not required</header><text display-inline="yes-display-inline">A Federal law enforcement officer may investigate an alleged violation of section 1159 of that title regardless of whether the Federal law enforcement officer receives a referral under subparagraph (A).</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF33F4EC7F4124CD18CE1ECA0C4B239F3"><enum>(2)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">The findings of an investigation of an alleged violation of section 1159 of title 18, United States Code, by any Federal department or agency under paragraph (1)(A) shall be submitted, as appropriate, to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0999DF5612914EAF8496AE774F18018E"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal or State prosecuting authority; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7A9211F4E08647E9B5E3356E724BA119"><enum>(B)</enum><text display-inline="yes-display-inline">the Board.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFEF51AA6411A486EB1C6F583B8FA8453"><enum>(3)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">On receiving the findings of an investigation under paragraph (2), the Board may—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFE33D0F3577A443DB07BE2776BAAAC37"><enum>(A)</enum><text display-inline="yes-display-inline">recommend to the Attorney General that criminal proceedings be initiated under section 1159 of title 18, United States Code; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H795FBFE45ABA4E3B8DE4191D832C44B0"><enum>(B)</enum><text display-inline="yes-display-inline">provide such support to the Attorney General relating to the criminal proceedings as the Attorney General determines to be appropriate.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDFB167690AF14EBCB98BEB63005403F1"><enum>(d)</enum><header display-inline="yes-display-inline">Civil actions</header><text display-inline="yes-display-inline">In lieu of, or in addition to, any criminal proceeding under subsection (c), the Board may recommend that the Attorney General initiate a civil action under section 6.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HA603858BBDC24297B684CD176BE405C3"><enum>(b)</enum><header display-inline="yes-display-inline">Cause of action for misrepresentation</header><text display-inline="yes-display-inline">Section 6 of the Act entitled <quote>An Act to promote the development of Indian arts and crafts and to create a board to assist therein, and for other purposes</quote> (25 U.S.C. 305e) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HF2366392E5A94315B623AB81DA9A818"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (d);</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD8F75AF01E8B415C8100FAE5D2590066"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (a) through (c) as subsections (b) through (d), respectively;</text> </paragraph>

<subsection commented="no" display-inline="no-display-inline" id="HF47A3088A2FA4C8F8EEA577943ABDA49"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HFA48E8D603244F87BFCD3653E9F38EC8"><enum>(1)</enum><header display-inline="yes-display-inline">Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> means an individual that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5673B3B0C163481B8D76A8127DA12489"><enum>(A)</enum><text display-inline="yes-display-inline">is a member of an Indian tribe; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9EA5AAF6AE2244DEA74BF507A0029350"><enum>(B)</enum><text display-inline="yes-display-inline">is certified as an Indian artisan by an Indian tribe.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA431A09D1FC2435291DAB3DBA4343EE"><enum>(2)</enum><header display-inline="yes-display-inline">Indian product</header><text display-inline="yes-display-inline">The term <term>Indian product</term> has the meaning given the term in any regulation promulgated by the Secretary.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H12E888A6BAEB433998CAF7A9F0B3BCE9"><enum>(3)</enum><header display-inline="yes-display-inline">Indian tribe</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9409DF94CFEE4856B9AE949CE3D7180"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (25 U.S.C. 450b).</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF1E210330E3A4093A5CABCB0114D8406"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> includes, for purposes of this section only, an Indian group that has been formally recognized as an Indian tribe by—</text> 
<clause commented="no" display-inline="no-display-inline" id="H60E8D468339D4113B4C7F0C983B021D"><enum>(i)</enum><text display-inline="yes-display-inline">a State legislature;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H761DFD7FB9BD4E9089D436B2E56FE532"><enum>(ii)</enum><text display-inline="yes-display-inline">a State commission; or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H12BA7ADC1C99432685F2EFF09730E187"><enum>(iii)</enum><text display-inline="yes-display-inline">another similar organization vested with State legislative tribal recognition authority.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H40A0DE336EEA4108B868D7D082EBB8B"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H39DA7DD00C454961A53478ABC6AD031"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (b) (as redesignated by paragraph (2)), by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCF7AF23A0CF549D4BEFE85433605EBF"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (c) (as redesignated by paragraph (2))—</text>

<subsection commented="no" display-inline="no-display-inline" id="H2CC16E1F7B5F4A6F87FA3B4914F770DE"><enum>(d)</enum><header display-inline="yes-display-inline">Persons that may initiate civil actions</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H96437776FC3F4217B96D964598AFC886"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A civil action under subsection (b) may be initiated by—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H89F6E16FEAD4402BA3D3C91E585C8EEF"><enum>(A)</enum><text display-inline="yes-display-inline">the Attorney General, at the request of the Secretary acting on behalf of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H90E32288E2164302AF07A2C62115E92F"><enum>(i)</enum><text display-inline="yes-display-inline">an Indian tribe;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H97C3AD8E5AE24A4FB07EF6F1BE178DD0"><enum>(ii)</enum><text display-inline="yes-display-inline">an Indian; or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H22FFD4459D2F445CB313EC833DA4DE7F"><enum>(iii)</enum><text display-inline="yes-display-inline">an Indian arts and crafts organization;</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2FB2A25DBE24411C87B5262B9C67C0A9"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian tribe, acting on behalf of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H4E89D557C5574A149D8E172837C37EB2"><enum>(i)</enum><text display-inline="yes-display-inline">the Indian tribe;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H6C115318454D43BEA7CE67BA96F0896B"><enum>(ii)</enum><text display-inline="yes-display-inline">a member of that Indian tribe; or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H6354F7643DF74835B8FE1F9DA0D883E"><enum>(iii)</enum><text display-inline="yes-display-inline">an Indian arts and crafts organization;</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5D1EE9F42DFA47A80000CAAAA01ED00"><enum>(C)</enum><text display-inline="yes-display-inline">an Indian; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HBA7C0E4E1DAE458CA4CBE5F4945B2852"><enum>(D)</enum><text display-inline="yes-display-inline">an Indian arts and crafts organization.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBC1997BA4A9F4331AAA2BECEB81B4145"><enum>(2)</enum><header display-inline="yes-display-inline">Disposition of amounts recovered</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0F0ADDCED8244AF7A8F27E52D498855"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an amount recovered in a civil action under this section shall be paid to the Indian tribe, the Indian, or the Indian arts and crafts organization on the behalf of which the civil action was initiated.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H47DF67844D934024B3A0C5FC7020B1B6"><enum>(B)</enum><header display-inline="yes-display-inline">Exceptions</header> 
<clause commented="no" display-inline="no-display-inline" id="H75AB511A77D0468291E0273C7C702070"><enum>(i)</enum><header display-inline="yes-display-inline">Attorney General</header><text display-inline="yes-display-inline">In the case of a civil action initiated under paragraph (1)(A), the Attorney General may deduct from the amount—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HCFC573B2E0AC4C4EBE86D8B07FE66EE"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of the cost of the civil action and reasonable attorney’s fees awarded under subsection (c), to be deposited in the Treasury and credited to appropriations available to the Attorney General on the date on which the amount is recovered; and</text> </subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H0B577EE7F8EF4B7E9EA483CC33189301"><enum>(II)</enum><text display-inline="yes-display-inline">the amount of the costs of investigation awarded under subsection (c), to reimburse the Board for the activities of the Board relating to the civil action.</text> </subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H0620356F83744C13B073DE14C80DCF7"><enum>(ii)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">In the case of a civil action initiated under paragraph (1)(B), the Indian tribe may deduct from the amount—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H9EC6D18B36DE4305858DB9345BCAA2A2"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of the cost of the civil action; and</text> </subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H4506F9FB8BD64B3499478F12359100CE"><enum>(II)</enum><text display-inline="yes-display-inline">reasonable attorney’s fees.</text> </subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA82797361E5C434B92903C3B9DA1423D"><enum>(7)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>(e) In the event that</quote> and inserting the following:</text>

<section commented="no" display-inline="no-display-inline" id="H180FEFBB8CAF4FB900E462A28F87F8A9" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Misrepresentation of Indian produced goods and products</header><text display-inline="no-display-inline">Section 1159 of title 18, United States Code, is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAFC8ABD9A7CF4D63BDF808EB557F9247"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HD3696F3D96544082853B2CC4578CD8E0" style="OLC"> 
<subsection commented="no" display-inline="no-display-inline" id="H267202C9C14949CD00808680E72D692C"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person that knowingly violates subsection (a) shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H6559841BBB4C493C963036B738BDFB2"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a first violation by that person—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8A2FA2CBDE70403CBDC03CE7B870B3C"><enum>(A)</enum><text display-inline="yes-display-inline">if the applicable goods are offered or displayed for sale at a total price of $1,000 or more, or if the applicable goods are sold for a total price of $1,000 or more—</text> 
<clause commented="no" display-inline="no-display-inline" id="HEF8A1FA66C464C65ADFFF1119BD65F23"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an individual, be fined not more than $250,000, imprisoned for not more than 5 years, or both; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HB65FB0A190E943AAB8247B779CFEFEB4"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a person other than an individual, be fined not more than $1,000,000; and</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H66C9869DDA864D85817DB28D35B8B1A3"><enum>(B)</enum><text display-inline="yes-display-inline">if the applicable goods are offered or displayed for sale at a total price of less than $1,000, or if the applicable goods are sold for a total price of less than $1,000—</text> 
<clause commented="no" display-inline="no-display-inline" id="H2F0AB9BD1C654381AB1F4CDEBB81B26"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an individual, be fined not more than $25,000, imprisoned for not more than 1 year, or both; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H7F74CEA3D6254FBCB0709CFD3434F58D"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a person other than an individual, be fined not more than $100,000; and</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H141CD74CC8B5432CA24E7E96859547C5"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a subsequent violation by that person, regardless of the amount for which any good is offered or displayed for sale or sold—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF964622CAFFD49A8A2ABB717B4005020"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an individual, be fined under this title, imprisoned for not more than 15 years, or both; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC83F144D632448A783CF358500AE41E0"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a person other than an individual, be fined not more than $5,000,000.</text> </subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2EF82B69A578482999D5E8194807E639"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking paragraph (3) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H63DC53D2E2A04FEFB7A3852561101D22" style="OLC">

<paragraph id="H883A1CE11EE9475E9025202CF343F8F8"><enum>(4)</enum><text>the complicated jurisdictional scheme that exists in Indian country—</text>

<subparagraph id="H58A1A1BDAAA84FA5BB15B66DB8F83502"><enum>(B)</enum><text>has been increasingly exploited by criminals; and</text></subparagraph> 
<subparagraph id="HCA870EB1262C40FCA20D9228BA649E0D"><enum>(C)</enum><text>requires a high degree of commitment and cooperation among tribal, Federal, and State law enforcement officials;</text></subparagraph></paragraph> 
<paragraph id="HC58A36C6329A419CB487CBD1A7B1A1ED"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HECFC73E1653C48ACB5474A418B5752CE"><enum>(A)</enum><text>domestic and sexual violence against American Indian and Alaska Native women has reached epidemic proportions;</text></subparagraph> 
<subparagraph id="H0BB6F444547B40ECA9DBEC1A8AB0B740" indent="up1"><enum>(B)</enum><text>34 percent of American Indian and Alaska Native women will be raped in their lifetimes; and</text></subparagraph> 
<subparagraph id="H516B14AE7E164E4F822BFAB47D6D4B69" indent="up1"><enum>(C)</enum><text>39 percent of American Indian and Alaska Native women will be subject to domestic violence;</text></subparagraph></paragraph> 
<paragraph id="HA290B1F96C3843BEBF4E4BAE99EA576C"><enum>(6)</enum><text>Indian tribes have faced significant increases in instances of domestic violence, burglary, assault, and child abuse as a direct result of increased methamphetamine use on Indian reservations; and</text></paragraph> 
<paragraph id="HB4EA8A127CD24D2B95A7EF086E0F3C77"><enum>(7)</enum><text>crime data is a fundamental tool of law enforcement, but for decades the Bureau of Indian Affairs and the Department of Justice have not been able to coordinate or consistently report crime and prosecution rates in tribal communities.</text></paragraph></subsection> 
<subsection id="H3FBA670776B14CDB981167C472A31493"><enum>(b)</enum><header>Purposes</header><text>The purposes of this title are—</text> 
<paragraph id="H179CCE8B3416467592177785BAB9AC3B"><enum>(1)</enum><text>to clarify the responsibilities of Federal, State, tribal, and local governments with respect to crimes committed in Indian country;</text></paragraph> 
<paragraph id="H80E1339CED1347C1B94118D334918E07"><enum>(2)</enum><text>to increase coordination and communication among Federal, State, tribal, and local law enforcement agencies;</text></paragraph> 
<paragraph id="H70119EB786054A11B2C5DF9BF69BE989"><enum>(3)</enum><text>to empower tribal governments with the authority, resources, and information necessary to safely and effectively provide public safety in Indian country;</text></paragraph> 
<paragraph id="H60DBB01A13EA488382B77AE4BCCAF7AA"><enum>(4)</enum><text>to reduce the prevalence of violent crime in Indian country and to combat sexual and domestic violence against American Indian and Alaska Native women;</text></paragraph> 
<paragraph id="H0F0C6A02F37E458FAC3D8AA6A4FB3315"><enum>(5)</enum><text>to prevent drug trafficking and reduce rates of alcohol and drug addiction in Indian country; and</text></paragraph> 
<paragraph id="H194C5F793C91477D95B6157A0A372785"><enum>(6)</enum><text>to increase and standardize the collection of criminal data and the sharing of criminal history information among Federal, State, and tribal officials responsible for responding to and investigating crimes in Indian country.</text></paragraph></subsection></section>

<subsection id="H2B7F1824E31E4144AD5DBD5909865B96"><enum>(a)</enum><header>In general</header><text>In this title:</text> 
<paragraph id="H033F0140166C4374805262B79B56B7FB"><enum>(1)</enum><header>Indian country</header><text>The term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code.</text></paragraph> 
<paragraph id="H96AC531093ED4A5CA57A58A422AF6F8F"><enum>(2)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 479a).</text></paragraph>

