		<official-title display="yes">To authorize the Secretary of the Interior
		  to lease certain lands in Virgin Islands National Park, and for other
		  purposes.</official-title>

		<section id="HC2B06B09B5CB4D1C982756818852CE9D" section-type="section-one"><enum>1.</enum><header>Caneel Bay lease
			 authorization</header>
			<subsection id="H44A15244E83341B9A500C8A76B9F338"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H57D75192DA2147F79117200084E737B5"><enum>(1)</enum><header>Park</header><text>The
			 term <term>Park</term> means the Virgin Islands National Park.</text>
				</paragraph><paragraph id="H750BB32D8D8648EEA58BC372811B9122"><enum>(2)</enum><header>Resort</header><text>The
			 term <term>resort</term> means the Caneel Bay resort on the island of St. John
			 in the Park.</text>
				</paragraph><paragraph id="HD31BBAD41D6A4D069DCF35F9F7F0D0C1"><enum>(3)</enum><header>Retained use
			 estate</header><text>The term <term>retained use estate</term> means the
			 retained use estate for the Caneel Bay property on the island of St. John
			 entered into between the Jackson Hole Preserve and the United States on
			 September 30, 1983.</text>
				</paragraph><paragraph id="H7620F5BF3A6748AF9986145356C900A"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></subsection><subsection id="H6339E894C71441BEB3E25BA9FFA9A089"><enum>(b)</enum><header>Lease
			 authorization</header>
				<paragraph id="HA449859CEE6044C49694A96B6756F886"><enum>(1)</enum><header>In
			 general</header><text>If the Secretary determines that the long-term benefit to
			 the Park would be greater by entering into a lease with the owner of the
			 retained use estate than by authorizing a concession contract upon the
			 termination of the retained use estate, the Secretary may enter into a lease
			 for the operation and management of the resort.</text>
				</paragraph><paragraph id="H5A65AA26AFF94446A04220379F41CD"><enum>(2)</enum><header>Acquisitions</header><text>The
			 Secretary may—</text>
					<subparagraph id="H8EF234AF6A46402985D6B9BB167BE5E2"><enum>(A)</enum><text>acquire associated
			 property from the owner of the retained use estate; and</text>
					</subparagraph><subparagraph id="H8A6F1E39B7324D198E59DF00CDD300FD"><enum>(B)</enum><text>on the acquisition
			 of property under subparagraph (A), administer the property as part of the
			 Park.</text>
					</subparagraph></paragraph><paragraph id="H427FD237C8CD4044960800B5F5DBFFE0"><enum>(3)</enum><header>Authority</header><text>Except
			 as otherwise provided by this section, a lease shall be in accordance with
			 subsection (k) of section 3 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/91/383">Public Law
			 91–383</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–2(k)</external-xref>), notwithstanding
			 paragraph (2) of that subsection.</text>
				</paragraph><paragraph id="HEB3DD91EDB984C0BBC193CA40192A46B"><enum>(4)</enum><header>Terms and
			 conditions</header><text>A lease authorized under this section shall—</text>
					<subparagraph id="H974D92F7EA3340CBB0AB68256C5EF2F2"><enum>(A)</enum><text>be for the minimum
			 number of years practicable, taking into consideration the need for the lessee
			 to secure financing for necessary capital improvements to the resort, but in no
			 event shall the term of the lease exceed 40 years;</text>
					</subparagraph><subparagraph id="H7AC88BACEEC041DDA0F95A5E0B9066C"><enum>(B)</enum><text>prohibit any
			 transfer, assignment, or sale of the lease or otherwise convey or pledge any
			 interest in the lease with prior written notification to, and approval by the
			 Secretary;</text>
					</subparagraph><subparagraph id="HEF80E663BEA84B708DB8B3A1A3D52FD"><enum>(C)</enum><text>ensure that the
			 general character of the resort property remains unchanged, including a
			 prohibition against—</text>
						<clause id="H7AA83047A0F64214908FCEBA9F27AFB4"><enum>(i)</enum><text>any
			 increase in the overall size of the resort; or</text>
						</clause><clause id="H8C906C646EC1417C8FA7F06BBE19F581"><enum>(ii)</enum><text>any
			 increase in the number of guest accommodations available at the resort;</text>
