			 election To accelerate the AMT and research credits in lieu of bonus
			 depreciation</header><text>Section 168(k)(4) of such Code (relating to election
			 to accelerate the AMT and research credits in lieu of bonus depreciation) is
			 amended—</text>
					<paragraph id="H751B646AED21460E8C785CAC0DB246B7"><enum>(1)</enum><text>by striking
			 <quote>2009</quote> and inserting <quote>2010</quote> in subparagraph (D)(iii)
			 (as redesignated by subsection (a)(3)), and</text>
					</paragraph><paragraph id="H09D61EAE3C3244B7A38B3983291C320E"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>

							<subparagraph id="H46E2B9721F014A53BEE337E1D3566795"><enum>(I)</enum><header>Special rules
				for extension property</header>
								<clause id="HC54E08BD22214D7ABDF8C3C27E4BF5B0"><enum>(i)</enum><header>Taxpayers
				previously electing acceleration</header><text>In the case of a taxpayer who
				made the election under subparagraph (A) for its first taxable year ending
				after March 31, 2008—</text>
									<subclause id="H21365D1EBCEA40FFA59D0D43662A707A"><enum>(I)</enum><text>the taxpayer may
				elect not to have this paragraph apply to extension property, but</text>
									</subclause><subclause id="HDB69E68BCADD42098557AB74EAB5FFF8"><enum>(II)</enum><text>if the taxpayer
				does not make the election under subclause (I), in applying this paragraph to
				the taxpayer a separate bonus depreciation amount, maximum amount, and maximum
				increase amount shall be computed and applied to eligible qualified property
				which is extension property and to eligible qualified property which is not
				extension property.</text>
									</subclause></clause><clause id="H613B1EA2D91A4C738089146D7BA6AA50"><enum>(ii)</enum><header>Taxpayers not
				previously electing acceleration</header><text>In the case of a taxpayer who
				did not make the election under subparagraph (A) for its first taxable year
				ending after March 31, 2008—</text>
									<subclause id="H7BDBD98FF7184541AA85C6C246184167"><enum>(I)</enum><text>the taxpayer may
				elect to have this paragraph apply to its first taxable year ending after
				December 31, 2009, and each subsequent taxable year, and</text>
									</subclause><subclause id="H180FD02458684B64B4E7552589D17CB5"><enum>(II)</enum><text>if the taxpayer
				makes the election under subclause (I), this paragraph shall only apply to
				eligible qualified property which is extension property.</text>
									</subclause></clause><clause id="H126C4EBD44CC4F39943F429AE2A5275C"><enum>(iii)</enum><header>Extension
				property</header><text>For purposes of this subparagraph, the term
				<term>extension property</term> means property which is eligible qualified
				property solely by reason of the extension of the application of the special
				allowance under paragraph (1) pursuant to the amendments made by section 101(a)
				of the <short-title>Restore American Jobs Act of
				2010</short-title> (and the application of such extension to this paragraph
				pursuant to the amendment made by section 3(b)(1) of such
				Act).</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HBEB600DFC7784813B60C1B95CE2B911A"><enum>(c)</enum><header>Effective
			 dates</header><text>The amendments made by this section shall apply to property
			 placed in service after December 31, 2009, in taxable years ending after such
			 date.</text>
				</subsection></section><section display-inline="no-display-inline" id="HD67CBA740CF443368189645D5691E709" section-type="subsequent-section"><enum>102.</enum><header>Increase in amount
			 allowed as deduction for start-up expenditures</header>
				<subsection id="H50220A07C7C143ED95B92687C458524A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 195 of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCCCC45CDDF4E4B6AA4AF326422DA847D" style="OLC">
						<paragraph id="H00CD3CB0673E404B9D0542211CCC082A"><enum>(3)</enum><header>Special rule for
				taxable years beginning in 2009, 2010, or 2011</header><text display-inline="yes-display-inline">In the case of a taxable year beginning in
				2010, 2011, or 2012, paragraph (1)(A)(ii) shall be applied—</text>
							<subparagraph id="H6B1CD73014084153AE41ED45FE9A2BB4"><enum>(A)</enum><text>by substituting
				<quote>$20,000</quote> for <quote>$5,000</quote>, and</text>
							</subparagraph><subparagraph id="H8C7CABD76C4243C5A9F7812F635A6B38"><enum>(B)</enum><text>by substituting
				<quote>$75,000</quote> for
				<quote>$50,000</quote>.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HC0433089DC2A45A298B8D4B63060915F"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred in taxable years beginning after the date of the enactment of
			 this Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="H67464CF2F4EF4E289056B1D03A046D26" section-type="subsequent-section"><enum>103.</enum><header>Removal of cellular
			 telephones (or similar telecommunications equipment) from listed
			 property</header>
				<subsection id="HF5BC711A1BCC4FFFB12B47DCB1D2D6CF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 280F(d)(4) of the Internal Revenue Code (defining listed property) is
			 amended by inserting <quote>and</quote> at the end of clause (iv), by striking
			 clause (v), and by redesignating clause (vi) as clause (v).</text>
				</subsection><subsection id="H219D97998D884BCF877E1F2C78D05AAD"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to taxable
			 years beginning after January 1, 2009.</text>

			 Business Investment Company loans from the Small Business Administration
			 treated as amounts at risk</header>
				<subsection id="H8D3FF089D126453D9E7F0176F1C22826"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (B) of
			 section 465(b)(6) of the Internal Revenue Code of 1986 is amended to read as
			 follows:</text>

				general</header><text>The term <term>qualified nonrecourse financing</term>
				means any financing—</text>
								<subclause id="HE2B907026C724BADA5A87C950781E0DA"><enum>(I)</enum><text>which is qualified
				real property financing or qualified SBIC financing,</text>
								</subclause><subclause id="HEC433281B60A4E6491FE7DB9AE1CDBF0"><enum>(II)</enum><text>except to the
				extent provided in regulations, with respect to which no person is personally
				liable for repayment, and</text>
								</subclause><subclause id="H05A7DE8C51234585BEAEDFD9E61F4674"><enum>(III)</enum><text>which is not
				convertible debt.</text>
								</subclause></clause><clause id="H05E2011C91294B47ABC8BBC58C795D8F"><enum>(ii)</enum><header>Qualified real
				property financing</header><text>The term <term>qualified real property
				financing</term> means any financing which—</text>
								<subclause id="HC7594F72A6934374A57C1FE3530559C5"><enum>(I)</enum><text display-inline="yes-display-inline">is borrowed by the taxpayer with respect to
				the activity of holding real property,</text>
								</subclause><subclause id="HAC5199A205684BD69349BC960EDAC824"><enum>(II)</enum><text>is secured by
				real property used in such activity, and</text>
								</subclause><subclause id="H3A441399702444579323B89C6B111B0A"><enum>(III)</enum><text display-inline="yes-display-inline">is borrowed by the taxpayer from a
				qualified person or represents a loan from any Federal, State, or local
				government or instrumentality thereof, or is guaranteed by any Federal, State,
				or local government.</text>
								</subclause></clause><clause id="HED58748C1AC94B2F96B249AAD80FEF5C"><enum>(iii)</enum><header>Qualified SBIC
				financing</header><text>The term <term>qualified SBIC financing</term> means
				any financing which—</text>
								<subclause id="H14217F2B847B4091A134C1E40C6393E3"><enum>(I)</enum><text>is borrowed by a
				small business investment company (within the meaning of section 301 of the
				Small Business Investment Act of 1958),</text>
								</subclause><subclause id="HF69D8368A2D341F2B162133A1CFE9B05"><enum>(II)</enum><text>is secured by
				property used or held, directly or indirectly, by such small business
				investment company, and</text>
								</subclause><subclause id="H9D2F5DA425D84756A0F4DAC769FCCF9E"><enum>(III)</enum><text>is borrowed
				from, or guaranteed by, the Small Business Administration under the authority
				of section 303(b) of such
				Act.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4DD5693E123C45AEAD6595C6A641C626"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Subparagraph (A) of section 465(b)(6) of such Code is
			 amended—</text>

				adjusted net capital gain (or, if less, taxable income),</text>

				excess (if any) of—</text>
									<subparagraph id="H636A22EBF3C049F881361DB71B5B30BA"><enum>(A)</enum><text display-inline="yes-display-inline">the unrecaptured section 1250 gain (or, if
				less, the net capital gain (determined without regard to subsection (b)(2))),
				over</text>
									</subparagraph><subparagraph id="H9AB1E443096E491AA263E542261CE916"><enum>(B)</enum><text>the excess (if
				any) of—</text>
										<clause id="HF6C9FEC83FDD44649C2E863FF1E3FDC6"><enum>(i)</enum><text>the sum of the
				amount on which tax is determined under paragraph (1) plus the net capital
				gain, over</text>
										</clause><clause id="HA48A65C3E8B0446AA83203D8EB064B16"><enum>(ii)</enum><text>taxable income,
				plus</text>
										</clause></subparagraph></paragraph><paragraph id="HC2383BA4316B4841A2D919A105BA69EE"><enum>(4)</enum><text>28 percent of the
				amount of taxable income in excess of the sum of the amounts on which tax is
				determined under the preceding paragraphs of this subsection.</text>

				special rules</header><text>For purposes of this section—</text>

			 expense business assets</header>

			 Internal Revenue Code of 1986 is amended to read as follows:</text>

				expenses</header><text display-inline="yes-display-inline">A taxpayer may elect
				to treat the cost of any property to which this section applies as an expense
				which is not chargeable to capital account. Any cost so treated shall be
				allowed as a deduction for the taxable year in which such property is placed in
				service.</text>
							</subsection><subsection id="HC42A453DF645486DBC1CC6321239E17D"><enum>(b)</enum><header>Property to
				which section applies</header>
								<paragraph id="H6DBBEAF8367F415DA95AB5021571AC10"><enum>(1)</enum><header>In
				general</header><text>This section shall apply to property—</text>
									<subparagraph id="H0C95E728172E4E7B98DF75423CBEFB0F"><enum>(A)</enum><text>which is—</text>
										<clause id="HB8BE51EE09B74D3FBFB1B150A32647C2"><enum>(i)</enum><text>tangible property
				(to which section 168 applies), or</text>
										</clause><clause id="H61F6ADCF1E11414D9E67549FA3876577"><enum>(ii)</enum><text>computer software
				(as defined in section 197(e)(3)(B)) which is described in section
				197(e)(3)(A)(i), to which section 167 applies,</text>
										</clause></subparagraph><subparagraph id="H17309B6E184548F89E17B827EB15775F"><enum>(B)</enum><text>which is section
				1245 property (as defined in section 1245(a)(3)) or 1250 property (as defined
				in section 1250(c)), and</text>
									</subparagraph><subparagraph id="HA14A96F647014E4C85768C87C3101847"><enum>(C)</enum><text>which is acquired
				by purchase for use in the active conduct of a trade or business.</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">Such term
				shall not include any property described in section 50(b) and shall not include
				air conditioning or heating units.</continuation-text></paragraph><paragraph id="H955826D9ADD44E5C9CE318D35B71552A"><enum>(2)</enum><header>Purchase
				defined</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), the term <term>purchase</term> means any acquisition of
				property, but only if—</text>
									<subparagraph id="H07F50FE813BA48E38B1346F1EE482863"><enum>(A)</enum><text>the property is
				not acquired from a person whose relationship to the person acquiring it would
				result in the disallowance of losses under section 267 or 707(b) (but, in
				applying section 267(b) and (c) for purposes of this section, paragraph (4) of
				section 267(c) shall be treated as providing that the family of an individual
				shall include only his spouse, ancestors, and lineal descendants),</text>
									</subparagraph><subparagraph id="HEBE2B9D0898C4256AC085D6058978363"><enum>(B)</enum><text>the property is
				not acquired by one component member of a controlled group from another
				component member of the same controlled group, and</text>
									</subparagraph><subparagraph id="H9EC8CD4AA6154701832CE179DD783FBD"><enum>(C)</enum><text>the basis of the
				property in the hands of the person acquiring it is not determined—</text>
										<clause id="H22086777EB524BB2928F00D33972DB2A"><enum>(i)</enum><text>in
				whole or in part by reference to the adjusted basis of such property in the
				hands of the person from whom acquired, or</text>
										</clause><clause id="HDBDD035E1D354B738BF8CE2BB5429C22"><enum>(ii)</enum><text>under section
				1014(a) (relating to property acquired from a decedent).</text>
										</clause></subparagraph></paragraph><paragraph id="H95E656856C6B4D81B4E467985849C2B1"><enum>(3)</enum><header>Cost</header><text>For
				purposes of this section, the cost of property does not include so much of the
				basis of such property as is determined by reference to the basis of other
				property held at any time by the person acquiring such property.</text>
								</paragraph><paragraph id="H929857A73ED24D678D280E0EDDB67842"><enum>(4)</enum><header>Controlled group
				defined</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>controlled group</term> has the meaning assigned to it
				by section 1563(a), except that, for such purposes, the phrase <quote>more than
				50 percent</quote> shall be substituted for the phrase <quote>at least 80
				percent</quote> each place it appears in section 1563(a)(1).</text>
								</paragraph><paragraph id="HC7CA8DAEF048496982B72E73795B9F03"><enum>(5)</enum><header>Coordination
				with section 38</header><text display-inline="yes-display-inline">No credit
				shall be allowed under section 38 with respect to any amount for which a
				deduction is allowed under subsection (a).</text>
								</paragraph><paragraph id="H381A0AF5C93E4F6FA84C7AE89A5720CB"><enum>(6)</enum><header>Recapture in
				certain cases</header><text>The Secretary shall, by regulations, provide for
				recapturing the benefit under any deduction allowable under subsection (a) with
				respect to any property which is not used predominantly in a trade or business
				at any time.</text>
								</paragraph></subsection><subsection id="H65A0FC37A8CA41FEA80841E6DF9E089A"><enum>(c)</enum><header>Election</header>
								<paragraph id="H45793FA855B7491A9F404D104A3DF02C"><enum>(1)</enum><header>In
				general</header><text>An election under this section for any taxable year
				shall—</text>
									<subparagraph id="HFEA9381D75734F8DA2FD2818D790E48A"><enum>(A)</enum><text>specify the items
				of property to which the election applies, and</text>
									</subparagraph><subparagraph id="HC95EB4FD34444177B7B021FACC4D2A47"><enum>(B)</enum><text>be made on the
				taxpayer’s return of the tax imposed by this chapter for the taxable
				year.</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">Such
				election shall be made in such manner as the Secretary may by regulations
				prescribe.</continuation-text></paragraph><paragraph id="HE7DC71B6323B4895BC237A40F7B50A54"><enum>(2)</enum><header>Election
				irrevocable</header><text>Any election made under this section, and any
				specification contained in any such election, may not be revoked except with
				the consent of the
				Secretary.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H17D68CE3AD6040FCBDE2F5FB166F0536"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to property
			 placed in service after the date of the enactment of this Act.</text>

			 for 2010</header>

			 of 1986 is amended by adding at the end the following new subsection:</text>

			 provisions</header>
				<section id="H2B5DA2A6637B4DF18BDEC84C90DB8FE3"><enum>601.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>United States-Colombia Trade Promotion Agreement Implementation
			 Act</quote>.</text>
				</section><section id="H368BEE18823741AAA65DCC85516922FD"><enum>602.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text>
					<paragraph id="HC14F1623A5694F948475117C963A549B"><enum>(1)</enum><text>to approve and
			 implement the free trade agreement between the United States and Colombia
			 entered into under the authority of section 2103(b) of the Bipartisan Trade
			 Promotion Authority Act of 2002 (19 U.S.C. 3803(b));</text>

			 General Provisions Relating to, the Agreement</header>
				<section id="HFE3AC08804DC47E793EDC4EA30919FD3"><enum>611.</enum><header>Approval and
			 entry into force of the agreement</header>
					<subsection id="H1A6BF5604AA04653922FBE5EE7D15B73"><enum>(a)</enum><header>Approval of
			 Agreement and Statement of Administrative Action</header><text>Pursuant to
			 section 2105 of the Bipartisan Trade Promotion Authority Act of 2002 (19 U.S.C.
			 3805) and section 151 of the <act-name parsable-cite="TA74">Trade Act of
			 1974</act-name> (19 U.S.C. 2191), Congress approves—</text>

			 States-Colombia Trade Promotion Agreement entered into on November 22, 2006,
			 with the Government of Colombia, as amended on June 28, 2007, by the United

