		<section id="H2C600ADFFF1948B7920708A081F91950" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>No Health Care Subsidies for Illegal
			 Aliens Act of 2010</short-title></quote>.</text>
		</section><section id="H7574664B73BF4F54A61D68E08E6835FA"><enum>2.</enum><header>Procedures for
			 eligibility determinations under title I of the Patient Protection and
			 Affordable Care Act</header>
			<subsection id="HD81F7471786248529CE150DA06B0E3B2"><enum>(a)</enum><header>Requirements for
			 in-Person attestation of citizenship status or status as eligible lawful
			 permanent resident</header><text display-inline="yes-display-inline">Section
			 1411 of the Patient Protection and Affordable Care Act is amended—</text>
				<paragraph id="H2061A2534BCB41F3A0FBFDD78A3E4495"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote><header-in-text level="subsection" style="OLC">Establishment
			 of program.—</header-in-text></quote> and all that follows through
			 <quote>determining—</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Verification process.—</header-in-text>The
			 Secretary shall ensure that eligibility determinations required by this Act are
			 conducted in accordance with the requirements of this section, including
			 requirements for determining—</quote>;</text>
				</paragraph><paragraph id="HB997BEB968354A4B93EEAD162FF643DD"><enum>(2)</enum><text>in subsection
			 (a)(1), by inserting <quote>eligible</quote> before <quote>alien</quote>;
			 and</text>
				</paragraph><paragraph id="HC696BB7BAEEA4FE9A03CBD77813C55F3"><enum>(3)</enum><text>in subsection
			 (b)(1)—</text>
					<subparagraph id="HA798DFEE64C345D8A970DA57F8F443E3"><enum>(A)</enum><text>by striking
			 <quote>provide—</quote> and inserting <quote>appear in person to provide the
			 Exchange with the following:</quote>; and</text>
					</subparagraph><subparagraph id="H8F3532DDA4CE455FBE2F99A0F127BC74"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as
			 subparagraph (C), by striking <quote>and</quote> at the end of subparagraph
			 (A), and by inserting after subparagraph (A) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H7E63971EE1664A92AF37C1DC2B3881FA" style="OLC">
							<subparagraph id="H99C6D56800724AB7AA787EFBDA8DE366"><enum>(B)</enum><text display-inline="yes-display-inline">a sworn statement, under penalty of
				perjury, specifically attesting to the fact that the enrollee is either—</text>
								<clause id="H85B069AB4D5A4F43AE1C8561A0F7DBCB"><enum>(i)</enum><text>a
				citizen or national of the United States; or</text>
								</clause><clause id="HADED25AB0AE441268EBE6DF20EA60DB4"><enum>(ii)</enum><text>an alien who
				meets the requirements under under subsection (a)(1) for eligibility for
				coverage under a qualified health plan offered through an Exchange;
				and</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HD41A563BA2F840F8AEB234ACA6529F7C"><enum>(b)</enum><header>Requirements for
			 establishment of status</header>
				<paragraph id="HCF3670A3925743B0B2703196D587EFA9"><enum>(1)</enum><header>In
			 general</header><text>Section 1411(b)(2) of such Act is amended by striking
			 subparagraphs (A) and (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6D4C036F5640453BB956A8C3AC25B918" style="OLC">
						<subparagraph id="H24C14437998047E09BA2882ADC4A1A73"><enum>(A)</enum><header>Evidence of
				citizenship or nationality</header><text display-inline="yes-display-inline">In
				the case of an enrollee whose eligibility is based on attestation of
				citizenship of the enrollee, satisfactory evidence, provided by the applicant,
				of citizenship or nationality (within the meaning of section 1903(x) of the
				Social Security Act (42 U.S.C. 1396b)).</text>
						</subparagraph><subparagraph id="HBF85CCD8295146649DAA8434BEED7D0C"><enum>(B)</enum><header>Evidence of
				satisfactory immigration status</header><text>In the case of an enrollee whose
				eligibility is based on attestation of the enrollee’s immigration
				status—</text>
							<clause id="H0CA38B88A55646BAB3A81506EB4D8D4E"><enum>(i)</enum><text>such information
				as is necessary for the applicant to demonstrate that the enrollee is in
				‘‘satisfactory immigration status’’ as defined and in accordance with the
				Systematic Alien Verification for Entitlements (SAVE) program established by
				section 1137 of the Social Security Act (42 U.S.C. 1320b–7), and</text>
							</clause><clause id="H135F4CDB3B5F4A0BADC2AEDA901F6B9A"><enum>(ii)</enum><text>such other
				additional identifying information as the Secretary, in consultation with the
				Secretary of Homeland Security, may require in order for the applicant to
				demonstrate satisfactory immigration status of the
				enrollee.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCEF5923BF0754348B58D8BC1C4F85B43"><enum>(2)</enum><header>Verification of
			 eligibility by Exchange through documentation</header>
					<subparagraph id="HA8E760F6E7AB4851818F082EA0509851"><enum>(A)</enum><header>Eligibility
			 verification by Exchange</header><text>Section 1411(c) of such Act is
			 amended—</text>
						<clause id="H962F1868BAB74EFA833F64AA392D9CB3"><enum>(i)</enum><text>by
