		  and harm caused by the blowout of the mobile offshore drilling unit Deepwater
		  Horizon and the resulting degradation of the Gulf over time, and for other

		<section id="H18C73FA19BB64FF09A0B7C4A9DA456DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gulf of Mexico Economic and Environmental Restoration Act
			 of 2010</short-title></quote>.</text>
		</section><section id="H86B0FD9BD6804C7AB807315E3C7D0AC9"><enum>2.</enum><header>Gulf of Mexico
			 Recovery Council</header>
			<subsection id="HBEAAD22F290C41C28A0402F98E1ACEA7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Gulf of Mexico
			 Recovery Council.</text>
			</subsection><subsection commented="no" id="H6D3AA1FE77A34C04BF917E09060E6FD1"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The Council shall consist of each member of
			 the Gulf Coast Ecosystem Restoration Task Force established by Executive Order
			 13554 (75 Fed. Reg. 62313).</text>
			</subsection><subsection id="H5638F6AF0729421496FAF2E00A0C5C74"><enum>(c)</enum><header>Chair</header><text display-inline="yes-display-inline">The Chair of the Council shall be the
			 member designated as the Chair of the Gulf Coast Ecosystem Restoration Task
			 Force under Executive Order 13554 (75 Fed. Reg. 62313).</text>
			</subsection><subsection id="H0A55266312544ADAABE0DFD8D3023E24"><enum>(d)</enum><header>Duties of the
			 Council</header><text>The Council shall—</text>
				<paragraph id="H60F5D32D48DC4FDB88E2627553182215"><enum>(1)</enum><text>establish
			 guidelines for State comprehensive restoration plans under section 4(b);</text>
				</paragraph><paragraph id="HA0AE296E7C8345A08A3782E6CA4287AE"><enum>(2)</enum><text display-inline="yes-display-inline">approve or disapprove State comprehensive
			 restoration plans under section 4(d);</text>
				</paragraph><paragraph id="H1A001D64D4E94971B7B4792909A4D2C7"><enum>(3)</enum><text display-inline="yes-display-inline">distribute funds under section 4(e) to
			 States that have State comprehensive restoration plans approved under section
			 4(d);</text>
				</paragraph><paragraph commented="no" id="HF343E5333B3741A6874A54A03A3BB80F"><enum>(4)</enum><text>annually review
			 State comprehensive restoration plans under section 4(e)(2);</text>
				</paragraph><paragraph commented="no" id="H422B0F8A705C44999F711F2B12B1A642"><enum>(5)</enum><text>establish a Gulf
			 of Mexico Observation System under section 5;</text>
				</paragraph><paragraph commented="no" id="HEB30028796C5442DA69EB8ABDE44C8A3"><enum>(6)</enum><text>establish a Gulf
			 of Mexico sea grant program under section 6;</text>
				</paragraph><paragraph id="H886C54F9786140FC8497B5E51BF87DB5"><enum>(7)</enum><text>establish a Gulf
			 of Mexico seafood marketing program under section 7;</text>
				</paragraph><paragraph commented="no" id="H089D1B19CB264B0190B92D04CD55B078"><enum>(8)</enum><text>establish a Gulf
			 of Mexico clean energy program under section 8;</text>
				</paragraph><paragraph id="H4546BE52229D452FA18B66364C4B3498"><enum>(9)</enum><text>establish a Gulf
			 coast-based working group that includes representatives of members of the
			 Council and other local agencies and representatives as appropriate for the
			 purposes of recommending, coordinating, and implementing policies, programs,
			 activities, and projects to accomplish Gulf coast economic development,
			 ecosystem restoration, and public health rehabilitation under this Act;</text>
				</paragraph><paragraph commented="no" id="H7E3DF783610D49FB875F46AF01F87F1A"><enum>(10)</enum><text>coordinate the
			 sharing of scientific information and other research associated with Gulf coast
			 economic development, ecosystem restoration, and public health rehabilitation;
			 and</text>
				</paragraph><paragraph id="H85951C70FAB042C488D643B1D2433FC5"><enum>(11)</enum><text>submit an annual
			 report to Congress under subsection (e).</text>
				</paragraph></subsection><subsection id="H0E13EFE9B0C54BDAA6478CCB7B69DB81"><enum>(e)</enum><header>Report</header><text>Not
			 later than September 30 of each year, the Council shall submit to Congress a
			 report that summarizes the activities of the Council and the policies, plans,
			 activities, and projects carried out under this Act.</text>
			</subsection><subsection commented="no" id="H4D4FD875484940EB8BCBBD21C193F3EB"><enum>(f)</enum><header>Nonapplicability
			 of Federal Advisory Committee Act</header><text>The Federal Advisory Committee
			 Act (5 U.S.C. App.) shall not apply to the Council or the working group
			 established under subsection (d)(9).</text>
			</subsection></section><section id="H9216E974475040C2B3CBD1B5A6C90B6D" section-type="subsequent-section"><enum>3.</enum><header>Gulf of Mexico
			 Economic and Environmental Recovery Fund</header>
			<subsection commented="no" id="HB170A943171C4FD8A83698BDF003FBDF"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the
			 United States a fund to be known as the Gulf of Mexico Economic and
			 Environmental Recovery Fund.</text>
			</subsection><subsection commented="no" id="H9307B52897B9432AAA3FD332BEDBDBFF"><enum>(b)</enum><header>Transfers to
			 fund</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Secretary of the Treasury shall deposit into the
			 Fund amounts equal to not less than 80 percent of any amounts collected by the
			 United States before, on, or after the date of the enactment of this Act as
			 penalties, settlements, or fines under sections 309 and 311 of the Federal
			 Water Pollution Control Act (33 U.S.C. 1319, 1321) in relation to the Gulf oil
			 spill.</text>
			</subsection><subsection commented="no" id="H99C679BCC6444A42AAEA88DA3F7E05FE"><enum>(c)</enum><header>Authorized
			 uses</header>
				<paragraph commented="no" id="H2734D2F4EDAE49D8AE94A0377DC99280"><enum>(1)</enum><header>In
			 general</header><text>The Fund shall be available to the Council, as provided
			 in appropriations Acts, only for activities related to Gulf coast economic
			 development, ecosystem restoration, and public health rehabilitation in
			 accordance with this Act.</text>
				</paragraph><paragraph commented="no" id="H7E8A3FA842E94E24BEFDE7394BE2638C"><enum>(2)</enum><header>Grants to
			 States</header>
					<subparagraph id="H2DA8627999EE422D9270C03BC95E6AD3"><enum>(A)</enum><header>In
			 general</header><text>The Council shall distribute 80 percent of the amounts