<section id="HD92CE63D15E3446FABFA472D97B0557F"><enum>204.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title, an amendment made by this title, or the application of such a provision or amendment to any individual, entity, or circumstance, is determined by a court of competent jurisdiction to be invalid, the remaining provisions of this title, the remaining amendments made by this title, and the application of those provisions and amendments to individuals, entities, or circumstances other than the affected individual, entity, or circumstance shall not be affected.</text></section> 
<section id="H1DB81F5D363541CEA1D3F3281177E490"><enum>205.</enum><header>Jurisdiction of the State of Alaska</header><text display-inline="no-display-inline">Nothing in this Act limits, alters, expands, or diminishes the civil or criminal jurisdiction of the State of Alaska, any subdivision of the State of Alaska, or any Indian tribe in that State.</text></section> 
<section id="H88C5F4B43CD1450BA4E750807090531D"><enum>206.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act confers on an Indian tribe criminal jurisdiction over non-Indians.</text></section></title>

<paragraph id="HCD19EB7B032E4ED69EDC794584B879B3"><enum>(13)</enum><text>providing technical assistance and training to tribal law enforcement officials to gain access and input authority to utilize the National Criminal Information Center and other national crime information databases pursuant to section 534 of title 28, United States Code;</text></paragraph> 
<paragraph id="HF8C2E47C8C3E4991913BFE17E511184E"><enum>(14)</enum><text>in coordination with the Attorney General pursuant to subsection (g) of section 302 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3732), collecting, analyzing, and reporting data regarding Indian country crimes on an annual basis;</text></paragraph> 
<paragraph id="H09EBD7F5ED38466DBE19035596C1412F"><enum>(15)</enum><text>on an annual basis, sharing with the Department of Justice all relevant crime data, including Uniform Crime Reports, that the Office of Justice Services prepares and receives from tribal law enforcement agencies on a tribe-by-tribe basis to ensure that individual tribal governments providing data are eligible for programs offered by the Department of Justice;</text></paragraph> 
<paragraph id="H3D81D54AE02D4DF1A6C0618C22A893FA"><enum>(16)</enum><text>submitting to the appropriate committees of Congress, for each fiscal year, a detailed spending report regarding tribal public safety and justice programs that includes—</text>

<subparagraph id="HBAE8540A5D93463FA2D86ADC62CBCFB2"><enum>(C)</enum><text>a list of the unmet staffing needs of law enforcement, corrections, and court personnel (including indigent defense and prosecution staff) at tribal and Bureau of Indian Affairs justice agencies, the replacement and repair needs of tribal and Bureau corrections facilities, needs for tribal police and court facilities, and public safety and emergency communications and technology needs; and</text></subparagraph> 
<subparagraph id="H6DA2373192734D4891417285945442C2"><enum>(D)</enum><text>the formula, priority list or other methodology used to determine the method of disbursement of funds for the public safety and justice programs administered by the Office of Justice Services;</text></subparagraph></paragraph> 
<paragraph id="H216C730794D3481CADD0AE2E459FA581"><enum>(17)</enum><text>submitting to the appropriate committees of Congress, for each fiscal year, a report summarizing the technical assistance, training, and other support provided to tribal law enforcement and corrections agencies that operate relevant programs pursuant to self-determination contracts or self-governance compacts with the Secretary; and</text></paragraph> 
<paragraph id="H5D1728BB73AE45F0BDC52BA2510C1514"><enum>(18)</enum><text>promulgating regulations to carry out this Act, and routinely reviewing and updating, as necessary, the regulations contained in subchapter B of title 25, Code of Federal Regulations (or successor regulations).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<subsection id="H7A766CAFAAF7451F9E9888F9823A4604"><enum>(f)</enum><header>Long-term plan for tribal detention programs</header><text>Not later than 1 year after the date of enactment of this subsection, the Secretary, acting through the Bureau, in coordination with the Department of Justice and in consultation with tribal leaders, tribal courts, tribal law enforcement officers, and tribal corrections officials, shall submit to Congress a long-term plan to address incarceration in Indian country, including—</text> 
<paragraph id="HD81A59C52D224CFB9A9F2A72F8A91828"><enum>(1)</enum><text>a description of proposed activities for—</text> 
<subparagraph id="H3B872B7EB5B346A5AB32E8B9DA9E15F6"><enum>(A)</enum><text>the construction, operation, and maintenance of juvenile (in accordance with section 4220(a)(3) of the Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986 (25 U.S.C. 2453(a)(3)) and adult detention facilities (including regional facilities) in Indian country;</text></subparagraph> 
<subparagraph id="HC179E3601051464CA529632F7D6BA95D"><enum>(B)</enum><text>contracting with State and local detention centers, upon approval of affected tribal governments; and</text></subparagraph> 
<subparagraph id="HDFE81E5B9B7042338B4302741F8AB5D8"><enum>(C)</enum><text>alternatives to incarceration, developed in cooperation with tribal court systems;</text></subparagraph></paragraph> 
<paragraph id="H26C0D7170E3F40968E19E208167FDE2D"><enum>(2)</enum><text>an assessment and consideration of the construction of Federal detention facilities in Indian country; and</text></paragraph> 
<paragraph id="H46AB8FF098A94DE09FBA025BC580AAD7"><enum>(3)</enum><text>any other alternatives as the Secretary, in coordination with the Attorney General and in consultation with Indian tribes, determines to be necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HABC8FE7B215442F982AB2E781B2DE66A"><enum>(c)</enum><header>Law enforcement authority</header><text>Section 4 of the Indian Law Enforcement Reform Act (25 U.S.C. 2803) is amended—</text> 
<paragraph id="HEC7433773BB3466DA5ECB226AC2AE29D"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>), or</quote> and inserting <quote>or offenses processed by the Central Violations Bureau); or</quote>; and</text></paragraph> 
<paragraph id="HAFA4F07D9D87491692EFF5999749D262"><enum>(2)</enum><text>in paragraph (3)—</text>

<item id="HEC2C37FD090A4C3A9327E4A0D4614201"><enum>(bb)</enum><text>title IX of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (21 U.S.C. 862a et seq.); or</text></item> 
<item id="HC7901549D942436B9E5990934EBEADD3"><enum>(cc)</enum><text>section 731 of the USA PATRIOT Improvement and Reauthorization Act of 2005 (21 U.S.C. 865);</text></item></subclause> 
<subclause id="H3CFA4AC1B3DD4C83A1B1B36AED92F92A" indent="up1"><enum>(II)</enum><text>a misdemeanor firearms offense in violation of chapter 44 of title 18, United States Code;</text></subclause> 
<subclause id="HDBCB4CD8F1B7450DA1DBB0672332F220" indent="up1"><enum>(III)</enum><text>a misdemeanor assault in violation of chapter 7 of title 18, United States Code; or</text></subclause> 
<subclause id="HF3109406FBA24E5293D97F195EE5F6FF" indent="up1"><enum>(IV)</enum><text>a misdemeanor liquor trafficking offense in violation of chapter 59 of title 18, United States Code; and</text></subclause></clause> 
<clause id="H43DC8CAE3C7B45E3B01F455C839B15A5" indent="up1"><enum>(ii)</enum><text>the employee has probable cause to believe that the individual to be arrested has committed, or is committing, the crime;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> 
<section id="HC5348B238AC8456290C8F08F1200222B"><enum>212.</enum><header>Disposition reports</header><text display-inline="no-display-inline">Section 10 of the Indian Law Enforcement Reform Act (25 U.S.C. 2809) is amended by striking subsections (a) through (d) and inserting the following:</text>

<subsection id="H481B71C959F3415D972122E689608977"><enum>(a)</enum><header>Coordination and data collection</header> 
<paragraph id="H8B5B6B70AE1E4F67A2489A370171A1A9"><enum>(1)</enum><header>Investigative coordination</header><text>Subject to subsection (c), if a law enforcement officer or employee of any Federal department or agency terminates an investigation of an alleged violation of Federal criminal law in Indian country without referral for prosecution, the officer or employee shall coordinate with the appropriate tribal law enforcement officials regarding the status of the investigation and the use of evidence relevant to the case in a tribal court with authority over the crime alleged.</text></paragraph> 
<paragraph id="H94CF788F9013494693D32E5B59831834"><enum>(2)</enum><header>Investigation data</header><text>The Federal Bureau of Investigation shall compile, on an annual basis and by Field Division, information regarding decisions not to refer to an appropriate prosecuting authority cases in which investigations had been opened into an alleged crime in Indian country, including—</text> 
<subparagraph id="H2136EC0EBB05484F8A5D740EA9AED8BD"><enum>(A)</enum><text>the types of crimes alleged;</text></subparagraph> 
<subparagraph id="HB4E11BC310F24EE29A0EC0C2AF15233F"><enum>(B)</enum><text>the statuses of the accused as Indians or non-Indians;</text></subparagraph> 
<subparagraph id="H8C9C4E8D0B584F94B495EE9DA7F2D390"><enum>(C)</enum><text>the statuses of the victims as Indians or non-Indians; and</text></subparagraph> 
<subparagraph id="H6B0AB62898B44410BE61F79FAD3347C6"><enum>(D)</enum><text>the reasons for deciding against referring the investigation for prosecution.</text></subparagraph></paragraph> 
<paragraph id="H370CED1B2EFE4F8BAA2915486E46CF60"><enum>(3)</enum><header>Prosecutorial coordination</header><text>Subject to subsection (c), if a United States Attorney declines to prosecute, or acts to terminate prosecution of, an alleged violation of Federal criminal law in Indian country, the United States Attorney shall coordinate with the appropriate tribal justice officials regarding the status of the investigation and the use of evidence relevant to the case in a tribal court with authority over the crime alleged.</text></paragraph> 
<paragraph id="H0A67634F84CE43788C0F4D7DCD5331C6"><enum>(4)</enum><header>Prosecution data</header><text>The United States Attorney shall submit to the Native American Issues Coordinator to compile, on an annual basis and by Federal judicial district, information regarding all declinations of alleged violations of Federal criminal law that occurred in Indian country that were referred for prosecution by law enforcement agencies, including—</text> 
<subparagraph id="H650EB0E56ADD4FB79203D2167737AB2E"><enum>(A)</enum><text>the types of crimes alleged;</text></subparagraph> 
<subparagraph id="HEACC739E6A8349B99E36D059E2755A71"><enum>(B)</enum><text>the statuses of the accused as Indians or non-Indians;</text></subparagraph> 
<subparagraph id="HDECF0ACFCE654C3580B50094C3458D20"><enum>(C)</enum><text>the statuses of the victims as Indians or non-Indians; and</text></subparagraph> 
<subparagraph id="H72BA8215B7ED4C27B9EA83FDFA9672A3"><enum>(D)</enum><text>the reasons for deciding to decline or terminate the prosecutions.</text></subparagraph></paragraph></subsection> 
<subsection id="HBC7AFCACA2D84DDDBD88B78FB3B8F911"><enum>(b)</enum><header>Annual reports</header><text>The Attorney General shall submit to Congress annual reports containing, with respect to the applicable calendar year, the information compiled under paragraphs (2) and (4) of subsection (a)—</text> 
<paragraph id="H5E4C457CEE96427AB30EF3D32C1CACC0"><enum>(1)</enum><text>organized—</text> 
<subparagraph id="HB50763673D8244288BE5991AB979BD94"><enum>(A)</enum><text>in the aggregate; and</text></subparagraph> 
<subparagraph id="H5E9E8064610346F59CAEAD9ADA2ACFAC"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HE72420AF6C614E46B7F6EEB5128B108B"><enum>(i)</enum><text>for the Federal Bureau of Investigation, by Field Division; and</text></clause> 
<clause id="HCF413C10CF494B7E8462C88C2E6DD455" indent="up1"><enum>(ii)</enum><text>for United States Attorneys, by Federal judicial district; and</text></clause></subparagraph></paragraph> 
<paragraph id="HC195D45CC0274742B9E10139D885C7E5"><enum>(2)</enum><text>including any relevant explanatory statements.</text></paragraph></subsection> 
<subsection id="H0BCEC7BA232B4FEAA112FE695440A31F"><enum>(c)</enum><header>Effect of section</header> 
<paragraph id="HC8673BC0A0CC448CA8D56E1CB48C3590"><enum>(1)</enum><header>In general</header><text>Nothing in this section requires any Federal agency or official to transfer or disclose any confidential, privileged, or statutorily protected communication, information, or source to an official of any Indian tribe.</text></paragraph> 
<paragraph id="H8C7A035C5BC34DF6870D368ECC833FF3"><enum>(2)</enum><header>Federal Rules of Criminal Procedure</header><text>Nothing in this section affects or limits the requirements of Rule 6 of the Federal Rules of Criminal Procedure.</text></paragraph> 
<paragraph id="H16D05246DCD448868ED2D49BEB392EF4"><enum>(3)</enum><header>Regulations</header><text>The Attorney General shall establish, by regulation, standards for the protection of the confidential or privileged communications, information, and sources described in this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA7040962DC71497CA4AACCE061D04226"><enum>213.</enum><header>Prosecution of crimes in Indian country</header> 
<subsection id="HD832E29CECA9480582486D1C5941F7ED"><enum>(a)</enum><header>Appointment of special prosecutors</header> 
<paragraph id="HAAC851C7B9EE4068A60E145EF8EE9F30"><enum>(1)</enum><header>In general</header><text>Section 543 of title 28, United States Code, is amended—</text> 
<subparagraph id="H21BC64C273FE4ABCA4D435634093D00B"><enum>(A)</enum><text>in subsection (a), by inserting before the period at the end the following: <quote>, including the appointment of qualified tribal prosecutors and other qualified attorneys to assist in prosecuting Federal offenses committed in Indian country</quote>; and</text></subparagraph> 
<subparagraph id="H85D31F5B6A7C4055B72A56411D8DEFCF"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="H36BF45EF420E4423A84D4A3D60071FDF"><enum>(2)</enum><header>Sense of Congress regarding consultation</header><text>It is the sense of Congress that, in appointing attorneys under section 543 of title 28, United States Code, to serve as special prosecutors in Indian country, the Attorney General should consult with tribal justice officials of each Indian tribe that would be affected by the appointment.</text></paragraph></subsection> 
<subsection id="HB1FF527A4C204D439148DAAF13ADEF41"><enum>(b)</enum><header>Tribal liaisons</header> 
<paragraph id="HDA80022FC63B43A091184F377649BEA7"><enum>(1)</enum><header>In general</header><text>The Indian Law Enforcement Reform Act (25 U.S.C. 2801 et seq.) is amended by adding at the end the following:</text>