						</paragraph><paragraph id="HC89837161D894664B0F85B82E9963B66"><enum>(2)</enum><text>the statement of
			 administrative action proposed to implement the Agreement that was submitted to
			 Congress on April 8, 2008.</text>
						</paragraph></subsection><subsection id="HF1C95BA8A32B47DBBC496E2CE787E77D"><enum>(b)</enum><header>Conditions for
			 Entry Into Force of the Agreement</header><text>At such time as the President
			 determines that Colombia has taken measures necessary to comply with those
			 provisions of the Agreement that are to take effect on the date on which the
			 Agreement enters into force, the President is authorized to exchange notes with
			 the Government of Colombia providing for the entry into force, on or after
			 January 1, 2009, of the Agreement with respect to the United States.</text>
					</subsection></section><section id="H0EFE58E198F74134AA97A53ED3676DA2"><enum>612.</enum><header>Relationship of
			 the Agreement to United States and State law</header>
					<subsection id="HF3ED1774AEAC4531B7E7D0F6E5502B2B"><enum>(a)</enum><header>Relationship of
			 Agreement to United States Law</header>
						<paragraph id="H97F338BA821349C0B22F750EE1E25298"><enum>(1)</enum><header>United states
			 law to prevail in conflict</header><text>No provision of the Agreement, nor the
			 application of any such provision to any person or circumstance, which is
			 inconsistent with any law of the United States shall have effect.</text>
						</paragraph><paragraph id="H61B601001C6C4139AD0A571BBCC2A4A7"><enum>(2)</enum><header>Construction</header><text>Nothing
			 in this title shall be construed—</text>

			 any law of the United States; or</text>

			 Agreement to State Law</header>
						<paragraph id="H2B062B1E293945C181CE14C2664C0117"><enum>(1)</enum><header>Legal
			 challenge</header><text>No State law, or the application thereof, may be
			 declared invalid as to any person or circumstance on the ground that the
			 provision or application is inconsistent with the Agreement, except in an
			 action brought by the United States for the purpose of declaring such law or
			 application invalid.</text>
						</paragraph><paragraph id="H7CA02283684E484B863BDA760E3D712A"><enum>(2)</enum><header>Definition of
			 state law</header><text>For purposes of this subsection, the term <term>State
			 law</term> includes—</text>
							<subparagraph id="H02EACA71C55E45FE9476C0646B76B7EE"><enum>(A)</enum><text>any law of a
			 political subdivision of a State; and</text>
							</subparagraph><subparagraph id="H90ABAD2355454877BA6C10FDD2F85630"><enum>(B)</enum><text>any State law
			 regulating or taxing the business of insurance.</text>
							</subparagraph></paragraph></subsection><subsection id="HF1E5EDBBA9334033BBEBDEE364212168"><enum>(c)</enum><header>Effect of
			 Agreement With Respect to Private Remedies</header><text>No person other than
			 the United States—</text>
						<paragraph id="H6D285BCE509E405F82A6888224778624"><enum>(1)</enum><text>shall have any
			 cause of action or defense under the Agreement or by virtue of congressional
			 approval thereof; or</text>
						</paragraph><paragraph id="H3240FD1741D241468ADE6DDDE4808391"><enum>(2)</enum><text>may challenge, in
			 any action brought under any provision of law, any action or inaction by any
			 department, agency, or other instrumentality of the United States, any State,
			 or any political subdivision of a State, on the ground that such action or
			 inaction is inconsistent with the Agreement.</text>
						</paragraph></subsection></section><section id="HBC3EBA398292479F9479441154F9631F"><enum>613.</enum><header>Implementing
			 actions in anticipation of entry into force and initial regulations</header>
					<subsection id="HBE7EF6C792CF4A1C81361FCF7BD328A4"><enum>(a)</enum><header>Implementing
			 Actions</header>
						<paragraph id="H325B659A142040BAA717B7C698B47993"><enum>(1)</enum><header>Proclamation
			 authority</header><text>After the date of the enactment of this Act—</text>
							<subparagraph id="H87D4A756079044BBACD9F2B8A4E3D108"><enum>(A)</enum><text>the President may
			 proclaim such actions, and</text>
							</subparagraph><subparagraph id="HB8D3B20163DA4B0182EAC920BCD7978D"><enum>(B)</enum><text>other appropriate
			 officers of the United States Government may issue such regulations,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">as may be
			 necessary to ensure that any provision of this title, or amendment made by this
			 title, that takes effect on the date on which the Agreement enters into force
			 is appropriately implemented on such date, but no such proclamation or
			 regulation may have an effective date earlier than the date on which the
			 Agreement enters into force.</continuation-text></paragraph><paragraph id="HC101F4C88B31497192CE99CC250B6BC0"><enum>(2)</enum><header>Effective date
			 of certain proclaimed actions</header><text>Any action proclaimed by the
			 President under the authority of this title that is not subject to the
			 consultation and layover provisions under section 614 may not take effect
			 before the 15th day after the date on which the text of the proclamation is
			 published in the Federal Register.</text>
						</paragraph><paragraph id="H02BE270F04B24A728BCE52E1FCE4F343"><enum>(3)</enum><header>Waiver of 15-day
			 restriction</header><text>The 15-day restriction contained in paragraph (2) on
			 the taking effect of proclaimed actions is waived to the extent that the
			 application of such restriction would prevent the taking effect on the date the
			 Agreement enters into force of any action proclaimed under this section.</text>
						</paragraph></subsection><subsection id="HF8EDF13E95C14D14BA853D6FEF302C3E"><enum>(b)</enum><header>Initial
			 Regulations</header><text>Initial regulations necessary or appropriate to carry
			 out the actions required by or authorized under this title or proposed in the
			 statement of administrative action submitted under section 611(a)(2) to
			 implement the Agreement shall, to the maximum extent feasible, be issued within
			 1 year after the date on which the Agreement enters into force. In the case of
			 any implementing action that takes effect on a date after the date on which the
			 Agreement enters into force, initial regulations to carry out that action
			 shall, to the maximum extent feasible, be issued within 1 year after such
			 effective date.</text>
					</subsection></section><section id="H7C6A59ABFAA8469A80B2413192BE1AA0"><enum>614.</enum><header>Consultation
			 and layover provisions for, and effective date of, proclaimed
			 actions</header><text display-inline="no-display-inline">If a provision of this
			 title provides that the implementation of an action by the President by
			 proclamation is subject to the consultation and layover requirements of this
			 section, such action may be proclaimed only if—</text>
					<paragraph id="H7BCB0462312846CAAEFB878A06433795"><enum>(1)</enum><text>the President has
			 obtained advice regarding the proposed action from—</text>
						<subparagraph id="H37DB5C2C17714990B02397E2DEB9F3BC"><enum>(A)</enum><text>the appropriate
			 advisory committees established under section 135 of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2155);
			 and</text>
						</subparagraph><subparagraph id="HE6BCD5D4C20444D5960E4232CDA9BDAE"><enum>(B)</enum><text>the
			 Commission;</text>
						</subparagraph></paragraph><paragraph id="H523395E17A324261A18894B6322928EE"><enum>(2)</enum><text>the President has
			 submitted to the Committee on Finance of the Senate and the Committee on Ways
			 and Means of the House of Representatives a report that sets forth—</text>
						<subparagraph id="HFA2EA222ADFC41D4AE8348AC5813F67E"><enum>(A)</enum><text>the action
			 proposed to be proclaimed and the reasons therefor; and</text>
						</subparagraph><subparagraph id="H4E8220EDDFF44A8B878D8F98E0450183"><enum>(B)</enum><text>the advice
			 obtained under paragraph (1);</text>
						</subparagraph></paragraph><paragraph id="H2BFCA0055388402095096887D9D5AFDF"><enum>(3)</enum><text>a
			 period of 60 calendar days, beginning on the first day on which the
			 requirements set forth in paragraphs (1) and (2) have been met, has expired;
			 and</text>
					</paragraph><paragraph id="H2BE77CB62F2C4C3D82C98AA138C2A4F0"><enum>(4)</enum><text>the President has
			 consulted with the committees referred to in paragraph (2) regarding the
			 proposed action during the period referred to in paragraph (3).</text>
					</paragraph></section><section id="H3313EE226FF842979592774AC16B47B2"><enum>615.</enum><header>Administration
			 of Dispute Settlement proceedings</header>
					<subsection id="HF34B0542F02F486AB0C1D3F7AA60F7AF"><enum>(a)</enum><header>Establishment or
			 Designation of Office</header><text>The President is authorized to establish or
			 designate within the Department of Commerce an office that shall be responsible
			 for providing administrative assistance to panels established under chapter 21
			 of the Agreement. The office shall not be considered to be an agency for
			 purposes of section 552 of title 5, United States Code.</text>
					</subsection><subsection id="H4BFD825C7998423FBA2B0CD21E373865"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for each
			 fiscal year after fiscal year 2008 to the Department of Commerce such sums as
			 may be necessary for the establishment and operations of the office established
			 or designated under subsection (a) and for the payment of the United States
			 share of the expenses of panels established under chapter 21 of the
			 Agreement.</text>
					</subsection></section><section id="H864614837382486981A7450C58CE60FE"><enum>616.</enum><header>Arbitration of
			 claims</header><text display-inline="no-display-inline">The United States is
			 authorized to resolve any claim against the United States covered by article
			 10.16.1(a)(i)(C) or article 10.16.1(b)(i)(C) of the Agreement, pursuant to the
			 Investor-State Dispute Settlement procedures set forth in section B of chapter
			 10 of the Agreement.</text>
				</section><section id="H8CAAA2B0AF1E4E7F94E4A0A382B2EA43"><enum>617.</enum><header>Effective
			 dates; effect of termination</header>
					<subsection id="H86AEA93D0AC8413E88A8E4F8804C0743"><enum>(a)</enum><header>Effective
			 Dates</header><text>Except as provided in subsection (b), this title and the
			 amendments made by this title take effect on the date on which the Agreement
			 enters into force.</text>
					</subsection><subsection id="H06527BEE31E34E859AEC6B51B6D0FAE0"><enum>(b)</enum><header>Exceptions</header><text>Sections
			 601 through 603 and this subtitle take effect on the date of the enactment of
			 this Act.</text>
					</subsection><subsection id="H24C5DC03FC714F35890CAE76E611CF01"><enum>(c)</enum><header>Termination of
			 the Agreement</header><text>On the date on which the Agreement terminates, this
			 title (other than this subsection) and the amendments made by this title shall
			 cease to have effect.</text>
					</subsection></section></subtitle><subtitle id="H4D6C083238BB4582B4E1F925E5335AEF"><enum>C</enum><header>Customs
			 Provisions</header>
				<section id="H8F98AC57A68A4DE4AC149280292F7750"><enum>621.</enum><header>Tariff
			 modifications</header>
					<subsection id="H1BE37568EF0140A588E8B1A729F24708"><enum>(a)</enum><header>Tariff
			 Modifications Provided for in the Agreement</header>
						<paragraph id="H07669EC849964507B9BF57BBA4FDD540"><enum>(1)</enum><header>Proclamation
			 authority</header><text>The President may proclaim—</text>
							<subparagraph id="HD8AF3AA424E44FF49743F2F93AF0CA47"><enum>(A)</enum><text>such modifications
			 or continuation of any duty,</text>
							</subparagraph><subparagraph id="H3A9010C0ABD1497BAB220690C8121E88"><enum>(B)</enum><text>such continuation
			 of duty-free or excise treatment, or</text>
							</subparagraph><subparagraph id="H0CD5A697A6D447C282F772DD6451E9EA"><enum>(C)</enum><text>such additional
			 duties,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">as the
			 President determines to be necessary or appropriate to carry out or apply
			 articles 2.3, 2.5, 2.6, 3.3.13, and Annex 2.3 of the Agreement.</continuation-text></paragraph><paragraph id="H5E0F257FBB6742548D85CEFB6C2FF6B0"><enum>(2)</enum><header>Effect on gsp
			 status</header><text>Notwithstanding section 502(a)(1) of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C.
			 2462(a)(1)), the President shall, on the date on which the Agreement enters
			 into force, terminate the designation of Colombia as a beneficiary developing
			 country for purposes of title V of the <act-name parsable-cite="TA74">Trade Act
			 of 1974</act-name> (19 U.S.C. 2461 et seq.).</text>
						</paragraph></subsection><subsection id="HC6B08BBE68E844C68C13F94814DE2323"><enum>(b)</enum><header>Other Tariff
			 Modifications</header><text>Subject to the consultation and layover provisions
			 of section 614, the President may proclaim—</text>
						<paragraph id="H95F1392E3ED94A1D85492D7E86BBA780"><enum>(1)</enum><text>such modifications
			 or continuation of any duty,</text>
						</paragraph><paragraph id="H8C7ADAEE70E6416BB457DE899EF992D8"><enum>(2)</enum><text>such modifications
			 as the United States may agree to with Colombia regarding the staging of any
			 duty treatment set forth in Annex 2.3 of the Agreement,</text>
						</paragraph><paragraph id="H6AC1BCFE8A534C70849790C614999EF9"><enum>(3)</enum><text>such continuation
			 of duty-free or excise treatment, or</text>
						</paragraph><paragraph id="H5824A44F548E4BACB7C79B7E88973FA6"><enum>(4)</enum><text>such additional
			 duties,</text>
						</paragraph><continuation-text continuation-text-level="subsection">as the
			 President determines to be necessary or appropriate to maintain the general
			 level of reciprocal and mutually advantageous concessions with respect to
			 Colombia provided for by the Agreement.</continuation-text></subsection><subsection id="H57199110219D429693E81017C145B239"><enum>(c)</enum><header>Conversion to Ad
			 Valorem Rates</header><text>For purposes of subsections (a) and (b), with
			 respect to any good for which the base rate in the Schedule of the United
			 States to Annex 2.3 of the Agreement is a specific or compound rate of duty,
			 the President may substitute for the base rate an ad valorem rate that the
			 President determines to be equivalent to the base rate.</text>
					</subsection><subsection id="HB14A8194547A499B8A1942E7E6D1379B"><enum>(d)</enum><header>Tariff Rate
			 Quotas</header><text>In implementing the tariff rate quotas set forth in
			 Appendix I to the Schedule of the United States to Annex 2.3 of the Agreement,
			 the President shall take such action as may be necessary to ensure that imports
			 of agricultural goods do not disrupt the orderly marketing of commodities in
			 the United States.</text>
					</subsection></section><section id="H68FA96A03D314230AFA5F228001C3E1C"><enum>622.</enum><header>Additional
			 duties on certain agricultural goods</header>
					<subsection id="H4D399F3F51524E9084E2F2343034A1FB"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="H64AE765CD7214B5B82F4561AFA1FA65A"><enum>(1)</enum><header>Applicable ntr
			 (mfn) rate of duty</header><text>The term <term>applicable NTR (MFN) rate of
			 duty</term> means, with respect to a safeguard good, a rate of duty equal to
			 the lowest of—</text>
							<subparagraph id="H716A3685689D4795A6BF6F32D04BAD89"><enum>(A)</enum><text>the base rate in
			 the Schedule of the United States to Annex 2.3 of the Agreement;</text>
							</subparagraph><subparagraph id="HA1D330BCDDC64CBD85F7F2BEC001B1FC"><enum>(B)</enum><text>the column 1
			 general rate of duty that would, on the day before the date on which the
			 Agreement enters into force, apply to a good classifiable in the same 8-digit
			 subheading of the HTS as the safeguard good; or</text>
							</subparagraph><subparagraph id="H1E9588849CC54F538C6184978CCE4591"><enum>(C)</enum><text>the column 1
			 general rate of duty that would, at the time the additional duty is imposed
			 under subsection (b), apply to a good classifiable in the same 8-digit
			 subheading of the HTS as the safeguard good.</text>
							</subparagraph></paragraph><paragraph id="HF3CDC02332884DBA86C0D27F1D814323"><enum>(2)</enum><header>Schedule rate of
			 duty</header><text>The term <term>schedule rate of duty</term> means, with
			 respect to a safeguard good, the rate of duty for that good that is set forth
			 in the Schedule of the United States to Annex 2.3 of the Agreement.</text>
						</paragraph><paragraph id="HE2D9F38143C84EA3B1B9A33328D31D28"><enum>(3)</enum><header>Safeguard
			 good</header><text>The term <term>safeguard good</term> means a good—</text>
							<subparagraph id="HD5FC14F29B474D53B0CCD080BF357DF2"><enum>(A)</enum><text>that is included
			 in the Schedule of the United States to Annex 2.18 of the Agreement;</text>
							</subparagraph><subparagraph id="HCFE2C7A07AE34B0E8A60BAE62D891AA1"><enum>(B)</enum><text>that qualifies as
			 an originating good under section 623, except that operations performed in or
			 material obtained from the United States shall be considered as if the
			 operations were performed in, and the material was obtained from, a country
			 that is not a party to the Agreement; and</text>
							</subparagraph><subparagraph id="H97D81B13FFB44FF98E9A263A02AD13C1"><enum>(C)</enum><text>for which a claim
			 for preferential tariff treatment under the Agreement has been made.</text>
							</subparagraph></paragraph></subsection><subsection id="H888A29DFC0B84ADC9D53F45C5E1F90BA"><enum>(b)</enum><header>Additional
			 Duties on Safeguard Goods</header>
						<paragraph id="H9DA17174AA2A4634BA523F4139F7929F"><enum>(1)</enum><header>In
			 general</header><text>In addition to any duty proclaimed under subsection (a)
			 or (b) of section 621, the Secretary of the Treasury shall assess a duty, in
			 the amount determined under paragraph (2), on a safeguard good imported into
			 the United States in a calendar year if the Secretary determines that, prior to
			 such importation, the total volume of that safeguard good that is imported into
			 the United States in that calendar year exceeds 140 percent of the volume that
			 is provided for that safeguard good in the corresponding year in the applicable
			 table contained in Appendix I of the General Notes to the Schedule of the
			 United States to Annex 2.3 of the Agreement. For purposes of this subsection,
			 year 1 in that table corresponds to the calendar year in which the Agreement
			 enters into force.</text>
						</paragraph><paragraph id="H32B0F86994A64518A49F0A1A22F91B5B"><enum>(2)</enum><header>Calculation of
			 additional duty</header><text>The additional duty on a safeguard good under
			 this subsection shall be—</text>
							<subparagraph id="HF273523737B245DBA7F71942012B30A9"><enum>(A)</enum><text>in years 1 through
			 4, an amount equal to 100 percent of the excess of the applicable NTR (MFN)
			 rate of duty over the schedule rate of duty;</text>
							</subparagraph><subparagraph id="HDCA57B8916D04E54A8940149F0B34DE7"><enum>(B)</enum><text>in years 5 through
			 7, an amount equal to 75 percent of the excess of the applicable NTR (MFN) rate
			 of duty over the schedule rate of duty; and</text>
							</subparagraph><subparagraph id="H63DCC4069F8943EEB663A3A9BFF89480"><enum>(C)</enum><text>in years 8 through
			 9, an amount equal to 50 percent of the excess of the applicable NTR (MFN) rate
			 of duty over the schedule rate of duty.</text>
							</subparagraph></paragraph><paragraph id="H326ECCDA6F5440B48D217CE531629A3B"><enum>(3)</enum><header>Notice</header><text>Not
			 later than 60 days after the Secretary of the Treasury first assesses an
			 additional duty in a calendar year on a good under this subsection, the
			 Secretary shall notify the Government of Colombia in writing of such action and
			 shall provide to that Government data supporting the assessment of the
			 additional duty.</text>
						</paragraph></subsection><subsection id="H8CE78C57E8C64C178E954996C9E1B90B"><enum>(c)</enum><header>Exceptions</header><text>No
			 additional duty shall be assessed on a good under subsection (b) if, at the
			 time of entry, the good is subject to import relief under—</text>
						<paragraph commented="no" id="HB7E78D7E354F4021838EC3C3B16B8ABE"><enum>(1)</enum><text>chapter 1 of
			 subtitle D of this title; or</text>
						</paragraph><paragraph id="H711CF729C8A6406999932336BE32D463"><enum>(2)</enum><text>chapter 1 of title
			 II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19
			 U.S.C. 2251 et seq.).</text>
						</paragraph></subsection><subsection id="H8D7D42BE68ED4D48A0DEE98D3EED22E1"><enum>(d)</enum><header>Termination</header><text>The
			 assessment of an additional duty on a good under subsection (b) shall cease to
			 apply to that good on the date on which duty-free treatment must be provided to
			 that good under the Schedule of the United States to Annex 2.3 of the
			 Agreement.</text>
					</subsection></section><section id="H4995255E15A5411A8EA35CF88F0AD2C3"><enum>623.</enum><header>Rules of
			 origin</header>
					<subsection id="H1602D7D8F5004614BE0DEE057BD40D79"><enum>(a)</enum><header>Application and
			 Interpretation</header><text>In this section:</text>
						<paragraph id="HDC99EA54C9B649A795776F996E38253D"><enum>(1)</enum><header>Tariff
			 classification</header><text>The basis for any tariff classification is the
			 HTS.</text>
						</paragraph><paragraph id="HF9F00E70D39549CFA284CC73E7BA5BA5"><enum>(2)</enum><header>Reference to
			 hts</header><text>Whenever in this section there is a reference to a chapter,
			 heading, or subheading, such reference shall be a reference to a chapter,
			 heading, or subheading of the HTS.</text>
						</paragraph><paragraph id="HADB7580624EC48BF8FA76B31EAA9E3A7"><enum>(3)</enum><header>Cost or
			 value</header><text>Any cost or value referred to in this section shall be
			 recorded and maintained in accordance with the generally accepted accounting
			 principles applicable in the territory of the country in which the good is
			 produced (whether Colombia or the United States).</text>
						</paragraph></subsection><subsection id="H2B15A5707D4341718F56483F3A761ABC"><enum>(b)</enum><header>Originating
			 Goods</header><text>For purposes of this title and for purposes of implementing
			 the preferential tariff treatment provided for under the Agreement, except as
			 otherwise provided in this section, a good is an originating good if—</text>
						<paragraph id="H574317F15B2C4FD1B366B5A2F2B8EE96"><enum>(1)</enum><text>the good is a good
			 wholly obtained or produced entirely in the territory of Colombia, the United
			 States, or both;</text>
						</paragraph><paragraph id="H6B359A411A3E45C984113ACA1E5F4357"><enum>(2)</enum><text>the good—</text>
							<subparagraph id="HB8F89E44B3E74AEA9DC52FBB4BEB658F"><enum>(A)</enum><text>is produced
			 entirely in the territory of Colombia, the United States, or both, and—</text>
								<clause id="H4B84C9CCB8D24EC5810E70CFD3556D13"><enum>(i)</enum><text>each
			 of the nonoriginating materials used in the production of the good undergoes an
			 applicable change in tariff classification specified in Annex 3–A or Annex 4.1
			 of the Agreement; or</text>
								</clause><clause id="H7E5A120508C64A26A315273EA2D986C8"><enum>(ii)</enum><text>the
			 good otherwise satisfies any applicable regional value-content or other
			 requirements specified in Annex 3–A or Annex 4.1 of the Agreement; and</text>
								</clause></subparagraph><subparagraph id="HE8AE5E174659403B9C25C0FF8D353FF1"><enum>(B)</enum><text>satisfies all
			 other applicable requirements of this section; or</text>
							</subparagraph></paragraph><paragraph id="H2CDB8601A0124872B8A61D7DFDDB2764"><enum>(3)</enum><text>the good is
			 produced entirely in the territory of Colombia, the United States, or both,
			 exclusively from materials described in paragraph (1) or (2).</text>
						</paragraph></subsection><subsection id="HD713A240B62A4455BE5B7F2ED464099E"><enum>(c)</enum><header>Regional
			 Value-Content</header>
						<paragraph id="H2623B0AAE6FA4C3DBF7511F3E9CCF5CE"><enum>(1)</enum><header>In
			 general</header><text>For purposes of subsection (b)(2), the regional
			 value-content of a good referred to in Annex 4.1 of the Agreement, except for
			 goods to which paragraph (4) applies, shall be calculated by the importer,
			 exporter, or producer of the good, on the basis of the build-down method
			 described in paragraph (2) or the build-up method described in paragraph
			 (3).</text>
						</paragraph><paragraph id="H1871BA9C8BE24EF68B1AB05C7A54BCBC"><enum>(2)</enum><header>Build-down
			 method</header>
							<subparagraph id="H009126BFDCDC46E3B83EA819241ABA7D"><enum>(A)</enum><header>In
			 general</header><text>The regional value-content of a good may be calculated on
			 the basis of the following build-down method:</text>