			 made available for expenditure from the Fund in a fiscal year to the Gulf
			 States to be used to carry out their respective State comprehensive restoration
			 plans approved by the Council under section 4(d)(2), in accordance with section
			 4(e).</text>
					</subparagraph><subparagraph id="H3F663B5F97F448CEA2ECA4F7C61FEF32"><enum>(B)</enum><header>Proportional
			 distribution</header><text>The Council shall allocate the amounts to be
			 distributed to each Gulf State under this paragraph as follows:</text>
						<clause id="HA7A67E46189347439AA28DA2FB6B7963"><enum>(i)</enum><text>60
			 percent shall be allocated based on each Gulf State’s proportionate share of
			 the length of Gulf coast shoreline in the Gulf States, as determined by the
			 Council based on the most recently available data from, or accepted by, the
			 Office of Coast Survey of the National Oceanic and Atmospheric Administration.</text>
						</clause><clause id="H2922AAEBA772432093796CD02DDC9038"><enum>(ii)</enum><text display-inline="yes-display-inline">40 percent shall be allocated based on each
			 Gulf State’s proportionate share of the aggregate population of all counties
			 contained in whole or in part within the designated Gulf coast boundaries of
			 the Gulf States, as determined by the Council based on the most recent United
			 States census.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="HC04DFEC793C14B7B8137BA09ADE05C01"><enum>(3)</enum><header>Regional
			 grants</header>
					<subparagraph commented="no" id="HA591A75BE949430CB73A926B9B6D06DC"><enum>(A)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">The Council shall
			 distribute the remaining 20 percent of the amounts made available for
			 expenditure from the Fund in such fiscal year in the form of grants as
			 follows:</text>
						<clause commented="no" id="HAFA8FB0BF7424F97820596B132E68BC6"><enum>(i)</enum><text>40 percent for the
			 Gulf of Mexico Observation System established under section 5.</text>
						</clause><clause commented="no" id="HA44C59AAAF724824BDA310023DCCF087"><enum>(ii)</enum><text display-inline="yes-display-inline">15 percent for the Gulf of Mexico sea grant
			 program established under section 6.</text>
						</clause><clause commented="no" id="H6525E99EA3AF46C5B6AA9D89503CAB69"><enum>(iii)</enum><text>15 percent for
			 the Gulf of Mexico seafood marketing program established under section
			 7.</text>
						</clause><clause commented="no" id="H83084947C9994814A9D078F4FD643271"><enum>(iv)</enum><text display-inline="yes-display-inline">30 percent for the Gulf of Mexico clean
			 energy program established under section 8.</text>
						</clause></subparagraph><subparagraph commented="no" id="H9CFDAC7F00394C0E807AF1AC0921C1C9"><enum>(B)</enum><header>Consistency with
			 regional ecosystem restoration strategy</header><text display-inline="yes-display-inline">The Council shall ensure that any funds
			 made available under this paragraph are used for projects and activities that
			 are not inconsistent with the regional ecosystem restoration strategy developed
			 by the Gulf Coast Ecosystem Restoration Task Force established by Executive
			 Order 13554 (75 Fed. Reg. 62313).</text>
					</subparagraph></paragraph></subsection></section><section id="HDDCCBC96ABFF49F6BA5A3D21E7426911"><enum>4.</enum><header>State
			 comprehensive restoration plans</header>
			<subsection id="H5DDBF5D945E742ED854065FFCF951DBD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In order to be
			 eligible to receive funds under section 3(c)(2), a Gulf State shall submit to
			 the Council a State comprehensive restoration plan regarding Gulf coast
			 economic development, ecosystem restoration, and public health rehabilitation
			 in the State, in accordance with this section.</text>
			</subsection><subsection id="HD7293060BE0F4650A04FF26FCCA4321C"><enum>(b)</enum><header>Guidelines</header>
				<paragraph id="HD51BF6F0FB3D4059AC94DE0D44C84DAA"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the date of the enactment of
			 this Act, and after providing notice and an opportunity for public comment, the
			 Council shall make available to the public guidelines for the development and
			 submission of State comprehensive restoration plans under this section.</text>
				</paragraph><paragraph id="HC10CF3B01C5F4225BC98F93D3EB50F1F"><enum>(2)</enum><header>Contents of
			 plan</header>
					<subparagraph commented="no" id="H18AECC3EA6E647B1BACF7056BFC7804A"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Council shall
			 require a State submitting a State comprehensive restoration plan under this
			 section to ensure that the plan addresses the effects in the State of the Gulf
			 oil spill with regards to the economy, the environment, and public health, both
			 physical and mental.</text>
					</subparagraph><subparagraph id="HDA836E32F2AD456DB23259CF55B38D07"><enum>(B)</enum><header>Specific
			 elements</header><text display-inline="yes-display-inline">The Council shall
			 require a State submitting a State comprehensive restoration plan under this
			 section to ensure that the plan specifically addresses the following
			 elements:</text>
						<clause id="H940F107B770E498ABC15658DA8F2CAA7"><enum>(i)</enum><text display-inline="yes-display-inline">Environmental restoration and remediation,
			 including in coastal and marine ecosystems.</text>
						</clause><clause commented="no" id="H493B2F0E2F88452EA1689BBBCFC65E7F"><enum>(ii)</enum><text display-inline="yes-display-inline">Academic and applied research regarding the
			 economy, environment, and public health.</text>
						</clause><clause id="H65EFE0ADDB134D71A1A6F98F1BD6389C"><enum>(iii)</enum><text>Seafood
			 marketing.</text>
						</clause><clause id="HEAB63806164F4D488B34683C12472015"><enum>(iv)</enum><text>Tourism
			 marketing.</text>
						</clause><clause id="H71655C0033C749ED9779119E1E623060"><enum>(v)</enum><text>Coastal land
			 acquisition.</text>
						</clause><clause id="H1C7EC154D33247648152BBB557EAA9EE"><enum>(vi)</enum><text display-inline="yes-display-inline">Ecosystem resource planning and coastal and
			 marine spatial planning (as that term is defined in Executive Order 13547 (75
			 Fed. Reg. 43023)).</text>
						</clause><clause commented="no" id="HF025B053E3084E8C9DAB81E995452FDC"><enum>(vii)</enum><text>Renewable and