<section id="H7510C47671764C6EAFFD496377084B81"><enum>13.</enum><header>Assistant United States Attorney tribal liaisons</header> 
<subsection id="H820C5215A95542D7A8B852814B5AC671"><enum>(a)</enum><header>Appointment</header><text>The United States Attorney for each district that includes Indian country shall appoint not less than 1 assistant United States Attorney to serve as a tribal liaison for the district.</text></subsection> 
<subsection id="H873C87FAAE1C414B954DC3B9897610BB"><enum>(b)</enum><header>Duties</header><text>The duties of a tribal liaison shall include the following:</text> 
<paragraph id="H7F69413C8C19490BBF6001C1C4038080"><enum>(1)</enum><text>Coordinating the prosecution of Federal crimes that occur in Indian country.</text></paragraph> 
<paragraph id="HFD6074620A3842D6A5812FA07C5E6097"><enum>(2)</enum><text>Developing multidisciplinary teams to combat child abuse and domestic and sexual violence offenses against Indians.</text></paragraph> 
<paragraph id="H38FA7217824B4B479C6E74F309CD8110"><enum>(3)</enum><text>Consulting and coordinating with tribal justice officials and victims’ advocates to address any backlog in the prosecution of major crimes in Indian country in the district.</text></paragraph> 
<paragraph id="HF7441B08D18B40D18D260A7CD7B8AD83"><enum>(4)</enum><text>Developing working relationships and maintaining communication with tribal leaders, tribal community and victims’ advocates, and tribal justice officials to gather information from, and share appropriate information with, tribal justice officials.</text></paragraph> 
<paragraph id="H5C20EA27726348FFAD057999BC200B4E"><enum>(5)</enum><text>Coordinating with tribal prosecutors in cases in which a tribal government has concurrent jurisdiction over an alleged crime, in advance of the expiration of any applicable statute of limitation.</text></paragraph> 
<paragraph id="H6DAF7F9F10D74EB4BB4E59A63679DE58"><enum>(6)</enum><text>Providing technical assistance and training regarding evidence gathering techniques and strategies to address victim and witness protection to tribal justice officials and other individuals and entities that are instrumental to responding to Indian country crimes.</text></paragraph> 
<paragraph id="HC062000DBB3B442693E538E9E990AE29"><enum>(7)</enum><text>Conducting training sessions and seminars to certify special law enforcement commissions to tribal justice officials and other individuals and entities responsible for responding to Indian country crimes.</text></paragraph> 
<paragraph id="H77EF15EB4DFF4BC9945FCA49DDD38A83"><enum>(8)</enum><text>Coordinating with the Office of Tribal Justice, as necessary.</text></paragraph> 
<paragraph id="H860E53E4434A44D8B673EC27BE4274DF"><enum>(9)</enum><text>Conducting such other activities to address and prevent violent crime in Indian country as the applicable United States Attorney determines to be appropriate.</text></paragraph></subsection> 
<subsection id="HFBE76043791D43C9BBB10D38A48F523F"><enum>(c)</enum><header>Effect of section</header><text>Nothing in this section limits the authority of any United States Attorney to determine the duties of a tribal liaison officer to meet the needs of the Indian tribes located within the relevant Federal district.</text></subsection> 
<subsection id="HDB0C7D7052C44F6D9FD1D50E395490DE"><enum>(d)</enum><header>Enhanced prosecution of minor crimes</header> 
<paragraph id="HAFF76F79B0CB4F6195F056DE19056BBE"><enum>(1)</enum><header>In general</header><text>Each United States Attorney serving a district that includes Indian country is authorized and encouraged—</text> 
<subparagraph id="HFF1FBEE02D014BB994DA57B1CE4C5BF5"><enum>(A)</enum><text>to appoint Special Assistant United States Attorneys pursuant to section 543(a) of title 28, United States Code, to prosecute crimes in Indian country as necessary to improve the administration of justice, and particularly when—</text> 
<clause id="H8D4EF2C1E0CB49EDB5DA8E879D016EA1"><enum>(i)</enum><text>the crime rate exceeds the national average crime rate; or</text></clause> 
<clause id="H7D18F08FA3EF43E7847E72BFA466FDB7"><enum>(ii)</enum><text>the rate at which criminal offenses are declined to be prosecuted exceeds the national average declination rate;</text></clause></subparagraph> 
<subparagraph id="HA8E0AFE060724CABBB098A9332EF5554"><enum>(B)</enum><text>to coordinate with applicable United States district courts regarding scheduling of Indian country matters and holding trials or other proceedings in Indian country, as appropriate;</text></subparagraph> 
<subparagraph id="HB27CD63D993945E3A96C5723DFA6975F"><enum>(C)</enum><text>to provide to appointed Special Assistant United States Attorneys appropriate training, supervision, and staff support; and</text></subparagraph> 
<subparagraph id="H19E9A7B704094FE19892D95B5F9E1026"><enum>(D)</enum><text>to provide technical and other assistance to tribal governments and tribal court systems to ensure that the goals of this subsection are achieved.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H715A0D812D804165B658989FAA009ACF"><enum>(2)</enum><header display-inline="yes-display-inline">Sense of Congress regarding consultation</header><text display-inline="yes-display-inline">It is the sense of Congress that, in appointing Special Assistant United States Attorneys under this subsection, a United States Attorney should consult with tribal justice officials of each Indian tribe that would be affected by the appointment.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB5FEAF0067D24C23AC503AE4C890E041"><enum>(2)</enum><header>Sense of Congress regarding evaluations of tribal liaisons</header> 
<subparagraph id="H7A898BC4113540599D112BAEA71E721D"><enum>(A)</enum><header>Findings</header><text>Congress finds that—</text> 
<clause id="H9263311981BF4C21A261C38CD6DE0D62"><enum>(i)</enum><text>many residents of Indian country rely solely on United States Attorneys offices to prosecute felony and misdemeanor crimes occurring on Indian land; and</text></clause> 
<clause id="HE922A0BF802F4EE5A834F661FF929E01"><enum>(ii)</enum><text>tribal liaisons have dual obligations of—</text> 
<subclause id="H3A78067F4D84480591DB65474F5C21B4"><enum>(I)</enum><text>coordinating prosecutions of Indian country crime; and</text></subclause> 
<subclause id="H1EFE4E75079F49A09887847DB54F0968"><enum>(II)</enum><text>developing relationships with residents of Indian country and serving as a link between Indian country residents and the Federal justice process.</text></subclause></clause></subparagraph> 
<subparagraph id="HBCD750B1AFDE424DBC2F9E1A27151B31"><enum>(B)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Attorney General should—</text> 
<clause id="H6294898CB535460BA6846C9A300C2C81"><enum>(i)</enum><text>take all appropriate actions to encourage the aggressive prosecution of all Federal crimes committed in Indian country; and</text></clause> 
<clause id="H9AAFC08AE1BB41DC8E201BF6AC5BBE3A"><enum>(ii)</enum><text>when appropriate, take into consideration the dual responsibilities of tribal liaisons described in subparagraph (A)(ii) in evaluating the performance of the tribal liaisons.</text></clause></subparagraph></paragraph></subsection></section>

<paragraph id="H60DEDA31E2FE4F4BBDB4BC1A797CF827"><enum>(1)</enum><header>Definitions</header><text>Section 4 of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 (25 U.S.C. 3653) is amended—</text> 
<subparagraph id="H9CBCFAF0B3134AA2AF1CC4A226CBCA66"><enum>(A)</enum><text>by redesignating paragraphs (2) through (7) as paragraphs (3) through (8), respectively; and</text></subparagraph>

<subsection id="H1AB88F9D28BA40E6ADF0E1016EE74179"><enum>(b)</enum><header>Personnel and funding</header><text>The Attorney General shall provide to the Office of Tribal Justice such personnel and funds as are necessary to establish the Office of Tribal Justice as a component of the Department under subsection (a).</text></subsection> 
<subsection id="H0CF832A3768C4D0C957CF3CC427597B4"><enum>(c)</enum><header>Duties</header><text>The Office of Tribal Justice shall—</text> 
<paragraph id="H2272514BC29A4BC6BAE609315FBCD762"><enum>(1)</enum><text>serve as the program and legal policy advisor to the Attorney General with respect to the treaty and trust relationship between the United States and Indian tribes;</text></paragraph> 
<paragraph id="H3DEAA8E96ED54CA9B8A670CCE8F4B702"><enum>(2)</enum><text>serve as the point of contact for federally recognized tribal governments and tribal organizations with respect to questions and comments regarding policies and programs of the Department and issues relating to public safety and justice in Indian country; and</text></paragraph> 
<paragraph id="HBCFA6A9CBB93459D96509D129928AA7B"><enum>(3)</enum><text>coordinate with other bureaus, agencies, offices, and divisions within the Department of Justice to ensure that each component has an accountable process to ensure meaningful and timely consultation with tribal leaders in the development of regulatory policies and other actions that affect—</text>

