		<section id="H75634A5B7DD34B1BA36E581CC8AD912A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Jobs in Your State Act of
			 2010</short-title></quote>.</text>
		</section><section id="HC7BA6AA742A54BC9904038B35C9BFD4E"><enum>2.</enum><header>Prohibition on
			 use of certain stimulus and disaster relief funds for business relocation
			 incentives</header>
			<subsection id="H45270C3FA1B64F9A96FF65FD41AF6A90"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A State or a
			 political subdivision of a State may not use any funds described in subsection
			 (b) as an incentive for a business—</text>
				<paragraph id="H0063B3D5CCDD4CA98C8117AF4653232C"><enum>(1)</enum><text>to relocate a
			 plant, facility, or other operation, in whole or in part, from one State to
			 another; or</text>
				</paragraph><paragraph id="H49BC332DFAA5497DB38B6612210FF8B0"><enum>(2)</enum><text>to expand such an
			 operation in a State in a manner that will result in a reduction in such an
			 operation in another State.</text>
				</paragraph></subsection><subsection id="H30735829DD4B4333828B02B088B3ECC9"><enum>(b)</enum><header>Funds
			 described</header><text display-inline="yes-display-inline">The funds described
			 in this subsection are the following:</text>
				<paragraph id="HD53F1B5808FC4AD0BFA7EA6DD482C389"><enum>(1)</enum><text display-inline="yes-display-inline">Funds made available under any of the
			 following:</text>
					<subparagraph id="H8B9B83DEFE46452DB0F9760446477156"><enum>(A)</enum><text>The American
			 Recovery and Reinvestment Act of 2009 (Public Law 111–5) or any amendment made
			 by such Act.</text>
					</subparagraph><subparagraph id="HFC9ED95CDE4A4F0ABF42EDDB799C6620"><enum>(B)</enum><text display-inline="yes-display-inline">The Hiring Incentives to Restore Employment
			 Act (Public Law 111–147) or any amendment made by such Act.</text>
					</subparagraph><subparagraph id="HF2F42EC1D9144516A003DA2536B66518"><enum>(C)</enum><text>Public Law 111–226
			 (relating to education jobs and Medicaid payments to States) or any amendment
			 made by such Public Law.</text>
					</subparagraph><subparagraph id="H4DF60D79E5224B2793BAAB3F2454400F"><enum>(D)</enum><text>The Small Business
			 Jobs Act of 2010 (H.R. 5297, as enacted into law) or any amendment made by such
			 Act.</text>
					</subparagraph><subparagraph id="H1140A17D16F5421EA4A5223E630ACA38"><enum>(E)</enum><text>The Robert T.
			 Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5211 et
			 seq.).</text>
					</subparagraph></paragraph><paragraph id="HCF26435CE41040DF8D97D999BF6B7537"><enum>(2)</enum><text>Funds for disaster
			 relief administered by the Secretary of Homeland Security.</text>
				</paragraph></subsection><subsection id="H67D1F602F49140C5962BE2C18243FB37"><enum>(c)</enum><header>Enforcement</header>
				<paragraph id="H81E54F8167C74762A51963B55BAD69BA"><enum>(1)</enum><header>Petition</header>
					<subparagraph id="H350F653A18C34632B7AD1F50498F6239"><enum>(A)</enum><header>By political
			 subdivision of State to Governor</header><text display-inline="yes-display-inline">A political subdivision of a State may
			 submit to the Governor of such State a petition stating that the political
			 subdivision has been adversely affected by a violation of subsection (a) and
			 requesting that the Governor submit to the Secretary of Commerce a petition for
			 an investigation of whether a violation has occurred.</text>
					</subparagraph><subparagraph id="H9C6EC254F8F14A3D88B7C3A08E507079"><enum>(B)</enum><header>By Governor to
			 Secretary of Commerce</header><text>A Governor who receives a petition under
			 subparagraph (A) may submit to the Secretary of Commerce a petition for an
			 investigation of whether a violation of subsection (a) has occurred.</text>
					</subparagraph></paragraph><paragraph id="H57924020B8ED4FC2B3D20FD9EEB869BE"><enum>(2)</enum><header>Investigation by
			 Secretary of Commerce</header><text display-inline="yes-display-inline">Upon
			 receiving a petition from a Governor under paragraph (1)(B), the Secretary of
