		<section id="HC6D75D8CFE5644DD8773333AF76F0B94" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Railroad Hours of Service Act of
			 2010</short-title></quote>.</text>
		</section><section id="H50BAF76FD4BB48A3A19C8F93590844E6"><enum>2.</enum><header>Redesignations</header><text display-inline="no-display-inline">Chapter 211 of title 49, United States Code,
			 is amended by redesignating sections 21101 through 21109 as sections 21102
			 through 21110, respectively.</text>
		</section><section id="H506E158D97A6457B8EBF7511D694E303" section-type="subsequent-section"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">Chapter 211 of title 49, United States Code,
			 is further amended by inserting before section 21102 (as so redesignated by
			 section 2 of this Act) the following:</text>
			<quoted-block display-inline="no-display-inline" id="H82AE62CAD845413EAF56792D3D1C7498" style="USC">
				<section id="HAE4D5182FFE7434C93398D7CDB504370"><enum>21101.</enum><header>Purpose</header><text display-inline="no-display-inline">Railroad employees covered by this chapter
				shall be provided predictable and defined work and rest
				periods.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H95141F2DC04F4D00B84AB6FB16CB1970"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 21102 (as so redesignated by section
			 2 of this Act) of chapter 211 of title 49, United States Code, is
			 amended—</text>
			<paragraph id="H0C4A59AE882040A4B0C0129375429BAE"><enum>(1)</enum><text>in paragraph (5),
			 by inserting <quote>and yardmaster employee</quote> before the period; and</text>
			</paragraph><paragraph id="H35F57B5757A045BAB42692D79FEF02CD"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE702C2E4A28945C0B65208FC25DE53C1" style="OLC">
					<paragraph id="H06EABC6C80F54D1AA9B8A2F809021581"><enum>(6)</enum><text display-inline="yes-display-inline"><quote>yardmaster employee</quote> means an
				employee who supervises and coordinates the activities of workers engaged in
				railroad traffic operations, including making up or breaking up trains and
				switching inbound or outbound
				traffic.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HACEF1C451D3845EDBBBD15CC043F9F69"><enum>5.</enum><header>Nonapplication,
			 exemption, and alternate hours of service regime</header><text display-inline="no-display-inline">Section 21103(c) (as so redesignated by
			 section 2 of this Act) of chapter 211 of title 49, United States Code is
			 amended—</text>
			<paragraph id="H928A133A4CEF46DB9A2AEC63537FCAF2"><enum>(1)</enum><text>in paragraph
			 (1)(A), by striking <quote>21109(b)</quote> and inserting
			 <quote>21110(b)</quote>;</text>
			</paragraph><paragraph id="HB667A6525AB746C2ADD7B3E9731A209E"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>21109(b)</quote> and inserting <quote>21110(b)</quote>;</text>
			</paragraph><paragraph id="H1B7472B51F3544388757F5B85381A04A"><enum>(3)</enum><text>by striking
			 subparagraph (C) of paragraph (4);</text>
			</paragraph><paragraph id="HFFA8FEAAD0984990A57344D80E996DEA"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (D) of
			 paragraph (4) as subparagraph (B); and</text>
			</paragraph><paragraph id="HFDC569D8EC564658BBF28D301D966592"><enum>(5)</enum><text>by striking
			 <quote>new section 21103</quote> each place it appears and inserting
			 <quote>section 21104</quote>.</text>
			</paragraph></section><section id="H5D54AD2F19374A608A84DC9F70BBB0BE"><enum>6.</enum><header>Limitations on
			 duty hours of train employees</header><text display-inline="no-display-inline">Section 21104 (as so redesignated by section
			 2 of this Act) of chapter 211 of title 49, United States Code, is
			 amended—</text>
			<paragraph id="H7BA9DE7F42B342FEA30348148EA2D76C"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H85A94DB45CAD4E17936E90716E5DDE66"><enum>(A)</enum><text>in paragraph
			 (3)—</text>
					<clause id="H5C3A2E78790843D3A30E0E9C1A862FCF"><enum>(i)</enum><text>by
			 striking <quote>remain or go on duty unless</quote> and inserting
			 <quote>initiate an on duty period unless</quote>; and</text>
					</clause><clause id="H5B71D248F2AC408C8206804C2E9F4D7D"><enum>(ii)</enum><text>by
			 striking <quote>during the prior 24 hours; or</quote> and inserting
			 <quote>immediately prior to going on duty; or</quote>;</text>
					</clause></subparagraph><subparagraph id="H5A2AFCD301D1485D9EFBFA18502CF623"><enum>(B)</enum><text>in paragraph
			 (4)(A)—</text>
					<clause id="H446DC8D6683F4914971DA2E4A64887F7"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>work</quote> and inserting <quote>initiate an on
			 duty period</quote>; and</text>
					</clause><clause id="H35057B2CBD854E3EADD3BE8E09E0F633"><enum>(ii)</enum><text>in
			 clause (ii), by striking <quote>works</quote> and inserting <quote>initiates an
			 on duty period on</quote>; and</text>
					</clause></subparagraph><subparagraph commented="no" id="HCB31C37A02EB40008F6E028F59711FC1"><enum>(C)</enum><text>in the matter
			 after paragraph (4) by inserting <quote>For purposes of paragraph (4)(A) and
			 (B), within 12 months after the date of enactment of the
			 <short-title>Railroad Hours of Service Act of
			 2010</short-title>, the Secretary shall prescribe regulations to require all
