		<section id="H13262B23A6A24BC8B4794C75EA8E73D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Protection Act of
			 2010</short-title></quote>.</text>
		</section><section id="H9D4B8A0C38CB4C1094170883AA16DCF9"><enum>2.</enum><header>Learned
			 intermediary defense</header>
			<subsection id="HB1FEBA2AEDDA467E8DA1148EF3AD997C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">It shall not be a
			 defense to any tort claim in any court in the United States that a manufacture
			 of a product has fulfilled that manufacturer’s duty of care when the
			 manufacturer provides all of the necessary information to a learned
			 intermediary who then interacts with the consumer of the product.</text>
			</subsection><subsection id="HE6D5106526C14903999FBE6EAC8768D2"><enum>(b)</enum><header>Definition</header><text>In
			 this section—</text>
				<paragraph id="HCE18BF55C03543BC94EE4A9B5A2679A4"><enum>(1)</enum><text>the term
			 <quote>learned intermediary</quote> means a person, licenced under applicable
			 State or Federal law, to advise a consumer whether or not to use the product in
			 question; and</text>
				</paragraph><paragraph id="H5A57663B590347B2A5B53B43FFCC1488"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>State</quote> includes the
			 District of Columbia, Puerto Rico, and any other commonwealth, possession, or
			 territory of the United States.</text>
