		<official-title>To amend the definition of a law enforcement officer
		  under subchapter III of chapter 83 and chapter 84 of title 5, United States
		  Code, respectively, to ensure the inclusion of certain
		  positions.</official-title>

		<section display-inline="no-display-inline" id="HC5326EF9C61B46BD958DE020B6892741" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Law Enforcement Officers Equity
			 Act</short-title></quote>.</text>
		</section><section id="H8C807AFB7D0942B290DFF92C4D784932"><enum>2.</enum><header>Amendments</header>
			<subsection id="HC347392AF03247658BBD8055653BEBCE"><enum>(a)</enum><header>Federal
			 Employees’ Retirement System</header>
				<paragraph id="H1502FEBAF0FA43159C99442D609408EF"><enum>(1)</enum><header>In
			 general</header><text>Paragraph (17) of section 8401 of title 5, United States
			 Code, is amended by striking <quote>and</quote> at the end of subparagraph (C),
			 and by adding at the end the following:</text>
					<quoted-block id="HA8A64B93A20A4F3DA9DF7844FA8600BD">
						<subparagraph id="H606AC35B69FE48A1891F4700E23FE555"><enum>(E)</enum><text>an employee (not
				otherwise covered by this paragraph)—</text>
							<clause id="HE1B0E26C306D43638BFA1D54A23BFD6F"><enum>(i)</enum><text>the duties of
				whose position include the investigation or apprehension of individuals
				suspected or convicted of offenses against the criminal laws of the United
				States; and</text>
							</clause><clause id="HB87A98AECB8D47FF8504947413235B70"><enum>(ii)</enum><text>who is authorized
				to carry a firearm; and</text>
							</clause></subparagraph><subparagraph id="HE17AEFDD63B84D2ABC56B7B39108964"><enum>(F)</enum><text>an employee of the
				Internal Revenue Service, the duties of whose position are primarily the
				collection of delinquent taxes and the securing of delinquent
				returns;</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HBDFAF465DB2A4FDBA94174E9B33000C3"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 8401(17)(C) of title 5, United States Code, is
			 amended by striking <quote>subparagraph (A) and (B)</quote> and inserting
			 <quote>subparagraphs (A), (B), (E), and (F)</quote>.</text>
				</paragraph></subsection><subsection id="HCC9D741C5AA24B4A858DE7E39896FB5"><enum>(b)</enum><header>Civil Service
			 Retirement System</header><text>Paragraph (20) of section 8331 of title 5,
			 United States Code, is amended by inserting after <quote>position.</quote> (in
			 the matter before subparagraph (A)) the following: <quote>For the purpose of
			 this paragraph, the employees described in the preceding provision of this
			 paragraph (in the matter before <quote>including</quote>) shall be considered
			 to include an employee, not otherwise covered by this paragraph, who satisfies
			 clauses (i)–(ii) of section 8401(17)(E) and an employee of the Internal Revenue
			 Service the duties of whose position are as described in section
			 8401(17)(F).</quote>.</text>
			</subsection><subsection id="HB033B91731EF412693AA53AF214C7EBF"><enum>(c)</enum><header>Effective
			 date</header><text>Except as provided in section 3, the amendments made by this
			 section shall take effect on the date of the enactment of this Act, and shall
			 apply only in the case of any individual first appointed as a law enforcement
			 officer (within the meaning of those amendments) on or after such date.</text>
			</subsection></section><section id="H9BFE2B456D904C1CBCEA6604C30E850"><enum>3.</enum><header>Treatment of
			 service performed by incumbents</header>
			<subsection id="HE2CCC60F18F140F38EDD5C0F359AC77"><enum>(a)</enum><header>Law enforcement
			 officer and service described</header>
				<paragraph id="H90E82396083940C19DAE071E534BA91E"><enum>(1)</enum><header>Law enforcement
			 officer</header><text>Any reference to a law enforcement officer described in
			 this subsection refers to an individual who satisfies the requirements of
			 section 8331(20) or 8401(17) of title 5, United States Code (relating to the
			 definition of a law enforcement officer) by virtue of the amendments made by
			 section 2.</text>
				</paragraph><paragraph id="H2EE993F59A0545BDA07738A1FFB6A15"><enum>(2)</enum><header>Service</header><text>Any
			 reference to service described in this subsection refers to service performed
			 as a law enforcement officer (as described in this subsection).</text>
				</paragraph></subsection><subsection id="H40F87CA78F434BD8ACD16FC04EC158EE"><enum>(b)</enum><header>Incumbent
			 defined</header><text>For purposes of this section, the term
			 <term>incumbent</term> means an individual who—</text>
				<paragraph id="HB5740E5FA12647BDB8C955896F003B02"><enum>(1)</enum><text>is first appointed
			 as a law enforcement officer (as described in subsection (a)) before the date
			 of the enactment of this Act; and</text>
				</paragraph><paragraph id="H6B1D60A3D4604AF6AEF49013B6976C96"><enum>(2)</enum><text>is serving as such
			 a law enforcement officer on such date.</text>
				</paragraph></subsection><subsection id="H1B67AE36ED7A4BB8804E8BE253302605"><enum>(c)</enum><header>Treatment of
			 service performed by incumbents</header>
				<paragraph id="H175B094C6A274F4EB354A8A9C5CBA65F"><enum>(1)</enum><header>In
			 general</header><text>Service described in subsection (a) which is performed by
			 an incumbent on or after the date of the enactment of this Act shall, for all
			 purposes (other than those to which paragraph (2) pertains), be treated as
			 service performed as a law enforcement officer (within the meaning of section
			 8331(20) or 8401(17) of title 5, United States Code, as appropriate).</text>
				</paragraph><paragraph id="H74445C4D08824BE89C0940C62EE635B7"><enum>(2)</enum><header>Retirement</header><text>Service
			 described in subsection (a) which is performed by an incumbent before, on, or
			 after the date of the enactment of this Act shall, for purposes of subchapter
