		<section display-inline="no-display-inline" id="H8555622CA2E841B1A9111D1ADCFBF062" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Emergency Centers
			 Establishment Act</short-title></quote>.</text>
		</section><section id="H5262D9CA3F3F4ABF92662B5EE48ACF55"><enum>2.</enum><header>Establishment of
			 national emergency centers</header>
			<subsection id="H2328FB04589146E6825CB2FBDE939AF4"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the requirements of this Act, the
			 Secretary of Homeland Security shall establish not fewer than 6 national
			 emergency centers on military installations.</text>
			</subsection><subsection id="H55E23372A6174C9AB5028C51D3F59A0E"><enum>(b)</enum><header>Purpose of
			 national emergency centers</header><text>The purpose of a national emergency
			 center shall be to use existing infrastructure—</text>
				<paragraph id="H579AF05CBB6749C09858463889588F3F"><enum>(1)</enum><text>to provide
			 temporary housing, medical, and humanitarian assistance to individuals and
			 families dislocated due to an emergency or major disaster;</text>
				</paragraph><paragraph id="HCFCB35ACA92E4F1BB54488E85BA7ADD1"><enum>(2)</enum><text>to provide
			 centralized locations for the purposes of training and ensuring the
			 coordination of Federal, State, and local first responders;</text>
				</paragraph><paragraph id="HF40690E5883E4D60A7DEBBC947A5BE95"><enum>(3)</enum><text>to provide
			 centralized locations to improve the coordination of preparedness, response,
			 and recovery efforts of government, private, and not-for-profit entities and
			 faith-based organizations; and</text>
				</paragraph><paragraph id="H965D809E3A374C59B824A01BD254152A"><enum>(4)</enum><text>to meet other
			 appropriate needs, as determined by the Secretary of Homeland Security.</text>
				</paragraph></subsection></section><section id="HD4CB3B16618C488EAEE28F003F47ECD7"><enum>3.</enum><header>Designation of
			 military installations as national emergency centers</header>
			<subsection id="H22CDB69C6B4A4E39820174D657EA024F"><enum>(a)</enum><header>In
			 general</header><text>Not later than 60 days after the date of the enactment of
			 this Act, the Secretary of Homeland Security, in consultation with the
			 Secretary of Defense, shall designate not fewer than 6 military installations
			 as sites for the establishment of national emergency centers.</text>
			</subsection><subsection id="HDEE43CE55A344B13BBF0C060FBB429CB"><enum>(b)</enum><header>Minimum
			 requirements</header><text>A site designated as a national emergency center
			 shall be—</text>
				<paragraph id="HD3B262F218F745E69137F35DCFA8D51E"><enum>(1)</enum><text>capable of meeting
			 for an extended period of time the housing, health, transportation, education,
			 public works, humanitarian and other transition needs of a large number of
			 individuals affected by an emergency or major disaster;</text>
				</paragraph><paragraph id="H373730C7584F4E33B549CBF8E2E25FE8"><enum>(2)</enum><text>environmentally
			 safe and shall not pose a health risk to individuals who may use the
			 center;</text>
				</paragraph><paragraph id="H0F583A79BB3B4D9BAB83E8CF44EBDF42"><enum>(3)</enum><text>capable of being
			 scaled up or down to accommodate major disaster preparedness and response
			 drills, operations, and procedures;</text>
				</paragraph><paragraph id="H68367FAA39794C22926FC1584DF60646"><enum>(4)</enum><text>capable of housing
			 existing permanent structures necessary to meet training and first responders
			 coordination requirements during nondisaster periods;</text>
				</paragraph><paragraph id="HDCFDBBCFFF7B4FFBA71162071C8876C6"><enum>(5)</enum><text>capable of hosting
			 the infrastructure necessary to rapidly adjust to temporary housing, medical,
			 and humanitarian assistance needs;</text>
				</paragraph><paragraph id="HC5F3AD080B7E4CF3A5290A43DEA1ABF4"><enum>(6)</enum><text>required to
			 consist of a complete operations command center, including 2 state-of-the art
			 command and control centers that will comprise a 24/7 operations watch center
			 as follows:</text>
					<subparagraph id="H3ECDE027BEE942799DDB5B722B0B3DE1"><enum>(A)</enum><text>one of the command
			 and control centers shall be in full ready mode; and</text>
					</subparagraph><subparagraph id="HE35F0C4D0276494BB5F16CE44F045295"><enum>(B)</enum><text>the other shall
			 be used daily for training; and</text>
					</subparagraph></paragraph><paragraph id="HC0726D7E049A435EBB802350EF04B726"><enum>(7)</enum><text>easily accessible
			 at all times and be able to facilitate handicapped and medical facilities,
			 including during an emergency or major disaster.</text>
				</paragraph></subsection><subsection id="H7777C679FBEC4A75981FDCF733729951"><enum>(c)</enum><header>Location of
			 national emergency centers</header><text>There shall be established not fewer
			 than one national emergency center in each of the following areas:</text>
				<paragraph id="HD8D699E087444C7FBFFBFC3381AB8B68"><enum>(1)</enum><text>The area
