		<section id="H6A3C63BB54B941EF85C2DFB2E09CBA55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe Schools Against Violence in
			 Education Act</short-title></quote> or the <quote><short-title>SAVE Act</short-title></quote>.</text>
		</section><section id="HB2A026249949414C9CA17E232999E593"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H1761F5FFA63048DE981CCAB4172ACD0A"><enum>(1)</enum><text>The Secretary of
			 Education reports that from 2003 to 2009 there have never been more than 47
			 schools in the entire Nation reported annually as persistently
			 dangerous.</text>
			</paragraph><paragraph id="H9F3B4C93B3724827B9F269F06ADABE9F"><enum>(2)</enum><text>The Office of the
			 New York State Comptroller’s May 2006 report found that at schools sampled for
			 this report more than 80 percent of the documented incidents were not reported
			 to the State, and in a number of instances the most serious types of incidents,
			 such as sexual offenses and incidents involving the use of a weapon, were
			 unreported.</text>
			</paragraph><paragraph id="HACEB09CF0E054DBB81EA6CD7A8B27E52"><enum>(3)</enum><text>In December 2009,
			 the National Center for Education Statistics and the Bureau of Justice
			 Statistics released a joint report that contains the most recent data, based on
			 self-reported information and surveys, available on crime and student safety,
			 titled <quote>Indicators of School Crime and Safety: 2009</quote> (the
			 <quote>Indicators</quote> report).</text>
			</paragraph><paragraph id="HF906C433C2294AD5AAECE2E366C3EA59"><enum>(4)</enum><text>According to the
			 <quote>Indicators</quote> report, in the 2007–2008 school year, there were an
			 estimated 55,700,000 students in pre-kindergarten through grade 12. The report
			 shows that among youth ages 5 to 18, there were 43 school-associated violent
			 deaths from July 1, 2007, through June 30, 2008. In 2007, among students ages
			 12 to 18, there were about 1.5 million victims of nonfatal crimes at school,
			 including 826,800 thefts and 684,100 violent crimes (simple assault and serious
			 violent crime).</text>
			</paragraph><paragraph id="HB2902E386A134942A022B19F4C0B3DC6"><enum>(5)</enum><text>In 2007, 10
			 percent of male students in grade 9 through grade 12 reported being threatened
			 or injured with a weapon on school property in the past year, compared to 5
			 percent of female students.</text>
			</paragraph><paragraph id="HFD7DBAF42BFA44EBAC49F1C1704166A6"><enum>(6)</enum><text>The
			 <quote>Indicators</quote> report states that in 2007, 5 percent of students
			 ages 12 to 18 reported that they had been afraid of attack at school.</text>
			</paragraph><paragraph id="HDACF96A2C8B1433288B29229C229A01E"><enum>(7)</enum><text>The
			 <quote>Indicators</quote> report states in 2007, 32 percent of students ages 12
			 to 18 reported having been bullied in schools during the school year.</text>
			</paragraph><paragraph id="HBF4AB817D692454D97067643D7D402AD"><enum>(8)</enum><text>The National
			 Incident-Based Reporting System (NIBRS) was developed by the Federal Bureau of
			 Investigation as part of the Uniform Crime Reporting (UCR) Program. NIBRS
			 currently collects data on all reported incidents of crime, including crime
			 occurring at school.</text>
			</paragraph><paragraph id="H3DF8D590098F48EA9E28DB9211D4C2C6"><enum>(9)</enum><text>Accurate data is
			 important to meet the educational goal of safe climate for academic
			 achievement. Accurate data enables administrators to assess the impact of
			 programs that have been implemented to promote school safety and to assess
			 whether additional efforts are needed.</text>
			</paragraph><paragraph id="H372B78A6EDA24784843A2FEC8C153742"><enum>(10)</enum><text>Students involved
			 in bullying are at a significant risk of experiencing a wide spectrum of
			 psychosomatic symptoms, running away from home, alcohol and drug abuse,