			 deadhead transportation in excess of a specific number of hours to be counted
			 as time on duty and shall reset the calendar day clock.</quote> before
			 <quote>The Secretary may waive</quote>;</text>
				</subparagraph></paragraph><paragraph id="HC4B8B453CAC84095BA073F787AD73E21"><enum>(2)</enum><text>in subsection
			 (b)(7), by striking <quote>when the employee is prevented</quote> and all that
			 follows through <quote>employee left the designated terminal.</quote> and
			 inserting <quote>. A train employee shall be notified before going off duty
			 whether such period off duty is an interim release.</quote>; and</text>
			</paragraph><paragraph id="H90E7DF62FBDA4C0B9776894C64163938"><enum>(3)</enum><text>in subsection
			 (c)(1)—</text>
				<subparagraph id="HE297A354DA02428B8061FB983E5AAB97"><enum>(A)</enum><text>in subparagraph
			 (A)(ii), by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="H7304E6591C0C4329A673249D8AEC6087"><enum>(B)</enum><text>in subparagraph
			 (B)(ii), by striking <quote>21109.</quote> and inserting <quote>21110;
			 and</quote>; and</text>
				</subparagraph><subparagraph id="H7FB17B6D6F3F47A5A057990367323944"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFC795B39FC714A9BBFA378C6B3CC8976" style="OLC">
						<subparagraph id="H8A9646EFC47E4E8381354B4321CBF32A"><enum>(C)</enum><text display-inline="yes-display-inline">to exceed 2 hours in deadhead
				transportation per each tour of
				duty.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H8E97A9700813480BA7BAFD80AEBD3045"><enum>7.</enum><header>Limitations on
			 duty hours of signal employees</header><text display-inline="no-display-inline">Section 21105 (as so redesignated by section
			 2 of this Act) of chapter 211 of title 49, United States Code, is
			 amended—</text>
			<paragraph id="H2EE67FA931094C5CBC01099EE15AF30D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by inserting <quote>,
			 including all work where there is a potential to interact or otherwise come
			 into contact with safety-critical devices or circuits,</quote> before <quote>is
			 time on duty</quote>;</text>
			</paragraph><paragraph id="HD2D5E8176EC2497C83D31AC2BB6AED2B"><enum>(2)</enum><text>in subsection (e),
			 by adding at the end the following: <quote>Signal employees operating motor
			 vehicles requiring a commercial driver’s license while on duty shall be
			 considered covered service.</quote>; and</text>
			</paragraph><paragraph id="H3099366E88B649A18247FA18B2BF7934"><enum>(3)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H0806EB12B92F4586A7EB2695ECECF30C" style="OLC">
					<subsection id="HF5D6421B36BB48F8A1C96A4226A8C3B1"><enum>(f)</enum><header>Safety-Critical
				devices or circuits</header><text display-inline="yes-display-inline">Time on
				duty shall include all work where there is a potential to interact or otherwise
				come into contact with safety-critical devices or
				circuits.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HFE732E871CF84195B477ED8489B5DAD8"><enum>8.</enum><header>Limitations on
			 duty hours of dispatching service employees and yardmaster
			 employees</header><text display-inline="no-display-inline">Section 21106 (as so
			 redesignated by section 2 of this Act) of chapter 211 of title 49, United
			 States Code, is amended—</text>
			<paragraph id="HAECC24591CD04874A253A571D285EA52"><enum>(1)</enum><text>in the section
			 heading by inserting <quote><header-in-text level="section" style="USC">and
			 yardmaster employees</header-in-text></quote> after <quote><header-in-text level="section" style="USC">service employees</header-in-text></quote>;</text>
			</paragraph><paragraph id="H8FE34DA666114B6AB7B7EE424D3AB063"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H057E46DB83F64510852E1024AF16CD38"><enum>(A)</enum><text>by striking
			 <quote>21103 or 21104</quote> and inserting <quote>21104 or 21105</quote>;
			 and</text>
				</subparagraph><subparagraph id="H24F0C36DCC2D46D2BF4C4937FB45C022"><enum>(B)</enum><text>by inserting
			 <quote>or yardmaster employee</quote> after <quote>service
			 employee</quote>;</text>
				</subparagraph></paragraph><paragraph id="H3B0A4C28D26F49DD8119D8DCED23D87E"><enum>(3)</enum><text>in subsection (b),
			 by inserting <quote>or yardmaster employee</quote> after <quote>a dispatching
			 service employee</quote>;</text>
			</paragraph><paragraph id="H6949FB6E22054DBE8E71D98D79BF4250"><enum>(4)</enum><text>in subsection (c),
			 by adding at the end the following: <quote>All commingle service involving
			 yardmaster service and dispatcher service mixing with freight service shall be
			 covered under the provisions of section 21104.</quote>; and</text>
			</paragraph><paragraph id="H3153107D0FAF412EA99C4F1B9FB6C284"><enum>(5)</enum><text>in subsection (d),
			 by inserting <quote>or yardmaster employee</quote> after <quote>dispatching
			 service employee</quote>.</text>
			</paragraph></section><section id="H5CF4A350D12D463D9A69EC9D1920A053"><enum>9.</enum><header>Clerical
			 amendment</header><text display-inline="no-display-inline">Chapter 211 of title
			 49, United States Code, is further amended by amending the table of sections at
			 the beginning of the chapter to read as follows:</text>