			 clean energy production and development, energy conservation, and related
			 retrofitting projects.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H8C0F977F56DA437893CF12B2ADC480CF"><enum>(c)</enum><header>Deadline</header><text display-inline="yes-display-inline">A State submitting to the Council a State
			 comprehensive restoration plan under this section shall do so not later than 90
			 days after the date on which the Council makes guidelines available to the
			 public under subsection (b).</text>
			</subsection><subsection id="H3847C50A8CA94A9FA62CBD813E7F0C01"><enum>(d)</enum><header>Review,
			 approval, and disapproval</header>
				<paragraph id="H7AF0719AFC3B4AC1AF77239AAE01AF28"><enum>(1)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 30 days after a State
			 submits to the Council a State comprehensive restoration plan under subsection
			 (a), the Council shall review and either approve or disapprove the State
			 comprehensive restoration plan in accordance with this subsection.</text>
				</paragraph><paragraph id="HFCC1FAC1F6F44B71BB11947E0E9805AD"><enum>(2)</enum><header>Approval</header><text display-inline="yes-display-inline">The Council may approve a State
			 comprehensive restoration plan from a State under this subsection if the plan
			 meets all of the requirements of subsection (b) and the guidelines made
			 available under such subsection.</text>
				</paragraph><paragraph id="HACB8EE26A38D4163A1469F55AEAF8B1E"><enum>(3)</enum><header>Disapproval</header><text display-inline="yes-display-inline">If the Council disapproves a State
			 comprehensive restoration plan under this subsection—</text>
					<subparagraph id="HA8B1CB1DCD1A4065820AE1D660E7DCAA"><enum>(A)</enum><text>the Council shall
			 provide to the State the reasons for the disapproval; and</text>
					</subparagraph><subparagraph id="H791F25A17D834C2B9BD9D088C86EF4A4"><enum>(B)</enum><text>the State may
			 submit a revised State comprehensive restoration plan not later than 30 days
			 after the date of such disapproval.</text>
					</subparagraph></paragraph></subsection><subsection id="H3C0C764C644C4A8BBA1C20A90636FA18"><enum>(e)</enum><header>Distribution of
			 funds</header>
				<paragraph id="HC293E80B30EC4C4FB2EC7A8CAF4DEFFB"><enum>(1)</enum><header>Timeline</header><text display-inline="yes-display-inline">If the Council approves a State
			 comprehensive restoration plan under subsection (d), the Council shall
			 establish a timeline for distributing funds to the State under section 3(c)(2)
			 and distribute the funds according to such timeline.</text>
				</paragraph><paragraph id="HE966C3489C9B4CE2ACD663359D9D1789"><enum>(2)</enum><header>Annual
			 review</header><text>Not later than September 30 of each year during which
			 funds are distributed to a State for a State comprehensive restoration plan
			 under section 3(c)(2), the Council shall conduct a review of the implementation
			 of the plan.</text>
				</paragraph><paragraph id="HCBF270F5926C462DB30CE450023006E6"><enum>(3)</enum><header>Withholding of
			 funds</header><text display-inline="yes-display-inline">If the Council finds,
			 based on an annual review conducted under paragraph (2), that a State is not
			 fully implementing its State comprehensive restoration plan or the
			 implementation of such plan is not achieving its stated objectives, the Council
			 may withhold funds that have not yet been distributed under the timeline
			 established under paragraph (1).</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H4C99F4825CF04790A4ED40386AD685E9"><enum>5.</enum><header>Gulf of Mexico
			 Observation System</header>
			<subsection id="H4FDDB60B29754B5EAC7B9642A7D4946E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Council shall establish a Gulf of
			 Mexico Observation System to observe, monitor, and map the Gulf in a
			 comprehensive manner in accordance with this section.</text>
			</subsection><subsection id="HB4DD71C00B8C49EA89F5D27872869D30"><enum>(b)</enum><header>Administration</header>
				<paragraph id="H40C769E2978E475A99A47D03619AC1CF"><enum>(1)</enum><header>In
			 general</header><text>The Gulf of Mexico Observation System established under
			 subsection (a) shall be implemented through a Gulf of Mexico Exploration
			 Research Center administered by an eligible entity chosen by the Council based
			 on an application demonstrating the ability of the eligible entity to carry out
			 the requirements of this section.</text>
				</paragraph><paragraph id="HE7E160EA52E943298B44A3921A18D212"><enum>(2)</enum><header>Grants</header><text display-inline="yes-display-inline">The Council shall make grants under section
			 3(c)(3)(A) to an eligible entity chosen under paragraph (1) for the
			 administration of the Gulf of Mexico Exploration Research Center.</text>
				</paragraph></subsection><subsection commented="no" id="H69A40EFBC17140CB9DC0A1B3CCF7BC4B"><enum>(c)</enum><header>Facilitation of
			 existing technologies</header><text>An eligible entity administering the Gulf
			 of Mexico Observation System under subsection (b) shall facilitate the use of
			 existing technologies in order to quickly increase observation and monitoring
			 capabilities in the Gulf, including facilitating—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HBF6074ACD1CF4CC9A1FCD25C0385999B"><enum>(1)</enum><text display-inline="yes-display-inline">enhancement of existing ocean-based
			 monitoring systems, including satellite imagery, moorings and autonomous
			 observation platforms, oceanographic research vessels, subsurface sea floor
			 mapping, coastal and wetland monitoring stations, robotic technology,
			 computational modeling and forecasting, and vessels to support coastal
			 monitoring and fishery assessment;</text>
				</paragraph><paragraph commented="no" id="HE5EB4A7AEC1A46B58612E19123A7CC13"><enum>(2)</enum><text display-inline="yes-display-inline">enhancement of the existing land-based
			 monitoring facilities through the acquisition, construction, and development of
			 laboratories, port infrastructure, equipment, and personnel that support,
			 interface, communicate with, and provide integrated observation functions that
			 supplement the ocean-based monitoring system;</text>
				</paragraph><paragraph commented="no" id="H85627F47AE8249F48F53BD538FCAED64"><enum>(3)</enum><text>support of