			 absenteeism and, above all, self-inflicted, accidental or perpetrated
			 injuries.</text>
			</paragraph><paragraph id="H1890BA81C4784F1183AAE72106EA579D"><enum>(11)</enum><text>Unlike
			 traditional forms of bullying, youth who are the targets of cyberbullying at
			 school are at greater risk for depression than are the youth who bully them,
			 according to a survey conducted by researchers at the National Institutes of
			 Health.</text>
			</paragraph></section><section id="H4AB62F45671942439C79DEADF62376F4"><enum>4.</enum><header>School safety
			 choice option</header>
			<subsection id="H0FCA9CCB3BB544B8A9FB1F81946C3E4C"><enum>(a)</enum><header>In
			 general</header><text>Section 9532 of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 7912) is amended to read as follows:</text>
				<quoted-block id="HEDE4B150585744CEAD116E4AC8963A47" style="OLC">
					<section id="H1116013C6FCE405F94416928E54E204A"><enum>9532.</enum><header>Safe school
				climate</header>
						<subsection id="H3A6F2FEA321945E0A5799D66C7F6880D"><enum>(a)</enum><header>State policies
				and Report</header>
							<paragraph id="HE8C45D0C692249938351D7F34B23E061"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving funds under part A of title
				I, a State shall—</text>
								<subparagraph id="H493CE5BD05494A17B9D5832DD5F8195B"><enum>(A)</enum><text>establish and
				implement—</text>
									<clause id="H9C8D1F77B546409CA96BBE0A57563E55"><enum>(i)</enum><text>a
				statewide policy requiring that—</text>
										<subclause id="HA113EEB6FFEB41A3B45385A2D16B33E6"><enum>(I)</enum><text>a student
				described in
				<internal-xref idref="H938F6EB06C874CACB747D989C8364CF3" legis-path="9532.(a)(2)">paragraph (2)</internal-xref> be allowed to attend a
				public elementary school or secondary school (including a public charter
				school) within a local educational agency under the jurisdiction of the State
				that has a safe climate for academic achievement; and</text>
										</subclause><subclause id="HC045F26069164AC596A2532A0C5860E4"><enum>(II)</enum><text display-inline="yes-display-inline">determinations with respect to which public
				elementary schools and secondary schools in the State do not have a safe
				climate for academic achievement are made in accordance with
				<internal-xref idref="H785550A8220B446D86FB2AD1D2DF5B49" legis-path="9532.(b)">subsection (b)</internal-xref>; and</text>
										</subclause></clause><clause id="HC9E2D99320784CEFADE5963D3EB05A51"><enum>(ii)</enum><text>a
				statewide policy with respect to offenders described in
				<internal-xref idref="H7390BEBC675A425588C2DAE4BD2177E9" legis-path="9532.(a)(3)">paragraph (3)</internal-xref>; and</text>
									</clause></subparagraph><subparagraph id="HD7D2D129DC03420B805A4AA8BD7655FF"><enum>(B)</enum><text>report to the
				Secretary, on an annual basis—</text>
									<clause id="H066B82072DE044EF85E77143597D0748"><enum>(i)</enum><text>the number of
				schools determined by the State to not have a safe climate for academic
				achievement;</text>
									</clause><clause id="HCE666C9B01E842ED96A0DB19B8872B3C"><enum>(ii)</enum><text>the number of
				students who have transferred from such schools; and</text>
									</clause><clause id="H3FB4EEFC447344AC946E2B1725903063"><enum>(iii)</enum><text>the number of
				offenders who have been removed from school pursuant to this section.</text>
									</clause></subparagraph></paragraph><paragraph id="H938F6EB06C874CACB747D989C8364CF3"><enum>(2)</enum><header>Description of
				student</header><text>A student described in this paragraph is a
				student—</text>
								<subparagraph id="H79C873D41A484F7B8C94CD0C760B619E"><enum>(A)</enum><text>who is attending a
				public elementary school or secondary school that does not have a safe climate
				for academic achievement, as determined by the State in accordance with