			 method</header>
							<subparagraph id="H165D6B2A3B6D4BFCAEBEE5245922C7AA"><enum>(A)</enum><header>In
			 general</header><text>The regional value-content of a good may be calculated on
			 the basis of the following build-up method:</text>

			 as a percentage.</text>

			 term <term>VOM</term> means the value of originating materials that are
			 acquired or self-produced, and used by the producer in the production of the
			 good.</text>
								</clause></subparagraph></paragraph><paragraph id="H6B4EF1325C744B07BE78B58ECA491341"><enum>(4)</enum><header>Special rule for
			 certain automotive goods</header>
							<subparagraph id="HB7EB649C84F64A8CAE044DDDDC3FBF47"><enum>(A)</enum><header>In
			 general</header><text>For purposes of subsection (b)(2), the regional
			 value-content of an automotive good referred to in Annex 4.1 of the Agreement
			 shall be calculated by the importer, exporter, or producer of the good, on the
			 basis of the following net cost method:</text>

			 good</header><text>The term <term>automotive good</term> means a good provided
			 for in any of subheadings 8407.31 through 8407.34, subheading 8408.20, heading
			 8409, or any of headings 8701 through 8708.</text>
								</clause><clause id="HCE708B975532494190F108811686F713"><enum>(ii)</enum><header>RVC</header><text>The
			 term <term>RVC</term> means the regional value-content of the automotive good,
			 expressed as a percentage.</text>
								</clause><clause id="H4871EA3AA23A4A6E89A41B4273AF5ACE"><enum>(iii)</enum><header>NC</header><text>The
			 term <term>NC</term> means the net cost of the automotive good.</text>
								</clause><clause id="HE58C77225CC6481B906127819E7CCC36"><enum>(iv)</enum><header>VNM</header><text>The
			 term <term>VNM</term> means the value of nonoriginating materials that are
			 acquired and used by the producer in the production of the automotive good, but
			 does not include the value of a material that is self-produced.</text>
								</clause></subparagraph><subparagraph id="H8672F8D2A5704ABE9A51222C06A9C939"><enum>(C)</enum><header>Motor
			 vehicles</header>
								<clause id="HFA709DA8A25047C88CC11B2902C88DFD"><enum>(i)</enum><header>Basis of
			 calculation</header><text>For purposes of determining the regional
			 value-content under subparagraph (A) for an automotive good that is a motor
			 vehicle provided for in any of headings 8701 through 8705, an importer,
			 exporter, or producer may average the amounts calculated under the formula
			 contained in subparagraph (A), over the producer’s fiscal year—</text>
									<subclause id="H2F0E2292CC7645EEB9CCC36F89FE0B9A"><enum>(I)</enum><text>with respect to
			 all motor vehicles in any one of the categories described in clause (ii);
			 or</text>
									</subclause><subclause id="H2C75D57D994D421091F3D39B6275DD36"><enum>(II)</enum><text>with respect to
			 all motor vehicles in any such category that are exported to the territory of
			 the United States or Colombia.</text>
									</subclause></clause><clause id="HC5AA3EB9BD324DCFB44AFBD9E70B0ECF"><enum>(ii)</enum><header>Categories</header><text>A
			 category is described in this clause if it—</text>
									<subclause id="H5E505BE68F3C477E8B058CAA22408C37"><enum>(I)</enum><text>is the same model
			 line of motor vehicles, is in the same class of motor vehicles, and is produced
			 in the same plant in the territory of Colombia or the United States, as the
			 good described in clause (i) for which regional value-content is being
			 calculated;</text>
									</subclause><subclause id="H1C024E5FA1434B43AEE2071E5BB75DB5"><enum>(II)</enum><text>is the same class
			 of motor vehicles, and is produced in the same plant in the territory of
			 Colombia or the United States, as the good described in clause (i) for which
			 regional value-content is being calculated; or</text>
									</subclause><subclause id="H40A6041DC97B43DBBEBA3766A8DD52EF"><enum>(III)</enum><text>is the same
			 model line of motor vehicles produced in the territory of Colombia or the
			 United States as the good described in clause (i) for which regional
			 value-content is being calculated.</text>
									</subclause></clause></subparagraph><subparagraph id="HB6B275102B1440A1A6D4570AA5573220"><enum>(D)</enum><header>Other automotive
			 goods</header><text>For purposes of determining the regional value-content
			 under subparagraph (A) for automotive materials provided for in any of
			 subheadings 8407.31 through 8407.34, in subheading 8408.20, or in heading 8409,
			 8706, 8707, or 8708, that are produced in the same plant, an importer,
			 exporter, or producer may—</text>
								<clause id="H3FEAD888049F4A7CA3821997B2FEE816"><enum>(i)</enum><text>average the
			 amounts calculated under the formula contained in subparagraph (A) over—</text>
									<subclause id="H638A0306A2FB4B949EB78833E4063344"><enum>(I)</enum><text>the fiscal year of
			 the motor vehicle producer to whom the automotive goods are sold,</text>
									</subclause><subclause id="H9A277FA5DE264B0FBD252F9B1CCA8DC5"><enum>(II)</enum><text>any quarter or
			 month, or</text>
									</subclause><subclause id="H16739554757C466880B8C8D30D219388"><enum>(III)</enum><text>the fiscal year
			 of the producer of such goods,</text>
									</subclause><continuation-text continuation-text-level="clause">if the goods
			 were produced during the fiscal year, quarter, or month that is the basis for
			 the calculation;</continuation-text></clause><clause id="HF6A52E0A853E487FA876108D49BE0F92"><enum>(ii)</enum><text>determine the
			 average referred to in clause (i) separately for such goods sold to 1 or more
			 motor vehicle producers; or</text>
								</clause><clause id="H46F75DD2EBF74C79A7906903D92F3D8C"><enum>(iii)</enum><text>make a separate
			 determination under clause (i) or (ii) for such goods that are exported to the
			 territory of Colombia or the United States.</text>
								</clause></subparagraph><subparagraph id="H36305CB07BB341BCA1DECC09B01BA8CF"><enum>(E)</enum><header>Calculating net
			 cost</header><text>The importer, exporter, or producer of an automotive good
			 shall, consistent with the provisions regarding allocation of costs provided
			 for in generally accepted accounting principles, determine the net cost of the
			 automotive good under subparagraph (B) by—</text>
								<clause id="HE5A8C8BD707944869AE2DD0B09B30EC5"><enum>(i)</enum><text>calculating the
			 total cost incurred with respect to all goods produced by the producer of the
			 automotive good, subtracting any sales promotion, marketing, and after-sales
			 service costs, royalties, shipping and packing costs, and nonallowable interest
			 costs that are included in the total cost of all such goods, and then
			 reasonably allocating the resulting net cost of those goods to the automotive
			 good;</text>
								</clause><clause id="H6CF5CF8F1A524AED9FB176DDD57FA12D"><enum>(ii)</enum><text>calculating the
			 total cost incurred with respect to all goods produced by that producer,
			 reasonably allocating the total cost to the automotive good, and then
			 subtracting any sales promotion, marketing, and after-sales service costs,
			 royalties, shipping and packing costs, and nonallowable interest costs that are
			 included in the portion of the total cost allocated to the automotive good;
			 or</text>
								</clause><clause id="H302904454ED94B089A4A26547718B57B"><enum>(iii)</enum><text>reasonably
			 allocating each cost that forms part of the total cost incurred with respect to
			 the automotive good so that the aggregate of these costs does not include any
			 sales promotion, marketing, and after-sales service costs, royalties, shipping
			 and packing costs, or nonallowable interest costs.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HD87E5B18D48145B2B064CC1F0BA78C87"><enum>(d)</enum><header>Value of
			 Materials</header>
						<paragraph id="H84F18895147F4046822EB907A82DA3AC"><enum>(1)</enum><header>In
			 general</header><text>For the purpose of calculating the regional value-content
			 of a good under subsection (c), and for purposes of applying the de minimis
			 rules under subsection (f), the value of a material is—</text>
							<subparagraph id="H878502AC1B6F4812B25D53D7C65EF117"><enum>(A)</enum><text>in the case of a
			 material that is imported by the producer of the good, the adjusted value of
			 the material;</text>
							</subparagraph><subparagraph id="H7802BFABCDCB4D0288B3A48E3E2FC9E7"><enum>(B)</enum><text>in the case of a
			 material acquired in the territory in which the good is produced, the value,
			 determined in accordance with Articles 1 through 8, Article 15, and the
			 corresponding interpretive notes, of the Agreement on Implementation of Article
			 VII of the General Agreement on Tariffs and Trade 1994 referred to in section
			 101(d)(8) of the Uruguay Round Agreements Act (19 U.S.C. 3511(d)(8)), as set
			 forth in regulations promulgated by the Secretary of the Treasury providing for
			 the application of such Articles in the absence of an importation by the
			 producer; or</text>
							</subparagraph><subparagraph id="HAE026A810ACB487AB10EA1ECAF276BDA"><enum>(C)</enum><text>in the case of a
			 material that is self-produced, the sum of—</text>
								<clause id="HD80011A625904E3EBF0E47CC5E42F77A"><enum>(i)</enum><text>all
			 expenses incurred in the production of the material, including general
			 expenses; and</text>
								</clause><clause id="H405E4DE8ECBF4B03AF1409E59A494A93"><enum>(ii)</enum><text>an
			 amount for profit equivalent to the profit added in the normal course of
			 trade.</text>
								</clause></subparagraph></paragraph><paragraph id="H7B3F82354B864796A3F6C6DD26969EDC"><enum>(2)</enum><header>Further
			 adjustments to the value of materials</header>
							<subparagraph id="H9FDC6A1C418542E6891C61B9A63C62F2"><enum>(A)</enum><header>Originating
			 material</header><text>The following expenses, if not included in the value of
			 an originating material calculated under paragraph (1), may be added to the
			 value of the originating material:</text>
								<clause id="H35130FB2A0AF4709909247A5D0CEEB4B"><enum>(i)</enum><text>The
			 costs of freight, insurance, packing, and all other costs incurred in
			 transporting the material within or between the territory of Colombia, the
			 United States, or both, to the location of the producer.</text>
								</clause><clause id="H808EA0E375964EA29FC3BB6BEEC5BE12"><enum>(ii)</enum><text>Duties, taxes,
			 and customs brokerage fees on the material paid in the territory of Colombia,
			 the United States, or both, other than duties or taxes that are waived,
			 refunded, refundable, or otherwise recoverable, including credit against duty
			 or tax paid or payable.</text>
								</clause><clause id="H3899B159E8A54454A278BA12B7E1A0ED"><enum>(iii)</enum><text>The cost of
			 waste and spoilage resulting from the use of the material in the production of
			 the good, less the value of renewable scrap or byproducts.</text>
								</clause></subparagraph><subparagraph id="HC328F8A715A541798C54478D91DAF817"><enum>(B)</enum><header>Nonoriginating
			 material</header><text>The following expenses, if included in the value of a
			 nonoriginating material calculated under paragraph (1), may be deducted from
			 the value of the nonoriginating material:</text>
								<clause id="HC547B9127AB54EA3B0F6C7D3C63D3304"><enum>(i)</enum><text>The
			 costs of freight, insurance, packing, and all other costs incurred in
			 transporting the material within or between the territory of Colombia, the
			 United States, or both, to the location of the producer.</text>
								</clause><clause id="H366F2403319E45B696F73B599B3ECCF9"><enum>(ii)</enum><text>Duties, taxes,
			 and customs brokerage fees on the material paid in the territory of Colombia,
			 the United States, or both, other than duties or taxes that are waived,
			 refunded, refundable, or otherwise recoverable, including credit against duty
			 or tax paid or payable.</text>
								</clause><clause id="H31C941D1F43742CAA0BBAE67AE1CEE1A"><enum>(iii)</enum><text>The cost of
			 waste and spoilage resulting from the use of the material in the production of
			 the good, less the value of renewable scrap or byproducts.</text>
								</clause><clause id="H72DE09863E5C45EE9B296D86B434774B"><enum>(iv)</enum><text>The
			 cost of originating materials used in the production of the nonoriginating
			 material in the territory of Colombia, the United States, or both.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HEF1AF61A5D5147418EAB24E2CC5057C3"><enum>(e)</enum><header>Accumulation</header>
						<paragraph id="H3A58A2DE1B0C454B91A333523404B142"><enum>(1)</enum><header>Originating
			 materials used in production of goods of another
			 country</header><text>Originating materials from the territory of Colombia or
			 the United States that are used in the production of a good in the territory of
			 the other country shall be considered to originate in the territory of such
			 other country.</text>
						</paragraph><paragraph id="HD874CF38846246B5B0E2538B0274BB9F"><enum>(2)</enum><header>Multiple
			 producers</header><text>A good that is produced in the territory of Colombia,
			 the United States, or both, by 1 or more producers, is an originating good if
			 the good satisfies the requirements of subsection (b) and all other applicable
			 requirements of this section.</text>
						</paragraph></subsection><subsection id="H205316311D8445E68BA0348500AE15D0"><enum>(f)</enum><header>De Minimis
			 Amounts of Nonoriginating Materials</header>
						<paragraph id="HE4E0FA3D53E043418875DF7509A02F8E"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraphs (2) and (3), a good that
			 does not undergo a change in tariff classification pursuant to Annex 4.1 of the
			 Agreement is an originating good if—</text>
							<subparagraph id="H7EBA55C5F01C473D8BCCCA3CAC6789E1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HB3579FFCECF8450786ACFDCFDA40B044"><enum>(i)</enum><text>the value of all
			 nonoriginating materials that—</text>
									<subclause id="H132F25B1E2D743639DEA5455BCE0F088" indent="up1"><enum>(I)</enum><text>are used in the production of the good,
			 and</text>
									</subclause><subclause id="HE3A32CAEB19944AC8778926E4CC64856" indent="up1"><enum>(II)</enum><text>do not undergo the applicable change in
			 tariff classification (set forth in Annex 4.1 of the Agreement),</text>
									</subclause></clause><continuation-text continuation-text-level="subparagraph">does not
			 exceed 10 percent of the adjusted value of the good;</continuation-text><clause id="H7D1700AB22AB4527B3AF3387D04C5A4A" indent="up1"><enum>(ii)</enum><text>the good meets all other
			 applicable requirements of this section; and</text>
								</clause><clause id="H79EC1AEA812142D191DEE63DB20CFDE9" indent="up1"><enum>(iii)</enum><text>the value of such nonoriginating
			 materials is included in the value of nonoriginating materials for any
			 applicable regional value-content requirement for the good; or</text>
								</clause></subparagraph><subparagraph id="HA068168AC9DE4C30B4705032647C5631"><enum>(B)</enum><text>the good meets the