			 III of chapter 83 and chapter 84 of title 5, United States Code, be treated as
			 service performed as a law enforcement officer (within the meaning of such
			 section 8331(20) or 8401(17), as appropriate), but only if an appropriate
			 written election is submitted to the Office of Personnel Management within 5
			 years after the date of the enactment of this Act or before separation from
			 Government service, whichever is earlier.</text>
				</paragraph></subsection><subsection id="H080FFA443EFC4A12AE8FE77584BCDDE6"><enum>(d)</enum><header>Individual
			 contributions for prior service</header>
				<paragraph id="HF879A0AD4E5A4322BF947EECE7008F12"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">An individual who
			 makes an election under subsection (c)(2) may, with respect to prior service
			 performed by such individual, contribute to the Civil Service Retirement and
			 Disability Fund the difference between the unrefunded individual contributions
			 made for such service and the individual contributions that should have been
			 made for such service if the amendments made by section 2 had then been in
			 effect.</text>
				</paragraph><paragraph id="HBFDFBCFD592F44AE897300C79A3890"><enum>(2)</enum><header>Effect of not
			 contributing</header><text>If no part of or less than the full amount required
			 under paragraph (1) is paid, all prior service of the incumbent shall remain
			 fully creditable as law enforcement officer service, but the resulting annuity
			 shall be reduced in a manner similar to that described in section 8334(d)(2) of
			 title 5, United States Code, to the extent necessary to make up the amount
			 unpaid.</text>
				</paragraph><paragraph id="H66916B98F9E5490FB04F9189AD69A81B"><enum>(3)</enum><header>Prior service
			 defined</header><text>For purposes of this section, the term <term>prior
			 service</term> means, with respect to any individual who makes an election
			 under subsection (c)(2), service (described in subsection (a)) performed by
			 such individual before the date as of which appropriate retirement deductions
			 begin to be made in accordance with such election.</text>
				</paragraph></subsection><subsection id="HAAE20A5CCE384739875144C5663DFB67"><enum>(e)</enum><header>Government
			 contributions for prior service</header>
				<paragraph id="HC1B39B4BC857445D8E00180087F1E4BF"><enum>(1)</enum><header>In
			 general</header><text>If an incumbent makes an election under subsection
			 (c)(2), the agency in or under which that individual was serving at the time of
			 any prior service (referred to in subsection (d)) shall remit to the Office of
			 Personnel Management, for deposit in the Treasury of the United States to the
			 credit of the Civil Service Retirement and Disability Fund, the amount required
			 under paragraph (2) with respect to such service.</text>
				</paragraph><paragraph id="HFCD26B788FC84D629675314BEEE61D31"><enum>(2)</enum><header>Amount
			 required</header><text>The amount an agency is required to remit is, with
			 respect to any prior service, the total amount of additional Government
			 contributions to the Civil Service Retirement and Disability Fund (above those
			 actually paid) that would have been required if the amendments made by section
			 2 had then been in effect.</text>
				</paragraph><paragraph id="HB727A1B36BEA46C8B4F2C714BFD3BB45"><enum>(3)</enum><header>Contributions to
			 be made ratably</header><text>Government contributions under this subsection on
			 behalf of an incumbent shall be made by the agency ratably (on at least an
			 annual basis) over the 10-year period beginning on the date referred to in
			 subsection (d)(3).</text>
				</paragraph></subsection><subsection id="H27B4D1D395024889B99BFEA34F839E2E"><enum>(f)</enum><header>Exemption from
			 mandatory separation</header><text>Nothing in section 8335(b) or 8425(b) of
			 title 5, United States Code, shall cause the involuntary separation of a law
			 enforcement officer (as described in subsection (a)) before the end of the
			 3-year period beginning on the date of the enactment of this Act.</text>
			</subsection><subsection id="H97404F656DA84935BAEFA68B6C2600FF"><enum>(g)</enum><header>Regulations</header><text>The
			 Office shall prescribe regulations to carry out this Act, including—</text>
				<paragraph id="H76F209C5850C4D26861D7480A905B52F"><enum>(1)</enum><text>provisions in
			 accordance with which interest on any amount under subsection (d) or (e) shall
			 be computed, based on section 8334(e) of title 5, United States Code;
			 and</text>
				</paragraph><paragraph id="H5996B8E75056472DBC832BAB29EB1B64"><enum>(2)</enum><text>provisions for the
			 application of this section in the case of—</text>
					<subparagraph id="HA6A51F61913E4E75A1D1C784D3017744"><enum>(A)</enum><text>any individual
			 who—</text>
						<clause id="H4B8D5CD59C5643A4BEFA181B9D16E259"><enum>(i)</enum><text>satisfies
			 paragraph (1) (but not paragraph (2)) of subsection (b); and</text>
						</clause><clause id="HAAF4A4566D2643DBA280BA4D0035FA54"><enum>(ii)</enum><text>serves as a law
			 enforcement officer (as described in subsection (a)) after the date of the
			 enactment of this Act; and</text>
						</clause></subparagraph><subparagraph id="HCA1AEA783CEB49A1A12783DDC4E1456D"><enum>(B)</enum><text>any individual
			 entitled to a survivor annuity (based on the service of an incumbent, or of an
			 individual under subparagraph (A), who dies before making an election under
			 subsection (c)(2)), to the extent of any rights that would then be available to
			 the decedent (if still living).</text>
					</subparagraph></paragraph></subsection><subsection id="H20A62B39B301467EB106BBDB2F56C372"><enum>(h)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be considered to apply
			 in the case of a reemployed annuitant.</text>