			 operational costs for staffing relating to existing technologies; and</text>
				</paragraph><paragraph id="HC3CF6D23129248F0A2745723907DC51A"><enum>(4)</enum><text>the development of
			 academic programs focused on training in supportive fields, such as data
			 assimilation, information synthesis and modeling, data visualization
			 capabilities, and data management and analysis.</text>
				</paragraph></subsection><subsection commented="no" id="H254361CA71F84065AE1C998C1B58DC11"><enum>(d)</enum><header>Development of
			 new technologies</header><text display-inline="yes-display-inline">An eligible
			 entity administering the Gulf of Mexico Observation System under subsection (b)
			 shall facilitate the development of new monitoring technologies.</text>
			</subsection><subsection id="HEF75D12E940F4404912CA06EC32FFE1C"><enum>(e)</enum><header>Specific
			 technologies</header>
				<paragraph id="H3A17303D023F415CBC2827DB5EF02E1E"><enum>(1)</enum><header>Deployment</header><text>An
			 eligible entity administering the Gulf of Mexico Observation System under
			 subsection (b) shall deploy monitoring technologies, including the
			 following:</text>
					<subparagraph id="HE1B75BB5C19048F685162EA5F4068C64"><enum>(A)</enum><text display-inline="yes-display-inline">Coastal sensor moorings.</text>
					</subparagraph><subparagraph id="HBAC6A773BD0A4F3C8CC70BCFF6128EEF"><enum>(B)</enum><text>Deep sea sensor
			 moorings.</text>
					</subparagraph><subparagraph id="HDE259FDE3DB346FD93B76EBD55D22C07"><enum>(C)</enum><text>Sea floor sensor
			 moorings in deep water.</text>
					</subparagraph><subparagraph id="HEB92183FF00949448C0B594216541672"><enum>(D)</enum><text>Sensor moorings on
			 oil and gas platforms and other structures.</text>
					</subparagraph><subparagraph id="H1B6E7347E9424A7BB0828E6E3222BDBB"><enum>(E)</enum><text>Data transmission
			 systems, including local- and regional-scale data nodes.</text>
					</subparagraph><subparagraph id="H41E30C53AF4A45B6A39D2561B3E4F646"><enum>(F)</enum><text>Research vessels
			 for system deployment, system maintenance, and emergency response.</text>
					</subparagraph><subparagraph id="HBB012B4F52474E799D9B0D9685B522B5"><enum>(G)</enum><text>Port facilities to
			 support research vessels, sensor moorings, and data transmission
			 systems.</text>
					</subparagraph><subparagraph id="H26DE7D7BC83C44849FAACC899CE492E2"><enum>(H)</enum><text>Sensor development
			 and testing programs.</text>
					</subparagraph><subparagraph commented="no" id="H2DD8942F4A744CF9BC3E0AFB3A804EC7"><enum>(I)</enum><text>High-frequency
			 radars to monitor physical properties of the surface water of the Gulf.</text>
					</subparagraph></paragraph><paragraph id="HF647D6EE65E9410486ADD2A6346CEC00"><enum>(2)</enum><header>Support</header><text>An
			 eligible entity administering the Gulf of Mexico Observation System under
			 subsection (b) shall support monitoring technologies, including the following:</text>
					<subparagraph id="HF1DBC104BBB049E1A29BE6320C1ED63C"><enum>(A)</enum><text>Autonomous
			 underwater vehicles.</text>
					</subparagraph><subparagraph id="H27C3962680DE494AADC9FB4E0008562C"><enum>(B)</enum><text>Satellite and
			 acoustic tagging programs for migratory fishes, cetaceans, and sea
			 turtles.</text>
					</subparagraph><subparagraph commented="no" id="H327588BD51EA42FDA065EDE9E5540BD1"><enum>(C)</enum><text>Computer modeling
			 systems.</text>
					</subparagraph></paragraph></subsection><subsection id="HCB8A48659D6C41508A4E0495DE1FE4C4"><enum>(f)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph commented="no" id="HC760664700804CE483061ED00F99C68D"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <quote>eligible entity</quote> means an
			 organization that—</text>
					<subparagraph commented="no" id="H62BE2D99E78749D1ADD7CC48C8F3A272"><enum>(A)</enum><text>is a consortium of
			 public and private institutions of higher education in a Gulf State;</text>
					</subparagraph><subparagraph commented="no" id="H3D65C702B13D4144A08DAF4BA731B4D8"><enum>(B)</enum><text>is formally
			 established by a board of higher education in a Gulf State for the purpose of
			 collaborating on marine science research;</text>
					</subparagraph><subparagraph commented="no" id="H045A6373AD6F4767BBBE4D68918487EE"><enum>(C)</enum><text>has its operations
			 physically located in the Gulf coast; and</text>
					</subparagraph><subparagraph commented="no" id="H9D6F79C705E848358F2A3C0403AD07ED"><enum>(D)</enum><text>demonstrates
			 experience in carrying out the kinds of activities described in this section
			 and the ability to carry out the requirements of subsections (c), (d), and
			 (e).</text>
					</subparagraph></paragraph><paragraph id="H7CD99DD389854FA99A0F45859C4AA522"><enum>(2)</enum><header>Gulf</header><text>The
			 term <quote>Gulf</quote> means the submerged lands of the Outer Continental
			 Shelf of the United States, and the areas of the exclusive economic zone of the
			 United States, within the Gulf of Mexico, including the associated coastal
			 watersheds, estuaries, beaches, and wetlands.</text>
				</paragraph></subsection><subsection id="H7AC0564C5209440585CC20BD7016B26E"><enum>(g)</enum><header>Coordination
			 with National Integrated Coastal and Ocean Observation System</header><text display-inline="yes-display-inline">The Council shall ensure that the Gulf of
			 Mexico Observation System established under subsection (a) is developed in
			 coordination with the National Integrated Coastal and Ocean Observation System
			 established under section 12304 of the Integrated Coastal and Ocean Observation
			 System Act of 2009 (33 U.S.C. 3603).</text>
			</subsection></section><section commented="no" id="H3D6B25AC55F141A0B34D5F7530FF73DD"><enum>6.</enum><header>Gulf of Mexico
			 sea grant program</header>
			<subsection commented="no" id="H8A822E454AFB4B2DB7D16B07E518EC59"><enum>(a)</enum><header>Establishment</header><text>The
			 Council shall establish a grant program to fund Gulf coast restoration projects
			 carried out by sea grant colleges or institutions, as designated under the
			 National Sea Grant College Program Act (33 U.S.C. 1121 et seq.), that are
			 located in Gulf States.</text>
			</subsection><subsection commented="no" id="HBCCACF52ADE4414BA05A7518A183F035"><enum>(b)</enum><header>Application</header><text>In
