		<official-title>To amend the Fair Credit Reporting Act with respect to
		  the applicability of identity theft guidelines to creditors.</official-title>

		<section id="H24195531FA8249478A32D30D39622D51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Red Flag Program Clarification Act of
			 2010</short-title></quote>.</text>
		</section><section id="HD58A3EDFC6264141A7B2FA71DF6BF7AA"><enum>2.</enum><header>Scope of certain
			 creditor requirements</header>
			<subsection id="H2498FCEFA6634F46BC477078C337C7AE"><enum>(a)</enum><header>Amendment to
			 FCRA</header><text display-inline="yes-display-inline">Section 615(e) of the
			 Fair Credit Reporting Act (15 U.S.C. 1681m(e)) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0FE131353C844F19B31D4FB4519F8EC8" style="OLC">
					<paragraph id="H6159F50601D34FF090ECD8B61A9944F1"><enum>(4)</enum><header>Definitions</header><text>As
				used in this subsection, the term <term>creditor</term>—</text>
						<subparagraph id="HD91822736093499D9EA9F4B6F0905A03"><enum>(A)</enum><text>means a creditor,
				as defined in section 702 of the Equal Credit Opportunity Act (15 U.S.C.
				1691a), that regularly and in the ordinary course of business—</text>
							<clause id="H138B05868206428DADE0A6C2031CCE2C"><enum>(i)</enum><text>obtains or uses
				consumer reports, directly or indirectly, in connection with a credit
				transaction;</text>
							</clause><clause id="H0313031C64344CF381549ED5907BAF78"><enum>(ii)</enum><text>furnishes
				information to consumer reporting agencies, as described in section 623, in
				connection with a credit transaction; or</text>
							</clause><clause id="HE3FE9A4ACB454A5BB7EE79DE01102018"><enum>(iii)</enum><text>advances funds
				to or on behalf of a person, based on an obligation of the person to repay the
				funds or repayable from specific property pledged by or on behalf of the
				person;</text>
							</clause></subparagraph><subparagraph id="H137C982A7EA4438D910460D282B2AE4D"><enum>(B)</enum><text>does not include a
				creditor described in subparagraph (A)(iii) that advances funds on behalf of a
				person for expenses incidental to a service provided by the creditor to that
				person; and</text>
						</subparagraph><subparagraph id="HF6CB35357913428586BF16FC522A9A98"><enum>(C)</enum><text>includes any other
				type of creditor, as defined in that section 702, as the agency described in
				paragraph (1) having authority over that creditor may determine appropriate by
				rule promulgated by that agency, based on a determination that such creditor
				offers or maintains accounts that are subject to a reasonably foreseeable risk
				of identity
				theft.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H0B8DA898E9AE40609CA1F24513BE2424"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall become effective on
			 the date of enactment of this Act.</text>
