		<official-title>To amend the Federal Property and Administrative Services
		  Act of 1949 and title 10, United States Code, to extend the number of years
		  that multiyear contracts may be entered into for the purchase of advanced
		  biofuel, and for other purposes.</official-title>

		<section id="HE5DBA926C034447DB58DDAF835A81C7F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Domestic Fuel for Enhancing National
			 Security Act of 2010</short-title></quote>.</text>
		</section><section id="HEE88C99C425F4EF2AE122F8659DA4402"><enum>2.</enum><header>Multiyear
			 contracts for advanced biofuel</header>
			<subsection id="H6BBE294D47D54F74BC27784A6D162078"><enum>(a)</enum><header>Civilian agency
			 contracts</header><text display-inline="yes-display-inline">Subsection (d) of
			 section 304B of the Federal Property and Administrative Services Act of 1949
			 (41 U.S.C. 254c) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF0656E2DC154425692BD6CEFBB458D76" style="OLC">
					<subsection id="HE212E81315614248AA94A36721AC3F4D"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section:</text>
						<paragraph id="HF0C4998F3BF3452586FE2D2F8F75AE77"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE37110715BA44E14AE3CFFFC5568CEC1"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
				term <term>multiyear contract</term> means a contract for the purchase of
				property or services for more than one, but not more than five, program years.</text>
							</subparagraph><subparagraph id="H7DB5612F3B7746B08B958271F426F552" indent="up1"><enum>(B)</enum><text>In the case of a contract for the
				purchase of advanced biofuel, the term <term>multiyear contract</term> means a
				contract for the purchase of such fuel for a period of up to 15 program
				years.</text>
							</subparagraph><subparagraph id="H16047DCB214B4583AFFF53AB260BF03D" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Such a contract may provide that
				performance under the contract during the second and subsequent years of the
				contract is contingent upon the appropriation of funds and (if it does so
				provide) may provide for a cancellation payment to be made to the contractor if
				such appropriations are not made.</text>
							</subparagraph></paragraph><paragraph id="HEC5D0215190D411999F5C22435234227"><enum>(2)</enum><text>The term
				<term>advanced biofuel</term> has the meaning given such term in section
				211(o)(1)(B) of the Clean Air Act (42 U.S.C. 7545(o)(1)(B)).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA8836BA463374F94B65957D4B0BC2608"><enum>(b)</enum><header>Defense
			 contracts</header><text>Subsection (k) of section 2306b of title 10, United
			 States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H9D28373DA242416EBA0EF54DC66CC7DA" style="USC">
					<subsection id="H674C09C4A5BA4FA889DBD2C6AEC78851"><enum>(k)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section:</text>
						<paragraph id="H3C940D35FFBC4568B40479E4D790384E"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H94DABECD93BB44B987F0823E007F1254"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
				term <term>multiyear contract</term> means a contract for the purchase of
				property or services for more than one, but not more than five, program years.</text>
							</subparagraph><subparagraph id="H1EA71469B1584A50A641BB96B22514F7" indent="up1"><enum>(B)</enum><text>In the case of a contract for the
				purchase of advanced biofuel, the term <term>multiyear contract</term> means a
				contract for the purchase of such fuel for a period of up to 15 program
				years.</text>
							</subparagraph><subparagraph id="HD516A30949604ABF81495C28622C9779" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Such a contract may provide that
				performance under the contract during the second and subsequent years of the
				contract is contingent upon the appropriation of funds and (if it does so
				provide) may provide for a cancellation payment to be made to the contractor if
				such appropriations are not made.</text>
							</subparagraph></paragraph><paragraph id="H5CD861B69A3B4E43AFC35E3CBCAD8389"><enum>(2)</enum><text>The term
				<term>advanced biofuel</term> has the meaning given such term in section
				211(o)(1)(B) of the Clean Air Act (42 U.S.C. 7545(o)(1)(B)).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H762DAB9B0E4C44F9BFBDC9335AD226BF"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to contracts
			 entered into on or after the date occurring 180 days after the date of the
			 enactment of this Act.</text>