			 order to be eligible to receive a grant under this section, a sea grant college
			 or institution located in a Gulf State shall submit to the Council an
			 application describing the research on Gulf coast restoration activities to be
			 carried out with funds made available through such grant, and how such research
			 is consistent with the purposes of both the National Sea Grant College Program
			 and this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H3772AE432A714FD98B2033ED06484D99"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">A sea grant college or institution
			 receiving a grant under this section shall submit an annual report to the
			 Council containing such information as the Council may require.</text>
			</subsection></section><section id="H536F79DFF8974439AF0D40141826C181"><enum>7.</enum><header>Gulf of Mexico
			 seafood marketing program</header>
			<subsection id="H2F674E66B7CD42D3AAC1C1ADBF375044"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Council shall establish a Gulf of
			 Mexico seafood marketing program to be carried out in accordance with this
			 section.</text>
			</subsection><subsection id="H691083B11F8C4334AC6D4B9362A1724A"><enum>(b)</enum><header>Gulf of Mexico
			 Seafood Marketing Board</header>
				<paragraph id="H0661DD8CBBA74F0CA991D45E3B7588B3"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Council shall establish a Gulf of
			 Mexico Seafood Marketing Board in accordance with this subsection.</text>
				</paragraph><paragraph id="H0CBC59A95D08451BADC2CFBFC6DBBAB6"><enum>(2)</enum><header>Members</header>
					<subparagraph id="HE2E9A299C39042EB8276E338742A2D0B"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Board shall
			 consist of 13 members appointed by the Council to reflect the expertise and
			 interests of the seafood industry located within the Gulf States.</text>
					</subparagraph><subparagraph id="H16F7D2325881413A8793A5C1AF1A73DD"><enum>(B)</enum><header>Selection</header>
						<clause id="HD0A13E021EBB4357808B132623D71840"><enum>(i)</enum><header>Solicitation of
			 nominees</header><text>Not later than 30 days after the date of the enactment
			 of this Act, the Council shall solicit from the Governors of the Gulf States
			 nominations of individuals to be appointed as members.</text>
						</clause><clause id="H19EEFA8CB2D1483C9E171B3F7BB1BB6E"><enum>(ii)</enum><header>Appointment</header><text>Not
			 later than 60 days after the date of the enactment of this Act, the Council
			 shall appoint members from among the individuals nominated under clause
			 (i).</text>
						</clause></subparagraph><subparagraph id="H2C20A45801CE4C1A9F7F22CDAF36A685"><enum>(C)</enum><header>Representation</header><text>The
			 Council shall ensure that the members fairly reflect the seafood industry
			 located within the Gulf States. The Board shall include the following:</text>
						<clause id="HEBE4D8EE2B664EF68AEC9BA0B84ECEEE"><enum>(i)</enum><text>3
			 individuals with experience in the harvesting of seafood.</text>
						</clause><clause id="H016E4196CF274396AB1E646D96724903"><enum>(ii)</enum><text>1
			 individual with experience in managing a large seafood processing
			 operation.</text>
						</clause><clause id="HAA15668A257D4CAC9208DA85493C7A11"><enum>(iii)</enum><text display-inline="yes-display-inline">1 individual with experience in managing a
			 small seafood processing operation.</text>
						</clause><clause id="HC9497C333D7D46009FB18CFC278664F4"><enum>(iv)</enum><text>1
			 individual with experience in seafood-related transportation and
			 logistics.</text>
						</clause><clause id="H71BA15D6A8FB418BAE1885C479038B73"><enum>(v)</enum><text>1
			 individual with experience in mass-market seafood distribution.</text>
						</clause><clause id="HA9018F0325464074ACC01E23C9001A49"><enum>(vi)</enum><text>1
			 individual with experience in mass-market seafood retail or food
			 service.</text>
						</clause><clause id="H989CCBA6747A4BE79F63D133229B37E0"><enum>(vii)</enum><text>1
			 individual with experience in the marketing of seafood.</text>
						</clause><clause id="H24F44D4CFAB1443DA22F8FB7736B1D03"><enum>(viii)</enum><text>1
			 individual recommended by a Gulf coast region or State seafood marketing
			 organization.</text>
						</clause><clause id="H26571CCA4D9B4175AC367F67736B7756"><enum>(ix)</enum><text>1
			 individual representing the aquaculture production of seafood.</text>
						</clause><clause id="H2AF463A77D4A4FF78AF3D8B275333815"><enum>(x)</enum><text>2
			 individuals representing the general public who are familiar with the seafood
			 industry as a whole.</text>
						</clause></subparagraph><subparagraph id="HB31D2312B5784FC8BFA210A5C18EF1E5"><enum>(D)</enum><header>Terms</header>
						<clause id="HDDC73FD5CFFA4F9D81DCC3283A5C8881"><enum>(i)</enum><header>In
			 general</header><text>Each member shall be appointed for a term of 3
			 years.</text>
						</clause><clause id="H56C687F714164109A21812A011742B15"><enum>(ii)</enum><header>Term
			 limit</header><text>No member may serve more than 3 consecutive terms.</text>
						</clause><clause id="HC093A906C06A429B8C8844D4B49C763F"><enum>(iii)</enum><header>Vacancies</header><text>A
			 vacancy on the Board shall not affect the ability of the Board to function. The
			 Council shall appoint a new member in the manner in which the original
			 appointment was made not later than 30 days after a vacancy occurs to fill the
			 unexpired term of the vacated member.</text>
						</clause></subparagraph><subparagraph id="HC80FC60A6BFF42E695B086C86C053184"><enum>(E)</enum><header>Removal</header><text display-inline="yes-display-inline">The Board may remove a member from office
			 for failure to attend 3 consecutive Board meetings without reasonable
			 excuse.</text>
					</subparagraph><subparagraph commented="no" id="H42286E3A5B26477AB55977A9C34CD672"><enum>(F)</enum><header>Compensation</header><text display-inline="yes-display-inline">Members shall serve without compensation,
			 but shall be reimbursed in accordance with section 5703 of title 5, United
			 States Code, for reasonable travel costs and expenses incurred in performing
			 their duties as a member.</text>
					</subparagraph></paragraph><paragraph id="H8906CAB0B1834715BCBF1A35CA2214F6"><enum>(3)</enum><header>Administration</header>
					<subparagraph id="H94D02BF98CDC43A4BD12C041FF28629D"><enum>(A)</enum><header>Chair</header><text>The
