		<official-title>To amend title 38, United States Code, to provide for the
		  entitlement of surviving spouses of members of the Armed Forces who die while
		  serving on active duty to educational assistance under the Post-9/11
		  Educational Assistance Program, and for other purposes.</official-title>

		<section id="H8E20DCBE6B4C42A8866C4A82F528814B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Spouses of Fallen Heroes Scholarship
			 Act</short-title></quote>.</text>
		</section><section id="H79693B4693EF40FCBE1F3FCAD20A5DC5"><enum>2.</enum><header>Entitlement of
			 surviving spouses of members of the Armed Forces who die while serving on
			 active duty to educational assistance under the Post-9/11 Educational
			 Assistance Program</header>
			<subsection id="H564C90428D9449858BEB539CADA1AE46"><enum>(a)</enum><header>Entitlement</header><text display-inline="yes-display-inline">Section 3311(b) of title 38, United States
			 Code, is amended by adding at the end the following new paragraph:</text>
				<quoted-block id="HA8D9B556F7BB473881A8C727216D7459" style="OLC">
					<paragraph id="H59B2CF0BB8C6426BA27F8E346E4EAF63"><enum>(10)</enum><text>An individual who
				is the surviving spouse of a person who, on or after September 11, 2001, dies
				in line of duty while serving on active duty as a member of the Armed
				Forces.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBC7151B6CD844D13A256A5247D9CAFA9"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">Section 3313(c)(1) of such title is amended
			 by striking “or (9)” and inserting “(9), or (10)”.</text>
			</subsection><subsection id="H1DBA522318184F198B302B49B17FEE28"><enum>(c)</enum><header>Time limitation
			 for use</header><text>Section 3321(b) of such title is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block id="HC0B360753AA641C490B043CEDA5B4777" style="OLC">
					<paragraph id="HCA429C675E7748F39FA60E1D4B6BF039"><enum>(5)</enum><header>Applicability to
				surviving spouses of deceased members</header><text>The period during which an
				individual entitled to educational assistance by reason of section 3311(b)(10)
				may use such individual’s entitlement expires on the date that is 20 years
				after the date of the death of the person from whom such entitlement is
				derived.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9D7AD113A4454209BAE19E22947116B9"><enum>(d)</enum><header>Precedence of
			 use of educational assistance benefits</header><text>Section 3322 of such title
			 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H5F65F52514CF4C469CAECA8F5924DFD3" style="USC">
					<subsection id="H66E7A617239A448B87484BB3B8B09052"><enum>(e)</enum><header>Surviving
				spouses</header><text display-inline="yes-display-inline">An individual who is
				eligible for educational assistance under a program established by this chapter
				by reason of section 3311(b)(10) of this title and who is also entitled to a
				program of educational assistance under chapter 35 of this title shall utilize
				the program established by this chapter first before receiving educational
				assistance under chapter 35 of this title. Use of both programs remains subject
				to the 48-month aggregate period for which an individual may receive assistance
				under two or more of the provisions of law listed in section 3695 of this
				title.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H854BF73FB8834E0983E117BB7854367D"><enum>(e)</enum><header>Definition of
			 surviving spouse</header><text>Section 3301 of such title is amended by adding
			 at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H76E54FD9635D4125A0ED59373AD8B62E" style="USC">
					<paragraph id="HC11BC9B481864F25AA797D21493C6B91"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>surviving spouse</term>
				means a person of the opposite sex who was the spouse of a veteran at the time
				of the veteran’s death, and who lived with the veteran continuously from the
				date of marriage to the date of the veteran’s death (except where there was a
				separation which was due to the misconduct of, or procured by, the veteran
				without the fault of the spouse) regardless of
				remarriage.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H139780F90F1349BE82BEE6D5895B3A9B"><enum>(f)</enum><header>Effective date;
			 applicability</header>
				<paragraph id="H82F283E4B5694A439A1571D3CB4258B0"><enum>(1)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 August 1, 2009.</text>
				</paragraph><paragraph id="H1C7D1829F2FD40DE832A980FB0057C15"><enum>(2)</enum><header>Applicability</header><text>The
			 Secretary of Veterans Affairs shall begin making payments to individuals
			 entitled to educational assistance by reason of paragraph (10) of section
			 3311(b) of title 38, United States Code, as added by subsection (a), by not
			 later than August 1, 2011. In the case of an individual entitled to educational
			 assistance by reason of such paragraph for the period beginning on August 1,
			 2009, and ending on July 31, 2011, the Secretary shall make retroactive
			 payments to such individual for such period by not later than August 1,
			 2011.</text>