<subparagraph id="H7D558528CB10429DB44B64452D93F290"><enum>(C)</enum><header>Training at State, tribal, and local academies</header><text>Law enforcement personnel of the Office of Justice Services or an Indian tribe may satisfy the training standards established under subparagraph (A) through training at a State or tribal police academy, a State, regional, local, or tribal college or university, or other training academy (including any program at a State, regional, local, or tribal college or university) that meets the appropriate Peace Officer Standards of Training.</text></subparagraph> 
<subparagraph id="H98525D34B80C44CBA0252E050F61E9B7"><enum>(D)</enum><header>Maximum age requirement</header><text>Pursuant to section 3307(e) of title 5, United States Code, the Secretary may employ as a law enforcement officer under section 4 any individual under the age of 47, if the individual meets all other applicable hiring requirements for the applicable law enforcement position.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<subparagraph id="HD44DF7CCFEF34561AB30A7E85E0AD749"><enum>(B)</enum><header>Timing</header><text>If a request for a background check is made by an Indian tribe that has contracted or entered into a compact for law enforcement or corrections services with the Bureau of Indian Affairs pursuant to the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (25 U.S.C. 450 et seq.), the Office of Justice Services shall complete the check not later than 60 days after the date of receipt of the request, unless an adequate reason for failure to respond by that date is provided to the Indian tribe in writing.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subparagraph id="H6331F73298864FDE9872AF2857F728FF"><enum>(B)</enum><header>Memoranda of agreement</header> 
<clause id="H570BF41E6B1F4781A25653F8B9220A0F"><enum>(i)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Tribal Law and Order Act of 2010</short-title>, the Secretary, in consultation with Indian tribes and tribal law enforcement agencies, shall develop minimum requirements to be included in special law enforcement commission agreements pursuant to this section.</text></clause> 
<clause id="H41CB9B1AFD3C461985049E5685AAE679"><enum>(ii)</enum><header>Substance of agreements</header><text>Each agreement entered into pursuant to this section shall reflect the status of the applicable certified individual as a Federal law enforcement officer under subsection (f), acting within the scope of the duties described in section 3(c).</text></clause> 
<clause id="H1AA6A0A14B7E46B6B2CB5A40BE87DF56"><enum>(iii)</enum><header>Agreement</header><text>Not later than 60 days after the date on which the Secretary determines that all applicable requirements under clause (i) are met, the Secretary shall offer to enter into a special law enforcement commission agreement with the Indian tribe.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H62C5F35B694147B2ABF0A152221F962D"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H03A618C5BBEC4529BA372C74E81E0083"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall establish, under the laws of the District of Columbia and in accordance with this title, a foundation, to be known as the <quote>Indian Law Enforcement Foundation</quote>.</text></paragraph> 
<paragraph id="H6E9E067E43F941449F4DBE31DEE0B8B6"><enum>(2)</enum><header>Funding determinations</header><text>No funds, gift, property, or other item of value (including any interest accrued on such an item) acquired by the Foundation shall—</text> 
<subparagraph id="H764AE776471547F6A9F23F367390DBF9"><enum>(A)</enum><text>be taken into consideration for purposes of determining Federal appropriations relating to the provision of public safety or justice services to Indians; or</text></subparagraph> 
<subparagraph id="H58B42A299DC24B94900049657EB19EF7"><enum>(B)</enum><text>otherwise limit, diminish, or affect the Federal responsibility for the provision of public safety or justice services to Indians.</text></subparagraph></paragraph></subsection> 
<subsection id="H375E764F905D4493A6DBCBCE528204C9"><enum>(b)</enum><header>Nature of corporation</header><text>The Foundation—</text> 
<paragraph id="H9EE2ACC62704466E95D55C6E0532816D"><enum>(1)</enum><text>shall be a charitable and nonprofit federally chartered corporation; and</text></paragraph> 
<paragraph id="H27748A2EEB424FA5B20D912E0112CB8B"><enum>(2)</enum><text>shall not be an agency or instrumentality of the United States.</text></paragraph></subsection> 
<subsection id="H714A75A95DFD4C6CB8BC93E165665D03"><enum>(c)</enum><header>Place of incorporation and domicile</header><text>The Foundation shall be incorporated and domiciled in the District of Columbia.</text></subsection> 
<subsection id="H6498C08D655747B4B92466F7A9F77A3C"><enum>(d)</enum><header>Duties</header><text>The Foundation shall—</text> 
<paragraph id="H4331996FD0A74BCC95292AEBE043DFD7"><enum>(1)</enum><text>encourage, accept, and administer, in accordance with the terms of each donation, private gifts of real and personal property, and any income from or interest in such gifts, for the benefit of, or in support of, public safety and justice services in American Indian and Alaska Native communities; and</text></paragraph> 
<paragraph id="H49809EC0C6FB4770B91687A01A0CB242"><enum>(2)</enum><text>assist the Office of Justice Services of the Bureau of Indian Affairs and Indian tribal governments in funding and conducting activities and providing education to advance and support the provision of public safety and justice services in American Indian and Alaska Native communities.</text></paragraph></subsection> 
<subsection id="H54D415A2B8FB4372A863F350E31EF79A"><enum>(e)</enum><header>Committee for the Establishment of the Indian Law Enforcement Foundation</header> 
<paragraph id="HAE67F36EE0974EEEBEEFBE1FCAE9843A"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a committee, to be known as the <quote>Committee for the Establishment of the Indian Law Enforcement Foundation</quote>, to assist the Secretary in establishing the Foundation.</text></paragraph> 
<paragraph id="H602E81E3166D4D30B7F6C716FFAF5022"><enum>(2)</enum><header>Duties</header><text>Not later than 180 days after the date of enactment of this section, the Committee shall—</text> 
<subparagraph id="H41B50AAB2F25472F926F3AE4A084619B"><enum>(A)</enum><text>carry out such activities as are necessary to incorporate the Foundation under the laws of the District of Columbia, including acting as incorporators of the Foundation;</text></subparagraph> 
<subparagraph id="HCF8841C34F244BA69B6F51B3D395F87B"><enum>(B)</enum><text>ensure that the Foundation qualifies for and maintains the status required to carry out this section, until the date on which the Board is established;</text></subparagraph> 
<subparagraph id="HBA1F91571FA8432897E5FAC220060A15"><enum>(C)</enum><text>establish the constitution and initial bylaws of the Foundation;</text></subparagraph> 
<subparagraph id="HCBB72AFCE65D4E279106ED719E5A9121"><enum>(D)</enum><text>provide for the initial operation of the Foundation, including providing for temporary or interim quarters, equipment, and staff; and</text></subparagraph> 
<subparagraph id="HF0DD5160AE714D77B6DBE6C18F4FAEA6"><enum>(E)</enum><text>appoint the initial members of the Board in accordance with the constitution and initial bylaws of the Foundation.</text></subparagraph></paragraph></subsection> 
<subsection id="H84689B68394C4B46B97CEBAB267A13FE"><enum>(f)</enum><header>Board of directors</header> 
<paragraph id="H68725DB971E24B2DB4C655F69F406859"><enum>(1)</enum><header>In general</header><text>The Board of Directors shall be the governing body of the Foundation.</text></paragraph> 
<paragraph id="HF414A15F72434838AC83878D1D4D166E"><enum>(2)</enum><header>Powers</header><text>The Board may exercise, or provide for the exercise of, the powers of the Foundation.</text></paragraph> 
<paragraph id="H428E91FEC10C4537BF911A9DCA595C70"><enum>(3)</enum><header>Selection</header> 
<subparagraph id="HB2234C703AE9433B87FB5505B17BC660"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the number of members of the Board, the manner of selection of the members (including the filling of vacancies), and the terms of office of the members shall be as provided in the constitution and bylaws of the Foundation.</text></subparagraph> 
<subparagraph id="H232A586BCEDB4FB690F7F98D24519790"><enum>(B)</enum><header>Requirements</header> 
<clause id="H93535F8D76084D149D968AFB261FF79C"><enum>(i)</enum><header>Number of members</header><text>The Board shall be composed of not less than 7 members.</text></clause> 
<clause id="H003E86F7BE054019BC53BCF0F389D1D1"><enum>(ii)</enum><header>Initial voting members</header><text>The initial voting members of the Board—</text> 
<subclause id="H75B01781DD1B44AB9B338B7EDB4E965B"><enum>(I)</enum><text>shall be appointed by the Committee not later than 180 days after the date on which the Foundation is established; and</text></subclause> 
<subclause id="H7EF53038803F43A5B394EA4D4E3A96CD"><enum>(II)</enum><text>shall serve for staggered terms.</text></subclause></clause> 
<clause id="HC17281B03D9348DA8F6FD17ACA43D462"><enum>(iii)</enum><header>Qualification</header><text>The members of the Board shall be United States citizens with knowledge or experience regarding public safety and justice in Indian and Alaska Native communities.</text></clause></subparagraph> 
<subparagraph id="H34A6E1E3A87340AB92885082AE0F17D0"><enum>(C)</enum><header>Compensation</header><text>A member of the Board shall not receive compensation for service as a member, but shall be reimbursed for actual and necessary travel and subsistence expenses incurred in the performance of the duties of the Foundation.</text></subparagraph></paragraph></subsection> 
<subsection id="H4D115F7D3CA74159B0592A870B5F0EA8"><enum>(g)</enum><header>Officers</header> 
<paragraph id="H93435A0EAB224D148CFBED0999378452"><enum>(1)</enum><header>In general</header><text>The officers of the Foundation shall be—</text> 
<subparagraph id="H401FB11AA0E7448A88D8491DFE196A36"><enum>(A)</enum><text>a Secretary, elected from among the members of the Board; and</text></subparagraph> 
<subparagraph id="H9FFE077D0CBE415F89AD6D2207E6E86A"><enum>(B)</enum><text>any other officers provided for in the constitution and bylaws of the Foundation.</text></subparagraph></paragraph> 
<paragraph id="H3CCCC488E3004DC68CB1A3E711D1F090"><enum>(2)</enum><header>Chief operating officer</header> 
<subparagraph id="HD202E4FAED0D48C88CE2A62553319C46"><enum>(A)</enum><header>Secretary</header><text>Subject to subparagraph (B), the Secretary of the Foundation may serve, at the direction of the Board, as the chief operating officer of the Foundation.</text></subparagraph> 
<subparagraph id="H3B44845D96D6479086CC4CF494678147"><enum>(B)</enum><header>Appointment</header><text>The Board may appoint a chief operating officer in lieu of the Secretary of the Foundation under subparagraph (A), who shall serve at the direction of the Board.</text></subparagraph></paragraph> 
<paragraph id="H3B02E8F08CD741E39E0FB40BA6EF4C88"><enum>(3)</enum><header>Election</header><text>The manner of election, term of office, and duties of the officers of the Foundation shall be as provided in the constitution and bylaws of the Foundation.</text></paragraph></subsection> 
<subsection id="H9C80873343F647E7ACAF842721EE27D6"><enum>(h)</enum><header>Powers</header><text>The Foundation—</text> 
<paragraph id="HCD1DFA29A1064493ABF724D7E1F20E85"><enum>(1)</enum><text>shall adopt a constitution and bylaws for the management of the property of the Foundation and the regulation of the affairs of the Foundation;</text></paragraph> 
<paragraph id="H3AFBAE3ADE62472399D7E896592D60EB"><enum>(2)</enum><text>may adopt and alter a corporate seal;</text></paragraph> 
<paragraph id="H8C34339B29DF463F9095F6DE999C950B"><enum>(3)</enum><text>may enter into contracts;</text></paragraph> 
<paragraph id="H8CE462857E48456AB89C7B7DCB5E8C4A"><enum>(4)</enum><text>may acquire (through gift or otherwise), own, lease, encumber, and transfer real or personal property as necessary or convenient to carry out the purposes of the Foundation;</text></paragraph> 
<paragraph id="H007E8E5FB5024F9BB40D39B5ED425739"><enum>(5)</enum><text>may sue and be sued; and</text></paragraph> 
<paragraph id="HDB4929D216EB4C88B86983A541799B6C"><enum>(6)</enum><text>may perform any other act necessary and proper to carry out the purposes of the Foundation.</text></paragraph></subsection> 
<subsection id="H16163D85215C4B86B1E7A12ACCF1E351"><enum>(i)</enum><header>Principal office</header> 
<paragraph id="H288C2E8E996A44DB9A8EB5E07312F6A1"><enum>(1)</enum><header>In general</header><text>The principal office of the Foundation shall be located in the District of Columbia.</text></paragraph> 
<paragraph id="H03ECCCD31B834FD4A7AA3F87EE590F00"><enum>(2)</enum><header>Activities; offices</header><text>The activities of the Foundation may be conducted, and offices may be maintained, throughout the United States in accordance with the constitution and bylaws of the Foundation.</text></paragraph></subsection> 
<subsection id="H297A7B9C899B478A89148A7D6532362B"><enum>(j)</enum><header>Service of process</header><text>The Foundation shall comply with the law on service of process of each State in which the Foundation is incorporated and of each State in which the Foundation carries on activities.</text></subsection> 
<subsection id="H2D83B5F269D046768E8BD8CF85D902E2"><enum>(k)</enum><header>Liability of officers, employees, and agents</header> 
<paragraph id="HC1E7222E01D84C4CA94937E76EFCD8AC"><enum>(1)</enum><header>In general</header><text>The Foundation shall be liable for the acts of the officers, employees, and agents of the Foundation acting within the scope of the authority of the officers, employees, and agents.</text></paragraph> 
<paragraph id="HC0E0D44CEB004A7DA951BEC3618CA2F6"><enum>(2)</enum><header>Personal liability</header><text>A member of the Board shall be personally liable only for gross negligence in the performance of the duties of the member.</text></paragraph></subsection> 
<subsection id="H84296C524558418EB2CEB3AE9B1C55EB"><enum>(l)</enum><header>Restrictions</header> 
<paragraph id="HBF35E9E074BA4C6292196C3B146AF150"><enum>(1)</enum><header>Limitation on spending</header><text>Beginning with the fiscal year following the first full fiscal year during which the Foundation is in operation, the administrative costs of the Foundation shall not exceed the percentage described in paragraph (2) of the sum of—</text> 
<subparagraph id="HF2431205E95C4114B1548050E7988659"><enum>(A)</enum><text>the amounts transferred to the Foundation under subsection (n) during the preceding fiscal year; and</text></subparagraph> 
<subparagraph id="H39766EF5A89C45069AFE987B8159C39B"><enum>(B)</enum><text>donations received from private sources during the preceding fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H3B5A3DB73A0B4EC4BBFEAE38C856840B"><enum>(2)</enum><header>Percentages</header><text>The percentages referred to in paragraph (1) are—</text> 
<subparagraph id="H245828357069407FA1A6194E7C6E74A3"><enum>(A)</enum><text>for the first 2 fiscal years described in that paragraph, 25 percent;</text></subparagraph> 
<subparagraph id="H53BDC3CA23A14779978BC1F95D131AE5"><enum>(B)</enum><text>for the following fiscal year, 20 percent; and</text></subparagraph> 
<subparagraph id="H51263890FB0342119871363CBC9D8BD2"><enum>(C)</enum><text>for each fiscal year thereafter, 15 percent.</text></subparagraph></paragraph> 
<paragraph id="HE1E18A87691D48A0BE85A6B5353AFBB9"><enum>(3)</enum><header>Appointment and hiring</header><text>The appointment of officers and employees of the Foundation shall be subject to the availability of funds.</text></paragraph> 
<paragraph id="HC7F180DD1B2B4BA9A71732B60F7B2DDD"><enum>(4)</enum><header>Status</header><text>A member of the Board or officer, employee, or agent of the Foundation shall not by reason of association with the Foundation be considered to be an officer, employee, or agent of the United States.</text></paragraph></subsection> 
<subsection id="H6ED03C714F9045EC9C25BD2C85E33B37"><enum>(m)</enum><header>Audits</header><text>The Foundation shall comply with section 10101 of title 36, United States Code, as if the Foundation were a corporation under part B of subtitle II of that title.</text></subsection> 
<subsection id="HC1E6A0B3D44D4F42A1515803A05459E5"><enum>(n)</enum><header>Funding</header><text>For each of fiscal years 2011 through 2015, out of any unobligated amounts available to the Secretary, the Secretary may use to carry out this section not more than $500,000.</text></subsection></section> 
<section id="H06B6A9562A4849E290C01F52F65405C5"><enum>703.</enum><header>Administrative services and support</header> 
<subsection id="H80FC40BF992649E189B5B41E9252AA9A"><enum>(a)</enum><header>Provision of support by Secretary</header><text>Subject to subsection (b), during the 5-year period beginning on the date on which the Foundation is established, the Secretary—</text> 
<paragraph id="HAEEE45A526AD478E90C82F8565993ADD"><enum>(1)</enum><text>may provide personnel, facilities, and other administrative support services to the Foundation;</text></paragraph> 
<paragraph id="H49C12F8837D14C0DA7D31CA543E76E54"><enum>(2)</enum><text>may provide funds for initial operating costs and to reimburse the travel expenses of the members of the Board; and</text></paragraph> 
<paragraph id="H3D2F3D973A944B3EBAB8E65A92A4C484"><enum>(3)</enum><text>shall require and accept reimbursements from the Foundation for—</text> 
<subparagraph id="HE8C317AB50A24B1CADE972C25928261B"><enum>(A)</enum><text>services provided under paragraph (1); and</text></subparagraph> 
<subparagraph id="H40B32F1C75DE4D69B1E550A141F197EC"><enum>(B)</enum><text>funds provided under paragraph (2).</text></subparagraph></paragraph></subsection> 
<subsection id="HCFBEF97CCA5041129FBEDBF5F8DD10A0"><enum>(b)</enum><header>Reimbursement</header><text>Reimbursements accepted under subsection (a)(3)—</text> 
<paragraph id="H638E561E3C054F8295049934B0ABB997"><enum>(1)</enum><text>shall be deposited in the Treasury of the United States to the credit of the applicable appropriations account; and</text></paragraph> 
<paragraph id="HF1F8927BB8924A4997DC27366A9C2615"><enum>(2)</enum><text>shall be chargeable for the cost of providing services described in subsection (a)(1) and travel expenses described in subsection (a)(2).</text></paragraph></subsection> 
<subsection id="HEDA995C1274746989E569386B330C31B"><enum>(c)</enum><header>Continuation of certain services</header><text>The Secretary may continue to provide facilities and necessary support services to the Foundation after the termination of the 5-year period specified in subsection (a) if the facilities and services are—</text> 
<paragraph id="HB2687AC7244C4FFBB579DF9B8AD581A3"><enum>(1)</enum><text>available; and</text></paragraph> 
<paragraph id="H6F78591CBA194287BEA57ECCB61715BB"><enum>(2)</enum><text>provided on reimbursable cost basis.</text></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8A382DFCEE8445399B891ABF79B60547"><enum>(d)</enum><header>Technical amendments</header><text>The Indian Self-Determination and Education Assistance Act is amended—</text> 
<paragraph id="H824889D661944C798C62717D29D78160"><enum>(1)</enum><text>by redesignating title V (25 U.S.C. 458bbb et seq.) as title VIII and moving the title so as to appear at the end of the Act;</text></paragraph> 
<paragraph id="H6618DAED448F41AC81C0AAA60B55917B"><enum>(2)</enum><text>by redesignating sections 501, 502, and 503 (25 U.S.C. 458bbb, 458bbb–1, 458bbb–2) as sections 801, 802, and 803, respectively; and</text></paragraph> 
<paragraph id="H76E2943C6D974424A663112E987CEC72"><enum>(3)</enum><text>in subsection (a)(2) of section 802 and paragraph (2) of section 803 (as redesignated by paragraph (2)), by striking <quote>section 501</quote> and inserting <quote>section 801</quote>.</text></paragraph></subsection> 
<subsection id="H4DC20FF8E42741DF9BD4EEF9086DFB09"><enum>(e)</enum><header>Acceptance and assistance</header><text>Section 5 of the Indian Law Enforcement Reform Act (25 U.S.C. 2804) is amended by adding at the end the following:</text>