						</clause></subparagraph><subparagraph id="HB124CDF04F18402496CCD3D8FA4F733"><enum>(D)</enum><text>prohibit the sale
			 of partial ownership shares or timeshares in the resort; and</text>
					</subparagraph><subparagraph id="H257E0BE949CD4CBE83F95D25BF00EDD2"><enum>(E)</enum><text>include any other
			 provisions determined by the Secretary to be necessary to protect the Park and
			 the public interest.</text>
					</subparagraph></paragraph><paragraph id="H286C991BFD104BD18CBC3E781CF22605"><enum>(5)</enum><header>Rental
			 amounts</header><text>In determining the fair market value rental of the lease
			 required under section 3(k)(4) of
			 <external-xref legal-doc="public-law" parsable-cite="pl/91/383">Public Law
			 91–383</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–2(k)(4)</external-xref>), the Secretary
			 shall take into consideration—</text>
					<subparagraph id="H6F4A846EF7324B9FB97ED92FADB0B8A0"><enum>(A)</enum><text>the value of any
			 associated property conveyed to the United States; and</text>
					</subparagraph><subparagraph id="HD71DB8F8E5554E18892CE077864FD608"><enum>(B)</enum><text>the value, if any,
			 of the relinquished term of the retained use estate.</text>
					</subparagraph></paragraph><paragraph id="HBE6605AE263C4F5086BB15D1A2CDF5BC"><enum>(6)</enum><header>Use of
			 proceeds</header><text>Rental amounts paid to the United States under a lease
			 shall be available to the Secretary, without further appropriation, for visitor
			 services and resource protection within the Park.</text>
				</paragraph><paragraph id="HF07F62FA426244CCABFBBBA18D08887"><enum>(7)</enum><header>Congressional
			 notification</header><text>The Secretary shall submit a proposed lease under
			 this section to the Committee on Energy and Natural Resources of the Senate and
			 the Committee on Natural Resources of the House of Representatives at least 60
			 days before the effective date of the lease.</text>
				</paragraph><paragraph id="HB395C6A3550743D2A689FA9686548E26"><enum>(8)</enum><header>Renewal</header><text>A
			 lease entered into under this section may not be extended or renewed.</text>
				</paragraph><paragraph id="H699B78203B934CF9BEEB960320F4359"><enum>(9)</enum><header>Termination</header><text>Upon
			 the termination of a lease entered into under this section, if the Secretary
			 determines the continuation of commercial services at the resort to be
			 appropriate, the services shall be provided in accordance with the National
			 Park Service Concessions Management Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/5951">16 U.S.C. 5951 et
			 seq.</external-xref>).</text>
				</paragraph></subsection><subsection id="HFB250627E88047ADA26E35B90880AB79"><enum>(c)</enum><header>Retained use
			 estate</header>
				<paragraph id="HC93D50AA280F4A9E84B9FA008DF2AC17"><enum>(1)</enum><header>In
			 general</header><text>As a condition of the lease, the owner of the retained
			 use estate shall terminate, extinguish, and relinquish to the Secretary all
			 rights under the retained use estate and shall transfer, without consideration,
			 ownership of improvements on the retained use estate to the National Park
			 Service.</text>
				</paragraph><paragraph id="HF28EF39F2155447089046E9608C50090"><enum>(2)</enum><header>Appraisal</header>
					<subparagraph id="H44390EB417954564AA70321636EF029F"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall require an appraisal by an
			 independent, qualified appraiser that is agreed to by the Secretary and the
			 owner of the retained use estate to determine the value, if any, of the
			 relinquished term of the retained use estate.</text>
					</subparagraph><subparagraph id="H6A5C959A3AD647C2A62F83AF2D2500CC"><enum>(B)</enum><header>Requirements</header><text>An
			 appraisal under paragraph (1) shall be conducted in accordance with—</text>
						<clause id="H8B00B50B13594D1E8C67C319D109395C"><enum>(i)</enum><text>the
			 Uniform Appraisal Standards for Federal Land Acquisitions; and</text>
						</clause><clause id="H46FE77A0D6594E09ACE50436C1DABC23"><enum>(ii)</enum><text>the
			 Uniform Standards of Professional Appraisal Practice.</text>
						</clause></subparagraph></paragraph></subsection></section></legis-body>