				<internal-xref idref="H785550A8220B446D86FB2AD1D2DF5B49" legis-path="9532.(b)">subsection (b)</internal-xref>; or</text>
								</subparagraph><subparagraph id="H974ECA33C3F547BE83E7D6CBAC068F25"><enum>(B)</enum><text>who becomes a
				victim of a violent criminal offense, as determined by State law—</text>
									<clause id="H15AE325BF0B149EFA3F371E205B9DD1C"><enum>(i)</enum><text>while in or on the
				grounds of a public elementary school or secondary school that the student
				attends;</text>
									</clause><clause id="H86F555FF01D443BC8E3336F1F995F467"><enum>(ii)</enum><text>at a school event
				or activity under the control and supervision of such school; or</text>
									</clause><clause id="H463BD656BC024EFDB8ACA3ED667BA7FE"><enum>(iii)</enum><text>on a school bus
				under the control and supervision of such school.</text>
									</clause></subparagraph></paragraph><paragraph id="H7390BEBC675A425588C2DAE4BD2177E9"><enum>(3)</enum><header>Policies with
				respect to offenders</header><text display-inline="yes-display-inline">A State
				policy with respect to offenders shall—</text>
								<subparagraph id="H3FCF6A47C6E84B79896C6DBAB1B1F36B"><enum>(A)</enum><text>permit a public
				elementary or secondary school in which a violent criminal offense described in
				<internal-xref idref="H974ECA33C3F547BE83E7D6CBAC068F25" legis-path="9532.(a)(2)(B)">paragraph (2)(B) </internal-xref>occurs or, in a
				case in which such offense did not occur in or on school grounds, a public
				elementary school or secondary school that had control and supervision over the
				event or activity or on the school bus where such offense occurred, to provide
				appropriate counseling and educational services to the offender of the offense
				in an alternative setting if removal of the offender from the school is
				determined to be appropriate by the school; and</text>
								</subparagraph><subparagraph id="HA0477183C0504EC09E74A7C795AA5B3D"><enum>(B)</enum><text>require that a
				school described in
				<internal-xref idref="H3FCF6A47C6E84B79896C6DBAB1B1F36B" legis-path="9532.(a)(3)(A)">subparagraph (A)</internal-xref> that knows that an
				offender of a violent criminal offense described in
				<internal-xref idref="H974ECA33C3F547BE83E7D6CBAC068F25" legis-path="9532.(a)(2)(B)">paragraph (2)(B)</internal-xref> is returning to
				the school notify, as soon as practicable prior to the offender’s return to the
				school, the parents of each victim of the offense committed by the offender
				that the offender is returning to the school.</text>
								</subparagraph></paragraph></subsection><subsection id="H785550A8220B446D86FB2AD1D2DF5B49"><enum>(b)</enum><header>Determinations
				of safe climate</header>
							<paragraph display-inline="no-display-inline" id="H88A4F382436F449090DD6EBB1712CDF6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A State policy with
				respect to determining which public elementary schools and secondary schools in
				the State do not have a safe climate for academic achievement shall require
				that—</text>
								<subparagraph id="H299107DB40AC45E0BE21D8C26583097C"><enum>(A)</enum><text>a State make such
				determinations—</text>
									<clause id="H47215201708A47BF85BE39CC025BF2CC"><enum>(i)</enum><text>by
				consulting with—</text>
										<subclause id="H3F251AB5210144D9ACFB5E506D2289AB"><enum>(I)</enum><text>a representative
				sample of local educational agencies, parent groups, and local law enforcement
				agencies; or</text>
										</subclause><subclause id="H09150188AAD44E9AA6164101D15BD40E"><enum>(II)</enum><text>other experts in
				the area of school safety;</text>
										</subclause></clause><clause id="H0313E0D1438E424A8ADF3880EC5D85A1"><enum>(ii)</enum><text>based, at a
				minimum, on school crime statistics and data—</text>