<paragraph id="HB3342EA07F7B45C7A1E9C112F6464DED"><enum>(1)</enum><text>a Federal, tribal, State, or other government agency; or</text></paragraph> 
<paragraph id="H4A3A97CD6F314AAB9D4D35156842B495"><enum>(2)</enum><text>the Indian Law Enforcement Foundation established under section 701(a) of the Indian Self-Determination and Education Assistance Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H836535803DC74624BE3DEE6F8C173430"><enum>232.</enum><header>Drug enforcement in Indian country</header> 
<subsection id="HCACC29DC6ABA4BDA8A124C55F4EB2123"><enum>(a)</enum><header>Education and research programs</header><text>Section 502 of the Controlled Substances Act (21 U.S.C. 872) is amended in subsections (a)(1) and (c), by inserting <quote> tribal,</quote> after <quote>State,</quote> each place it appears.</text></subsection> 
<subsection id="HC9C3A880AED441B28BA3E9E9E0AD1600"><enum>(b)</enum><header>Public-private education program</header><text>Section 503 of the Comprehensive Methamphetamine Control Act of 1996 (21 U.S.C. 872a) is amended—</text>

<subsection id="HCA34ACBA5E254E54B3A52F04AB800C06"><enum>(c)</enum><header>Cooperative arrangements</header><text>Section 503 of the Controlled Substances Act (21 U.S.C. 873) is amended—</text>

<subsection id="H21FD869DA5944DDCB17C24847330F974"><enum>(e)</enum><header>Effect of grants</header><text>Nothing in this section or any amendment made by this section—</text> 
<paragraph id="H353A485185324401A93E13ADFA7E77EA"><enum>(1)</enum><text>allows the grant to be made to, or used by, an entity for law enforcement activities that the entity lacks jurisdiction to perform; or</text></paragraph> 
<paragraph id="H88EE4EB65675492A9249ECB52D7E1E6A"><enum>(2)</enum><text>has any effect other than to authorize, award, or deny a grant of funds to a federally recognized Indian tribe for the purposes described in the relevant grant program.</text></paragraph></subsection></section> 
<section id="H157D49EA770B4FA39FAFEA128376C2D1"><enum>233.</enum><header>Access to national criminal information databases</header> 
<subsection id="H26CB3904ACFF4773A35D4CAF959B04DE"><enum>(a)</enum><header>Access to national criminal information databases</header><text>Section 534 of title 28, United States Code, is amended—</text> 
<paragraph id="HCCA48E8D07B84835ABE562F46ADA7E01"><enum>(1)</enum><text>in subsection (a)(4), by inserting <quote>Indian tribes,</quote> after <quote>the States,</quote>;</text></paragraph> 
<paragraph id="HDF77E9E5782E42439703998BF6712028"><enum>(2)</enum><text>by striking subsection (d) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1DB37B3F1FA0421591E24FD100042289" style="OLC"> 
<subsection id="H851B236CC5DE47B3BDBFDD49A7BE53A2"><enum>(d)</enum><header>Indian law enforcement agencies</header><text>The Attorney General shall permit tribal and Bureau of Indian Affairs law enforcement agencies—</text> 
<paragraph id="H48645B54475F4EF28AF433F85565EC62"><enum>(1)</enum><text>to access and enter information into Federal criminal information databases; and</text></paragraph> 
<paragraph id="H3A0CF581153F4007AE7E987F810A3067"><enum>(2)</enum><text>to obtain information from the databases.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8302FB384DC24203B39AD52C59A7F39D"><enum>(3)</enum><text>by redesignating the second subsection (e) as subsection (f); and</text></paragraph> 
<paragraph id="H3FC8D3F64ECA4669A18AC558C88AA22A"><enum>(4)</enum><text>in paragraph (2) of subsection (f) (as redesignated by paragraph (3)), in the matter preceding subparagraph (A), by inserting <quote>, tribal,</quote> after <quote>Federal</quote>.</text></paragraph></subsection> 
<subsection id="H18CE3DE4F92741A5B56A55F47F055CFC"><enum>(b)</enum><header>Requirement</header> 
<paragraph id="H965614F3971D4F798B39D1D3984C20AC"><enum>(1)</enum><header>In general</header><text>The Attorney General shall ensure that tribal law enforcement officials that meet applicable Federal or State requirements be permitted access to national crime information databases.</text></paragraph> 
<paragraph id="HA4433FC6EA1C4ED69269B1F6055D36D3"><enum>(2)</enum><header>Sanctions</header><text>For purpose of sanctions for noncompliance with requirements of, or misuse of, national crime information databases and information obtained from those databases, a tribal law enforcement agency or official shall be treated as Federal law enforcement agency or official.</text></paragraph> 
<paragraph id="H226959CDB5BD4574B576443581CFB3D1"><enum>(3)</enum><header>NCIC</header><text>Each tribal justice official serving an Indian tribe with criminal jurisdiction over Indian country shall be considered to be an authorized law enforcement official for purposes of access to the National Crime Information Center of the Federal Bureau of Investigation.</text></paragraph></subsection></section> 
<section id="H46DCC13CFFEA4B8392B2D8A34BC66F8F"><enum>234.</enum><header>Tribal court sentencing authority</header> 
<subsection id="H5D56E2D90C554E1E94188D321D8B6318"><enum>(a)</enum><header>Individual rights</header><text display-inline="yes-display-inline">Section 202 of the Indian Civil Rights Act of 1968 (25 U.S.C. 1302), is amended—</text> 
<paragraph id="HB01B1FE89A9D43E391C34E1E8C087B57"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>No Indian tribe</quote> and inserting the following:</text>

