		<official-title>To amend the Help America Vote Act of 2002 to require
		  that States certify that aliens are prohibited from voting in elections for
		  State or local office as a condition of receiving funds under such Act, and for
		  other purposes.</official-title>

		<section id="H05CFCEDE7EF6496CB1AFDB96FDD2D846" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Voter Integrity
			 Act</short-title></quote>.</text>
		</section><section id="H2288ECDE99F44E179C3C8360D2CC1C55"><enum>2.</enum><header>Prohibition on
			 voting by aliens as condition of receiving certain funds under Help America
			 Vote Act of 2002</header>
			<subsection id="H120F580B09884C3CA2C12FDC1C6C2DE4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title IX of the Help
			 America Vote Act of 2002 (42 U.S.C. 15541 et seq.) is amended by adding at the
			 end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H06C33BD78B19447898FD0E7BC189F4B8" style="OLC">
					<section id="H585EF9F2345E4F8E9FE86894B8670A21"><enum>907.</enum><header>Prohibition on
				voting by aliens as condition of receiving certain funds</header>
						<subsection id="HAF57E99FD52445B3B63DB30C2CCF4947"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A grant or other
				payment under this Act may not be made to a State after the date of the
				enactment of this section unless such State certifies that—</text>
							<paragraph id="H0B17ECEDFBD5412C90F6DDEE7EAB8E3C"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to an election for State or
				local office administered by such State or a unit of local government in such
				State after the date of the receipt of such grant or other payment, at the time
				of such certification and at the time of such election, the laws of such State
				prohibit an alien from voting in such election; and</text>
							</paragraph><paragraph id="H9776B8776C994353A183C5BC63AE1CA1"><enum>(2)</enum><text>such State will
				make a good-faith effort to enforce the prohibition described in paragraph
				(1).</text>
							</paragraph></subsection><subsection id="H64FAB8F56873454AA46E11C9F7934817"><enum>(b)</enum><header>False
				certification</header><text display-inline="yes-display-inline">If a Federal
				agency making a grant or other payment to a State under this Act determines
				that such State has made a false certification under subsection (a)—</text>
							<paragraph id="HE11E58FAD0A54980B5B5540EDF110CD7"><enum>(1)</enum><text>such State shall
				repay to the United States an amount equal to the portion of all grants or
				other payments under this Act made by such agency and received by such State
				during the period beginning on the day after the date of the enactment of this
				section and ending on the date of the determination; and</text>
							</paragraph><paragraph id="HAC00FC20B8FD49F4A838248272C223A7"><enum>(2)</enum><text>an additional
				grant or other payment under this Act may not be made to such State
				until—</text>
								<subparagraph id="HC6F26C4BB35947BE8CF8A5D13557997A"><enum>(A)</enum><text>the repayment
				required by paragraph (1) has been completed; and</text>
								</subparagraph><subparagraph id="H2990B017628F4F98BB8788EF2910A365"><enum>(B)</enum><text>such State
				demonstrates to the satisfaction of the Federal agency making such grant or
				other payment that the certifications required by subsection (a) are
				true.</text>
								</subparagraph></paragraph></subsection><subsection id="H9E5564FAE7F04A76BB7542F5552B3629"><enum>(c)</enum><header>Exceptions</header>
							<paragraph id="HA8AE8B863D8740769E3E494F4F3ACFFF"><enum>(1)</enum><header>Voting by
				certain alien members of the Armed Forces</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to prohibit a State from allowing to vote in an election for State or local
				office a person who may be naturalized under section 329 of the Immigration and
				Nationality Act (8 U.S.C. 1440) by reason of active-duty service as a member of
				the Selected Reserve of the Ready Reserve or in an active-duty status in the
				military, air, or naval forces of the United States during the period
				designated by the President in Executive Order 13269.</text>
							</paragraph><paragraph id="HBBB7C29902C741F0A97FD58338429A62"><enum>(2)</enum><header>Certain funds
				for assisting absent uniformed services voters and overseas
				voters</header><text>This section shall not apply with respect to requirements
				payments described in section 251(b)(3).</text>
							</paragraph></subsection><subsection id="HE44C873FF1CB4A3AB5E329BB1860359F"><enum>(d)</enum><header>Alien
				defined</header><text>In this section, the term <term>alien</term> has the
				meaning given such term in section 101(a)(3) of the Immigration and Nationality
				Act (8 U.S.C.
				1101(a)(3)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCE67BAC4E41B4BCB865197705264C81F"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents in section 1(b) of such Act (42
			 U.S.C. 15301 note) is amended by inserting after the item relating to section
			 906 the following new item:</text>