										<subclause id="H241C627FDE444323B390300A7BB1B041"><enum>(I)</enum><text>collected by the
				State pursuant to section 4141 and under
				<internal-xref idref="H936FC20A631142E3902D193C42044B9D" legis-path="9532.(c)">subsection (c)</internal-xref> of this section;
				and</text>
										</subclause><subclause id="H3C8D5E7AA5DD4E49BFADF0EA2F835325"><enum>(II)</enum><text>made available by
				the Federal Bureau of Investigation pursuant to
				<internal-xref idref="HD5F7F13B1D0D4CF1A47F916FBEC283A0" legis-path="9532.(d)">subsection (d)</internal-xref>; and</text>
										</subclause></clause><clause id="HC522827FC8384374A646AE4A73B9D918"><enum>(iii)</enum><text display-inline="yes-display-inline">in time to permit a local educational
				agency to allow a student enrolled in a school that does not have a safe
				climate for academic achievement to instead enroll, at least 45 days before the
				start of the school year, at a school with a safe climate for academic
				achievement;</text>
									</clause></subparagraph><subparagraph id="H668227B08CC04D0D921BE551344C4138"><enum>(B)</enum><text>after making
				determinations in accordance with
				<internal-xref idref="HE13DC8FAADE04BC5943793FEB3186A14" legis-path="9532.(c)(1)">subparagraph (A)</internal-xref>, the State
				shall—</text>
									<clause id="H73D01BD1B132466C9A3000E1515B41FE"><enum>(i)</enum><text>notify each local educational agency in the State serving schools that are
				determined to not have a safe climate for academic achievement of such schools;
				and</text>
									</clause><clause id="H95039530D346472D9137AF20F050EA44"><enum>(ii)</enum><text>require that
				within a week of receiving notice under
				<internal-xref idref="H73D01BD1B132466C9A3000E1515B41FE" legis-path="9532.(b)(1)(B)(i)">clause (i)</internal-xref>, a local educational
				agency shall provide to the parent of each student enrolled in each such
				school, a notice of the determination with respect to the school that meets the
				requirements of
				<internal-xref idref="H4DB0883097B64081873B21032BBE00AB" legis-path="9532.(b)(2)">paragraph (2)</internal-xref>; and</text>
									</clause></subparagraph><subparagraph id="H35E97B24B3234B5A9DA8297B7AC7956F"><enum>(C)</enum><text>a school
				determined under this paragraph to not have a safe climate for academic
				achievement develop, in consultation with parents, students, school employees,
				local law enforcement, representatives of local public health and mental health
				agencies, and experts in school safety, an intervention plan to create a safer
				school environment that is based on an analysis of the data and school crime
				statistics with respect to such school—</text>
									<clause id="HBC108006CD88455DA57EF496191458A4"><enum>(i)</enum><text>collected by the
				State under section 4141 and subsection (c) of this section; and</text>
									</clause><clause id="H9BECA9B073954F1D85E0149BDDB454D3"><enum>(ii)</enum><text>made available by
				the Federal Bureau of Investigation pursuant to
				<internal-xref idref="HD5F7F13B1D0D4CF1A47F916FBEC283A0" legis-path="9532.(d)">subsection (d)</internal-xref>.</text>
									</clause></subparagraph></paragraph><paragraph id="H4DB0883097B64081873B21032BBE00AB"><enum>(2)</enum><header>Form of
				notice</header><text display-inline="yes-display-inline">A notice to a parent
				under
				<internal-xref idref="H95039530D346472D9137AF20F050EA44" legis-path="9532.(b)(1)(B)(ii)">paragraph (1)(B)(ii)</internal-xref>
				shall—</text>
								<subparagraph id="H08A00B45209947EFB704B6466A7AE506"><enum>(A)</enum><text>describe the
				determination with respect to the school in which the child of the parent is
				enrolled and explain that, by reason of the determination and pursuant to
				<internal-xref idref="H3A6F2FEA321945E0A5799D66C7F6880D" legis-path="9532.(a)">subsection (a)(1)(A)(i)</internal-xref>, the child may