			 Commerce shall conduct an investigation to determine whether a violation of
			 subsection (a) has occurred.</text>
				</paragraph><paragraph id="H91A9030937C9482AA94E03958527DBF3"><enum>(3)</enum><header>Results of
			 investigation; referral to Secretary of the Treasury</header><text>If the
			 Secretary of Commerce determines under paragraph (2) that a violation of
			 subsection (a) has occurred, the State that committed the violation (or in the
			 case of a violation by a political subdivision of a State, the State of which
			 such political subdivision is a part) shall be liable to the United States for
			 the amount of funds used in violation of such subsection. The Secretary of
			 Commerce shall inform the Secretary of the Treasury that the United States has
			 a claim against such State.</text>
				</paragraph><paragraph id="H4E3048DA9A364BAAB495C946D4181627"><enum>(4)</enum><header>Collection by
			 Secretary of the Treasury</header><text display-inline="yes-display-inline">If
			 the Secretary of the Treasury is informed under paragraph (3) that the United
			 States has a claim against a State, the Secretary shall take such action as is
			 necessary to collect on such claim.</text>
				</paragraph><paragraph id="HAB5FF1C798EE4288B0456081869ED140"><enum>(5)</enum><header>Prohibition on
			 receipt of certain funds until repayment made</header><text>A State that is
			 determined to be liable to the United States under paragraph (3) shall not
			 receive any funds described in subsection (b) during the period beginning on
			 the date of the determination of liability and ending on the date on which the
			 State fully repays to the United States the amount of funds used in violation
			 of subsection (a).</text>
				</paragraph><paragraph id="H9BBC02AA35B14B3B9B4B39A0760F0405"><enum>(6)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection shall be construed to
			 limit the authority or responsibility of any other Federal official to enforce
			 subsection (a) under other Federal law.</text>
				</paragraph></subsection><subsection id="H61A70919D6404617AABC75706E7806C5"><enum>(d)</enum><header>GAO
			 report</header><text>Biannually during the 5-year period that ends on the date
			 that is 5 years after the date of the enactment of this Act, the Comptroller
			 General of the United States shall submit to the Committee on Energy and
			 Commerce of the House of Representatives and the Committee on Commerce,
			 Science, and Transportation of the Senate a report on the impact of the
			 preceding provisions of this section. Such a report shall include, for the
			 period covered by the report—</text>
				<paragraph id="HF91ACC636FA64B198C89402CF789A408"><enum>(1)</enum><text>a
			 statement of the number of petitions received by the Secretary of Commerce
			 under subsection (c)(1)(B) and a summary of the disposition of such petitions,
			 including a list of the instances in which the Secretary found violations of
			 subsection (a);</text>
				</paragraph><paragraph id="HB16629B6B84B45D1A82B95911CDAC2F0"><enum>(2)</enum><text display-inline="yes-display-inline">a list of any claims of the United States
			 described in subsection (c)(3) that arose, were outstanding, or were collected
			 in whole or in part; and</text>
				</paragraph><paragraph id="H67564D72A4434A6E9C0AB60D0E13485A"><enum>(3)</enum><text>a
			 list of any funds that were withheld under subsection (c)(5).</text>
				</paragraph></subsection><subsection commented="no" id="H752C42D902D44BE79405F155C4D56E75"><enum>(e)</enum><header>State
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <term>State</term> includes the District of Columbia, the Commonwealth of
			 Puerto Rico, Guam, the United States Virgin Islands, American Samoa, and the
			 Commonwealth of the Northern Mariana Islands.</text>
			</subsection><subsection id="H6B0CF5E44D7148E4A0C10797C6E5351E"><enum>(f)</enum><header>Effective
			 date</header><text>This section shall apply with respect to funds obligated by
			 a State or a political subdivision of a State after the date of the enactment
			 of this Act.</text>