			 Board shall be chaired by a member selected by a majority of members
			 voting.</text>
					</subparagraph><subparagraph id="HB98FF199AA5F4FC1BEE74F91ACA39120"><enum>(B)</enum><header>Quorum</header><text display-inline="yes-display-inline">A simple majority of members shall
			 constitute a quorum, but a lesser number may hold hearings.</text>
					</subparagraph><subparagraph id="H2A6F2B3DAFFF45C7AD2F05A8F8D467DD"><enum>(C)</enum><header>Executive
			 director</header>
						<clause id="H33CE4BEE5216412181374DA7DF75FCCE"><enum>(i)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Board shall
			 employ an executive director.</text>
						</clause><clause id="H9BD1DEC2B23B475B9F9E75170A5A081B"><enum>(ii)</enum><header>Salary
			 limit</header><text>The salary of an executive director employed under clause
			 (i) may not exceed the highest rate of basic pay established for the Senior
			 Executive Service under section 5382 of title 5, United States Code.</text>
						</clause><clause id="HDC073B66F20742928CA8BB020CF38B47"><enum>(iii)</enum><header>Qualifications</header><text>In
			 order to be qualified to be employed as an executive director under clause (i),
			 an individual must have demonstrated experience in the marketing and promotion
			 of food products.</text>
						</clause></subparagraph><subparagraph id="H58C845E933CB498395ECD642BD09FC0A"><enum>(D)</enum><header>Staff</header><text>An
			 executive director employed by the Board under subparagraph (C), with the
			 approval of the Board, may select and employ such additional staff as the
			 executive director determines necessary.</text>
					</subparagraph><subparagraph commented="no" id="H4784A15B1A674438B9009563BF908A41"><enum>(E)</enum><header>Limitation on
			 administrative expenses</header><text display-inline="yes-display-inline">Not
			 more than 5 percent of the funds distributed by the Council to the Board each
			 year may be used by the Board to pay its administrative expenses.</text>
					</subparagraph></paragraph><paragraph id="HDD4C117FF73D4DBD89D7BBBCA4DF9923"><enum>(4)</enum><header>Seafood
			 marketing plans</header>
					<subparagraph id="H90C9AC464D084CA2A9DC782DAF38B0C7"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 September 30 of each year, the Board shall submit to the Council a seafood
			 marketing plan that describes the consumer education, research, and other
			 marketing activities planned by the Board for the following year, including the
			 selection procedures and criteria the Board plans to use for the awarding of
			 grants.</text>
					</subparagraph><subparagraph id="H1208F4AABB4D4BBD960E0810E96EF1D0"><enum>(B)</enum><header>Purposes</header><text>The
			 Board shall design a seafood marketing plan submitted under this paragraph for
			 the purposes of—</text>
						<clause id="H8ABAAB753DD64E1FAC7886E9E0F6B8EC"><enum>(i)</enum><text>increasing
			 consumer demand for seafood;</text>
						</clause><clause id="H71A3FBA2D8184D4C8E9DFFF768B7E40D"><enum>(ii)</enum><text>encouraging,
			 expanding, or improving the marketing and utilization of seafood; and</text>
						</clause><clause id="HBEDBD167F9724292A7E92EB1DB6A583B"><enum>(iii)</enum><text>improving
			 consumer education, research, and other marketing activities regarding
			 seafood.</text>
						</clause></subparagraph><subparagraph id="H1849046294274B97A26ECA291D272AA2"><enum>(C)</enum><header>Specific
			 marketing activities permitted</header><text display-inline="yes-display-inline">The Board may include in a seafood
			 marketing plan submitted under this paragraph marketing activities that
			 reference a particular brand or trade name.</text>
					</subparagraph><subparagraph id="H8B0838B046104190A57EDE7D4FF39512"><enum>(D)</enum><header>Review;
			 approval; disapproval</header>
						<clause id="HD4DCF3732AF04D8895BF01780BF8F740"><enum>(i)</enum><header>Review</header><text>Not
			 later than 30 days after the Board submits to the Council a seafood marketing
			 plan under this paragraph, the Council shall review the marketing plan and
			 approve or disapprove the plan in accordance with this subparagraph.</text>
						</clause><clause id="H0EF0E19A4C3842339B5FBFFCC3D61416"><enum>(ii)</enum><header>Approval</header><text>If
			 the Council determines that the plan meets the requirements of this paragraph,
			 the Council shall approve the plan and make a grant to the Board in accordance
			 with section 3(c)(3)(A).</text>
						</clause><clause id="H2556A13482A040E582A31856FDD386D3"><enum>(iii)</enum><header>Disapproval</header><text display-inline="yes-display-inline">If the Council does not approve a plan
			 under clause (ii)—</text>
							<subclause id="H7DAAF49E090E4B9B8D201647AF868030"><enum>(I)</enum><text>the Council shall
			 provide to the Board the reasons for the disapproval; and</text>
							</subclause><subclause id="HC5E050A2B96A4431B446110189A1FFD0"><enum>(II)</enum><text>the Board shall
			 submit a revised plan not later than 30 days after the date of such
			 disapproval.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H9E4014A1646146AE9735F020187C9567"><enum>(5)</enum><header>Grants to
			 organizations and individuals</header>
					<subparagraph id="HED4A33BF27A14EEE92A5675B647706CD"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Board shall make
			 grants to organizations and individuals, subject to such terms and conditions
			 as the Board may require and consistent with the purposes of this section and
			 the marketing plan approved by the Council.</text>
					</subparagraph><subparagraph id="H159D36E523A6420BAA175C1B80979BC3"><enum>(B)</enum><header>Promotion of
			 partnerships</header><text display-inline="yes-display-inline">In making grants
			 under this subsection, the Board shall promote cost-sharing partnerships with
			 non-Federal entities and may limit grant amounts to a portion of the estimated
			 cost of a project.</text>
					</subparagraph><subparagraph id="H852A76EE64DA454991DFC7CE3A9FD2DB"><enum>(C)</enum><header>Matching
			 funds</header><text display-inline="yes-display-inline">If the Board conditions
			 the making of a grant under this subsection on the availability of matching
			 funds, such matching funds may include funds from private sources, funds from
			 State or local governments, or the value of in-kind contributions.</text>