				attend a school that has a safe climate for academic achievement within the
				local educational agency; and</text>
								</subparagraph><subparagraph id="H5860919472F540F09107D5B718D8E3EA"><enum>(B)</enum><text>be written in an
				understandable and uniform format and, to the extent practicable, in a language
				that the parent can understand.</text>
								</subparagraph></paragraph></subsection><subsection id="H936FC20A631142E3902D193C42044B9D"><enum>(c)</enum><header>Collection of
				relevant information and school crime statistics</header>
							<paragraph id="HE13DC8FAADE04BC5943793FEB3186A14"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">As a condition of
				receiving funds under part A of title I, a State shall—</text>
								<subparagraph id="H992F66E9014247F98F86F0582FEA31D1"><enum>(A)</enum><text>collect the data
				described in
				<internal-xref idref="H046D6C89EB49441293FEAB07C1F8DF89" legis-path="9532.(c)(2)">paragraph (2)</internal-xref> for use in
				determinations of whether a school has a safe climate for academic achievement
				for purposes of
				<internal-xref idref="HE8C45D0C692249938351D7F34B23E061" legis-path="9532.(a)(1)">subsection (a)(1)(A)(i)</internal-xref>; and</text>
								</subparagraph><subparagraph id="H02643A5DA54543BB8280906C6653924B"><enum>(B)</enum><text>not later than 1
				year after the first time information is collected under subparagraph (A) and
				annually thereafter—</text>
									<clause id="HC2687B3A33804877B6E6E4FCC3BE40EB"><enum>(i)</enum><text>prepare, publish,
				and distribute, in a timely manner and through appropriate publications,
				mailings, or the Internet, to all students enrolled in a public elementary
				school or secondary school in the State, the families of such students, and
				school staff, an annual report containing, at a minimum, the school crime
				statistics collected under
				<internal-xref idref="H3D8DD283EA734342A260D16BFD426447" legis-path="9532.(c)(2)(G)">paragraph (2)(G)</internal-xref>; and</text>
									</clause><clause id="H5407ADD25E6B48448278BDCF5E22A905"><enum>(ii)</enum><text>submit to the
				Secretary such statistics.</text>
									</clause></subparagraph></paragraph><paragraph id="H046D6C89EB49441293FEAB07C1F8DF89"><enum>(2)</enum><header>Description of
				data</header><text>The data described in this paragraph
				include—<italic></italic></text>
								<subparagraph id="HD45989C193FB498FA80282A3D9D36079"><enum>(A)</enum><text>truancy rates with
				respect to each public elementary school and secondary school in the
				State;</text>
								</subparagraph><subparagraph id="H262457DF85C045828BD70557C9DCE273"><enum>(B)</enum><text>the frequency,
				seriousness, and incidence of bullying, cyberbullying, violence, and
				drug-related offenses, at—</text>
									<clause id="H79BFFD24A16D4761A11ED476B378AD39"><enum>(i)</enum><text>any event or
				activity under the control and supervision of an public elementary school or
				secondary school in the State; or</text>
									</clause><clause id="H7927EB3464B54E50B21C0465A5B9B156"><enum>(ii)</enum><text>on school buses
				under the control and supervision of any such school or the State;</text>
									</clause></subparagraph><subparagraph id="H9AB4AB12618E4B6FA6476EA6214B5CFE"><enum>(C)</enum><text>suspension rates
				for 1 day or more, including in-school suspensions, and expulsion rates,
				desegregated by the categories described in section 1111(b)(3)(C)(viii), with
				respect to each elementary school and secondary school in the State;</text>
								</subparagraph><subparagraph commented="no" id="HE2D1B5AFF3004778B7EB3D0A5B00F50B"><enum>(D)</enum><text>the types of
				violence prevention curricula, programs, and services provided by the chief
				executive officer, the State educational agency, and local educational
				agencies, in the State;</text>