			 requirements set forth in paragraph 2 of Annex 4.6 of the Agreement.</text>
							</subparagraph></paragraph><paragraph id="H895E7FD665504B8E841DAEA25482136F"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
			 (1) does not apply to the following:</text>
							<subparagraph id="H98EA3E1124E44156914F3955A85063EE"><enum>(A)</enum><text>A nonoriginating
			 material provided for in chapter 4, or a nonoriginating dairy preparation
			 containing over 10 percent by weight of milk solids provided for in subheading
			 1901.90 or 2106.90, that is used in the production of a good provided for in
			 chapter 4.</text>
							</subparagraph><subparagraph id="HF74479CBCCC3484FAD62416C1D0B188A"><enum>(B)</enum><text>A nonoriginating
			 material provided for in chapter 4, or a nonoriginating dairy preparation
			 containing over 10 percent by weight of milk solids provided for in subheading
			 1901.90, that is used in the production of any of the following goods:</text>
								<clause id="H86C87E08AFDD4119901FFFA91B20A9D9"><enum>(i)</enum><text>Infant
			 preparations containing over 10 percent by weight of milk solids provided for
			 in subheading 1901.10.</text>
								</clause><clause id="H969BC2ED8E0F40288C18FD8284F68EA1"><enum>(ii)</enum><text>Mixes and doughs,
			 containing over 25 percent by weight of butterfat, not put up for retail sale,
			 provided for in subheading 1901.20.</text>
								</clause><clause id="H4992E044F72541F995D62AAEA06DEC57"><enum>(iii)</enum><text>Dairy
			 preparations containing over 10 percent by weight of milk solids provided for
			 in subheading 1901.90 or 2106.90.</text>
								</clause><clause id="HB6B763214FE54F90A3622485DB542838"><enum>(iv)</enum><text>Goods provided
			 for in heading 2105.</text>
								</clause><clause id="H41536D3E5E3449508D015EC59A8E5847"><enum>(v)</enum><text>Beverages
			 containing milk provided for in subheading 2202.90.</text>
								</clause><clause id="HF4BAA272B43341FBB515DEF274DD8840"><enum>(vi)</enum><text>Animal feeds
			 containing over 10 percent by weight of milk solids provided for in subheading
			 2309.90.</text>
								</clause></subparagraph><subparagraph id="HEE1FE89FE29147738C33246265610F95"><enum>(C)</enum><text>A nonoriginating
			 material provided for in heading 0805, or any of subheadings 2009.11 through
			 2009.39, that is used in the production of a good provided for in any of
			 subheadings 2009.11 through 2009.39, or in fruit or vegetable juice of any
			 single fruit or vegetable, fortified with minerals or vitamins, concentrated or
			 unconcentrated, provided for in subheading 2106.90 or 2202.90.</text>
							</subparagraph><subparagraph id="HF942D319263D4797934FA655D08283E0"><enum>(D)</enum><text>A nonoriginating
			 material provided for in heading 0901 or 2101 that is used in the production of
			 a good provided for in heading 0901 or 2101.</text>
							</subparagraph><subparagraph id="H798D3B6FF4E040918F2AF1CC239A249F"><enum>(E)</enum><text>A nonoriginating
			 material provided for in chapter 15 that is used in the production of a good
			 provided for in any of headings 1501 through 1508, or any of headings 1511
			 through 1515.</text>
							</subparagraph><subparagraph id="H488822B256584A58ACE7D098D4744BCF"><enum>(F)</enum><text>A nonoriginating
			 material provided for in heading 1701 that is used in the production of a good
			 provided for in any of headings 1701 through 1703.</text>
							</subparagraph><subparagraph id="H4177B2AA07CA46AE983EC60EAF13E992"><enum>(G)</enum><text>A nonoriginating
			 material provided for in chapter 17 that is used in the production of a good
			 provided for in subheading 1806.10.</text>
							</subparagraph><subparagraph id="H0F19E89D98FB480D8810229A271DF342"><enum>(H)</enum><text>Except as provided
			 in subparagraphs (A) through (G) and Annex 4.1 of the Agreement, a
			 nonoriginating material used in the production of a good provided for in any of
			 chapters 1 through 24, unless the nonoriginating material is provided for in a
			 different subheading than the good for which origin is being determined under
			 this section.</text>
							</subparagraph><subparagraph id="H49D23B4A51FD4179AFA1093D98514416"><enum>(I)</enum><text>A nonoriginating
			 material that is a textile or apparel good.</text>
							</subparagraph></paragraph><paragraph id="H124014A22CE349A588B4CE098CFE2FC0"><enum>(3)</enum><header>Textile or
			 apparel goods</header>
							<subparagraph id="H3ECE924057E64D0BBB135182BF6B5296"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), a textile or
			 apparel good that is not an originating good because certain fibers or yarns
			 used in the production of the component of the good that determines the tariff
			 classification of the good do not undergo an applicable change in tariff
			 classification, set forth in Annex 3–A of the Agreement, shall be considered to
			 be an originating good if—</text>
								<clause id="H325EC407CA884FE7B0F21AB810F8B163"><enum>(i)</enum><text>the
			 total weight of all such fibers or yarns in that component is not more than 10
			 percent of the total weight of that component; or</text>
								</clause><clause id="HD688CA7D13F0412CBA238394517D3FE7"><enum>(ii)</enum><text>the
			 yarns are those described in section 204(b)(3)(B)(vi)(IV) of the Andean Trade
			 Preference Act (19 U.S.C. 3203(b)(3)(B)(vi)(IV)) (as in effect on the date of
			 the enactment of this Act).</text>
								</clause></subparagraph><subparagraph id="H8BDA5D5BFBC145B3970B97742408C072"><enum>(B)</enum><header>Certain textile
			 or apparel goods</header><text>A textile or apparel good containing elastomeric
			 yarns in the component of the good that determines the tariff classification of
			 the good shall be considered to be an originating good only if such yarns are
			 wholly formed in the territory of Colombia, the United States, or both.</text>
							</subparagraph><subparagraph id="HD70AC9DDF94E448888DD6F5D8D1389CE"><enum>(C)</enum><header>Yarn, fabric, or
			 fiber</header><text>For purposes of this paragraph, in the case of a good that
			 is a yarn, fabric, or fiber, the term <term>component of the good that
			 determines the tariff classification of the good</term> means all of the fibers
			 in the good.</text>
							</subparagraph></paragraph></subsection><subsection id="H99CBA4B8827B4395A416599D9925EBBF"><enum>(g)</enum><header>Fungible Goods
			 and Materials</header>
						<paragraph id="H9CBE4280E7E74496985B9DED7E8855D7"><enum>(1)</enum><header>In
			 general</header>
							<subparagraph id="HECFD07087B8F46548A797897B8B399E6"><enum>(A)</enum><header>Claim for
			 preferential tariff treatment</header><text>A person claiming that a fungible
			 good or fungible material is an originating good may base the claim either on
			 the physical segregation of the fungible good or fungible material or by using
			 an inventory management method with respect to the fungible good or fungible
			 material.</text>
							</subparagraph><subparagraph id="H4F292B1E5B274BA8A7385162FC5A9A47"><enum>(B)</enum><header>Inventory
			 management method</header><text>In this subsection, the term <term>inventory
			 management method</term> means—</text>
								<clause id="H598A51E5C4314739B7201F073025C5ED"><enum>(i)</enum><text>averaging;</text>
								</clause><clause id="H354585049193428DB728F91960308412"><enum>(ii)</enum><text><quote>last-in,
			 first-out</quote>;</text>
								</clause><clause id="H6042C22D02124515B94D7FFD200A28F2"><enum>(iii)</enum><text><quote>first-in,
			 first-out</quote>; or</text>
								</clause><clause id="H1B29F99B81404AF5844A91B0707D2B85"><enum>(iv)</enum><text>any
			 other method—</text>
									<subclause id="H35792326D57B48EEA3382A9E335DB845"><enum>(I)</enum><text>recognized in the
			 generally accepted accounting principles of the country in which the production
			 is performed (whether Colombia or the United States); or</text>
									</subclause><subclause id="H4D696AC92A294D16A5C597A5624E2CA1"><enum>(II)</enum><text>otherwise
			 accepted by that country.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H73616EFEC18A42BBA37F219FCF8F3747"><enum>(2)</enum><header>Election of
			 inventory method</header><text>A person selecting an inventory management
			 method under paragraph (1) for a particular fungible good or fungible material
			 shall continue to use that method for that fungible good or fungible material
			 throughout the fiscal year of such person.</text>
						</paragraph></subsection><subsection id="H768AD1149ADE421A9F67FD5EA29C49D7"><enum>(h)</enum><header>Accessories,
			 Spare Parts, or Tools</header>
						<paragraph id="HF355CDA6529C421E9781BAC2519C0685"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraphs (2) and (3), accessories, spare
			 parts, or tools delivered with a good that form part of the good’s standard
			 accessories, spare parts, or tools shall—</text>
							<subparagraph id="HD073CB8607624AA190B5DE43191F3DA8"><enum>(A)</enum><text>be treated as
			 originating goods if the good is an originating good; and</text>
							</subparagraph><subparagraph id="H5A77F1B1C5B74ABF9E3C3A97C18E4A87"><enum>(B)</enum><text>be disregarded in
			 determining whether all the nonoriginating materials used in the production of
			 the good undergo the applicable change in tariff classification set forth in
			 Annex 4.1 of the Agreement.</text>
							</subparagraph></paragraph><paragraph id="H641980662A0A43D1A828FE2845576A56"><enum>(2)</enum><header>Conditions</header><text>Paragraph
			 (1) shall apply only if—</text>
							<subparagraph id="HDFCE2903D4744C879F29C8D7F02C33DD"><enum>(A)</enum><text>the accessories,
			 spare parts, or tools are classified with and not invoiced separately from the
			 good, regardless of whether such accessories, spare parts, or tools are
			 specified or are separately identified in the invoice for the good; and</text>
							</subparagraph><subparagraph id="HEFEAE3F8D24B45F893EFF695C00C82CE"><enum>(B)</enum><text>the quantities and
			 value of the accessories, spare parts, or tools are customary for the
			 good.</text>
							</subparagraph></paragraph><paragraph id="H91A9C55069A744D1847AFAA142A6CE6A"><enum>(3)</enum><header>Regional
			 value-content</header><text>If the good is subject to a regional value-content
			 requirement, the value of the accessories, spare parts, or tools shall be taken
			 into account as originating or nonoriginating materials, as the case may be, in
			 calculating the regional value-content of the good.</text>
						</paragraph></subsection><subsection id="HC093A1C62DDF407EA1DA633E36258DC0"><enum>(i)</enum><header>Packaging
			 Materials and Containers for Retail Sale</header><text>Packaging materials and
			 containers in which a good is packaged for retail sale, if classified with the
			 good, shall be disregarded in determining whether all the nonoriginating
			 materials used in the production of the good undergo the applicable change in
			 tariff classification set forth in Annex 3–A or Annex 4.1 of the Agreement,
			 and, if the good is subject to a regional value-content requirement, the value
			 of such packaging materials and containers shall be taken into account as
			 originating or nonoriginating materials, as the case may be, in calculating the
			 regional value-content of the good.</text>
					</subsection><subsection id="H1B5C24CE651A45CFAD5CDB347684B6F3"><enum>(j)</enum><header>Packing
			 Materials and Containers for Shipment</header><text>Packing materials and
			 containers for shipment shall be disregarded in determining whether a good is
			 an originating good.</text>
					</subsection><subsection id="H717E0B9D851840F5994A690214D4A9F1"><enum>(k)</enum><header>Indirect
			 Materials</header><text>An indirect material shall be treated as an originating
			 material without regard to where it is produced.</text>
					</subsection><subsection id="H50E881A391F14DC4B7693D60EB95CF91"><enum>(l)</enum><header>Transit and
			 Transhipment</header><text>A good that has undergone production necessary to
			 qualify as an originating good under subsection (b) shall not be considered to
			 be an originating good if, subsequent to that production, the good—</text>
						<paragraph id="H18E1AE922A0A4EDE9B723A3EBB2A1447"><enum>(1)</enum><text>undergoes further
			 production or any other operation outside the territory of Colombia or the
			 United States, other than unloading, reloading, or any other operation
			 necessary to preserve the good in good condition or to transport the good to
			 the territory of Colombia or the United States; or</text>
						</paragraph><paragraph id="H2EB072AFA3F94A98AA176733CAA49223"><enum>(2)</enum><text>does not remain
			 under the control of customs authorities in the territory of a country other
			 than Colombia or the United States.</text>
						</paragraph></subsection><subsection id="H9320852310854B00A0D07495DFC0503F"><enum>(m)</enum><header>Goods
			 Classifiable as Goods Put Up in Sets</header><text>Notwithstanding the rules
			 set forth in Annex 3–A and Annex 4.1 of the Agreement, goods classifiable as
			 goods put up in sets for retail sale as provided for in General Rule of
			 Interpretation 3 of the HTS shall not be considered to be originating goods
			 unless—</text>
						<paragraph id="HADA403417C99435FAF02892155845ECE"><enum>(1)</enum><text>each of the goods
			 in the set is an originating good; or</text>
						</paragraph><paragraph id="H0331A49F542C407E98D3CF4BA78622D6"><enum>(2)</enum><text>the total value of
			 the nonoriginating goods in the set does not exceed—</text>
							<subparagraph id="HD96E5886A5AA4C86B16068C8CC48E0B1"><enum>(A)</enum><text>in the case of
			 textile or apparel goods, 10 percent of the adjusted value of the set;
			 or</text>
							</subparagraph><subparagraph id="H6592008055C4497281E1C1EDBB594B7E"><enum>(B)</enum><text>in the case of a
			 good, other than a textile or apparel good, 15 percent of the adjusted value of
			 the set.</text>
							</subparagraph></paragraph></subsection><subsection id="H965B75B0E19F474397BB868BEC2BB689"><enum>(n)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="HDBD8079CECE748C5AD6C8F1C620DA261"><enum>(1)</enum><header>Adjusted
			 value</header><text>The term <term>adjusted value</term> means the value
			 determined in accordance with articles 1 through 8, article 15, and the
			 corresponding interpretive notes, of the Agreement on Implementation of Article
			 VII of the General Agreement on Tariffs and Trade 1994 referred to in section
			 101(d)(8) of the Uruguay Round Agreements Act (19 U.S.C. 3511(d)(8)), adjusted,
			 if necessary, to exclude any costs, charges, or expenses incurred for
			 transportation, insurance, and related services incident to the international
			 shipment of the merchandise from the country of exportation to the place of
			 importation.</text>
						</paragraph><paragraph id="H35307C7993854CCEAD5D198A7B37472E"><enum>(2)</enum><header>Class of motor
			 vehicles</header><text>The term <term>class of motor vehicles</term> means any
			 one of the following categories of motor vehicles:</text>
							<subparagraph id="H351D8B4647874A77B032EEF8B7BD3B80"><enum>(A)</enum><text>Motor vehicles
