		<official-title>To provide for the adjustment of status for certain
		  long-term conditional residents.</official-title>

		<section id="H771093948AB74C7286CFC929D1642F1B" section-type="section-one"><enum>1.</enum><header>Adjustment of
			 status</header><text display-inline="no-display-inline">Section 245 of the
			 Immigration and Nationality Act (8 U.S.C. 1255) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="HB8A852E113A24732A11B06243713038C" style="OLC">
				<subsection id="HFAD341003F724719BC528E2C6BC8BF45"><enum>(n)</enum><header>Adjustment of
				status for alien entrepreneurs</header>
					<paragraph id="H3BFF4555EBD44DEEBE2A3ED3D9CFCE5A"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Homeland Security shall adjust the
				status of an alien described in paragraph (2) to that of an alien lawfully
				admitted for permanent residency if the alien—</text>
						<subparagraph id="HBBF57CBB0EDD4EEA9C1CD9CCAFC6BB2A"><enum>(A)</enum><text>applies for such
				adjustment;</text>
						</subparagraph><subparagraph id="H12FCFBA6048B4D889316DD5031AE3BBB"><enum>(B)</enum><text>is physically
				present in the United States on the date on which the application for such
				adjustment is filed;</text>
						</subparagraph><subparagraph id="H98B87DE8A1D448A5871C9E607BC0BE8D"><enum>(C)</enum><text>is admissible to
				the United States as an immigrant (except as provided in paragraph (3));
				and</text>
						</subparagraph><subparagraph id="H766C2FA753724F268F96FFA489E1CD5C"><enum>(D)</enum><text>pays the standard
				fee for applicants for adjustment of status under this section.</text>
						</subparagraph></paragraph><paragraph id="H616019D22CEE46CFAFC594CD6B17F2A7"><enum>(2)</enum><header>Aliens eligible
				for adjustment of status</header><text>An alien is described in this paragraph
				if the alien—</text>
						<subparagraph id="H6BBCCC40A8144454950D1A3D0083ECB3"><enum>(A)</enum><text>became a
				conditional resident under this section as an alien entrepreneur, alien spouse,
				or alien child (as such terms are defined in section 216A(f)) on or before
				December 31, 1998;</text>
						</subparagraph><subparagraph id="H8F81DACFADBD41D38D52098397E72262"><enum>(B)</enum><text>filed an
				application to remove his or her conditional resident status on an I–829 form
				on or before December 31, 2000, in accordance with section 216A; and</text>
						</subparagraph><subparagraph id="H4BCC983DC610425BA6C936130C4931E0"><enum>(C)</enum><text>had such form or a
				motion to reopen or reconsider the denial of such form pending before the
				Department of Homeland Security as of the date of the enactment of this
				subsection.</text>
						</subparagraph></paragraph><paragraph id="H79F6E242DDAF4A4ABC0517BE9AF94AA2"><enum>(3)</enum><header>Waiver of
				certain grounds for inadmissibility</header>
						<subparagraph id="HD7951C566C9E46E491C3C02DF7DF832F"><enum>(A)</enum><header>Inapplicable
				provisions</header><text>Paragraphs (5) and (7)(A) of section 212(a) shall not
				apply to an adjustment of status under this subsection.</text>
						</subparagraph><subparagraph id="HE4F1DDEE279A4C4888B9A9CC22448DFF"><enum>(B)</enum><header>Permissible
				waivers</header><text>The Secretary of Homeland Security may waive any other
				provision of section 212(a) (except for paragraphs (2)(C) and (3)) with respect
				to an adjustment of status under this subsection—</text>
							<clause id="H24E30EA033CA418D9CABC301BA51E11A"><enum>(i)</enum><text>for humanitarian
				purposes;</text>
							</clause><clause id="H2E5872F8227141B6A683774E5525823A"><enum>(ii)</enum><text>to assure family
				unity; or</text>
							</clause><clause id="H778D5E97144C45A59F8CFE408D20C5F0"><enum>(iii)</enum><text>if such waiver
				is otherwise in the public
				interest.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
