<section section-type="section-one" id="H78898BBC759943919BBA6CD6444205C8" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seniors’ Tax Simplification Act of 2009</short-title></quote>.</text></section> 
<section id="H3B69648BE2B04A68AD72C761C49B7488"><enum>2.</enum><header>Form 1040S for seniors</header> 
<subsection id="H7E525FCBF2A145D9AB1704C662109DD"><enum>(a)</enum><header>In general</header><text>The Secretary of the Treasury (or the Secretary’s delegate) shall make available a form, to be known as <quote>Form 1040S</quote>, for use by individuals to file the return of tax imposed by chapter 1 of the Internal Revenue Code of 1986. Such form shall be as similar as practicable to Form 1040EZ, except that—</text> 
<paragraph id="H13AEAF8C399A4FEAB587F27196113DF3"><enum>(1)</enum><text>the form shall be available to individuals who have attained age 65 as of the close of the taxable year,</text></paragraph> 
<paragraph id="HD42600B97CA148748EC5830487C7121E"><enum>(2)</enum><text>the form may be used even if income for the taxable year includes—</text> 
<subparagraph id="HE7716ACC23E042C5B3DEA9820023E06"><enum>(A)</enum><text>social security benefits (as defined in section 86(d) of the Internal Revenue Code of 1986),</text></subparagraph> 
<subparagraph id="H760DA3902A634B9DB3C1B87916D500E2"><enum>(B)</enum><text>distributions from qualified retirement plans (as defined in section 4974(c) of such Code), annuities or other such deferred payment arrangements,</text></subparagraph> 
<subparagraph id="H9781CE32EF8D482EB685949937B003D"><enum>(C)</enum><text>interest and dividends, or</text></subparagraph> 
<subparagraph id="H47E84675EEAD482893E450853B5C6D96"><enum>(D)</enum><text>capital gains and losses taken into account in determining adjusted net capital gain (as defined in section 1(h)(3)), and</text></subparagraph></paragraph> 
<paragraph id="HF271E1EE14114AF8BCFCF48E7CA731BB"><enum>(3)</enum><text>the form shall be available without regard to the amount of any item of taxable income or the total amount of taxable income for the taxable year.</text></paragraph></subsection> 
<subsection id="H3BBFE2C429D3424EA925AB821E00D8E5"><enum>(b)</enum><header>Effective date</header><text>The form required by subsection (a) shall be made available for taxable years beginning after the date of the enactment of this Act.</text></subsection></section>