			 provided for in subheading 8701.20, 8704.10, 8704.22, 8704.23, 8704.32, or
			 8704.90, or heading 8705 or 8706, or motor vehicles for the transport of 16 or
			 more persons provided for in subheading 8702.10 or 8702.90.</text>
							</subparagraph><subparagraph id="H485ADF85CBEA47A485407C3A6D461CD9"><enum>(B)</enum><text>Motor vehicles
			 provided for in subheading 8701.10 or any of subheadings 8701.30 through
			 8701.90.</text>
							</subparagraph><subparagraph id="H38B3B5BAE40848AB8C2C5E4004FB41DC"><enum>(C)</enum><text>Motor vehicles for
			 the transport of 15 or fewer persons provided for in subheading 8702.10 or
			 8702.90, or motor vehicles provided for in subheading 8704.21 or
			 8704.31.</text>
							</subparagraph><subparagraph id="H1CD3D7B8FD9E459795A2F138ABC36230"><enum>(D)</enum><text>Motor vehicles
			 provided for in any of subheadings 8703.21 through 8703.90.</text>
							</subparagraph></paragraph><paragraph id="H812290AD17EE44D786E05D41F59D5500"><enum>(3)</enum><header>Fungible good or
			 fungible material</header><text>The term <term>fungible good</term> or
			 <term>fungible material</term> means a good or material, as the case may be,
			 that is interchangeable with another good or material for commercial purposes
			 and the properties of which are essentially identical to such other good or
			 material.</text>
						</paragraph><paragraph id="H4A3798246D414ED68E76D3365BFCA25A"><enum>(4)</enum><header>Generally
			 accepted accounting principles</header><text>The term <term>generally accepted
			 accounting principles</term> means the recognized consensus or substantial
			 authoritative support in the territory of Colombia or the United States, as the
			 case may be, with respect to the recording of revenues, expenses, costs,
			 assets, and liabilities, the disclosure of information, and the preparation of
			 financial statements. The principles may encompass broad guidelines of general
			 application as well as detailed standards, practices, and procedures.</text>
						</paragraph><paragraph id="H6C6725AF406241CEBA63315E207CF18D"><enum>(5)</enum><header>Good wholly
			 obtained or produced entirely in the territory of colombia, the united states,
			 or both</header><text>The term <term>good wholly obtained or produced entirely
			 in the territory of Colombia, the United States, or both</term> means any of
			 the following:</text>
							<subparagraph id="HB6C59973E405498E892245188E402A63"><enum>(A)</enum><text>Plants and plant
			 products harvested or gathered in the territory of Colombia, the United States,
			 or both.</text>
							</subparagraph><subparagraph id="H3BD3C59133C14D04BA528B3921F264EF"><enum>(B)</enum><text>Live animals born
			 and raised in the territory of Colombia, the United States, or both.</text>
							</subparagraph><subparagraph id="HF4A62D190CF546D4A5E33A28E79394DA"><enum>(C)</enum><text>Goods obtained in
			 the territory of Colombia, the United States, or both from live animals.</text>
							</subparagraph><subparagraph id="H18F085D764AF4AC28B27E55C75AF0911"><enum>(D)</enum><text>Goods obtained
			 from hunting, trapping, fishing, or aquaculture conducted in the territory of
			 Colombia, the United States, or both.</text>
							</subparagraph><subparagraph id="H2798515829AE45868780F339EC2DAEB0"><enum>(E)</enum><text>Minerals and other
			 natural resources not included in subparagraphs (A) through (D) that are
			 extracted or taken from the territory of Colombia, the United States, or
			 both.</text>
							</subparagraph><subparagraph id="H145C45DA772F442E83D9A5FF0566E76C"><enum>(F)</enum><text>Fish, shellfish,
			 and other marine life taken from the sea, seabed, or subsoil outside the
			 territory of Colombia or the United States by—</text>
								<clause id="HF7EF0F985A884FC4ABBE954673B0B27F"><enum>(i)</enum><text>a
			 vessel that is registered or recorded with Colombia and flying the flag of
			 Colombia; or</text>
								</clause><clause id="H790053F6C3954E21AD181696147535F8"><enum>(ii)</enum><text>a
			 vessel that is documented under the laws of the United States.</text>
								</clause></subparagraph><subparagraph id="HE5FCF48270EC42639C67EF76F1646A39"><enum>(G)</enum><text>Goods produced on
			 board a factory ship from goods referred to in subparagraph (F), if such
			 factory ship—</text>
								<clause id="HCE03513D1E9B43688D3042606D0CA86A"><enum>(i)</enum><text>is
			 registered or recorded with Colombia and flies the flag of Colombia; or</text>
								</clause><clause id="H5B6FE7F18EBF474FA6120F9AD8DBFAAE"><enum>(ii)</enum><text>is
			 a vessel that is documented under the laws of the United States.</text>
								</clause></subparagraph><subparagraph id="HC396A3DEB39442F892812E99C564D6DF"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="HBE62175130094746B115377E84330C93"><enum>(i)</enum><text>Goods taken by Colombia
			 or a person of Colombia from the seabed or subsoil outside the territorial
			 waters of Colombia, if Colombia has rights to exploit such seabed or
			 subsoil.</text>
								</clause><clause id="HC969B92EDEA04927B89FE77A558B670C" indent="up1"><enum>(ii)</enum><text>Goods taken by the United States
			 or a person of the United States from the seabed or subsoil outside the
			 territorial waters of the United States, if the United States has rights to
			 exploit such seabed or subsoil.</text>
								</clause></subparagraph><subparagraph id="idB75C6DA5BEDB4238AD6754961C5BE2AA"><enum>(I)</enum><text>Goods taken from
			 outer space, if the goods are obtained by Colombia or the United States or a
			 person of Colombia or the United States and not processed in the territory of a
			 country other than Colombia or the United States.</text>
							</subparagraph><subparagraph id="H0E17786A73C14EE3B5ECC00966FC54F6"><enum>(J)</enum><text>Waste and scrap
			 derived from—</text>
								<clause id="HE90B15F2AA9C45F8B0259A34C7F129D2"><enum>(i)</enum><text>manufacturing or
			 processing operations in the territory of Colombia, the United States, or both;
			 or</text>
								</clause><clause id="HDF2B7454B47548BBB5D87C2CD053297A"><enum>(ii)</enum><text>used goods
			 collected in the territory of Colombia, the United States, or both, if such
			 goods are fit only for the recovery of raw materials.</text>
								</clause></subparagraph><subparagraph id="H2FEB1FD38F8D428FBCFD7B62F090A1C8"><enum>(K)</enum><text>Recovered goods
			 derived in the territory of Colombia, the United States, or both, from used
			 goods, and used in the territory of Colombia, the United States, or both, in
			 the production of remanufactured goods.</text>
							</subparagraph><subparagraph id="HE82B93312C8648E89A253AC2B444C2BE"><enum>(L)</enum><text>Goods, at any
			 stage of production, produced in the territory of Colombia, the United States,
			 or both, exclusively from—</text>
								<clause id="H5613674A6B8E4EC3A711499CE24F8355"><enum>(i)</enum><text>goods referred to
			 in any of subparagraphs (A) through (J); or</text>
								</clause><clause id="H406B50CC2DC7492D951C557260E99769"><enum>(ii)</enum><text>the
			 derivatives of goods referred to in clause (i).</text>
								</clause></subparagraph></paragraph><paragraph id="H5BD754A06DB843F5A63AF87850074897"><enum>(6)</enum><header>Identical
			 goods</header><text>The term <term>identical goods</term> means goods that are
			 the same in all respects relevant to the rule of origin that qualifies the
			 goods as originating goods.</text>
						</paragraph><paragraph id="H1EA19CABA91D4CA49A0BC5A033445BE9"><enum>(7)</enum><header>Indirect
			 material</header><text>The term <term>indirect material</term> means a good
			 used in the production, testing, or inspection of another good but not
			 physically incorporated into that other good, or a good used in the maintenance
			 of buildings or the operation of equipment associated with the production of
			 another good, including—</text>
							<subparagraph id="HA3940AEEA8D34CC9B200A24678D974DA"><enum>(A)</enum><text>fuel and
			 energy;</text>
							</subparagraph><subparagraph id="HF402EB01123B4B08B2FAEDDDECC1416A"><enum>(B)</enum><text>tools, dies, and
			 molds;</text>
							</subparagraph><subparagraph id="H20CDF76B0F44446D9F8CE1DE385FB971"><enum>(C)</enum><text>spare parts and
			 materials used in the maintenance of equipment or buildings;</text>
							</subparagraph><subparagraph id="H1DD77BD24D3D4CA78E166123813346BA"><enum>(D)</enum><text>lubricants,
			 greases, compounding materials, and other materials used in production or used
			 to operate equipment or buildings;</text>
							</subparagraph><subparagraph id="H511803FB81F4453695DCD329949AEAF6"><enum>(E)</enum><text>gloves, glasses,
			 footwear, clothing, safety equipment, and supplies;</text>
							</subparagraph><subparagraph id="H2DF15A209C9B441A9C176DC21163B1C4"><enum>(F)</enum><text>equipment,
			 devices, and supplies used for testing or inspecting the good;</text>
							</subparagraph><subparagraph id="H0EBA522A61FD4F49BF231AA5054FDBEB"><enum>(G)</enum><text>catalysts and
			 solvents; and</text>
							</subparagraph><subparagraph id="HAA02CF5A87B049EB871A8BB96C6B5E8C"><enum>(H)</enum><text>any other goods
			 that are not incorporated into the other good but the use of which in the
			 production of the other good can reasonably be demonstrated to be a part of
			 that production.</text>
							</subparagraph></paragraph><paragraph id="H3E04C57ED8A34425A8CC955B181C6A58"><enum>(8)</enum><header>Material</header><text>The
			 term <term>material</term> means a good that is used in the production of
			 another good, including a part or an ingredient.</text>
						</paragraph><paragraph id="HDB0A53F2E3734A849E962EDBAA42D740"><enum>(9)</enum><header>Material that is
			 self-produced</header><text>The term <term>material that is
			 self-produced</term> means an originating material that is produced by a
			 producer of a good and used in the production of that good.</text>
						</paragraph><paragraph id="H5A84C6266B0F4E75AE6364CB34506BBB"><enum>(10)</enum><header>Model line of
			 motor vehicles</header><text>The term <term>model line of motor vehicles</term>
			 means a group of motor vehicles having the same platform or model name.</text>
						</paragraph><paragraph id="HBB98F0BC8DED41DE89C8A507347D4406"><enum>(11)</enum><header>Net
			 cost</header><text>The term <term>net cost</term> means total cost minus sales
			 promotion, marketing, and after-sales service costs, royalties, shipping and
			 packing costs, and nonallowable interest costs that are included in the total
			 cost.</text>
						</paragraph><paragraph id="HBD04583D36AB4391A30024FB71A03347"><enum>(12)</enum><header>Nonallowable
			 interest costs</header><text>The term <term>nonallowable interest costs</term>
			 means interest costs incurred by a producer that exceed 700 basis points above
			 the applicable official interest rate for comparable maturities of the country
			 in which the producer is located.</text>
						</paragraph><paragraph id="H72ABD9FBFD2840F5B31125FC66DCEBA1"><enum>(13)</enum><header>Nonoriginating
			 good or nonoriginating material</header><text>The terms <term>nonoriginating
			 good</term> and <term>nonoriginating material</term> mean a good or material,
			 as the case may be, that does not qualify as originating under this
			 section.</text>
						</paragraph><paragraph id="H6F6B2C30CC844D8AA5FE5EB91A9E5C37"><enum>(14)</enum><header>Packing
			 materials and containers for shipment</header><text>The term <term>packing
			 materials and containers for shipment</term> means goods used to protect
			 another good during its transportation and does not include the packaging
			 materials and containers in which the other good is packaged for retail
			 sale.</text>
						</paragraph><paragraph id="H0BAE4D1F26174BFFA3119722503BBFFA"><enum>(15)</enum><header>Preferential
			 tariff treatment</header><text>The term <term>preferential tariff
			 treatment</term> means the customs duty rate, and the treatment under article
			 2.10.4 of the Agreement, that is applicable to an originating good pursuant to
			 the Agreement.</text>
						</paragraph><paragraph id="HBECFD27F6A2B4DCEA7BE71A98F355A75"><enum>(16)</enum><header>Producer</header><text>The
			 term <term>producer</term> means a person who engages in the production of a
			 good in the territory of Colombia or the United States.</text>
						</paragraph><paragraph id="H9C986CBBEEE047459763CD7000EE8A50"><enum>(17)</enum><header>Production</header><text>The
			 term <term>production</term> means growing, mining, harvesting, fishing,
			 raising, trapping, hunting, manufacturing, processing, assembling, or
			 disassembling a good.</text>
						</paragraph><paragraph id="HCA31713D31B340969BFB2C7E256144D3"><enum>(18)</enum><header>Reasonably
			 allocate</header><text>The term <term>reasonably allocate</term> means to
			 apportion in a manner that would be appropriate under generally accepted
			 accounting principles.</text>
						</paragraph><paragraph id="HA5F90EC4A8D84AC3BF1BD650E6B994CB"><enum>(19)</enum><header>Recovered
			 goods</header><text>The term <term>recovered goods</term> means materials in
			 the form of individual parts that are the result of—</text>
							<subparagraph id="HC02BA12112D0498D94A21E7C7C943BA3"><enum>(A)</enum><text>the disassembly of
			 used goods into individual parts; and</text>
							</subparagraph><subparagraph id="H8A975D1C47234760952F2E110082B584"><enum>(B)</enum><text>the cleaning,
			 inspecting, testing, or other processing that is necessary for improvement to
			 sound working condition of such individual parts.</text>
							</subparagraph></paragraph><paragraph id="HE4C6BA7E6BFE49CE9CCA930BAA20F0B0"><enum>(20)</enum><header>Remanufactured
			 good</header><text>The term <term>remanufactured good</term> means an
			 industrial good assembled in the territory of Colombia or the United States, or
			 both, that is classified under chapter 84, 85, 87, or 90 or heading 9402, other
			 than a good classified under heading 8418 or 8516, and that—</text>
							<subparagraph id="H74FA41390FDC43BBAFD26E2A6F7D1892"><enum>(A)</enum><text>is entirely or
			 partially comprised of recovered goods; and</text>
							</subparagraph><subparagraph id="H1E285B97ABE74565A649BCBA84F88118"><enum>(B)</enum><text>has a similar life
			 expectancy and enjoys a factory warranty similar to such a good that is
			 new.</text>
							</subparagraph></paragraph><paragraph id="H21657B410FBA42C0ADC4CD99F272D03F"><enum>(21)</enum><header>Total
			 cost</header>
							<subparagraph id="H9C82FAC14E4C4F58BCA81B1A5CDCD0FC"><enum>(A)</enum><header>In
			 general</header><text>The term <term>total cost</term>—</text>
								<clause id="HE049980906A4498DA14ECDD03AF3B937"><enum>(i)</enum><text>means all product
			 costs, period costs, and other costs for a good incurred in the territory of
			 Colombia, the United States, or both; and</text>
								</clause><clause id="HC29DFBC64211459A9DBBB933F9CB3C9F"><enum>(ii)</enum><text>does not include
			 profits that are earned by the producer, regardless of whether they are
			 retained by the producer or paid out to other persons as dividends, or taxes
			 paid on those profits, including capital gains taxes.</text>