<subparagraph id="H95767705AEB64CFD8334859A48BB0C0C" indent="up1"><enum>(C)</enum><text>subject to subsection (b), impose for conviction of any 1 offense any penalty or punishment greater than imprisonment for a term of 3 years or a fine of $15,000, or both; or</text></subparagraph> 
<subparagraph id="H9F14883A2EF24D5593263FB14655D14F" indent="up1"><enum>(D)</enum><text>impose on a person in a criminal proceeding a total penalty or punishment greater than imprisonment for a term of 9 years;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H18FAD224AF03450EA08CD0AE76EB657A"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2E1F9160E73D41559BDA5D3919EE34FC" style="OLC"> 
<subsection id="HFCDDD33C2CE94DE9AE8850EA132980E9"><enum>(b)</enum><header>Offenses subject to greater than 1-year imprisonment or a fine greater than $5,000</header><text>A tribal court may subject a defendant to a term of imprisonment greater than 1 year but not to exceed 3 years for any 1 offense, or a fine greater than $5,000 but not to exceed $15,000, or both, if the defendant is a person accused of a criminal offense who—</text> 
<paragraph id="H2AA99AAA42F94B76B48759B1F70B0EB2"><enum>(1)</enum><text>has been previously convicted of the same or a comparable offense by any jurisdiction in the United States; or</text></paragraph> 
<paragraph id="H2AF85316249A4982A61EF7C63E8C1471"><enum>(2)</enum><text>is being prosecuted for an offense comparable to an offense that would be punishable by more than 1 year of imprisonment if prosecuted by the United States or any of the States.</text></paragraph></subsection> 
<subsection id="H769398AB1AC24A5E84CDFE9E771EB927"><enum>(c)</enum><header>Rights of defendants</header><text>In a criminal proceeding in which an Indian tribe, in exercising powers of self-government, imposes a total term of imprisonment of more than 1 year on a defendant, the Indian tribe shall—</text> 
<paragraph id="H54AED56E5DE247458CA1CE26ADF4841B"><enum>(1)</enum><text>provide to the defendant the right to effective assistance of counsel at least equal to that guaranteed by the United States Constitution; and</text></paragraph> 
<paragraph id="H0AA03CBB3BDD4C9D80B1A433D684A33D"><enum>(2)</enum><text>at the expense of the tribal government, provide an indigent defendant the assistance of a defense attorney licensed to practice law by any jurisdiction in the United States that applies appropriate professional licensing standards and effectively ensures the competence and professional responsibility of its licensed attorneys;</text></paragraph> 
<paragraph id="H3757DDE3725B40AA8089724FAB4502B8"><enum>(3)</enum><text>require that the judge presiding over the criminal proceeding—</text> 
<subparagraph id="H3B167E6B03B6484380AFA472F3CFF5C4"><enum>(A)</enum><text>has sufficient legal training to preside over criminal proceedings; and</text></subparagraph> 
<subparagraph id="HF47AB5A49F9D495F873F0ED1BCC9DB6F"><enum>(B)</enum><text>is licensed to practice law by any jurisdiction in the United States;</text></subparagraph></paragraph> 
<paragraph id="H9B1F41C0B21646FAAD900D5F66A141A5"><enum>(4)</enum><text>prior to charging the defendant, make publicly available the criminal laws (including regulations and interpretative documents), rules of evidence, and rules of criminal procedure (including rules governing the recusal of judges in appropriate circumstances) of the tribal government; and</text></paragraph> 
<paragraph id="H56AF3FB5AFE4435BAF47FB67E141279C"><enum>(5)</enum><text>maintain a record of the criminal proceeding, including an audio or other recording of the trial proceeding.</text></paragraph></subsection> 
<subsection id="H624EB6D81F284FBB908D4F7B40582960"><enum>(d)</enum><header>Sentences</header><text>In the case of a defendant sentenced in accordance with subsections (b) and (c), a tribal court may require the defendant—</text> 
<paragraph id="HD213C91F30134F54BAB6BF6AE1B3D0EA"><enum>(1)</enum><text>to serve the sentence—</text> 
<subparagraph id="H9B078192FCAD4BACB594F516D0387581"><enum>(A)</enum><text>in a tribal correctional center that has been approved by the Bureau of Indian Affairs for long-term incarceration, in accordance with guidelines to be developed by the Bureau of Indian Affairs (in consultation with Indian tribes) not later than 180 days after the date of enactment of the <short-title>Tribal Law and Order Act of 2010</short-title>;</text></subparagraph> 
<subparagraph id="H3B0194E8A01342ECB78C8F21D0DCD456"><enum>(B)</enum><text>in the nearest appropriate Federal facility, at the expense of the United States pursuant to the Bureau of Prisons tribal prisoner pilot program described in section 304(c) of the <short-title>Tribal Law and Order Act of 2010</short-title>;</text></subparagraph> 
<subparagraph id="HDD7228866BC4444AA72215561EE5AD58"><enum>(C)</enum><text>in a State or local government-approved detention or correctional center pursuant to an agreement between the Indian tribe and the State or local government; or</text></subparagraph> 
<subparagraph id="H831E6578AFF545F8A3A36FFD1541D542"><enum>(D)</enum><text>in an alternative rehabilitation center of an Indian tribe; or</text></subparagraph></paragraph> 
<paragraph id="H245403249DED47B5A43B1A77CF4C5E5C"><enum>(2)</enum><text>to serve another alternative form of punishment, as determined by the tribal court judge pursuant to tribal law.</text></paragraph></subsection> 
<subsection id="HC621C73FA2DC4339A39AA2896BF074EB"><enum>(e)</enum><header>Definition of offense</header><text>In this section, the term <term>offense</term> means a violation of a criminal law.</text></subsection> 
<subsection id="H4482D434644D4B23A4FE4125F0ACEEDB"><enum>(f)</enum><header>Effect of section</header><text>Nothing in this section affects the obligation of the United States, or any State government that has been delegated authority by the United States, to investigate and prosecute any criminal violation in Indian country.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE6CBE591C37D47DBB3DAA35E1C4325EA"><enum>(b)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Attorney General, in coordination with the Secretary of the Interior, shall submit a report to the appropriate committees of Congress that includes—</text> 
<paragraph id="H92C7CE37472D4D9F924DEA52EBCD0A0A"><enum>(1)</enum><text>a description of the effectiveness of enhanced tribal court sentencing authority in curtailing violence and improving the administration of justice on Indian lands; and</text></paragraph> 
<paragraph id="HC8ACCDDC5ED64550B0DB210D210A5FC3"><enum>(2)</enum><text>a recommendation of whether enhanced sentencing authority should be discontinued, enhanced, or maintained at the level authorized under this title.</text></paragraph></subsection> 
<subsection id="H65E52C6094CA4D2C8F26E625252C0BF0"><enum>(c)</enum><header>Bureau of prisons tribal prisoner pilot program</header> 
<paragraph id="H4CF1F93E7F8D4F5882E0D1E8E4F3B9A2"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this title, the Director of the Bureau of Prisons shall establish a pilot program under which the Bureau of Prisons shall accept offenders convicted in tribal court pursuant to section 202 of the Indian Civil Rights Act of 1968 (25 U.S.C. 1302) (as amended by this section), subject to the conditions described in paragraph (2).</text></paragraph> 
<paragraph id="HCC8914EDD44F4790A911CB3533D443A7"><enum>(2)</enum><header>Conditions</header> 
<subparagraph id="H4B6B1338FE6348CCB1EE607747A37CA5"><enum>(A)</enum><header>In general</header><text>As a condition of participation in the pilot program described in paragraph (1), the tribal court shall submit to the Attorney General a request for confinement of the offender, for approval by the Attorney General (or a designee) by not later than 30 days after the date of submission.</text></subparagraph> 
<subparagraph id="H23E4CA4E3C7E4C7A8FDC46C2BEF4CB5D"><enum>(B)</enum><header>Limitations</header><text>Requests for confinement shall be limited to offenders convicted of a violent crime (comparable to the violent crimes described in section 1153(a) of title 18, United States Code) for which the sentence includes a term of imprisonment of 2 or more years.</text></subparagraph> 
<subparagraph id="HE5771BE50FAF4FBF912C931AEF27F486"><enum>(C)</enum><header>Custody conditions</header><text>The imprisonment by the Bureau of Prisons shall be subject to the conditions described in section 5003 of title 18, United States Code, regarding the custody of State offenders, except that the offender shall be placed in the nearest available and appropriate Federal facility, and imprisoned at the expense of the United States.</text></subparagraph> 
<subparagraph id="HF73D126DC55E40F692464BC6EF95C1AA"><enum>(D)</enum><header>Cap</header><text>The Bureau of Prisons shall confine not more than 100 tribal offenders at any time.</text></subparagraph></paragraph> 
<paragraph id="HBC28C38D7B1942A9A3E55BAD8A4E105F"><enum>(3)</enum><header>Rescinding requests</header> 
<subparagraph id="HF110491C80374E0CBE6AF8A2EE9BC76A"><enum>(A)</enum><header>In general</header><text>The applicable tribal government shall retain the authority to rescind the request for confinement of a tribal offender by the Bureau of Prisons under this paragraph at any time during the sentence of the offender.</text></subparagraph> 
<subparagraph id="HAFAA465FC38E4E98AFB64B841AA601CB"><enum>(B)</enum><header>Return to tribal custody</header><text>On rescission of a request under subparagraph (A), a tribal offender shall be returned to tribal custody.</text></subparagraph></paragraph> 
<paragraph id="HA12BE36A53BD4761A9DDED53000DDA30"><enum>(4)</enum><header>Reassessment</header><text>If tribal court demand for participation in this pilot program exceeds 100 tribal offenders, a representative of the Bureau of Prisons shall notify Congress.</text></paragraph> 
<paragraph id="HA7F4E227A30F4C04A1D880C6ED928DB9"><enum>(5)</enum><header>Report</header><text>Not later than 3 years after the date of establishment of the pilot program, the Attorney General shall submit to Congress a report describing the status of the program, including recommendations regarding the future of the program, if any.</text></paragraph> 
<paragraph id="HC530EA82CCFF46ECAD5DDE006AF2A811"><enum>(6)</enum><header>Termination</header><text>Except as otherwise provided by an Act of Congress, the pilot program under this paragraph shall expire on the date that is 4 years after the date on which the program is established.</text></paragraph></subsection> 
<subsection id="H37BA35CAE6E44AAE86CCAB08F67A0EDC"><enum>(d)</enum><header>Grants and contracts</header><text>Section 1007(b) of the Economic Opportunity Act of 1964 (42 U.S.C. 2996f(b)) is amended by striking paragraph (2) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE6A7FE9EB33B4FCCB34582CD5F5592B8" style="OLC"> 
<paragraph id="H4F5310A7E3B34BDB8B5BF16F1346E562"><enum>(2)</enum><text>to provide legal assistance with respect to any criminal proceeding, except to provide assistance to a person charged with an offense in an Indian tribal court;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H2A13F052DCF84A09A0ECFD2866735CD8"><enum>235.</enum><header>Indian Law and Order Commission</header><text display-inline="no-display-inline">The Indian Law Enforcement Reform Act (25 U.S.C. 2801 et seq.) (as amended by section 214(b)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H01852A12CA25444FA862FA92C9150977" style="OLC"> 
<section id="HC94EA92F27BD46B7BA274BBB994D782D"><enum>15.</enum><header>Indian Law and Order Commission</header> 
<subsection id="H873157C63FCC43A8B4795366FE69B728"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the Indian Law and Order Commission (referred to in this section as the <quote>Commission</quote>).</text></subsection> 
<subsection id="HA53E7C9BAFA84EBBB057F84F9101E6F8"><enum>(b)</enum><header>Membership</header> 
<paragraph id="HB5D8600EDBD14B798A07FA221F434011"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of 9 members, of whom—</text> 
<subparagraph id="H18614458D6D044D88C70B34CF6C1B248"><enum>(A)</enum><text>3 shall be appointed by the President, in consultation with—</text> 
<clause id="H7E9D78435D2D47758D6EB25D05EBBCBA"><enum>(i)</enum><text>the Attorney General; and</text></clause> 
<clause id="H08BC1F99D83B41A29EC3EA94817E56EE"><enum>(ii)</enum><text>the Secretary;</text></clause></subparagraph> 
<subparagraph id="H4732286B8EB14AB091F84D7571AF92AB"><enum>(B)</enum><text>2 shall be appointed by the Majority Leader of the Senate, in consultation with the Chairpersons of the Committees on Indian Affairs and the Judiciary of the Senate;</text></subparagraph> 
<subparagraph id="H79C74DA4318D4EA6935803337646C0E9"><enum>(C)</enum><text>1 shall be appointed by the Minority Leader of the Senate, in consultation with the Vice Chairperson and Ranking Member of the Committees on Indian Affairs and the Judiciary of the Senate;</text></subparagraph> 
<subparagraph id="H9BA5D2BF2EE446E1994358583EAB75BE"><enum>(D)</enum><text>2 shall be appointed by the Speaker of the House of Representatives, in consultation with the Chairpersons of the Committees on the Judiciary and Natural Resources of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HABD05BE9B1D74BB496FEFAA0DA43212E"><enum>(E)</enum><text>1 shall be appointed by the Minority Leader of the House of Representatives, in consultation with the Ranking Members of the Committees on the Judiciary and Natural Resources of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="H08F8633C602B436CB0A0B9BB3730282A"><enum>(2)</enum><header>Requirements for eligibility</header><text>Each member of the Commission shall have significant experience and expertise in—</text> 
<subparagraph id="HF8C9395FAA1B47DC807C39FE1DA4C70E"><enum>(A)</enum><text>the Indian country criminal justice system; and</text></subparagraph> 
<subparagraph id="H65F0A7AB44AE47B59C96F08D88BBB92F"><enum>(B)</enum><text>matters to be studied by the Commission.</text></subparagraph></paragraph> 
<paragraph id="H708B6B580B1A46FEB719A5A338FE8619"><enum>(3)</enum><header>Consultation required</header><text>The President, the Speaker and Minority Leader of the House of Representatives, and the Majority Leader and Minority Leader of the Senate shall consult before the appointment of members of the Commission under paragraph (1) to achieve, to the maximum extent practicable, fair and equitable representation of various points of view with respect to the matters to be studied by the Commission.</text></paragraph> 
<paragraph id="H9D98BEE9A9C64C76A05D67D2325E2A0E"><enum>(4)</enum><header>Term</header><text>Each member shall be appointed for the life of the Commission.</text></paragraph> 
<paragraph id="H5F75DCF7F7CD4F72B19606D5C732BED4"><enum>(5)</enum><header>Time for initial appointments</header><text>The appointment of the members of the Commission shall be made not later than 60 days after the date of enactment of this Act.</text></paragraph> 
<paragraph id="HEE6EBB609F6247C6B95FCD336A27D9B0"><enum>(6)</enum><header>Vacancies</header><text>A vacancy in the Commission shall be filled—</text> 
<subparagraph id="H84A3E9340AAB4692B0037B31027B2DC2"><enum>(A)</enum><text>in the same manner in which the original appointment was made; and</text></subparagraph> 
<subparagraph id="H51C38EB102724F7F826FCC72255C22EC"><enum>(B)</enum><text>not later than 60 days after the date on which the vacancy occurred.</text></subparagraph></paragraph></subsection> 
<subsection id="HF0F21899E43C4CF2946FFB730C1762E0"><enum>(c)</enum><header>Operation</header> 
<paragraph id="HA60EC39696034902BD3915041B66B277"><enum>(1)</enum><header>Chairperson</header><text>Not later than 15 days after the date on which all members of the Commission have been appointed, the Commission shall select 1 member to serve as Chairperson of the Commission.</text></paragraph> 
<paragraph id="HE7F3234A0745475198FA4D49E3F62FB6"><enum>(2)</enum><header>Meetings</header> 
<subparagraph id="HF286B1872E7248D58C98C23451F70287"><enum>(A)</enum><header>In general</header><text>The Commission shall meet at the call of the Chairperson.</text></subparagraph> 
<subparagraph id="H583D7AB0B41240A3B3B5680DDEE1997C"><enum>(B)</enum><header>Initial meeting</header><text>The initial meeting shall take place not later than 30 days after the date described in paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="H398CB466BB81433084E08A2FA1BFA44C"><enum>(3)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph> 
<paragraph id="HF14CE650CAA54A429DC7523967DD19C7"><enum>(4)</enum><header>Rules</header><text>The Commission may establish, by majority vote, any rules for the conduct of Commission business, in accordance with this Act and other applicable law.</text></paragraph></subsection> 
<subsection id="H48C49E2B2B9047B6B238D717E534401D"><enum>(d)</enum><header>Comprehensive study of criminal justice system relating to Indian country</header><text>The Commission shall conduct a comprehensive study of law enforcement and criminal justice in tribal communities, including—</text> 
<paragraph id="HF93FE5BF283948C3A40072F625044B05"><enum>(1)</enum><text>jurisdiction over crimes committed in Indian country and the impact of that jurisdiction on—</text> 
<subparagraph id="H46601D4521154D20BE0F841948867267"><enum>(A)</enum><text>the investigation and prosecution of Indian country crimes; and</text></subparagraph> 
<subparagraph id="HF003106719A643F3A25032E4C1B48FDE"><enum>(B)</enum><text>residents of Indian land;</text></subparagraph></paragraph> 
<paragraph id="H10544254C7204213971647C1449552D4"><enum>(2)</enum><text>the tribal jail and Federal prisons systems and the effect of those systems with respect to—</text> 
<subparagraph id="H2654EE86A1444959B508F8DB3ADFCBAF"><enum>(A)</enum><text>reducing Indian country crime; and</text></subparagraph> 
<subparagraph id="H6058BD3D178440AE86A7170FE7356D99"><enum>(B)</enum><text>rehabilitation of offenders;</text></subparagraph></paragraph> 
<paragraph id="HDC0F6FB592B14A66922F7119DB624B66"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H630B23C4A9AF48758FD0052BA9E9AFAA"><enum>(A)</enum><text>tribal juvenile justice systems and the Federal juvenile justice system as relating to Indian country; and</text></subparagraph> 
<subparagraph id="HA16CD7FC74CD4C31B4A6EC13FC500583" indent="up1"><enum>(B)</enum><text>the effect of those systems and related programs in preventing juvenile crime, rehabilitating Indian youth in custody, and reducing recidivism among Indian youth;</text></subparagraph></paragraph> 
<paragraph id="H775BDA64A7214EC5A51CE480DDDC35F1"><enum>(4)</enum><text>the impact of the Indian Civil Rights Act of 1968 (25 U.S.C. 1301 et seq.) on—</text> 
<subparagraph id="H61830F742D914DAAAC7F53F6866AAAAD"><enum>(A)</enum><text>the authority of Indian tribes;</text></subparagraph> 
<subparagraph id="H71C30DA29C4F4E89BF15A5581287565A"><enum>(B)</enum><text>the rights of defendants subject to tribal government authority; and</text></subparagraph> 
<subparagraph id="HAB4D9A99052845C6BCDFB395F6B82A9A"><enum>(C)</enum><text>the fairness and effectiveness of tribal criminal systems; and</text></subparagraph></paragraph> 
<paragraph id="H929D78AE5B644BD7A8124BE9620E46DE"><enum>(5)</enum><text>studies of such other subjects as the Commission determines relevant to achieve the purposes of the <short-title>Tribal Law and Order Act of 2010</short-title>.</text></paragraph></subsection> 
<subsection id="HD9BCE410B8364970980FEC5E52BEC0C5"><enum>(e)</enum><header>Recommendations</header><text>Taking into consideration the results of the study under paragraph (1), the Commission shall develop recommendations on necessary modifications and improvements to justice systems at the tribal, Federal, and State levels, including consideration of—</text> 
<paragraph id="H56E59A6BE033479D90FAC4B8F508B9F7"><enum>(1)</enum><text>simplifying jurisdiction in Indian country;</text></paragraph> 
<paragraph id="H65524B9AA4FE41BD89B5C261AC71A147"><enum>(2)</enum><text>improving services and programs—</text> 
<subparagraph id="H58BDEA960CF14765B0D748BAF4371AA1"><enum>(A)</enum><text>to prevent juvenile crime on Indian land;</text></subparagraph> 
<subparagraph id="HC12AE15642B346A9AC3E06303795B4E8"><enum>(B)</enum><text>to rehabilitate Indian youth in custody; and</text></subparagraph> 
<subparagraph id="H8B102B53C25E4523B18D329406394D7C"><enum>(C)</enum><text>to reduce recidivism among Indian youth;</text></subparagraph></paragraph> 
<paragraph id="H187AAFB81C104D8DB12B6EDA0FFE9400"><enum>(3)</enum><text>adjustments to the penal authority of tribal courts and exploring alternatives to incarceration;</text></paragraph> 
<paragraph id="H41D13EF9C0954A478E589BB7ABDEEF84"><enum>(4)</enum><text>the enhanced use of chapter 43 of title 28, United States Code (commonly known as <quote>the Federal Magistrates Act</quote>) in Indian country;</text></paragraph> 
<paragraph id="H99BF4FABCA1F4DD28E54EF217B08CDFD"><enum>(5)</enum><text>effective means of protecting the rights of victims and defendants in tribal criminal justice systems (including defendants incarcerated for a period of less than 1 year);</text></paragraph> 
<paragraph id="H85DF871A45C0499EA1DFFF20CFC6C5CE"><enum>(6)</enum><text>changes to the tribal jails and Federal prison systems; and</text></paragraph> 
<paragraph id="H583A5252E5524B798A98744E029B64E3"><enum>(7)</enum><text>other issues that, as determined by the Commission, would reduce violent crime in Indian country.</text></paragraph></subsection> 
<subsection id="HD2410F9DB45E429E83A9BB48CFC1DB8C"><enum>(f)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Commission shall submit to the President and Congress a report that contains—</text> 
<paragraph id="H38B0ACF539B340E7B97DFFB95D1CE547"><enum>(1)</enum><text>a detailed statement of the findings and conclusions of the Commission; and</text></paragraph> 
<paragraph id="H298BCB597C9F4569ABE521363A011D97"><enum>(2)</enum><text>the recommendations of the Commission for such legislative and administrative actions as the Commission considers to be appropriate.</text></paragraph></subsection> 
<subsection id="H780D896E9E474763B5C5F3003A68B3B5"><enum>(g)</enum><header>Powers</header> 
<paragraph id="H97A47E813ED04AFE9C131D950F0026CB"><enum>(1)</enum><header>Hearings</header> 
<subparagraph id="HCEA64D65FA0F4E1FBA18D6F4D9DD4B03"><enum>(A)</enum><header>In general</header><text>The Commission may hold such hearings, meet and act at such times and places, take such testimony, and receive such evidence as the Commission considers to be advisable to carry out the duties of the Commission under this section.</text></subparagraph> 
<subparagraph id="HA0A7A2DC2376460CBA779FFA1322B2E8"><enum>(B)</enum><header>Public requirement</header><text>The hearings of the Commission under this paragraph shall be open to the public.</text></subparagraph></paragraph> 
<paragraph id="H32FFC4362DBB4139BD020D228736D459"><enum>(2)</enum><header>Witness expenses</header> 
<subparagraph id="HA3E1574280694CCCAE820B3F268F49EC"><enum>(A)</enum><header>In general</header><text>A witness requested to appear before the Commission shall be paid the same fees and allowances as are paid to witnesses under section 1821 of title 28, United States Code.</text></subparagraph> 
<subparagraph id="HB4CA4A849B964DD08996CEED5AF8829B"><enum>(B)</enum><header>Per diem and mileage</header><text>The fees and allowances for a witness shall be paid from funds made available to the Commission.</text></subparagraph></paragraph>

