		<official-title display="yes">To amend the Elementary and Secondary
		  Education Act of 1965 to require criminal background checks for school
		  employees.</official-title>

		<section id="HC88E330652E048A888B872DDD2A16986" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited at the
			 <quote><short-title>Protecting Students from Sexual and
			 Violent Predators Act</short-title></quote>.</text>
		</section><section id="HAB66CE590C0A4F4D8DB95097DF283198"><enum>2.</enum><header>Background
			 checks</header><text display-inline="no-display-inline">Subpart 2 of part E of
			 title IX of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et
			 seq.</external-xref>) is amended by adding at the end the following:</text>

				<section id="H819EC78477554A6EADC649EAE11C5361"><enum>9537.</enum><header>Background
				checks</header>
					<subsection id="HCFF7E2CE6D4B4812BAEABB11FD9D858A"><enum>(a)</enum><header>Background
				checks</header><text>Each State that receives funds under this Act shall have
				in effect policies and procedures that—</text>
						<paragraph id="HBA99D1BFB9894243BE4CC888AC7D2B23"><enum>(1)</enum><text>require that
				criminal background checks be conducted for school employees that
				include—</text>
							<subparagraph id="H0FEDAEE1F231497581ADC35F5DB0974E"><enum>(A)</enum><text>a search of the
				State criminal registry or repository in the State in which the school employee
				resides and each State in which such school employee previously resided;</text>
							</subparagraph><subparagraph id="HCBDBD55636EF46DF84C96564AD61C199"><enum>(B)</enum><text>a search of
				State-based child abuse and neglect registries and databases in the State in
				which the school employee resides and each State in which such school employee
				previously resided;</text>
							</subparagraph><subparagraph id="HABA70E89C3D64990B4574DF2B22E5862"><enum>(C)</enum><text>a search of the
				National Crime Information Center of the Department of Justice;</text>
							</subparagraph><subparagraph id="H2B352145414348759CE0EC74CE233F41"><enum>(D)</enum><text>a Federal Bureau
				of Investigation fingerprint check using the Integrated Automated Fingerprint
				Identification System; and</text>
							</subparagraph><subparagraph id="H7262D882C7AD44A9A54D8B20C3D07BC6"><enum>(E)</enum><text>a search of the
				National Sex Offender Registry established under section 19 of the Adam Walsh
				Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16919">42 U.S.C. 16919</external-xref>);</text>
							</subparagraph></paragraph><paragraph id="HE127FD5365FD4DE3AAEE01F754A095AD"><enum>(2)</enum><text>prohibit the
				employment of school employees for a position as a school employee if such
				individual—</text>
							<subparagraph id="HCF03D6AAA7F540CE8ED465F51A408E14"><enum>(A)</enum><text>refuses to consent
				to the criminal background check described in
				<internal-xref idref="HBA99D1BFB9894243BE4CC888AC7D2B23" legis-path="9537.(a)(1)">paragraph (1)</internal-xref>;</text>
							</subparagraph><subparagraph id="H3CDBBE0890D74B1EB1843A171ACD535B"><enum>(B)</enum><text>makes a false
				statement in connection with such criminal background check;</text>
							</subparagraph><subparagraph id="HE7890AAAC275401391E799127D02DB45"><enum>(C)</enum><text>has been convicted
				of a felony consisting of—</text>
								<clause id="H673F32F3104549D9A02BF35181F177EC"><enum>(i)</enum><text>homicide;</text>
								</clause><clause id="H1F32042F2A8A4C9A8542BB7DD704589D"><enum>(ii)</enum><text>child abuse or
				neglect;</text>
								</clause><clause id="H5A0A1A05AF5B41A796915A49935C197B"><enum>(iii)</enum><text>a crime against
				children, including child pornography;</text>
								</clause><clause id="H03108A43634E4BFB92547858A0C1D858"><enum>(iv)</enum><text>spousal
				abuse;</text>
								</clause><clause id="HD4EBAA6D95FA4C0DAEE765F0C23272C0"><enum>(v)</enum><text>a
				crime involving rape or sexual assault;</text>
								</clause><clause id="HF9E556B1DCC54C7094C7A107A3D2A8F2"><enum>(vi)</enum><text>kidnapping;</text>
								</clause><clause id="H84493401EBD6482B90BAC6AA14AC207B"><enum>(vii)</enum><text>arson; or</text>
								</clause><clause id="H1728CBF6803A406AB5D225DB1045CD02"><enum>(viii)</enum><text>physical
				assault, battery, or a drug-related offense, committed within the past 5 years;
				or</text>
								</clause></subparagraph><subparagraph id="H54DE74996C254C14A08888923E2CC8B1"><enum>(D)</enum><text display-inline="yes-display-inline">has been convicted of any other crime that
				is a violent or sexual crime against a minor;</text>
							</subparagraph></paragraph><paragraph id="H9B67CCC0F97F4A89B8B5C62E92024ED2"><enum>(3)</enum><text>require that a
				local educational agency or State educational agency that receives information
				from a criminal background check conducted under this section that an
				individual who has applied for employment with such agency as a school employee
				is a sexual predator report to local law enforcement that such individual has
				so applied;</text>
						</paragraph><paragraph id="H1EF39613296E434EA15B174FEC55776E"><enum>(4)</enum><text>require that the
				criminal background checks described in
				<internal-xref idref="HBA99D1BFB9894243BE4CC888AC7D2B23" legis-path="9537.(a)(1)">paragraph (1)</internal-xref> be periodically
				repeated; and</text>
						</paragraph><paragraph id="H1A934635B9ED498290A2337F49F3E818"><enum>(5)</enum><text display-inline="yes-display-inline">provide for a timely process by which a
				school employee may appeal the results of a criminal background check conducted
				under this section to challenge the accuracy or completeness of the information
				produced by such background check and seek appropriate relief for any final
				employment decision based on materially inaccurate or incomplete information
				produced by such background check, but that does not permit the school employee
				to be employed as a school employee during such process.</text>
						</paragraph></subsection><subsection id="HE4048B3E08744EF495CDA338E1B33325"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H58C9D624AEA64A5B8E700A7852FCA512"><enum>(1)</enum><header>School
				Employee</header><text>The term <term>school employee</term> means—</text>
							<subparagraph id="H1F45D0ADEBF4428FA98A38203D957CBC"><enum>(A)</enum><text>an employee of, or
				a person seeking employment with, a local educational agency or State
				educational agency, and who has a job duty that results in exposure to
				students; or</text>
							</subparagraph><subparagraph id="H67F24D4573C6495291E79AC0AE5BAED1"><enum>(B)</enum><text>an employee of, or
				a person seeking employment with, a for-profit or nonprofit entity, or local
				public agency, that has a contract or agreement to provide services with a
				school, local educational agency, or State educational agency, and whose job
				duty—</text>
								<clause id="HC9701C9315E0436482961FA9272FD3F9"><enum>(i)</enum><text>is
				to provide such services; and</text>
								</clause><clause id="H9289B7175202474FB60518668A6ED8D8"><enum>(ii)</enum><text>results in
				exposure to students.</text>
								</clause></subparagraph></paragraph><paragraph id="HF8DB575CA0E949488B6C0CD266659C96"><enum>(2)</enum><header>Sexual
				Predator</header><text>The term <term>sexual predator</term> means a person 18
				years of age or older who has been convicted of, or pled guilty to, a sexual
				offense against a
				minor.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H885779ADF9AC4117BE3951655651034C"><enum>3.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 2 of the
			 Elementary and Secondary Education Act of 1965 is amended by adding after the
			 item relating to section 9536 the following:</text>