			 consisting of Federal Emergency Management Agency Regions I, II, and
			 III.</text>
				</paragraph><paragraph id="H75E709D23CD4462C912F64C6BB9370CF"><enum>(2)</enum><text>The area
			 consisting of Federal Emergency Management Agency Region IV.</text>
				</paragraph><paragraph id="HDC4F9C33FFFE49F0B82252A66570664E"><enum>(3)</enum><text>The area
			 consisting of Federal Emergency Management Agency Regions V and VII.</text>
				</paragraph><paragraph id="H53307EE0E08346B2869BB9C99BCC3F35"><enum>(4)</enum><text>The area
			 consisting of Federal Emergency Management Agency Region VI.</text>
				</paragraph><paragraph id="H8BA5B0CE1D154407B125451F5E2652F4"><enum>(5)</enum><text>The area
			 consisting of Federal Emergency Management Agency Regions VIII and X.</text>
				</paragraph><paragraph id="HB9C3FAAAA96B40C8861918448548A500"><enum>(6)</enum><text>The area
			 consisting of Federal Emergency Management Agency Region IX.</text>
				</paragraph></subsection><subsection id="H6DE5E3B1B8044ED3A60C5364FCB0F813"><enum>(d)</enum><header>Preference for
			 designation of closed military installations</header><text>Wherever possible,
			 the Secretary of Homeland Security, in consultation with the Secretary of
			 Defense, shall designate a closed military installation as a site for a
			 national emergency center. If the Secretaries of Homeland Security and Defense
			 jointly determine that there is not a sufficient number of closed military
			 installations that meet the requirements of subsections (b) and (c), the
			 Secretaries shall jointly designate portions of existing military installations
			 other than closed military installations as national emergency centers.</text>
			</subsection><subsection id="HC7E6710E32FE4A988F5D8705E5F94F06"><enum>(e)</enum><header>Transfer of
			 control of closed military installations</header><text>If a closed military
			 installation is designated as a national emergency center, not later than 180
			 days after the date of designation, the Secretary of Defense shall transfer to
			 the Secretary of Homeland Security administrative jurisdiction over such closed
			 military installation.</text>
			</subsection><subsection id="H6D41FB8633594AF0AA6A711F225FC1C1"><enum>(f)</enum><header>Cooperative
			 agreement for joint use of existing military installations</header><text>If an
			 existing military installation other than a closed military installation is
			 designated as a national emergency center, not later than 180 days after the
			 date of designation, the Secretary of Homeland Security and the Secretary of
			 Defense shall enter into a cooperative agreement to provide for the
			 establishment of the national emergency center.</text>
			</subsection><subsection id="H5A59C61548614C68BCBDEA17A14BD220"><enum>(g)</enum><header>Reports</header>
				<paragraph id="HD2831F60E00A4D9C8C77C356E9158D50"><enum>(1)</enum><header>Preliminary
			 report</header><text>Not later than 90 days after the date of the enactment of
			 this Act, the Secretary of Homeland Security, acting jointly with the Secretary
			 of Defense, shall submit to Congress a report that contains for each designated
			 site—</text>
					<subparagraph id="HFB43BC39980746FD99E55A797447E683"><enum>(A)</enum><text>an outline of the
			 reasons why the site was selected;</text>
					</subparagraph><subparagraph id="H66576F85576F490BA27C5FC8F1507307"><enum>(B)</enum><text>an outline of the
			 need to construct, repair, or update any existing infrastructure at the
			 site;</text>
					</subparagraph><subparagraph id="HBE3ADBDAB18843CAA83666473856E95B"><enum>(C)</enum><text>an outline of the
			 need to conduct any necessary environmental clean-up at the site;</text>
					</subparagraph><subparagraph id="H57680F15848647DB819F2E5F7848C220"><enum>(D)</enum><text>an outline of
			 preliminary plans for the transfer of control of the site from the Secretary of
			 Defense to the Secretary of Homeland Security, if necessary under subsection
			 (e); and</text>
					</subparagraph><subparagraph id="H4DC2B900621D4BC891B28080CD8DBD62"><enum>(E)</enum><text>an outline of
			 preliminary plans for entering into a cooperative agreement for the
			 establishment of a national emergency center at the site, if necessary under
			 subsection (f).</text>
					</subparagraph></paragraph><paragraph id="HB11C92477A3C4658B503F277F81819AD"><enum>(2)</enum><header>Update
			 report</header><text display-inline="yes-display-inline">Not later than 120
			 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security, acting jointly with the Secretary of Defense, shall submit to
			 Congress a report that contains for each designated site—</text>
					<subparagraph id="H3A93B1EF41B54693A4D04F0EB2C9BD7C"><enum>(A)</enum><text>an update on the
			 information contained in the report as required by paragraph (1);</text>
					</subparagraph><subparagraph id="H2D9E8C0A5D9B49F6A55DACC3841BDFBD"><enum>(B)</enum><text>an outline of the