<subparagraph id="HE395B34572184D4EA599827CCB1CDECC"><enum>(A)</enum><header>In general</header><text>The Commission may secure directly from a Federal agency such information as the Commission considers to be necessary to carry out this section.</text></subparagraph> 
<subparagraph id="H9A577E5C46E84163850A40382DEB3807"><enum>(B)</enum><header>Tribal and State agencies</header><text>The Commission may request the head of any tribal or State agency to provide to the Commission such information as the Commission considers to be necessary to carry out this section.</text></subparagraph></paragraph> 
<paragraph id="H408D9C38FC5E48AC8F6104C8A0D10C56"><enum>(4)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</text></paragraph> 
<paragraph id="H40ED8820C97B49ACBA7E8D564EE65EC9"><enum>(5)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></paragraph></subsection> 
<subsection id="HBC831C7C4C3F41A3A66B95806337E06E"><enum>(h)</enum><header>Commission personnel matters</header> 
<paragraph id="H9A5EF7D388B5448D974EF7C60FB34499"><enum>(1)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of chapter 57 of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text></paragraph> 
<paragraph id="H1BAD22FF70A84BA39C3572E13DC1D4C9"><enum>(2)</enum><header>Detail of Federal employees</header><text>On the affirmative vote of <fraction>2/3</fraction> of the members of the Commission and the approval of the appropriate Federal agency head, an employee of the Federal Government may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status, benefits, or privileges.</text></paragraph> 
<paragraph id="H544437F0184647B1920B30A7890DCC88"><enum>(3)</enum><header>Procurement of temporary and intermittent services</header><text>On request of the Commission, the Attorney General shall provide to the Commission, on a reimbursable basis, reasonable and appropriate office space, supplies, and administrative assistance.</text></paragraph></subsection> 
<subsection id="H2379AA5743684F5F9BA0FA32B33559B7"><enum>(i)</enum><header>Contracts for research</header> 
<paragraph id="HFF39AB3F65FE4E3D8187FE7BF8AD4FDC"><enum>(1)</enum><header>Researchers and experts</header> 
<subparagraph id="HE861F70D39A5404C9E2178A36B13086D"><enum>(A)</enum><header>In general</header><text>On an affirmative vote of <fraction>2/3</fraction> of the members of the Commission, the Commission may select nongovernmental researchers and experts to assist the Commission in carrying out the duties of the Commission under this section.</text></subparagraph> 
<subparagraph id="H970420518083436DB9F2B906560620BD"><enum>(B)</enum><header>National Institute of Justice</header><text>The National Institute of Justice may enter into a contract with the researchers and experts selected by the Commission under subparagraph (A) to provide funding in exchange for the services of the researchers and experts.</text></subparagraph></paragraph> 
<paragraph id="H96E67FBF7F5748D8AD7C75386A125230"><enum>(2)</enum><header>Other organizations</header><text>Nothing in this subsection limits the ability of the Commission to enter into contracts with any other entity or organization to carry out research necessary to carry out the duties of the Commission under this section.</text></paragraph></subsection> 
<subsection id="H3989C4F664DC4E4A917A3AE40B13D424"><enum>(j)</enum><header>Tribal Advisory Committee</header> 
<paragraph id="HB304E3AFE7AD4A40AAD8CCBE0746A9A3"><enum>(1)</enum><header>Establishment</header><text>The Commission shall establish a committee, to be known as the <quote>Tribal Advisory Committee</quote>.</text></paragraph> 
<paragraph id="H0F5758A327E744C1900A83E3F39725A0"><enum>(2)</enum><header>Membership</header> 
<subparagraph id="H6863140E8BFB4FEF99907E984AE65D79"><enum>(A)</enum><header>Composition</header><text>The Tribal Advisory Committee shall consist of 2 representatives of Indian tribes from each region of the Bureau of Indian Affairs.</text></subparagraph> 
<subparagraph id="HFB94B93266E34E12B062FCCEB1F88394"><enum>(B)</enum><header>Qualifications</header><text>Each member of the Tribal Advisory Committee shall have experience relating to—</text> 
<clause id="H02F0ACF9AEFE48C49275D963A18F3506"><enum>(i)</enum><text>justice systems;</text></clause> 
<clause id="H54995F867D284F3D99D47CE27060F931"><enum>(ii)</enum><text>crime prevention; or</text></clause> 
<clause id="H0038CD2EF9F14CF79902DEB4A5A3D268"><enum>(iii)</enum><text>victim services.</text></clause></subparagraph></paragraph> 
<paragraph id="H2C4DAB48E1254C81AF33E8E7313A1140"><enum>(3)</enum><header>Duties</header><text>The Tribal Advisory Committee shall—</text> 
<subparagraph id="H6CECBA2D64E74342BCE82D8E6F2E1052"><enum>(A)</enum><text>serve as an advisory body to the Commission; and</text></subparagraph> 
<subparagraph id="H602BEA4A480E4EA59FF8D58F9C740266"><enum>(B)</enum><text>provide to the Commission advice and recommendations, submit materials, documents, testimony, and such other information as the Commission determines to be necessary to carry out the duties of the Commission under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="HDB11E75AA90D4565B005026C8BC26920"><enum>(k)</enum><header>Funding</header><text>For the fiscal year after the date of enactment of the <short-title>Tribal Law and Order Act of 2010</short-title>, out of any unobligated amounts available to the Secretary of the Interior or the Attorney General, the Secretary or the Attorney General may use to carry out this section not more than $2,000,000.</text></subsection> 
<subsection id="HF020B3CA8BA14B2FA9D26EB58BE0BB28"><enum>(l)</enum><header>Termination of commission</header><text>The Commission shall terminate 90 days after the date on which the Commission submits the report of the Commission under subsection (f).</text></subsection> 
<subsection id="H201B173B3B8E46AD9F0E02CD7A0D2449"><enum>(m)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<clause id="HB976D4C006424AC4A661FC17ECC214DA"><enum>(iv)</enum><text>provides technical assistance to the affected agencies to establish effective and permanent interagency communication and coordination; and</text></clause> 
<clause id="H6FACEB9E365743CEB13124D224052E3B"><enum>(v)</enum><text>determines whether collaboration is feasible, cost-effective, and within agency capability.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause>

<paragraph id="HB9A7C02F908F4A8682967E38D8E107A6"><enum>(2)</enum><header>Youth-related training</header><text>Any training provided to Bureau of Indian Affairs or tribal law enforcement or judicial personnel under paragraph (1) shall include training in issues relating to youth alcohol and substance abuse prevention and treatment.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>

<paragraph id="H1E2CC18708034A03B76B93E8D24DFEB6"><enum>(2)</enum><header>Priority of funding</header><text>In providing grants to Indian tribal governments under this subsection, the Attorney General shall take into consideration reservation crime rates and tribal law enforcement staffing needs of each Indian tribal government.</text></paragraph> 
<paragraph id="HE30D5DD630C048BA9179F0CC635E4444"><enum>(3)</enum><header>Federal share</header><text>Because of the Federal nature and responsibility for providing public safety on Indian land, the Federal share of the cost of any activity carried out using a grant under this subsection—</text> 
<subparagraph id="HB7C667E15321437CB383296F1DA97795"><enum>(A)</enum><text>shall be 100 percent; and</text></subparagraph> 
<subparagraph id="H420E5D180DA049EBAEFB0AFE7A8CBEBB"><enum>(B)</enum><text>may be used to cover indirect costs.</text></subparagraph></paragraph> 
<paragraph id="HEABFAC0F458C458DA8DA2DF17197ADEF"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $40,000,000 for each of fiscal years 2011 through 2015.</text></paragraph></subsection> 
<subsection id="H4BC1AB5990CA4C8486742BE8AD1B6D71"><enum>(k)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this subsection, the Attorney General shall submit to Congress a report describing the extent and effectiveness of the Community Oriented Policing (COPS) initiative as applied in Indian country, including particular references to—</text> 
<paragraph id="H37DBE20A08B44F2EBD1C4285AF9B5EB8"><enum>(1)</enum><text>the problem of intermittent funding;</text></paragraph> 
<paragraph id="H2676A7A278AB432FBFD403EDD8342467"><enum>(2)</enum><text>the integration of COPS personnel with existing law enforcement authorities; and</text></paragraph> 
<paragraph id="HBC49DCE5FF0045139F5710886357B115"><enum>(3)</enum><text>an explanation of how the practice of community policing and the broken windows theory can most effectively be applied in remote tribal locations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subsection id="H45A74F6EB1344805BFC80F1F8ACA5C14"><enum>(a)</enum><header>In general</header><text>Section 20109 of the Violent Crime Control and Law Enforcement Act of 1994 (42 U.S.C. 13709) is amended by striking subsection (a) and inserting the following:</text>

<paragraph id="H86A22F6CA730490C851AE4209DB24B40"><enum>(1)</enum><header>In general</header><text>Section 20109 of the Violent Crime Control and Law Enforcement Act of 1994 (42 U.S.C. 13709) is amended by striking subsection (b) and inserting the following:</text>

<subsection id="H4B1C355A26424F49B205A6BAB2F62586"><enum>(b)</enum><header>Grants to indian tribes</header> 
<paragraph id="H87FFCDF5C937455981C39F485A396E2E"><enum>(1)</enum><header>In general</header><text>From the amounts reserved under subsection (a), the Attorney General shall provide grants—</text> 
<subparagraph id="H952D7F9088FC4C3E8E17E70876C82929"><enum>(A)</enum><text>to Indian tribes for purposes of—</text> 
<clause id="H04546693EE924528A1B24323E2B922B1"><enum>(i)</enum><text>construction and maintenance of jails on Indian land for the incarceration of offenders subject to tribal jurisdiction;</text></clause> 
<clause id="H96D3BE46C3D44BA6855C906C6928E643"><enum>(ii)</enum><text>entering into contracts with private entities to increase the efficiency of the construction of tribal jails; and</text></clause> 
<clause id="HB38C59C9912349B3A4AD72101C95821C"><enum>(iii)</enum><text>developing and implementing alternatives to incarceration in tribal jails;</text></clause></subparagraph> 
<subparagraph id="HD72B769974854A12815D39DBDCA2A9BC"><enum>(B)</enum><text>to Indian tribes for the construction of tribal justice centers that combine tribal police, courts, and corrections services to address violations of tribal civil and criminal laws;</text></subparagraph> 
<subparagraph id="HFC7CD89543B2434FBD524AAC31B4CD9B"><enum>(C)</enum><text>to consortia of Indian tribes for purposes of constructing and operating regional detention centers on Indian land for long-term incarceration of offenders subject to tribal jurisdiction, as the applicable consortium determines to be appropriate.</text></subparagraph></paragraph> 
<paragraph id="HDC8C451FE09A43CF82B4F9A8A4422161"><enum>(2)</enum><header>Priority of funding</header><text>in providing grants under this subsection, the Attorney General shall take into consideration applicable—</text> 
<subparagraph id="HCEFD8014523B4328AC4FB3E047DEB236"><enum>(A)</enum><text>reservation crime rates;</text></subparagraph> 
<subparagraph id="HC81844187CA64A5B920519CE05B48071"><enum>(B)</enum><text>annual tribal court convictions; and</text></subparagraph> 
<subparagraph id="H17BDB6D095A6445CA04524634B7F843E"><enum>(C)</enum><text>bed space needs.</text></subparagraph></paragraph> 
<paragraph id="H2C9FD0772A0A4062A0CE528A3FFD0A73"><enum>(3)</enum><header>Federal share</header><text>Because of the Federal nature and responsibility for providing public safety on Indian land, the Federal share of the cost of any activity carried out using a grant under this subsection shall be 100 percent.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H77BD071B02264CFEA23F532C828ECC66"><enum>(2)</enum><header>Conforming amendment</header><text>Section 20109(c) of the Violent Crime Control and Law Enforcement Act of 1994 (42 U.S.C. 13709(c)) is amended by inserting <quote>or consortium of Indian tribes, as applicable,</quote> after <quote>Indian tribe</quote>.</text></paragraph> 
<paragraph id="H74E4CB63C01B4D33BDFC61DE8DC2BDDA"><enum>(3)</enum><header>Long-term plan</header><text>Section 20109 of the Violent Crime Control and Law Enforcement Act of 1994 (42 U.S.C. 13709) is amended by adding at the end the following:</text>