			 striking the subsection heading and inserting <quote><header-in-text level="subsection" style="OLC">Verification of eligibility through
			 documentation.—</header-in-text></quote>; and</text>
						</clause><clause id="H793027BC3F004A57870CA962301E7162"><enum>(ii)</enum><text>by
			 striking paragraphs (1) and (2) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H151DC9ACBFB847CFA5BB4E2CBBBB4565" style="OLC">
								<paragraph id="H0DBEA2A353D3404EBCEC40DC44070487"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each Exchange shall
				conduct eligibility verification, using the information provided by an
				applicant under subsection (b), in accordance with this subsection.</text>
								</paragraph><paragraph id="HFAB113E3E82C49AA9A2B79D1CD94CB54"><enum>(2)</enum><header>Verification of
				citizenship or immigration status</header>
									<subparagraph id="H16686F199D45495CB0F5AB4BC3B389AC"><enum>(A)</enum><header>Verification of
				attestation of citizenship</header><text>Each Exchange shall verify, based on
				satisfactory documentary evidence of citizenship or nationality provided in
				accordance with subsection (b)(2)(A), the eligibility for enrollment of each
				individual who has been attested by an applicant, as required by subsection
				(b)(1)(B), to be a citizen or national of the United States.</text>
									</subparagraph><subparagraph id="HEE0C757B42314878B2C3B4F536C99755"><enum>(B)</enum><header>Verification of
				attestation of eligible immigration status</header><text display-inline="yes-display-inline">Each Exchange shall verify, based on
				evidence provided pursuant to subsection (b)(2)(B), the eligibility for
				enrollment of each individual who has been attested by an applicant, as
				required by subsection (b)(1)(B), to be an alien who is eligible for coverage
				under a qualified health plan offered through an
				Exchange.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HF9DF207DC9874A2A9A280FE8A25EB79D"><enum>(B)</enum><header>Documentation
			 provided with application</header><text display-inline="yes-display-inline">Section 1411(b)(1)(C) of such Act (as
			 redesignated under subsection (a)(3)(A)) is amended by inserting <quote>and
			 documentation thereof in accordance with this section</quote> before the
			 period.</text>
					</subparagraph></paragraph><paragraph id="HF1C9BD8440704EECAA191E3000B0ED1C"><enum>(3)</enum><header>Elimination of
			 Secretarial authority to make modifications to methods for
			 verification</header><text>Section 1411(c)(4) of such Act is amended—</text>
					<subparagraph id="HD5FCEF9FEEE043A99C32F76FD6E90AE7"><enum>(A)</enum><text>by striking
			 <quote><header-in-text level="subparagraph" style="OLC">Methods.—</header-in-text></quote> and all that follows through
			 <quote>The Secretary, in consultation</quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">Methods.—</header-in-text>The Secretary, in
			 consultation</quote>;</text>
					</subparagraph><subparagraph id="HCCDC2F1895E54C4693F75D593AB0DC79"><enum>(B)</enum><text>by striking
			 subparagraph (B); and</text>
					</subparagraph><subparagraph id="H6D3B6FE7AD3E439B831E022E1F5D2514"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) and (ii) as
			 subparagraphs (A) and (B), respectively.</text>
					</subparagraph></paragraph><paragraph id="H41CCE169E11A4120B60D04D2C6A92652"><enum>(4)</enum><header>Conforming
			 amendments relating to requirements for Secretarial verification</header>
					<subparagraph id="H434096D205B146B1868F3386D41FFD52"><enum>(A)</enum><header>In
			 general</header><text>Section 1411 of such Act is amended by striking
			 subsection (d) and redesignating subsections (e) through (i) as subsections (d)
			 through (h), respectively.</text>
					</subparagraph><subparagraph id="HF94F6F999539453C989FC162F08D4801"><enum>(B)</enum><header>Additional
			 conforming amendments</header><text>Subsection (d) of such section 1411 (as
			 redesignated by subparagraph (A)) is amended—</text>
						<clause id="HAE353BF13BE14009A91AD6108DA8609B"><enum>(i)</enum><text>in
			 paragraph (1), by striking the last sentence; and</text>
						</clause><clause id="HA6C1A0CA3F444E4A9AE1D7E4C23D8981"><enum>(ii)</enum><text>in
			 subparagraphs (A) and (B) of paragraph (2), by striking <quote>subsections (c)
			 and (d)</quote> each place it appears and inserting <quote>subsection
			 (c)</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="HBEE7984EAAA74A728A5F274787592D56"><enum>(5)</enum><header>Treatment of
			 inconsistencies in accordance with existing secondary verification
			 process</header><text>Section 1411(d)(3) of such Act (as redesignated by
			 paragraph (4)(A)) is amended by striking <quote>under section 1902(ee) of the
			 Social Security Act (as in effect on January 1, 2010)</quote> and inserting
			 <quote>in accordance with the secondary verification process established
			 consistent with section 1137 of the Social Security Act (as in effect as of
			 January 1, 2009)</quote>.</text>
				</paragraph></subsection></section><section id="H195D3F3CF3EC4615997C82276A611C59"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply as if included in the enactment of the Patient Protection
			 and Affordable Care Act.</text>