					</subparagraph><subparagraph id="H30565581FBA4407EBF98249AD3780D6C"><enum>(D)</enum><header>Distribution
			 goal</header><text>The Board shall seek to distribute not less than 10 percent
			 of the funds it distributes under this subsection in a fiscal year through
			 grants to minority-owned businesses, veteran-owned businesses, and small
			 businesses.</text>
					</subparagraph></paragraph><paragraph id="HF985A26C23A9401DBFFF6D50B05DCD16"><enum>(6)</enum><header>Records</header><text display-inline="yes-display-inline">The Board shall maintain accounting records
			 of the receipt and disbursement of all funds of the Board, which shall be
			 subject to the review of the Council.</text>
				</paragraph><paragraph id="H9FEB874A5786443B8E559C00D100316C"><enum>(7)</enum><header>Report</header><text>Not
			 later than September 1 of each year, the Board shall submit to the Council a
			 report detailing the expenditures of the Board during the previous 12 months
			 and the results of such expenditures.</text>
				</paragraph></subsection><subsection id="HA715E6318F1F435698E861BB290820F6"><enum>(c)</enum><header>Report</header><text>Not
			 later than September 30 of each year, the Council shall submit to Congress a
			 report regarding the results of the operations of the Gulf of Mexico seafood
			 marketing program.</text>
			</subsection><subsection commented="no" id="H6BA9BFB06DE541A4A7A98869064B4434"><enum>(d)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1B324E81E3C34AB180D6CA6AF9B02FCA"><enum>(1)</enum><header>Board</header><text>The
			 term <quote>Board</quote> means the Gulf of Mexico Seafood Marketing Board
			 established by subsection (b)(1).</text>
				</paragraph><paragraph id="H1FD05F659A3B4112B9B851A21B456D41"><enum>(2)</enum><header>Member</header><text>The
			 term <quote>member</quote> means a member of the Board.</text>
				</paragraph><paragraph commented="no" id="H1D49F5A9BFF2480F9A85D26AB04EDC32"><enum>(3)</enum><header>Minority-owned
			 business</header><text>The term <quote>minority-owned business</quote> means a
			 business—</text>
					<subparagraph commented="no" id="HBC440B5BF57D4960A4395AD4DE8835F5"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 51 percent of which is owned
			 by one or more socially and economically disadvantaged individuals or, in the
			 case of any publicly owned business, not less than 51 percent of the stock of
			 which is owned by one or more socially and economically disadvantaged
			 individuals; and</text>
					</subparagraph><subparagraph commented="no" id="HBAE102B35E7B449B9E57EBBD546F8C0D"><enum>(B)</enum><text display-inline="yes-display-inline">the management and daily business
			 operations of which are controlled by one or more socially and economically
			 disadvantaged individuals.</text>
					</subparagraph></paragraph><paragraph id="H79AB749E735740FCADD0A73A9D8A43E3"><enum>(4)</enum><header>Seafood</header><text display-inline="yes-display-inline">The term <quote>seafood</quote> means
			 farm-raised and wild-caught fish and shellfish harvested in the Gulf coast for
			 human consumption.</text>
				</paragraph><paragraph commented="no" id="HFE314A585A164A19B037AF37B4FB1F04"><enum>(5)</enum><header>Small
			 business</header><text>The term <quote>small business</quote> has the meaning
			 given the term <quote>small business concern</quote> in section 3 of the Small
			 Business Act (15 U.S.C. 632).</text>
				</paragraph><paragraph commented="no" id="HF44531B1378D4AB9A80A1CF28E51C400"><enum>(6)</enum><header>Socially and
			 economically disadvantaged individual</header><text display-inline="yes-display-inline">The term <quote>socially and economically
			 disadvantaged individual</quote> means an individual described as socially and
			 economically disadvantaged in section 8(a) of the Small Business Act (15 U.S.C.
			 637(a)).</text>
				</paragraph><paragraph commented="no" id="HD9B308D88BDD41078D599206D15E66FC"><enum>(7)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <quote>veteran</quote> has the
			 meaning given that term in section 101(2) of title 38, United States Code.</text>
				</paragraph><paragraph commented="no" id="H9415364D012440499DC9A6D68E73AC06"><enum>(8)</enum><header>Veteran-owned
			 business</header><text display-inline="yes-display-inline">The term
			 <quote>veteran-owned business</quote> means a business—</text>
					<subparagraph commented="no" id="HB149401CFC914F86A68EDD6B761BDD71"><enum>(A)</enum><text>not less than 51
			 percent of which is owned by one or more veterans or, in the case of any
			 publicly owned business, not less than 51 percent of the stock of which is
			 owned by one or more veterans; and</text>
					</subparagraph><subparagraph commented="no" id="H2FE1733C55AE46B1820820A596A1E2B5"><enum>(B)</enum><text>the management and
			 daily business operations of which are controlled by one or more
			 veterans.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="H0BBDDA2B933243108FD8A38A9F02577E"><enum>8.</enum><header>Gulf of Mexico
			 clean energy program</header>
			<subsection commented="no" id="H10C50CD94D8345F496293119FA1EEA17"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Council shall establish a Gulf of
			 Mexico clean energy program to make grants to eligible entities for qualified
			 clean energy projects and qualified energy efficiency projects, in accordance
			 with this section.</text>
			</subsection><subsection commented="no" id="H06A429722BC1470BB0B9258907D65D73"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">In order to be eligible to receive a grant
			 under this section, an eligible entity shall submit to the Council an
			 application at such time, in such form, and containing such information as the
			 Council may require.</text>
			</subsection><subsection commented="no" id="HDAF2E5B0C5FB4F2296D4487B58EC67A4"><enum>(c)</enum><header>Report</header><text>An
			 eligible entity receiving a grant under this section shall submit an annual
			 report to the Council containing such information as the Council may
			 require.</text>
			</subsection><subsection commented="no" id="H53336734A9FF44EEA888BC5BB432EF9F"><enum>(d)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph commented="no" id="H40B5B7633A634DD0AB6D417A492C9261"><enum>(1)</enum><header>Clean energy
			 project</header><text display-inline="yes-display-inline">The term <quote>clean