			 costs</header><text>The term <term>product costs</term> means costs that are
			 associated with the production of a good and include the value of materials,
			 direct labor costs, and direct overhead.</text>
								</clause><clause id="H38C05E1D6D4A4D109C2CE9147C46C649"><enum>(ii)</enum><header>Period
			 costs</header><text>The term <term>period costs</term> means costs, other than
			 product costs, that are expensed in the period in which they are incurred, such
			 as selling expenses and general and administrative expenses.</text>
								</clause><clause id="HC8A4F8A40C5747D59E76AC407149A927"><enum>(iii)</enum><header>Other
			 costs</header><text>The term <term>other costs</term> means all costs recorded
			 on the books of the producer that are not product costs or period costs, such
			 as interest.</text>
								</clause></subparagraph></paragraph><paragraph id="H1D56280397B842B4A319A153A0A6309F"><enum>(22)</enum><header>Used</header><text>The
			 term <term>used</term> means utilized or consumed in the production of
			 goods.</text>
						</paragraph></subsection><subsection id="H234D288137CA40FF970CF87448910D59"><enum>(o)</enum><header>Presidential
			 Proclamation Authority</header>
						<paragraph id="H22011999D9474604B3E5AE5C05ED4A20"><enum>(1)</enum><header>In
			 general</header><text>The President is authorized to proclaim, as part of the
			 HTS—</text>
							<subparagraph id="HBFF48B67D10042C6875E3CEDE03D32BD"><enum>(A)</enum><text>the provisions set
			 forth in Annex 3–A and Annex 4.1 of the Agreement; and</text>
							</subparagraph><subparagraph id="HD93045DA98074F169373C1D2B8FB1946"><enum>(B)</enum><text>any additional
			 subordinate category that is necessary to carry out this title consistent with
			 the Agreement.</text>
							</subparagraph></paragraph><paragraph id="H8E6165AB11C34A86A124649B7ADE2CC7"><enum>(2)</enum><header>Fabrics and
			 yarns not available in commercial quantities in the united
			 states</header><text>The President is authorized to proclaim that a fabric or
			 yarn is added to the list in Annex 3–B of the Agreement in an unrestricted
			 quantity, as provided in article 3.3.5(e) of the Agreement.</text>
						</paragraph><paragraph id="H6CEFD3884EBF4BCE9946EE906059E390"><enum>(3)</enum><header>Modifications</header>
							<subparagraph id="H941BD03A26CE49FC8C29B7BAE9A2F48F"><enum>(A)</enum><header>In
			 general</header><text>Subject to the consultation and layover provisions of
			 section 614, the President may proclaim modifications to the provisions
			 proclaimed under the authority of paragraph (1)(A), other than provisions of
			 chapters 50 through 63 (as included in Annex 3–A of the Agreement).</text>
							</subparagraph><subparagraph id="HF2C18E52573E4B138DA482C94AB69D11"><enum>(B)</enum><header>Additional
			 proclamations</header><text>Notwithstanding subparagraph (A), and subject to
			 the consultation and layover provisions of section 614, the President may
			 proclaim before the end of the 1-year period beginning on the date of the
			 enactment of this Act, modifications to correct any typographical, clerical, or
			 other nonsubstantive technical error regarding the provisions of chapters 50
			 through 63 (as included in Annex 3–A of the Agreement).</text>
							</subparagraph></paragraph><paragraph id="H8364043F05F6490DA3A301E60A7929E5"><enum>(4)</enum><header>Fabrics, yarns,
			 or fibers not available in commercial quantities in colombia and the united
			 states</header>
							<subparagraph id="H039A80875C134254A16FB7370F2ABBB1"><enum>(A)</enum><header>In
			 general</header><text>Notwithstanding paragraph (3)(A), the list of fabrics,
			 yarns, and fibers set forth in Annex 3–B of the Agreement may be modified as
			 provided for in this paragraph.</text>
							</subparagraph><subparagraph id="H2F5FE5D865B2439A9735D784B3C0EB91"><enum>(B)</enum><header>Definitions</header><text>In
			 this paragraph:</text>
								<clause id="H7028A2C5A00C46E29A67CD1EDA1B1A78"><enum>(i)</enum><text>The
			 term <term>interested entity</term> means the Government of Colombia, a
			 potential or actual purchaser of a textile or apparel good, or a potential or
			 actual supplier of a textile or apparel good.</text>
								</clause><clause id="H394533934F544DDC962636A17E7B2E38"><enum>(ii)</enum><text>All
			 references to <quote>day</quote> and <quote>days</quote> exclude Saturdays,
			 Sundays, and legal holidays observed by the Government of the United
			 States.</text>
								</clause></subparagraph><subparagraph id="HD00AF3B640234E4EBBBB4A6A790132C3"><enum>(C)</enum><header>Requests to add
			 fabrics, yarns, or fibers</header><clause commented="no" display-inline="yes-display-inline" id="H743CAEE6700647BB8C13C52572F9D5BA"><enum>(i)</enum><text>An interested entity may
			 request the President to determine that a fabric, yarn, or fiber is not
			 available in commercial quantities in a timely manner in Colombia and the
			 United States and to add that fabric, yarn, or fiber to the list in Annex 3–B
			 of the Agreement in a restricted or unrestricted quantity.</text>
								</clause><clause id="HF0E3E0D0BAB14CDC904A64E703B09BF7" indent="up1"><enum>(ii)</enum><text>After receiving a request under
			 clause (i), the President may determine whether—</text>
									<subclause id="H9C71F569702D4A44AA176D4378E52D30"><enum>(I)</enum><text>the fabric, yarn, or fiber is available
			 in commercial quantities in a timely manner in Colombia or the United States;
			 or</text>
									</subclause><subclause id="HA77710E215FC4BE6BB896D84C4F13A8F"><enum>(II)</enum><text>any interested entity objects to the
			 request.</text>
									</subclause></clause><clause id="H647AEA7B39634A72B89BD4713E2010A0" indent="up1"><enum>(iii)</enum><text>The President may, within the
			 time periods specified in clause (iv), proclaim that the fabric, yarn, or fiber
			 that is the subject of the request is added to the list in Annex 3–B of the
			 Agreement in an unrestricted quantity, or in any restricted quantity that the
			 President may establish, if the President has determined under clause (ii)
			 that—</text>
									<subclause id="H46C9CF7A400443F9B479499F6C4EDF26"><enum>(I)</enum><text>the fabric, yarn, or fiber is not
			 available in commercial quantities in a timely manner in Colombia and the
			 United States; or</text>
									</subclause><subclause id="H10535DA1A2F34F94BACAD3110F68A22C"><enum>(II)</enum><text>no interested entity has objected to the
			 request.</text>
									</subclause></clause><clause id="H8DDB5FFA26B34543B4693FB1B82C9B16" indent="up1"><enum>(iv)</enum><text>The time periods within which the
			 President may issue a proclamation under clause (iii) are—</text>
									<subclause id="H81111B57B6AC4116953CFE5CFE63323C"><enum>(I)</enum><text>not later than 30 days after the date on
			 which a request is submitted under clause (i); or</text>
									</subclause><subclause id="HF7F617CE8C674629B229BD41B70958E4"><enum>(II)</enum><text>not later than 44 days after the request
			 is submitted, if the President determines, within 30 days after the date on
			 which the request is submitted, that the President does not have sufficient
			 information to make a determination under clause (ii).</text>
									</subclause></clause><clause id="H5C9E39B78A224E45A426D0CBF3695EB9" indent="up1"><enum>(v)</enum><text>Notwithstanding section 613(a)(2),
			 a proclamation made under clause (iii) shall take effect on the date on which
			 the text of the proclamation is published in the Federal Register.</text>
								</clause><clause id="HE246440301CE453AA1318981A8F81AD4" indent="up1"><enum>(vi)</enum><text>Not later than 6 months after
			 proclaiming under clause (iii) that a fabric, yarn, or fiber is added to the
			 list in Annex 3–B of the Agreement in a restricted quantity, the President may
			 eliminate the restriction if the President determines that the fabric, yarn, or
			 fiber is not available in commercial quantities in a timely manner in Colombia
			 and the United States.</text>
								</clause></subparagraph><subparagraph id="H284181BEF7CA4EB198FBA27393F6B7F8"><enum>(D)</enum><header>Deemed approval
			 of request</header><text>If, after an interested entity submits a request under
			 subparagraph (C)(i), the President does not, within the applicable time period
			 specified in subparagraph (C)(iv), make a determination under subparagraph
			 (C)(ii) regarding the request, the fabric, yarn, or fiber that is the subject
			 of the request shall be considered to be added, in an unrestricted quantity, to
			 the list in Annex 3–B of the Agreement beginning—</text>
								<clause id="HA0B09C4414B44C8B9C989D193E378F00"><enum>(i)</enum><text>45
			 days after the date on which the request was submitted; or</text>
								</clause><clause id="H7765DB99031C4C81B8BAB77909BFBDEB"><enum>(ii)</enum><text>60
			 days after the date on which the request was submitted, if the President made a
			 determination under subparagraph (C)(iv)(II).</text>
								</clause></subparagraph><subparagraph id="HD0189350DBB14352A94C18DC960E8A18"><enum>(E)</enum><header>Requests to
			 restrict or remove fabrics, yarns, or fibers</header><clause commented="no" display-inline="yes-display-inline" id="HA20206926FCC4AF28781D3EDADC7227E"><enum>(i)</enum><text>Subject to clause (ii),
			 an interested entity may request the President to restrict the quantity of, or
			 remove from the list in Annex 3–B of the Agreement, any fabric, yarn, or
			 fiber—</text>
									<subclause id="HDAF2E2BCB1D94D2889CEB28C2AE30E3C" indent="up1"><enum>(I)</enum><text>that has been added to that list in an
			 unrestricted quantity pursuant to paragraph (2) or subparagraph (C)(iii) or (D)
			 of this paragraph; or</text>
									</subclause><subclause id="HF9828DC5927D41379EEC651C09A08B2A" indent="up1"><enum>(II)</enum><text>with respect to which the President has
			 eliminated a restriction under subparagraph (C)(vi).</text>
									</subclause></clause><clause id="HE51E08244305401CB5178B63D879AD18" indent="up1"><enum>(ii)</enum><text>An interested entity may submit a
			 request under clause (i) at any time beginning 6 months after the date of the
			 action described in subclause (I) or (II) of that clause.</text>
								</clause><clause id="H805C665540604C0FA1B51770DF161C53" indent="up1"><enum>(iii)</enum><text>Not later than 30 days after the
			 date on which a request under clause (i) is submitted, the President may
			 proclaim an action provided for under clause (i) if the President determines
			 that the fabric, yarn, or fiber that is the subject of the request is available
			 in commercial quantities in a timely manner in Colombia or the United
			 States.</text>
								</clause><clause id="HAFA8A213E00A4134963B24F8A0A48EFE" indent="up1"><enum>(iv)</enum><text>A proclamation under clause (iii)
			 shall take effect no earlier than the date that is 6 months after the date on
			 which the text of the proclamation is published in the Federal Register.</text>
								</clause></subparagraph><subparagraph id="HDF197CC2C0344163B0EECEA6FA0850A7"><enum>(F)</enum><header>Procedures</header><text>The
			 President shall establish procedures—</text>
								<clause id="H94F80BB717844A098C901EED36D6F450"><enum>(i)</enum><text>governing the
			 submission of a request under subparagraphs (C) and (E); and</text>
								</clause><clause id="HDB6499E741D549768292DDC5125F7EF5"><enum>(ii)</enum><text>providing an
			 opportunity for interested entities to submit comments and supporting evidence
			 before the President makes a determination under subparagraph (C) (ii) or (vi)
			 or (E)(iii).</text>
								</clause></subparagraph></paragraph></subsection></section><section commented="no" id="H75C76B31C28C47ECA3CBE1FED3FA3224"><enum>624.</enum><header>Customs user
			 fees</header>
					<subsection commented="no" id="HDB53F940901F45B692D5D2D7AA84DEA5"><enum>(a)</enum><header>In
			 General</header><text>Section 13031(b) of the Consolidated Omnibus Budget
			 Reconciliation Act of 1985 (19 U.S.C. 58c(b)) is amended by adding after
			 paragraph (18), the following:</text>
						<quoted-block id="HB6CD00A08ABD443CAAF6785B235363FF" style="OLC">
							<paragraph commented="no" id="HF54FFADF81C54BDA865CA1F872D4A6EA"><enum>(19)</enum><text>No fee may be
				charged under subsection (a)(9) or (10) with respect to goods that qualify as
				originating goods under section 203 of the United States-Colombia Trade
				Promotion Agreement Implementation Act. Any service for which an exemption from
				such fee is provided by reason of this paragraph may not be funded with money
				contained in the Customs User Fee
				Account.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="H9DC19791004A47D8922C7096D7148678"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall take effect on
			 October 1, 2013.</text>
					</subsection><subsection commented="no" id="HD22F941009304CDB83B398D74FB3591D"><enum>(c)</enum><header>Refund</header><text>Any
			 fee described in paragraph (19) of section 13031(b) of the Consolidated Omnibus
			 Budget Reconciliation Act of 1985 (19 U.S.C. 58c(b)) (as added by subsection
			 (a)) that is paid on or after the date that the United States-Colombia Trade
			 Promotion Agreement enters into force and before October 1, 2013, shall be
			 refunded with interest if application for such refund is made on or after
			 October 1, 2013, and before July 1, 2014.</text>
					</subsection></section><section id="HBC9EE99E8A9542D0A25E2E2D9E5F6772"><enum>625.</enum><header>Disclosure of
			 incorrect information; false certifications of origin; denial of preferential
			 tariff treatment</header>
					<subsection id="H1A261357E9AA4DD5A64BB83A3706FD4C"><enum>(a)</enum><header>Disclosure of
			 Incorrect Information</header><text>Section 592 of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (19 U.S.C. 1592)
			 is amended—</text>
						<paragraph id="HCAFCB8450E1944B092ABD8E1BF757F15"><enum>(1)</enum><text>in subsection
			 (c)—</text>
							<subparagraph id="HF14E6924BEAC43239515112CEF49C9C8"><enum>(A)</enum><text>by redesignating
			 paragraph (11) as paragraph (12); and</text>
							</subparagraph><subparagraph id="HFEE9B817CF42472191F8D4EE4155851D"><enum>(B)</enum><text>by inserting after
			 paragraph (10) the following new paragraph:</text>
								<quoted-block id="H8B6A80DCB6C24E7C8A31DE29AD8068D1" style="OLC">
									<paragraph id="H3C63FEDF769B4A81AEFFC282F87E95DE"><enum>(11)</enum><header>Prior
				disclosure regarding claims under the united states-colombia trade promotion
				agreement</header><text>An importer shall not be subject to penalties under
				subsection (a) for making an incorrect claim that a good qualifies as an
				originating good under section 623 of the United States-Colombia Trade
				Promotion Agreement Implementation Act if the importer, in accordance with
				regulations issued by the Secretary of the Treasury, promptly and voluntarily
				makes a corrected declaration and pays any duties owing with respect to that
				good.</text>
									</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="HB2D336FBEA9E4A07AFE8A065A7A61603"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
							<quoted-block id="H30C69199C8E34C79B5BFCD2948D8B90E" style="OLC">
								<subsection id="HBB88E34C4ED54F8EA2D80EFA87E6FA1A"><enum>(j)</enum><header>False
				Certifications of Origin Under the United States-Colombia Trade Promotion
				Agreement</header>
									<paragraph id="HDC25AA0336194C5D9F266BBEED4E7C9D"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), it is unlawful for any person
				to certify falsely, by fraud, gross negligence, or negligence, in a CTPA
				certification of origin (as defined in section 508(i)(1)(B) of this Act) that a
				good exported from the United States qualifies as an originating good under the
				rules of origin provided for in section 623 of the United States-Colombia Trade
				Promotion Agreement Implementation Act. The procedures and penalties of this
				section that apply to a violation of subsection (a) also apply to a violation
				of this subsection.</text>
									</paragraph><paragraph id="H85F4E9872554413ABFB0E77ACCF44D5D"><enum>(2)</enum><header>Prompt and
				voluntary disclosure of incorrect information</header><text>No penalty shall be
				imposed under this subsection if, promptly after an exporter or producer that
				issued a CTPA certification of origin has reason to believe that such
				certification contains or is based on incorrect information, the exporter or
				producer voluntarily provides written notice of such incorrect information to
				every person to whom the certification was issued.</text>
									</paragraph><paragraph id="H5A1A9A4739F847DBB05EBAA4E0EC7A82"><enum>(3)</enum><header>Exception</header><text>A
				person shall not be considered to have violated paragraph (1) if—</text>
										<subparagraph id="HE2982326D9E74A88B9F455CD93D9A676"><enum>(A)</enum><text>the information
				was correct at the time it was provided in a CTPA certification of origin but
				was later rendered incorrect due to a change in circumstances; and</text>
										</subparagraph><subparagraph id="H29EF6858C34947FC9FE0F551AAD67DE5"><enum>(B)</enum><text>the person
				promptly and voluntarily provides written notice of the change in circumstances
				to all persons to whom the person provided the
				certification.</text>
										</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H6A54D5FA58004A408083293FE7828438"><enum>(b)</enum><header>Denial of
			 Preferential Tariff Treatment</header><text>Section 514 of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (19 U.S.C. 1514)
			 is amended by adding at the end the following new subsection:</text>
						<quoted-block act-name="Tariff Act of 1930" id="HB42EEDBBAC2D4D97A330336BBFC12D02" style="OLC">
							<subsection id="H958FF9FAF8E34DCBB1352129EB99C241"><enum>(j)</enum><header>Denial of
				Preferential Tariff Treatment Under the United States-Colombia Trade Promotion
				Agreement</header><text>If U.S. Customs and Border Protection or U.S.
				Immigration and Customs Enforcement of the Department of Homeland Security
				finds indications of a pattern of conduct by an importer, exporter, or producer
				of false or unsupported representations that goods qualify under the rules of
				origin provided for in section 623 of the United States-Colombia Trade
				Promotion Agreement Implementation Act, U.S. Customs and Border Protection, in
				accordance with regulations issued by the Secretary of the Treasury, may
				suspend preferential tariff treatment under the United States-Colombia Trade
				Promotion Agreement to entries of identical goods covered by subsequent
				representations by that importer, exporter, or producer until U.S. Customs and
				Border Protection determines that representations of that person are in
				conformity with such section
				623.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H7C7D5343D576475EA5D08E6103847715"><enum>626.</enum><header>Reliquidation
			 of entries</header><text display-inline="no-display-inline">Subsection (d) of
			 section 520 of the <act-name parsable-cite="TA30">Tariff Act of 1930</act-name>
			 (19 U.S.C. 1520(d)) is amended in the matter preceding paragraph (1)—</text>
					<paragraph id="H9BC5000260F8457380233B506727FCD3"><enum>(1)</enum><text>by striking