			 progress made toward the transfer of control of the site, if necessary under
			 subsection (e);</text>
					</subparagraph><subparagraph id="HA99F7BB735B6453080A6F0013C4BB433"><enum>(C)</enum><text>an outline of the
			 progress made toward entering a cooperative agreement for the establishment of
			 a national emergency center at the site, if necessary under subsection (f);
			 and</text>
					</subparagraph><subparagraph id="HA10E8D717B7D4B8483A0364C0C355D49"><enum>(D)</enum><text>recommendations
			 regarding any authorizations and appropriations that may be necessary to
			 provide for the establishment of a national emergency center at the
			 site.</text>
					</subparagraph></paragraph><paragraph id="HAB6310663D2C4E7A8022B4FA68EDDF73"><enum>(3)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Secretary of Homeland
			 Security, acting jointly with the Secretary of Defense, shall submit to
			 Congress a report that contains for each designated site—</text>
					<subparagraph id="HE50332B564C34364B8D2F150289C0ED6"><enum>(A)</enum><text>finalized
			 information detailing the transfer of control of the site, if necessary under
			 subsection (e);</text>
					</subparagraph><subparagraph id="H301186A671D14D2FB21F7C3D96708E11"><enum>(B)</enum><text>the finalized
			 cooperative agreement for the establishment of a national emergency center at
			 the site, if necessary under subsection (f); and</text>
					</subparagraph><subparagraph id="H1332001DB8754BA29C277E385BB23188"><enum>(C)</enum><text>any additional
			 information pertinent to the establishment of a national emergency center at
			 the site.</text>
					</subparagraph></paragraph><paragraph id="H63439932720E459785DA48B782FD1431"><enum>(4)</enum><header>Additional
			 reports</header><text>The Secretary of Homeland Security, acting jointly with
			 the Secretary of Defense, may submit to Congress additional reports as
			 necessary to provide updates on steps being taken to meet the requirements of
			 this Act.</text>
				</paragraph></subsection></section><section id="HEC518028C23F48E48A3D82A07F4549EC"><enum>4.</enum><header>Limitations on
			 statutory construction</header><text display-inline="no-display-inline">This
			 Act does not affect—</text>
			<paragraph id="H75CF44E7CFC04C298D04E9875FE6E8A5"><enum>(1)</enum><text>the authority of
			 the Federal Government to provide emergency or major disaster assistance or to
			 implement any disaster mitigation and response program, including any program
			 authorized by the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (42 U.S.C. 5121 et seq.); or</text>
			</paragraph><paragraph id="H26B253C8B74F4F72B0A1343BFB0461DB"><enum>(2)</enum><text>the authority of a
			 State or local government to respond to an emergency.</text>
			</paragraph></section><section id="H675DF3E9E6694C0C8B385890FDA04660"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated $180,000,000 for each of fiscal years 2009 and
			 2010 to carry out this Act. Such funds shall remain available until
			 expended.</text>
		</section><section id="H52412781B5714D03A7066FEFA6CCF604"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="HA7F89E1E261245858935414EB6F775EF"><enum>(1)</enum><header>Closed military
			 installation</header><text>The term <term>closed military installation</term>
			 means a military installation, or portion thereof, approved for closure or
			 realignment under the Defense Base Closure and Realignment Act of 1990 (part A
			 of title XXIX of Public Law 101–510; 10 U.S.C. 2687 note) that meet all, or 2
			 out of the 3 following requirements:</text>
				<subparagraph id="HFAE8578D03FA4BBC9925A392630F0ABC"><enum>(A)</enum><text>Is located in
			 close proximity to a transportation corridor.</text>
				</subparagraph><subparagraph id="H65D6A41C03B84EE1BF79FA097B35D0D4"><enum>(B)</enum><text>Is located in a
			 State with a high level or threat of disaster related activities.</text>
				</subparagraph><subparagraph id="H379678B9A9F54763AAFC01DC0BADDAF7"><enum>(C)</enum><text>Is located near a
			 major metropolitan center.</text>
				</subparagraph></paragraph><paragraph id="HCEE84426B9F04F688DCF088229197E6A"><enum>(2)</enum><header>Emergency</header><text display-inline="yes-display-inline">The term <term>emergency</term> has the
			 meaning given such term in section 102 of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (42 U.S.C. 5122).</text>
			</paragraph><paragraph id="H416EF111F5B248068BE7EB754E71AFC9"><enum>(3)</enum><header>Major
			 disaster</header><text>The term <term>major disaster</term> has the meaning
			 given such term in section 102 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (42 U.S.C. 5122).</text>
			</paragraph><paragraph id="H41615512F6244766B4AEF8E7253E2DDA"><enum>(4)</enum><header>Military
			 installation</header><text>The term <term>military installation</term> has the
			 meaning given such term in section 2910 of the Defense Base Closure and
			 Realignment Act of 1990 (part A of title XXIX of Public Law 101–510; 10 U.S.C.
			 2687 note).</text>