			 energy project</quote> means any electricity generation, transmission, storage,
			 heating, cooling, industrial process, or manufacturing project the primary
			 purpose of which is the deployment, development, or production of an energy
			 system or technology that avoids, reduces, or sequesters air pollutants or
			 anthropogenic greenhouse gases, including projects based on the following
			 energy technologies:</text>
					<subparagraph commented="no" id="H8BAA76D0BFE243439E73A548004EFB10"><enum>(A)</enum><text>Solar.</text>
					</subparagraph><subparagraph commented="no" id="H0A4276B20AAD48EAA6E2425B69F88A59"><enum>(B)</enum><text>Wind.</text>
					</subparagraph><subparagraph commented="no" id="H5C04FBFFF20340BA95F2C59C75995846"><enum>(C)</enum><text>Geothermal.</text>
					</subparagraph><subparagraph commented="no" id="H783A052ACDF542958CDB2A68023106B1"><enum>(D)</enum><text>Biomass.</text>
					</subparagraph><subparagraph commented="no" id="H395173BD2BA04798803C46E6EB156A82"><enum>(E)</enum><text>Hydropower.</text>
					</subparagraph><subparagraph commented="no" id="H92D9800E08104CAFA41688A6ACF73734"><enum>(F)</enum><text>Ocean.</text>
					</subparagraph><subparagraph commented="no" id="H7EE044C935444BECBB8ED8899FE2F833"><enum>(G)</enum><text>Fuel cell.</text>
					</subparagraph><subparagraph commented="no" id="HE171DE5FA9074C11912A616159A0EBEB"><enum>(H)</enum><text>Advanced
			 battery.</text>
					</subparagraph><subparagraph commented="no" id="H8745063F2E5C458EB4206656DB0F2B06"><enum>(I)</enum><text>Carbon capture and
			 sequestration.</text>
					</subparagraph><subparagraph commented="no" id="HA71729A8E7E547BABD07C4161847FA15"><enum>(J)</enum><text>Next generation
			 biofuels.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H1D5D9C68B0D642FBACDD4281C76D80D7"><enum>(2)</enum><header>Eligible
			 entity</header><text>The term <quote>eligible entity</quote> means a State or
			 local government, an individual, a nonprofit organization, or a private
			 business.</text>
				</paragraph><paragraph commented="no" id="H7785612E17FD48FDBDD329ECFDE37211"><enum>(3)</enum><header>Energy
			 efficiency project</header><text>The term <quote>energy efficiency
			 project</quote> means any project, technology, function, or measure that
			 results in the reduction of energy use required to achieve the same level of
			 service or output prior to the application of such project, technology,
			 function, or measure, or substantially reduces greenhouse gas emissions
			 relative to emissions that would have occurred prior to the application of such
			 project, technology, function, or measure.</text>
				</paragraph><paragraph commented="no" id="H28D8F4F7A8D149DB810AAB457F2737F0"><enum>(4)</enum><header>Qualified clean
			 energy project</header><text>The term <quote>qualified clean energy
			 project</quote> means a clean energy project that—</text>
					<subparagraph commented="no" id="H013CA16993854D7B959E5831088EABCC"><enum>(A)</enum><text>is carried out
			 within a Gulf State;</text>
					</subparagraph><subparagraph commented="no" id="HED211ED2B86F49FB826409F6A872C122"><enum>(B)</enum><text>pays wages in
			 accordance with subchapter IV of chapter 31 of title 40, United States Code
			 (commonly known as the Davis-Bacon Act); and</text>
					</subparagraph><subparagraph commented="no" id="H1885F3E689B94693A584B2A6FB2AC6D0"><enum>(C)</enum><text>satisfies any
			 other conditions established by the Council.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HA9D95BAF9D9C4AE2BFC25E4F1557A5CF"><enum>(5)</enum><header>Qualified energy
			 efficiency project</header><text>The term <quote>qualified energy efficiency
			 project</quote> means an energy efficiency project, including Smart Grid
			 technologies and functions characterized in section 1301 of the Energy
			 Independence and Security Act of 2007 (42 U.S.C. 17381) and end-use
			 technologies for efficiency gains in new construction and across existing
			 infrastructure, that—</text>
					<subparagraph commented="no" id="H0F1F0DAE302A44649B39AFE4E2351D6A"><enum>(A)</enum><text>is carried out
			 within a Gulf State;</text>
					</subparagraph><subparagraph commented="no" id="H52FB1FE2DA9440F7980DE299FCDFB7C2"><enum>(B)</enum><text>pays wages in
			 accordance with subchapter IV of chapter 31 of title 40, United States Code
			 (commonly known as the Davis-Bacon Act); and</text>
					</subparagraph><subparagraph commented="no" id="H3E6E9748FCFC43AEB303A6F7CF8862F3"><enum>(C)</enum><text>satisfies any
			 other conditions established by the Council.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="H1990FD34F605486FA3D9B51AFB06886B" section-type="subsequent-section"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph commented="no" id="H856396E8C82F4615B550AE8D7A2556DA"><enum>(1)</enum><header>Fund</header><text display-inline="yes-display-inline">The term <quote>Fund</quote> means the Gulf
			 of Mexico Economic and Environmental Recovery Fund established by section
			 3(a).</text>
			</paragraph><paragraph commented="no" id="H1040199554694F7399FE02063D2D6163"><enum>(2)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Gulf of Mexico Recovery Council established
			 by section 2(a).</text>
			</paragraph><paragraph commented="no" id="H7F60D9A40DB540D686944EC9B20AFDF5"><enum>(3)</enum><header>Gulf
			 coast</header><text>The term <term>Gulf coast</term> means the coastal zones,
			 as determined pursuant to the Coastal Zone Management Act of 1972 (16 U.S.C.
			 1451 et seq.), of the States of Alabama, Florida, Louisiana, and Mississippi
			 and adjacent State waters and submerged lands of the Outer Continental Shelf in
			 the Gulf of Mexico.</text>
			</paragraph><paragraph commented="no" id="H620675D1209E49A4B715583B253FFBAE"><enum>(4)</enum><header>Gulf
			 States</header><text display-inline="yes-display-inline">The term <quote>Gulf
			 States</quote> means the States of Alabama, Florida, Louisiana, and
			 Mississippi.</text>
			</paragraph><paragraph commented="no" id="H9F7067364BC34FDCAD589ED5CE01D981"><enum>(5)</enum><header>Gulf oil
			 spill</header><text display-inline="yes-display-inline">The term <quote>Gulf
			 oil spill</quote> means the oil spill in the Gulf of Mexico caused by the
			 mobile offshore drilling unit Deepwater Horizon that began on April 20,
			 2010.</text>