								<paragraph id="H9A24D7650168443ABD4BBE4EF661339A"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
									<subparagraph id="H64D07A6843EB45A0AB103DEFBD19C3F4"><enum>(A)</enum><header>Records and
				supporting documents</header><text>The term <term>records and supporting
				documents</term> means, with respect to an exported good under paragraph (2),
				records and documents related to the origin of the good, including—</text>
										<clause id="H094F28BE2A3B435E82BAA12F0EB62055"><enum>(i)</enum><text>the purchase,
				cost, and value of, and payment for, the good;</text>
										</clause><clause id="H204ED8F99320401197A2FC0A09D7FB3D"><enum>(ii)</enum><text>the purchase,
				cost, and value of, and payment for, all materials, including indirect
				materials, used in the production of the good; and</text>
										</clause><clause id="HB25E47E8A1F24841AC0043309DC888FC"><enum>(iii)</enum><text>the production
				of the good in the form in which it was exported.</text>
										</clause></subparagraph><subparagraph id="HD2CD0F8E4DAC44EE8FE1620ED504C708"><enum>(B)</enum><header>CTPA
				certification of origin</header><text>The term <term>CTPA certification of
				origin</term> means the certification established under article 4.15 of the
				United States-Colombia Trade Promotion Agreement that a good qualifies as an
				originating good under such Agreement.</text>
									</subparagraph></paragraph><paragraph id="HD68865BEFE9949B89D462916722576EE"><enum>(2)</enum><header>Exports to
				colombia</header><text>Any person who completes and issues a CTPA certification
				of origin for a good exported from the United States shall make, keep, and,
				pursuant to rules and regulations promulgated by the Secretary of the Treasury,
				render for examination and inspection all records and supporting documents
				related to the origin of the good (including the certification or copies
				thereof).</text>
								</paragraph><paragraph id="H95D5BA6589984FB9A7EDDBAB4E8F115C"><enum>(3)</enum><header>Retention
				period</header><text>The person who issues a CTPA certification of origin shall
				keep the records and supporting documents relating to that certification of
				origin for a period of at least 5 years after the date on which the
				certification is issued.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H739D643630924F96BBC2CB50E3B05016"><enum>(3)</enum><text>in subsection (j),
			 as so redesignated by striking <quote>(f), (g), or (h)</quote> and inserting
			 <quote>(f), (g), (h), or (i)</quote>.</text>
					</paragraph></section><section id="H019DF709F95A4E15935D19BA138DB514"><enum>628.</enum><header>Enforcement
			 relating to trade in textile or apparel goods</header>
					<subsection id="H5BE91888613344839D640D05F676E8A3"><enum>(a)</enum><header>Action During
			 Verification</header>
						<paragraph id="HD6A0BA79C1D94ADFA5A9712C03830B80"><enum>(1)</enum><header>In
			 general</header><text>If the Secretary of the Treasury requests the Government
			 of Colombia to conduct a verification pursuant to article 3.2 of the Agreement
			 for purposes of making a determination under paragraph (2), the President may
			 direct the Secretary to take appropriate action described in subsection (b)
			 while the verification is being conducted.</text>
						</paragraph><paragraph id="HA5067DFF47C84741ABF5A07B92FA3AF2"><enum>(2)</enum><header>Determination</header><text>A
			 determination under this paragraph is a determination of the Secretary
			 that—</text>
							<subparagraph id="HFF7211636D47466395996E46C608C90E"><enum>(A)</enum><text>an exporter or
			 producer in Colombia is complying with applicable customs laws, regulations,
			 and procedures regarding trade in textile or apparel goods, or</text>
							</subparagraph><subparagraph id="HCF25FB8B69274C35AEAE5A236AF2594B"><enum>(B)</enum><text>a claim that a
			 textile or apparel good exported or produced by such exporter or
			 producer—</text>
								<clause id="H9069440C3F0F486195FBEDD180B0ED23"><enum>(i)</enum><text>qualifies as an
			 originating good under section 623, or</text>
								</clause><clause id="H59DB0F47A0794AEF8A060B79C53B24F0"><enum>(ii)</enum><text>is
			 a good of Colombia,</text>
								</clause><continuation-text continuation-text-level="subparagraph">is
			 accurate.</continuation-text></subparagraph></paragraph></subsection><subsection id="H3CF7D844E73847528BDAA1BA1ECC9790"><enum>(b)</enum><header>Appropriate
			 Action Described</header><text>Appropriate action under subsection (a)(1)
			 includes—</text>
						<paragraph id="HE0CAB06440F74D05A4F08AFA3F8EE5BC"><enum>(1)</enum><text>suspension of
			 preferential tariff treatment under the Agreement with respect to—</text>
							<subparagraph id="HF3DEACB716524637BC6AC76646711C97"><enum>(A)</enum><text>any textile or
			 apparel good exported or produced by the person that is the subject of a
			 verification under subsection (a)(1) regarding compliance described in
			 subsection (a)(2)(A), if the Secretary determines that there is insufficient
			 information to support any claim for preferential tariff treatment that has
			 been made with respect to any such good; or</text>
							</subparagraph><subparagraph id="H70DCD478C32948DC9FAE5A5B18761FE9"><enum>(B)</enum><text>the textile or
			 apparel good for which a claim of preferential tariff treatment has been made
			 that is the subject of a verification under subsection (a)(1) regarding a claim
			 described in subsection (a)(2)(B), if the Secretary determines that there is
			 insufficient information to support that claim;</text>
							</subparagraph></paragraph><paragraph id="H2A65219631BA4ED4B451BF8153D5FF48"><enum>(2)</enum><text>denial of
			 preferential tariff treatment under the Agreement with respect to—</text>
							<subparagraph id="H81090745963F41FBBC5DD9DB135BF6BD"><enum>(A)</enum><text>any textile or
			 apparel good exported or produced by the person that is the subject of a
			 verification under subsection (a)(1) regarding compliance described in
			 subsection (a)(2)(A), if the Secretary determines that the person has provided
			 incorrect information to support any claim for preferential tariff treatment
			 that has been made with respect to any such good; or</text>
							</subparagraph><subparagraph id="HDCB0FAACAB524F72868DF39352638F40"><enum>(B)</enum><text>the textile or
			 apparel good for which a claim of preferential tariff treatment has been made
			 that is the subject of a verification under subsection (a)(1) regarding a claim
			 described in subsection (a)(2)(B), if the Secretary determines that a person
			 has provided incorrect information to support that claim;</text>
							</subparagraph></paragraph><paragraph id="H32FACD7A8BB84C50B1FB9A51B2D315EA"><enum>(3)</enum><text>detention of any
			 textile or apparel good exported or produced by the person that is the subject
			 of a verification under subsection (a)(1) regarding compliance described in
			 subsection (a)(2)(A) or a claim described in subsection (a)(2)(B), if the
			 Secretary determines that there is insufficient information to determine the
			 country of origin of any such good; and</text>
						</paragraph><paragraph id="HD6B228D837EA422F87127466EF3ABDF6"><enum>(4)</enum><text>denial of entry
			 into the United States of any textile or apparel good exported or produced by
			 the person that is the subject of a verification under subsection (a)(1)
			 regarding compliance described in subsection (a)(2)(A) or a claim described in
			 subsection (a)(2)(B), if the Secretary determines that the person has provided
			 incorrect information as to the country of origin of any such good.</text>
						</paragraph></subsection><subsection id="H656A36F60CD3455E8E5919C05F79FCEC"><enum>(c)</enum><header>Action on
			 Completion of a Verification</header><text>On completion of a verification
			 under subsection (a), the President may direct the Secretary to take
			 appropriate action described in subsection (d) until such time as the Secretary
			 receives information sufficient to make the determination under subsection
			 (a)(2) or until such earlier date as the President may direct.</text>
					</subsection><subsection id="H3F78FEBC334D4587A3AC49238C66A0DA"><enum>(d)</enum><header>Appropriate
			 Action Described</header><text>Appropriate action under subsection (c)
			 includes—</text>
						<paragraph id="H043E70FA1E8042689B28006ACE85EE30"><enum>(1)</enum><text>denial of
			 preferential tariff treatment under the Agreement with respect to—</text>
							<subparagraph id="HBEAE13719B5F4894BB8A2B758CCD0C44"><enum>(A)</enum><text>any textile or
			 apparel good exported or produced by the person that is the subject of a
			 verification under subsection (a)(1) regarding compliance described in
			 subsection (a)(2)(A), if the Secretary determines that there is insufficient
			 information to support, or that the person has provided incorrect information
			 to support, any claim for preferential tariff treatment that has been made with
			 respect to any such good; or</text>
							</subparagraph><subparagraph id="H73799267677C4C218836A865AF65A058"><enum>(B)</enum><text>the textile or
			 apparel good for which a claim of preferential tariff treatment has been made
			 that is the subject of a verification under subsection (a)(1) regarding a claim
			 described in subsection (a)(2)(B), if the Secretary determines that there is
			 insufficient information to support, or that a person has provided incorrect
			 information to support, that claim; and</text>
							</subparagraph></paragraph><paragraph id="H0F9D29ACC6094E6FBA0BD5E03C8A8FA5"><enum>(2)</enum><text>denial of entry
			 into the United States of any textile or apparel good exported or produced by
			 the person that is the subject of a verification under subsection (a)(1)
			 regarding compliance described in subsection (a)(2)(A) or a claim described in
			 subsection (a)(2)(B), if the Secretary determines that there is insufficient
			 information to determine, or that the person has provided incorrect information
			 as to, the country of origin of any such good.</text>
						</paragraph></subsection><subsection id="H7942627273E54C87900895D5AEED4239"><enum>(e)</enum><header>Publication of
			 Name of Person</header><text>In accordance with article 3.2.6 of the Agreement,
			 the Secretary may publish the name of any person that the Secretary has
			 determined—</text>
						<paragraph id="H0B9B1FC37EB240E49F94EE698D632A20"><enum>(1)</enum><text>is engaged in
			 circumvention of applicable laws, regulations, or procedures affecting trade in
			 textile or apparel goods; or</text>
						</paragraph><paragraph id="HAC4546C34B0E4B469BF4BF3003E3EA43"><enum>(2)</enum><text>has failed to
			 demonstrate that it produces, or is capable of producing, textile or apparel
			 goods.</text>
						</paragraph></subsection><subsection id="H195C4527C09949AC8186BBDF15339178"><enum>(f)</enum><header>Verifications in
			 the United States</header><text>If the government of a country that is a party
			 to a free trade agreement with the United States makes a request for a
			 verification pursuant to that agreement, the Secretary may request a
			 verification of the production of any textile or apparel good in order to
			 assist that government in determining—</text>
						<paragraph id="H22B07DC0807A4509B4E3ABB6659156C2"><enum>(1)</enum><text>whether a claim of
			 origin under the agreement for a textile or apparel good is accurate; or</text>
						</paragraph><paragraph id="HE807326DD81744D8B8ECF99E92BE6261"><enum>(2)</enum><text>whether an
			 exporter, producer, or other enterprise located in the United States involved
			 in the movement of textile or apparel goods from the United States to the
			 territory of the requesting government is complying with applicable customs
			 laws, regulations, and procedures regarding trade in textile or apparel
			 goods.</text>
						</paragraph></subsection></section><section id="HB842CB7CAA9E4FDAAD608FF9D95A776B"><enum>629.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of the Treasury shall
			 prescribe such regulations as may be necessary to carry out—</text>
					<paragraph id="H290FAF8F23BD4C26A54B965DEDDDBE47"><enum>(1)</enum><text>subsections (a)
			 through (n) of section 623;</text>
					</paragraph><paragraph id="H4A18C6349DA54FEA958AD81AE829730C"><enum>(2)</enum><text>the amendment made
			 by section 724; and</text>
					</paragraph><paragraph id="HA14DD478128C42F494A786D6CB121711"><enum>(3)</enum><text>any proclamation
			 issued under section 623(o).</text>
					</paragraph></section></subtitle><subtitle id="H0E43BB9BDDAC46919DD345DEDB4F8218"><enum>D</enum><header>Relief From
			 Imports</header>
				<section id="H98E72DD82E0749E1B3D74BF000194343"><enum>631.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="HC1F0AA467418425D8377F41D7AF8452E"><enum>(1)</enum><header>Colombian
			 article</header><text>The term <term>Colombian article</term> means an article
			 that qualifies as an originating good under section 623(b).</text>
					</paragraph><paragraph id="HABB8B34EA03A433498C0C1E443E0E90B"><enum>(2)</enum><header>Colombian
			 textile or apparel article</header><text>The term <term>Colombian textile or
			 apparel article</term> means a textile or apparel good (as defined in section
			 603(4)) that is a Colombian article.</text>
					</paragraph></section><chapter id="id29B1413AE93E48E2A7DABE9BBC244983"><enum>1</enum><header>Relief From
			 Imports Benefiting From the Agreement</header>
					<section id="HFD7D2EF4A65D4FB7914A64F1126178C8"><enum>641.</enum><header>Commencing of
			 action for relief</header>
						<subsection id="H4584927BD4844353A35D51AFB32547A5"><enum>(a)</enum><header>Filing of
			 Petition</header><text>A petition requesting action under this chapter for the
			 purpose of adjusting to the obligations of the United States under the
			 Agreement may be filed with the Commission by an entity, including a trade
			 association, firm, certified or recognized union, or group of workers, that is
			 representative of an industry. The Commission shall transmit a copy of any
			 petition filed under this subsection to the United States Trade
			 Representative.</text>
						</subsection><subsection id="H46E180C1A0A542418840B1E6D2858BAC"><enum>(b)</enum><header>Investigation
			 and Determination</header><text>Upon the filing of a petition under subsection
			 (a), the Commission, unless subsection (d) applies, shall promptly initiate an
			 investigation to determine whether, as a result of the reduction or elimination
			 of a duty provided for under the Agreement, a Colombian article is being
			 imported into the United States in such increased quantities, in absolute terms
			 or relative to domestic production, and under such conditions that imports of
			 the Colombian article constitute a substantial cause of serious injury or
			 threat thereof to the domestic industry producing an article that is like, or
			 directly competitive with, the imported article.</text>
						</subsection><subsection id="H41F2E37605214DE3A2EE536CDF2218B8"><enum>(c)</enum><header>Applicable
			 Provisions</header><text>The following provisions of section 202 of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2252)
			 apply with respect to any investigation initiated under subsection (b):</text>
							<paragraph id="H0975D093A710464EBE7F87B6B7935C9D"><enum>(1)</enum><text>Paragraphs (1)(B)
			 and (3) of subsection (b).</text>
							</paragraph><paragraph id="H02D3F872237A4A919DCC0B910B12BF2E"><enum>(2)</enum><text>Subsection
			 (c).</text>
							</paragraph><paragraph id="H22D502BA81B64C4592AA0F2E0F502CBB"><enum>(3)</enum><text>Subsection
			 (i).</text>
							</paragraph></subsection><subsection id="H5095DCEBD8DF4E97A74BC91C50B543BB"><enum>(d)</enum><header>Articles Exempt
			 From Investigation</header><text>No investigation may be initiated under this
			 section with respect to any Colombian article if, after the date on which the
			 Agreement enters into force, import relief has been provided with respect to
			 that Colombian article under this chapter.</text>
						</subsection></section><section id="HD0E913DED12A46978FA225B212C64CA1"><enum>642.</enum><header>Commission
			 action on petition</header>
						<subsection id="H2FAF665098744BF789ED3AD5CDAD3878"><enum>(a)</enum><header>Determination</header><text>Not
			 later than 120 days after the date on which an investigation is initiated under
			 section 641(b) with respect to a petition, the Commission shall make the
			 determination required under that section.</text>
						</subsection><subsection id="HA64ED7D0DD58434DA82E1E7AA78BFB9F"><enum>(b)</enum><header>Applicable
			 Provisions</header><text>For purposes of this chapter, the provisions of
			 paragraphs (1), (2), and (3) of section 330(d) of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (19 U.S.C. 1330(d)
			 (1), (2), and (3)) shall be applied with respect to determinations and findings
			 made under this section as if such determinations and findings were made under
			 section 202 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>
			 (19 U.S.C. 2252).</text>
						</subsection><subsection id="H7F70A8001E234E67AE4D946DDF67BC73"><enum>(c)</enum><header>Additional
			 Finding and Recommendation if Determination Affirmative</header>
							<paragraph id="H585A9A00AB60466EBCC69A82961BD687"><enum>(1)</enum><header>In
			 general</header><text>If the determination made by the Commission under
			 subsection (a) with respect to imports of an article is affirmative, or if the
			 President may consider a determination of the Commission to be an affirmative
			 determination as provided for under paragraph (1) of section 330(d) of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (19 U.S.C.
			 1330(d)), the Commission shall find, and recommend to the President in the
			 report required under subsection (d), the amount of import relief that is
			 necessary to remedy or prevent the injury found by the Commission in the
			 determination and to facilitate the efforts of the domestic industry to make a
			 positive adjustment to import competition.</text>
							</paragraph><paragraph id="HB77972715435488DB7655128263BD950"><enum>(2)</enum><header>Limitation on
			 relief</header><text>The import relief recommended by the Commission under this
			 subsection shall be limited to the relief described in section 643(c).</text>
							</paragraph><paragraph id="H4B8B6E6CD5D04EFB9635174F759FCC2C"><enum>(3)</enum><header>Voting; separate
			 views</header><text>Only those members of the Commission who voted in the
			 affirmative under subsection (a) are eligible to vote on the proposed action to
			 remedy or prevent the injury found by the Commission. Members of the Commission
			 who did not vote in the affirmative may submit, in the report required under
			 subsection (d), separate views regarding what action, if any, should be taken
			 to remedy or prevent the injury.</text>
							</paragraph></subsection><subsection id="HE2A09B6E6BE547F7A9AFFE3A3FE15596"><enum>(d)</enum><header>Report to
			 President</header><text>Not later than the date that is 30 days after the date
			 on which a determination is made under subsection (a) with respect to an
			 investigation, the Commission shall submit to the President a report that
			 includes—</text>
							<paragraph id="H98E33C3D6E4F4C2C8851422A00F37199"><enum>(1)</enum><text>the determination
			 made under subsection (a) and an explanation of the basis for the
			 determination;</text>
							</paragraph><paragraph id="H31FB73B97CDB487A9C3D4F0F0AC53EDF"><enum>(2)</enum><text>if the
			 determination under subsection (a) is affirmative, any findings and
			 recommendations for import relief made under subsection (c) and an explanation
			 of the basis for each recommendation; and</text>
							</paragraph><paragraph id="H1CCD4D7A62D1487996B356201C48E9B6"><enum>(3)</enum><text>any dissenting or
			 separate views by members of the Commission regarding the determination
			 referred to in paragraph (1) and any finding or recommendation referred to in
			 paragraph (2).</text>
							</paragraph></subsection><subsection id="H796959D4E5A94A69B75BCD3718D72EA3"><enum>(e)</enum><header>Public
			 Notice</header><text>Upon submitting a report to the President under subsection
			 (d), the Commission shall promptly make public the report (with the exception
			 of information which the Commission determines to be confidential) and shall
			 publish a summary of the report in the Federal Register.</text>
						</subsection></section><section id="H7653AAB6CA844F7881EF15F20BB9E638"><enum>643.</enum><header>Provision of
			 relief</header>
						<subsection id="H11E338F2171643E98C59C3A71460D485"><enum>(a)</enum><header>In
			 General</header><text>Not later than the date that is 30 days after the date on
			 which the President receives the report of the Commission in which the
			 Commission’s determination under section 642(a) is affirmative, or which
			 contains a determination under section 642(a) that the President considers to
			 be affirmative under paragraph (1) of section 330(d) of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (19 U.S.C.
			 1330(d)(1)), the President, subject to subsection (b), shall provide relief
			 from imports of the article that is the subject of such determination to the
			 extent that the President determines necessary to remedy or prevent the injury
			 found by the Commission and to facilitate the efforts of the domestic industry
			 to make a positive adjustment to import competition.</text>
						</subsection><subsection id="H4B55516FECAB4539B55FF680B948EFBF"><enum>(b)</enum><header>Exception</header><text>The
			 President is not required to provide import relief under this section if the
			 President determines that the provision of the import relief will not provide
			 greater economic and social benefits than costs.</text>
						</subsection><subsection id="H50A3DCF78E3740778A1B4A9EC321A72B"><enum>(c)</enum><header>Nature of
			 Relief</header>
							<paragraph id="H0D7A54C66DA44F249444EBA707512D82"><enum>(1)</enum><header>In
			 general</header><text>The import relief that the President is authorized to
			 provide under this section with respect to imports of an article is as
			 follows:</text>
								<subparagraph id="HB60B288ABEFF4F24BBAA63715E70145B"><enum>(A)</enum><text>The suspension of
			 any further reduction provided for under Annex 2.3 of the Agreement in the duty
			 imposed on the article.</text>
								</subparagraph><subparagraph id="H6B8EE058F1B3488DA7D9006D72C824F6"><enum>(B)</enum><text>An increase in the
			 rate of duty imposed on the article to a level that does not exceed the lesser
			 of—</text>
									<clause id="HF748672FA6534937BE9EFB3C44CD7C49"><enum>(i)</enum><text>the
			 column 1 general rate of duty imposed under the HTS on like articles at the
			 time the import relief is provided; or</text>
									</clause><clause id="H8EE8D46C64FE4AB788E94F00CC81A82B"><enum>(ii)</enum><text>the
			 column 1 general rate of duty imposed under the HTS on like articles on the day
			 before the date on which the Agreement enters into force.</text>
									</clause></subparagraph></paragraph><paragraph id="HD22B3D7659144954BA908078DC057FD9"><enum>(2)</enum><header>Progressive
			 liberalization</header><text>If the period for which import relief is provided
			 under this section is greater than 1 year, the President shall provide for the