<subsection id="H77E27EA11B924B05ADFC623258501DDD"><enum>(d)</enum><header>Long-term plan</header><text>Not later than 1 year after the date of enactment of this subsection, the Attorney General, in coordination with the Bureau of Indian Affairs and in consultation with tribal leaders, tribal law enforcement officers, and tribal corrections officials, shall submit to Congress a long-term plan to address incarceration in Indian country, including—</text> 
<paragraph id="HF8312D058E754207BF72BA7532F1B7D5"><enum>(1)</enum><text>a description of proposed activities for—</text> 
<subparagraph id="H634F81CB78544831A849C568AC9C0C9F"><enum>(A)</enum><text>construction, operation, and maintenance of juvenile (in accordance with section 4220(a)(3) of the Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986 (25 U.S.C. 2453(a)(3)) and adult detention facilities (including regional facilities) in Indian country;</text></subparagraph> 
<subparagraph id="H53DF05E7182C4C3F8A037916EC78EC00"><enum>(B)</enum><text>contracting with State and local detention centers, on approval of the affected tribal governments; and</text></subparagraph> 
<subparagraph id="H113CA60ABAD54AABA34814DE49C429E8"><enum>(C)</enum><text>alternatives to incarceration, developed in cooperation with tribal court systems;</text></subparagraph></paragraph> 
<paragraph id="H4DACD14AEEC04F9A982BB476688AE9D4"><enum>(2)</enum><text>an assessment and consideration of the construction of Federal detention facilities in Indian country; and</text></paragraph> 
<paragraph id="H9AE3D650E4DF48B5B77849EEF52ACC64"><enum>(3)</enum><text>any other alternatives as the Attorney General, in coordination with the Bureau of Indian Affairs and in consultation with Indian tribes, determines to be necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HFF9F670418734F3FB7C74622D6EDBF00"><enum>245.</enum><header>Tribal probation office liaison program</header><text display-inline="no-display-inline">Title II of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 (25 U.S.C. 3681 et seq.) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB7D0A7C3408C4142AC5F636A8287E35E" style="OLC"> 
<section id="H8EF924AFDD884590BE74B291DDF527EF"><enum>203.</enum><header>Assistant probation officers</header><text display-inline="no-display-inline">To the maximum extent practicable, the chief judge or chief probation or pretrial services officer of each judicial district, in coordination with the Office of Tribal Justice and the Office of Justice Services, shall—</text> 
<paragraph id="H6998E0B1579F4F1A820676C7FBE5E100"><enum>(1)</enum><text>appoint individuals residing in Indian country to serve as probation or pretrial services officers or assistants for purposes of monitoring and providing services to Federal prisoners residing in Indian country; and</text></paragraph> 
<paragraph id="H735C8B2F0A76418091DFFE2532A985B7"><enum>(2)</enum><text>provide substance abuse, mental health, and other related treatment services to offenders residing on Indian land.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4EDCB900F5194D3E9BC63B184C602074"><enum>246.</enum><header>Tribal youth program</header> 
<subsection id="H4891A821340C44629B08D5E3F8F35EA1"><enum>(a)</enum><header>Incentive grants for local delinquency prevention programs</header><text>Section 504 of the Juvenile Justice and Delinquency Prevention Act of 1974 (42 U.S.C. 5783) is amended—</text> 
<paragraph id="HC66AD555CD954B14931FC78EA9EB7640"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, or to federally recognized Indian tribe or consortia of federally recognized Indian tribes under subsection (d)</quote> after <quote>subsection (b)</quote>; and</text></paragraph> 
<paragraph id="H93925EB631A445B9865E53118EE389F2"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H20488E61477042C699D1CD892006CFEF"><enum>(d)</enum><header>Grants for tribal delinquency prevention and response programs</header> 
<paragraph id="H2120B7E2C9904772869455DA64392017"><enum>(1)</enum><header>In general</header><text>The Administrator shall make grants under this section, on a competitive basis, to eligible Indian tribes or consortia of Indian tribes, as described in paragraph (2)—</text> 
<subparagraph id="H35AFE5884C24413588A910614583B801"><enum>(A)</enum><text>to support and enhance—</text> 
<clause id="H322C26B47A624E71B2F9B1306315F39E"><enum>(i)</enum><text>tribal juvenile delinquency prevention services; and</text></clause> 
<clause id="H93114FCA4A5947348A55517AF58E89AB"><enum>(ii)</enum><text>the ability of Indian tribes to respond to, and care for, juvenile offenders; and</text></clause></subparagraph> 
<subparagraph id="H326DDE264C5B43C2AFA9CCD71888F598"><enum>(B)</enum><text>to encourage accountability of Indian tribal governments with respect to preventing juvenile delinquency and responding to, and caring for, juvenile offenders.</text></subparagraph></paragraph> 
<paragraph id="H70BB18EE16DA48B2B3EEBB08FA49E13D"><enum>(2)</enum><header>Eligible indian tribes</header><text>To be eligible to receive a grant under this subsection, an Indian tribe or consortium of Indian tribes shall submit to the Administrator an application in such form and containing such information as the Administrator may require.</text></paragraph> 
<paragraph id="HD97D0D5B69884CA4BEB4AF2059A9A7BD"><enum>(3)</enum><header>Considerations</header><text>In providing grants under this subsection, the Administrator shall take into consideration, with respect to the Indian tribe to be served, the—</text> 
<subparagraph id="H96925AD3A75D427C8B0E28DBC96A5E98"><enum>(A)</enum><text>juvenile crime rates;</text></subparagraph> 
<subparagraph id="HBB9F1590CA3F4784ABF1EF6B80BB1AB1"><enum>(B)</enum><text>dropout rates; and</text></subparagraph> 
<subparagraph id="H1D228DF128B1498D991BD0D042F6B4D2"><enum>(C)</enum><text>number of at-risk youth.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA27848DAA8FA40C4B8FA720911FA8920"><enum>(4)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $25,000,000 for each of fiscal years 2011 through 2015.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<paragraph id="H45FC4B7B92B74CF29E0B087462A1D0F5"><enum>(1)</enum><header>State</header> 
<subparagraph id="HA7DA6CFDA71C4C0D8F1932885BA0F2E0"><enum>(A)</enum><header>In general</header><text>The term <term>State</term> means the State of Alaska.</text></subparagraph> 
<subparagraph id="H6BAD04DA6CC3477FA83FAF50FBE7C03C"><enum>(B)</enum><header>Inclusion</header><text>The term <term>State</term> includes any political subdivision of the State of Alaska.</text></subparagraph></paragraph> 
<paragraph id="HF5BACAC1988D40A880465D88B7C55455"><enum>(2)</enum><header>Village public safety officer</header><text>The term <term>village public safety officer</term> means an individual employed as a village public safety officer under the program established by the State pursuant to Alaska Statute 18.65.670.</text></paragraph> 
<paragraph id="H7B25E613793E407DB5E821A636A599ED"><enum>(3)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given that term in section 4 of the Indian Self-Determination and Educational Assistance Act (25 U.S.C. 450b(l)).</text></paragraph></subsection> 
<subsection id="H9515917DBC2945779BE71C4E718F1403"><enum>(b)</enum><header>COPS grants</header><text>The State and any Indian tribe or tribal organization in the State that employs a village public safety officer shall be eligible to apply for a grant under section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796dd) (provided that only an Indian tribe or tribal organization may receive a grant under the tribal resources grant program under subsection (j) of that section) on an equal basis with other eligible applicants for funding under that section.</text></subsection> 
<subsection id="H557D25516F8449CD8471A6016DF90BAB"><enum>(c)</enum><header>Staffing for Adequate Fire and Emergency Response grants</header><text>The State and any Indian tribe or tribal organization in the State that employs a village public safety officer shall be eligible to apply for a grant under the Staffing for Adequate Fire and Emergency Response program under section 34 of the Federal Fire Prevention and Control Act of 1974 (15 U.S.C. 2229a) on an equal basis with other eligible applicants for funding under that program.</text></subsection> 
<subsection id="H0FE671CC0A7C4631ABC699CAB9D6B221"><enum>(d)</enum><header>Training for village public safety officers and tribal law enforcement positions funded under COPS program</header> 
<paragraph id="HF33ED909AF1847B3B0CD40DF10B7EBCA"><enum>(1)</enum><header>In general</header><text>Any village public safety officer or tribal law enforcement officer in the State shall be eligible to participate in any training program offered at the Indian Police Academy of the Federal Law Enforcement Training Center.</text></paragraph> 
<paragraph id="H42F2FAC9520341659C4A5FAA48447B9B"><enum>(2)</enum><header>Funding</header><text>Funding received pursuant to grants approved under section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796dd) may be used for training of officers at programs described in paragraph (1) or at a police academy in the State certified by the Alaska Police Standards Council.</text></paragraph></subsection>

<section id="H5D285B890EB94A0E8E206F1F77EF1025"><enum>263.</enum><header>Testimony by Federal employees</header><text display-inline="no-display-inline">The Indian Law Enforcement Reform Act (25 U.S.C. 2801 et seq.) (as amended by section 235) is amended by adding at the end the following:</text>

<paragraph id="HCAE57183734741AB84DE206C808A8B75"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Justice Services or the Director of the Indian Health Service, as appropriate (referred to in this section as the <term>Director concerned</term>), shall approve or disapprove, in writing, any request or subpoena from a tribal or State court for a law enforcement officer, sexual assault nurse examiner, or other employee under the supervision of the Director concerned to provide documents or testimony in a deposition, trial, or other similar criminal proceeding regarding information obtained in carrying out the official duties of the employee.</text></paragraph> 
<paragraph id="HB2255C2266A846E8849F94BFF30B85E7"><enum>(2)</enum><header>Deadline</header><text>The court issuing a subpoena under paragraph (1) shall provide to the appropriate Federal employee (or agency in the case of a document request) notice regarding the request to provide testimony (or release a document) by not less than 30 days before the date on which the testimony will be provided.</text></paragraph></subsection> 
<subsection id="HE782CC6DA3BF418FB6F335118B2D507E"><enum>(b)</enum><header>Approval</header> 
<paragraph id="H9B46D69C733440428E7EAF08529E1ACC"><enum>(1)</enum><header>In general</header><text>The Director concerned shall approve a request or subpoena under subsection (a) if the request or subpoena does not violate the policy of the Department to maintain impartiality.</text></paragraph> 
<paragraph id="H2447C936FB234A2D94C13A27566BC266"><enum>(2)</enum><header>Failure to approve</header><text>If the Director concerned fails to approve or disapprove a request or subpoena for testimony or release of a document by the date that is 30 days after the date of receipt of notice of the request or subpoena, the request or subpoena shall be considered to be approved for purposes of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7F9BDB6A2A104D1E9366E6919D9D1589"><enum>264.</enum><header>Coordination of Federal agencies</header><text display-inline="no-display-inline">Any report of the Secretary of Health and Human Services to Congress on the development of Indian victim services and victim advocate training programs shall include any recommendations that the Secretary determines to be necessary to prevent the sex trafficking of Indian women.</text></section> 
<section id="HB659AF20DB3F4B6AB0FB61A75FE922F1"><enum>265.</enum><header>Sexual assault protocol</header><text display-inline="no-display-inline">The Indian Law Enforcement Reform Act (25 U.S.C. 2801 et seq.) (as amended by section 236) is amended by adding at the end the following:</text>

<section id="H024438498652407F90014910E6918B7F"><enum>17.</enum><header>Policies and protocol</header><text display-inline="no-display-inline">The Director of the Indian Health Service, in coordination with the Director of the Office of Justice Services and the Director of the Office on Violence Against Women of the Department of Justice, in consultation with Indian Tribes and Tribal Organizations, and in conference with Urban Indian Organizations, shall develop standardized sexual assault policies and protocol for the facilities of the Service, based on similar protocol that has been established by the Department of Justice.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3A45254030BC4C3DA1BC6E5D433D2D81"><enum>266.</enum><header>Study of IHS sexual assault and domestic violence response capabilities</header> 
<subsection id="H4BFB4EDA311C4E81937DF9F458AD324C"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall—</text> 
<paragraph id="H4B33F893BE924ECEB9FE8CFD834664B3"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study of the capability of Indian Health Service facilities in remote Indian reservations and Alaska Native villages, including facilities operated pursuant to contracts or compacts under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b et seq.), to collect, maintain, and secure evidence of sexual assaults and domestic violence incidents required for criminal prosecution; and</text></paragraph> 
<paragraph id="H6B112C621ACC4647B82C22D796518A87"><enum>(2)</enum><text display-inline="yes-display-inline">develop recommendations for improving those capabilities.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H57EFC50C8F384F338C4067B11A297C34"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the results of the study under subsection (a), including the recommendations developed under that subsection, if any.</text></subsection></section></subtitle></title>