			 progressive liberalization (described in article 8.2.2 of the Agreement) of
			 such relief at regular intervals during the period of its application.</text>
							</paragraph></subsection><subsection id="H938F15681C424F699F1D3AC4D4AA2DD1"><enum>(d)</enum><header>Period of
			 Relief</header>
							<paragraph id="H186ECD268AE04534BF5B3BAD342F61E5"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), any import relief that the
			 President provides under this section may not be in effect for more than 2
			 years.</text>
							</paragraph><paragraph id="H580766B2E3F2486B9B6DC1F92431420C"><enum>(2)</enum><header>Extension</header>
								<subparagraph id="HD36EC8226571473D9B8A42C7882892C8"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (C), the President, after
			 receiving a determination from the Commission under subparagraph (B) that is
			 affirmative, or which the President considers to be affirmative under paragraph
			 (1) of section 330(d) of the <act-name parsable-cite="TA30">Tariff Act of
			 1930</act-name> (19 U.S.C. 1330(d)(1)), may extend the effective period of any
			 import relief provided under this section by up to 2 years, if the President
			 determines that—</text>
									<clause id="H570801D6C5CC44EFA785516175BF8CAD"><enum>(i)</enum><text>the
			 import relief continues to be necessary to remedy or prevent serious injury and
			 to facilitate adjustment by the domestic industry to import competition;
			 and</text>
									</clause><clause id="HA732FF83B6124653BA999522484D2E48"><enum>(ii)</enum><text>there is evidence
			 that the industry is making a positive adjustment to import competition.</text>
									</clause></subparagraph><subparagraph id="H2784059DC7514A1B8DBAC2CF66FC6AF0"><enum>(B)</enum><header>Action by
			 commission</header>
									<clause id="HD3B92DA9C6DF4F70A1E162564F917E7E"><enum>(i)</enum><header>Investigation</header><text>Upon
			 a petition on behalf of the industry concerned that is filed with the
			 Commission not earlier than the date that is 9 months, and not later than the
			 date that is 6 months, before the date on which any action taken under
			 subsection (a) is to terminate, the Commission shall conduct an investigation
			 to determine whether action under this section continues to be necessary to
			 remedy or prevent serious injury and whether there is evidence that the
			 industry is making a positive adjustment to import competition.</text>
									</clause><clause id="H29797341504C411F833C642CD9E7342D"><enum>(ii)</enum><header>Notice and
			 hearing</header><text>The Commission shall publish notice of the commencement
			 of any proceeding under this subparagraph in the Federal Register and shall,
			 within a reasonable time thereafter, hold a public hearing at which the
			 Commission shall afford interested parties and consumers an opportunity to be
			 present, to present evidence, and to respond to the presentations of other
			 parties and consumers, and otherwise to be heard.</text>
									</clause><clause id="HFE7654D1891C4F008A468F4FECFC12A7"><enum>(iii)</enum><header>Report</header><text>The
			 Commission shall submit to the President a report on its investigation and
			 determination under this subparagraph not later than 60 days before the action
			 under subsection (a) is to terminate, unless the President specifies a
			 different date.</text>
									</clause></subparagraph><subparagraph id="H367F2B1B03E34838A7FB971AE5973CE5"><enum>(C)</enum><header>Period of import
			 relief</header><text>Any import relief provided under this section, including
			 any extensions thereof, may not, in the aggregate, be in effect for more than 4
			 years.</text>
								</subparagraph></paragraph></subsection><subsection id="H666C4B29C80542A0815C72943391084B"><enum>(e)</enum><header>Rate After
			 Termination of Import Relief</header><text>When import relief under this
			 section is terminated with respect to an article—</text>
							<paragraph id="H5DF73719087842DEA701E1321ECFBB89"><enum>(1)</enum><text>the rate of duty
			 on that article after such termination and on or before December 31 of the year
			 in which such termination occurs shall be the rate that, according to the
			 Schedule of the United States to Annex 2.3 of the Agreement, would have been in
			 effect 1 year after the provision of relief under subsection (a); and</text>
							</paragraph><paragraph id="H5A9230EC93FA452490F7D8AA93901297"><enum>(2)</enum><text>the rate of duty
			 for that article after December 31 of the year in which such termination occurs
			 shall be, at the discretion of the President, either—</text>
								<subparagraph id="H33FF7F0F2F7D484F81DDA971ECB1C861"><enum>(A)</enum><text>the applicable
			 rate of duty for that article set forth in the Schedule of the United States to
			 Annex 2.3 of the Agreement; or</text>
								</subparagraph><subparagraph id="HBCB99B84BCBC41A1949531B696140A98"><enum>(B)</enum><text>the rate of duty
			 resulting from the elimination of the tariff in equal annual stages ending on
			 the date set forth in the Schedule of the United States to Annex 2.3 of the
			 Agreement for the elimination of the tariff.</text>
								</subparagraph></paragraph></subsection><subsection id="H7F9BE722C1744711959B8B985AA7CA8D"><enum>(f)</enum><header>Articles Exempt
			 From Relief</header><text>No import relief may be provided under this section
			 on—</text>
							<paragraph id="H71EAC5915F494001B4E2BB803068305B"><enum>(1)</enum><text>any article that
			 is subject to import relief under—</text>
								<subparagraph id="HC574316FC3D34F4E8475EEB3F89C2BE7"><enum>(A)</enum><text>subtitle B;
			 or</text>
								</subparagraph><subparagraph id="H53F6F379040046C9A27594FBEBC7E0CE"><enum>(B)</enum><text>chapter 1 of title
			 II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19
			 U.S.C. 2251 et seq.); or</text>
								</subparagraph></paragraph><paragraph id="HD4DF48168C1D40869A7AE917995770E2"><enum>(2)</enum><text>any article on
			 which an additional duty assessed under section 722(b) is in effect.</text>
							</paragraph></subsection></section><section id="H51EBBA96E5384587A3EC6B8704537197"><enum>644.</enum><header>Termination of
			 relief authority</header>
						<subsection id="H78F89B8E3B1740F3A1CFD6971B012847"><enum>(a)</enum><header>General
			 Rule</header><text>Subject to subsection (b), no import relief may be provided
			 under this chapter after the date that is 10 years after the date on which the
			 Agreement enters into force.</text>
						</subsection><subsection id="H7F69264A6BD74F5E923898BC9A4FA6FD"><enum>(b)</enum><header>Exception</header><text>If
			 an article for which relief is provided under this chapter is an article for
			 which the period for tariff elimination, set forth in the Schedule of the
			 United States to Annex 2.3 of the Agreement, is greater than 10 years, no
			 relief under this subtitle may be provided for that article after the date on
			 which that period ends.</text>
						</subsection></section><section id="HCF996B6C7982468B945E937C67AC71FF"><enum>645.</enum><header>Compensation
			 authority</header><text display-inline="no-display-inline">For purposes of
			 section 123 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>
			 (19 U.S.C. 2133), any import relief provided by the President under section 643
			 shall be treated as action taken under chapter 1 of title II of such Act (19
			 U.S.C. 2251 et seq.).</text>
					</section><section id="HBB13B3539A7E492B9ECC892B9E091218"><enum>646.</enum><header>Confidential
			 business information</header><text display-inline="no-display-inline">Section
			 202(a)(8) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>
			 (19 U.S.C. 2252(a)(8)) is amended in the first sentence—</text>
						<paragraph id="HA0926878DD474546BCFB04D0343FE4D9"><enum>(1)</enum><text>by striking
			 <quote>and</quote>; and</text>
						</paragraph><paragraph id="H733D666D783F489C974CC1AABE2FA293"><enum>(2)</enum><text>by inserting
			 before the period at the end <quote>, and title III of the United
			 States-Colombia Trade Promotion Agreement Implementation Act</quote>.</text>
						</paragraph></section></chapter><chapter id="H2F1B68768F454E45AFA3E7E410E9EAF4"><enum>2</enum><header>Textile and
			 Apparel Safeguard Measures</header>
					<section id="HFBC6EEF18BEB436B9CC0EF75E9F32BF2"><enum>651.</enum><header>Commencement of
			 action for relief</header>
						<subsection id="HA34919D65DD74EF0833CFBCB031BBE31"><enum>(a)</enum><header>In
			 General</header><text>A request for action under this chapter for the purpose
			 of adjusting to the obligations of the United States under the Agreement may be
			 filed with the President by an interested party. Upon the filing of a request,
			 the President shall review the request to determine, from information presented
			 in the request, whether to commence consideration of the request.</text>
						</subsection><subsection id="H74B1D687E6A14A0C882AB0C5F12FCA41"><enum>(b)</enum><header>Publication of
			 Request</header><text>If the President determines that the request under
			 subsection (a) provides the information necessary for the request to be
			 considered, the President shall publish in the Federal Register a notice of
			 commencement of consideration of the request, and notice seeking public
			 comments regarding the request. The notice shall include a summary of the
			 request and the dates by which comments and rebuttals must be received.</text>
						</subsection></section><section id="H2018FF678C424705BD09C735D6854465"><enum>652.</enum><header>Determination
			 and provision of relief</header>
						<subsection id="HDA20AFBB9862480996C3B948BE71EC92"><enum>(a)</enum><header>Determination</header>
							<paragraph id="HF9F02D9C992445B69A484E5F62B40B46"><enum>(1)</enum><header>In
			 general</header><text>If a positive determination is made under section 651(b),
			 the President shall determine whether, as a result of the elimination of a duty
			 under the Agreement, a Colombian textile or apparel article is being imported
			 into the United States in such increased quantities, in absolute terms or
			 relative to the domestic market for that article, and under such conditions as
			 to cause serious damage, or actual threat thereof, to a domestic industry
			 producing an article that is like, or directly competitive with, the imported
			 article.</text>
							</paragraph><paragraph id="H52BC1A1B60564B9187B86E2B01A0BBAE"><enum>(2)</enum><header>Serious
			 damage</header><text>In making a determination under paragraph (1), the
			 President—</text>
								<subparagraph id="HAD94A460C0EF4766A759D5F34EBB47FE"><enum>(A)</enum><text>shall examine the
			 effect of increased imports on the domestic industry, as reflected in changes
			 in such relevant economic factors as output, productivity, utilization of
			 capacity, inventories, market share, exports, wages, employment, domestic
			 prices, profits and losses, and investment, no one of which is necessarily
			 decisive; and</text>
								</subparagraph><subparagraph id="H07CED243A334417A854BAFADD1B3CF81"><enum>(B)</enum><text>shall not consider
			 changes in consumer preference or changes in technology in the United States as
			 factors supporting a determination of serious damage or actual threat
			 thereof.</text>
								</subparagraph></paragraph></subsection><subsection id="H6E1CD6FC2B7949B48F3AFBF817070BCC"><enum>(b)</enum><header>Provision of
			 Relief</header>
							<paragraph id="H6386A78B216D4287B49176A9561F9BF6"><enum>(1)</enum><header>In
			 general</header><text>If a determination under subsection (a) is affirmative,
			 the President may provide relief from imports of the article that is the
			 subject of such determination, as provided in paragraph (2), to the extent that
			 the President determines necessary to remedy or prevent the serious damage and
			 to facilitate adjustment by the domestic industry.</text>
							</paragraph><paragraph id="H1106572CB1A94378B8FF70E642381932"><enum>(2)</enum><header>Nature of
			 relief</header><text>The relief that the President is authorized to provide
			 under this subsection with respect to imports of an article is an increase in
			 the rate of duty imposed on the article to a level that does not exceed the
			 lesser of—</text>
								<subparagraph id="H6794CDCF15914ADFAFF93C2D6B6F732D"><enum>(A)</enum><text>the column 1
			 general rate of duty imposed under the HTS on like articles at the time the
			 import relief is provided; or</text>
								</subparagraph><subparagraph id="H89CBB9CA4BBB4D45AA92C909852860D5"><enum>(B)</enum><text>the column 1
			 general rate of duty imposed under the HTS on like articles on the day before
			 the date on which the Agreement enters into force.</text>
								</subparagraph></paragraph></subsection></section><section id="HE06D4C1511704FF3B86F307A2C649F98"><enum>653.</enum><header>Period of
			 relief</header>
						<subsection id="H1D75B80F006F4F318A6D8E2BE0B501CA"><enum>(a)</enum><header>In
			 General</header><text>Subject to subsection (b), the import relief that the
			 President provides under section 652(b) may not be in effect for more than 2
			 years.</text>
						</subsection><subsection id="H02153A7F037D4744845562F6F315615A"><enum>(b)</enum><header>Extension</header>
							<paragraph id="H7B73133DC6F54EBB9F8BB952AD31457F"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the President may extend the
			 effective period of any import relief provided under this chapter for a period
			 of not more than 1 year, if the President determines that—</text>
								<subparagraph id="H7C951F77A0CB4AB38DA52507666D68C8"><enum>(A)</enum><text>the import relief
			 continues to be necessary to remedy or prevent serious damage and to facilitate
			 adjustment by the domestic industry to import competition; and</text>
								</subparagraph><subparagraph id="H3D06530064AA446F9E1D970307962B14"><enum>(B)</enum><text>there is evidence
			 that the industry is making a positive adjustment to import competition.</text>
								</subparagraph></paragraph><paragraph id="HA6274A4D175F4737ABC76D7C93B88015"><enum>(2)</enum><header>Limitation</header><text>Any
			 relief provided under this chapter, including any extensions thereof, may not,
			 in the aggregate, be in effect for more than 3 years.</text>
							</paragraph></subsection></section><section id="H61DDFE7802094144A4F3AF3CAF25468F"><enum>654.</enum><header>Articles exempt
			 from relief</header><text display-inline="no-display-inline">The President may
			 not provide import relief under this chapter with respect to an article
			 if—</text>
						<paragraph id="H6D426D2BFB5F4DA0BA625FF41ADC41AF"><enum>(1)</enum><text>import relief
			 previously has been provided under this chapter with respect to that article;
			 or</text>
						</paragraph><paragraph id="HC43243BB72F04F4393A792C40BF309F2"><enum>(2)</enum><text>the article is
			 subject to import relief under—</text>
							<subparagraph id="HE24BEB932E434D17B4D820C0B0016367"><enum>(A)</enum><text>chapter 1;
			 or</text>
							</subparagraph><subparagraph id="H56CCD0A622F545DA8C290EC63ED069C1"><enum>(B)</enum><text>chapter 1 of title
			 II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19
			 U.S.C. 2251 et seq.).</text>
							</subparagraph></paragraph></section><section id="HECB70D0BD7494CFFB2BCA57C6122095F"><enum>655.</enum><header>Rate after
			 termination of import relief</header><text display-inline="no-display-inline">On the date on which import relief under
			 this chapter is terminated with respect to an article, the rate of duty on that
			 article shall be the rate that would have been in effect, but for the provision
			 of such relief.</text>
					</section><section id="H5CC092A5E09E41208EB3A589B2C89A32"><enum>656.</enum><header>Termination of
			 relief authority</header><text display-inline="no-display-inline">No import
			 relief may be provided under this chapter with respect to any article after the
			 date that is 5 years after the date on which the Agreement enters into
			 force.</text>
					</section><section id="HB9E28326A2BD472EA9D6509A573687FA"><enum>657.</enum><header>Compensation
			 authority</header><text display-inline="no-display-inline">For purposes of
			 section 123 of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>
			 (19 U.S.C. 2133), any import relief provided by the President under this
			 chapter shall be treated as action taken under chapter 1 of title II of such
			 Act (19 U.S.C. 2251 et seq.).</text>
					</section><section id="HE1A8036B508848D7AA904ADE52C1FCDB"><enum>658.</enum><header>Confidential
			 business information</header><text display-inline="no-display-inline">The
			 President may not release information received in connection with an
			 investigation or determination under this chapter which the President considers
			 to be confidential business information unless the party submitting the
			 confidential business information had notice, at the time of submission, that
			 such information would be released by the President, or such party subsequently
			 consents to the release of the information. To the extent a party submits
			 confidential business information, the party shall also provide a
			 nonconfidential version of the information in which the confidential business
			 information is summarized or, if necessary, deleted.</text>
					</section></chapter><chapter id="H96DEE78678B544A2BD23E84A474B8650"><enum>3</enum><header>Cases Under Title
			 <enum-in-header>II</enum-in-header> of the <act-name parsable-cite="TA74">Trade
			 Act of 1974</act-name></header>
					<section id="HD4DA73A7970D4027924327CF54438D03"><enum>661.</enum><header>Findings and
			 action on goods of Colombia</header>
						<subsection id="HDC786041400E4E4A92CD08E9817C660C"><enum>(a)</enum><header>Effect of
			 Imports</header><text>If, in any investigation initiated under chapter 1 of
			 title II of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19
			 U.S.C. 2251 et seq.), the Commission makes an affirmative determination (or a
			 determination which the President may treat as an affirmative determination
			 under such chapter by reason of section 330(d) of the
			 <act-name parsable-cite="TA30">Tariff Act of 1930</act-name>), the Commission
			 shall also find (and report to the President at the time such injury
			 determination is submitted to the President) whether imports of the article of
			 Colombia that qualify as originating goods under section 623(b) are a
			 substantial cause of serious injury or threat thereof.</text>
						</subsection><subsection id="H8F4B4323B77F4C588A39E69A9C585A85"><enum>(b)</enum><header>Presidential
			 Determination Regarding Imports of Colombia</header><text>In determining the
			 nature and extent of action to be taken under chapter 1 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2251 et
			 seq.), the President may exclude from the action goods of Colombia with respect
			 to which the Commission has made a negative finding under subsection
			 (a).</text>
						</subsection></section></chapter></subtitle><subtitle id="H6A9527FEC48E41369365F5EF7C2F69FB"><enum>E</enum><header>Procurement</header>
				<section id="H31F4550A2ECA4A4A96E17D8E02A7EF76"><enum>671.</enum><header>Eligible
			 products</header><text display-inline="no-display-inline">Section 308(4)(A) of
			 the <act-name parsable-cite="TAA79">Trade Agreements Act of 1979</act-name> (19
			 U.S.C. 2518(4)(A)) is amended—</text>
					<paragraph id="HF35F0B56B02C4A8C832A2213764809B5"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of clause (vi);</text>
					</paragraph><paragraph id="HD68E7201DAF6400791598525C2425208"><enum>(2)</enum><text>by striking the
			 period at the end of clause (vii) and inserting <quote>; or</quote>; and</text>
					</paragraph><paragraph id="H86F85E0CF0554D06993FB45F8752984F"><enum>(3)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block id="H467F93260399443AAC1F1617FC625CCB" style="OLC">
							<clause id="H1052D367D9274E5EBF95B7DEF28BE782"><enum>(viii)</enum><text>a party to the
				United States-Colombia Trade Promotion Agreement, a product or service of that
				country or instrumentality which is covered under that agreement for
				procurement by the United
				States.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section></subtitle><subtitle id="HDBEDFD047E5045058689E9230D07DA83"><enum>F</enum><header>Offsets</header>
				<section id="HF0E51B0E5C1F48F5B8D009BB76844543"><enum>681.</enum><header>Customs user
			 fees</header>
					<subsection id="H7ECB6F0B16954D5DAD1FDB4974861A7A"><enum>(a)</enum><header>In
			 General</header><text>Section 13031(j)(3)(A) of the Consolidated Omnibus Budget
			 Reconciliation Act of 1985 (19 U.S.C. 58c(j)(3)(A)) shall be applied by
			 extending by 155 days the date in effect on the date of the enactment of this
			 Act after which fees may not be charged under paragraphs (9) and (10) of
			 subsection (a) of such section 13031.</text>
					</subsection><subsection id="H34681D00963347688E81C7C7F586AB80"><enum>(b)</enum><header>Other
			 Fees</header><text>Section 13031(j)(3)(B)(i) of the Consolidated Omnibus Budget
			 Reconciliation Act of 1985 (19 U.S.C. 58c(j)(3)(B)(i)) shall be applied by
			 extending by 155 days the date in effect on the date of the enactment of this
			 Act after which fees may not be charged under paragraphs (1) through (8) of
			 subsection (a) of such section 13031.</text>
					</subsection></section><section id="HAED517F986AF474DB92FA1CE5B60E9A4"><enum>682.</enum><header>Time for
			 payment of corporate estimated taxes</header>
					<subsection id="H9FF8FDC83D664C468962383C22D2905D"><enum>(a)</enum><header>Corporate
			 Estimated Tax Due in 2012</header><text>The percentage under subparagraph (B)
			 of section 401(1) of the Tax Increase Prevention and Reconciliation Act of 2005
			 (Public Law 109–222; 26 U.S.C. 6655 note) in effect on the date of the
			 enactment of this Act is increased by 1 percentage point.</text>
					</subsection><subsection id="HE18DBA7C47FE4E3CA394410F139C2E6F"><enum>(b)</enum><header>Corporate
			 Estimated Tax Due in 2013</header><text>The percentage under subparagraph (C)
			 of section 401(1) of the Tax Increase Prevention and Reconciliation Act of 2005
			 (Public Law 109–222; 26 U.S.C. 6655 note) in effect on the date of the
			 enactment of this Act is increased by 2 percentage points.</text>
					</subsection></section></subtitle></title><title id="HBFA4F0C17D814D60AAF61310A54E31B2"><enum>VII</enum><header>United
			 States-Panama Free Trade Agreement and United States-Korea Free Trade
			 Agreement</header>
			<section commented="no" id="HB336EDF81E7B47409A34B89EDF69326D"><enum>701.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the President should submit to Congress the United States-Panama
			 Free Trade Agreement and United States-Korea Free Trade Agreement and work to
			 ensure the approval and entry into force of such Agreements with respect to the
			 United States.</text>
			</section></title><title id="HA6FD9642599B4B2AA37E610E3D361823"><enum>VIII</enum><header>Repeal of
			 Patient Protection and Affordable Care Act</header>
			<section id="H24EDC9BDB8144EAF930F6AE365DBC5A3"><enum>801.</enum><header>Repeal</header><text display-inline="no-display-inline">Effective as of the enactment of the Patient
			 Protection and Affordable Care Act, such Act is repealed, and the provisions of
			 law amended or repealed by such Act are restored or revived as if such Act had
			 not been enacted.</text>