								</subparagraph><subparagraph id="H46BABF3BF22F40C28630F07C244110D1"><enum>(E)</enum><text>the incidence and
				prevalence, age of onset, perception of health risk, and perception of social
				disapproval of drug use and violence by youth in each public elementary school
				and secondary school in the State and community served by each such
				school;</text>
								</subparagraph><subparagraph id="H91764E4F54364C7EA6CE753B0B566AD4"><enum>(F)</enum><text display-inline="yes-display-inline">the existence and implementation of
				emergency preparedness plans in each elementary school and secondary school in
				the State; and</text>
								</subparagraph><subparagraph id="H3D8DD283EA734342A260D16BFD426447"><enum>(G)</enum><text display-inline="yes-display-inline">the school crime statistics described in
				<internal-xref idref="HE30A16C8A6654FCFAD85356EAC36148C" legis-path="9532.(c)(3)">paragraph (3)</internal-xref> with respect to each
				public elementary school and secondary school in the State.</text>
								</subparagraph></paragraph><paragraph id="HE30A16C8A6654FCFAD85356EAC36148C"><enum>(3)</enum><header>School crime
				statistics</header><text>The school crime statistics described in this
				paragraph include statistics concerning the occurrence of any criminal offenses
				reported to local police agencies that have occurred at a school, on school
				grounds, or at school-sponsored activities during the most recent calendar year
				and the 2 preceding calendar years, including—</text>
								<subparagraph commented="no" id="H95FC8646E1D042E2A72397804F03EB3B"><enum>(A)</enum><text>murder;</text>
								</subparagraph><subparagraph commented="no" id="H0259BD610CB84EB98F6BF4A5DBEFD80F"><enum>(B)</enum><text>sex offenses,
				forcible or nonforcible;</text>
								</subparagraph><subparagraph commented="no" id="HF00ED4AE15224E75B70C1EB7EC8E3377"><enum>(C)</enum><text>robbery;</text>
								</subparagraph><subparagraph commented="no" id="HF9C514851AE242B1BC4C4ED91045E926"><enum>(D)</enum><text>aggravated
				assault;</text>
								</subparagraph><subparagraph commented="no" id="HF8C96B0678BC4775B4394D5AF9EF7292"><enum>(E)</enum><text>burglary;</text>
								</subparagraph><subparagraph commented="no" id="H2854ECBCA8514B7396B3978D414A6290"><enum>(F)</enum><text>manslaughter;</text>
								</subparagraph><subparagraph commented="no" id="H87064512DFE344DD9291215E849645C0"><enum>(G)</enum><text>arson; and</text>
								</subparagraph><subparagraph commented="no" id="HBF596CB480F941B8998B4B02ACC45484"><enum>(H)</enum><text>crimes for which a
				person has been arrested or referred for disciplinary action, including for
				liquor law violations, drug-related violations, or weapons possession.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H615D84C37F424E8B9AAA194F310DC2A6"><enum>(4)</enum><header>Data collection
				requirements</header><text>Data collected by a State under
				<internal-xref idref="H88A4F382436F449090DD6EBB1712CDF6" legis-path="9532.(b)(1)">paragraph (1)</internal-xref> shall be based on
				information that—</text>
								<subparagraph commented="no" id="HB29EE4420E7A4FD5829034613DA2BA0B"><enum>(A)</enum><text>is verifiable and
				reported—</text>
									<clause id="HEDA46A595A67488D8367066E18324074"><enum>(i)</enum><text>in
				a consistent and uniform manner; and</text>
									</clause><clause id="H0C720A604B334CE893D0E61D8D6C2CBE"><enum>(ii)</enum><text>in a manner
				consistent with the guidance provided under
				<internal-xref idref="H390594CB287143DFA34F97404EF3F8B2" legis-path="9532.(g)">subsection (g)</internal-xref>; and</text>
									</clause></subparagraph><subparagraph commented="no" id="H288AA9556B6C4C6C987BFB5B133D2330"><enum>(B)</enum><text>allows for
				State-by-State comparison and the evaluation described in

								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H7146CF65A8154ADDB0BC0C930F4BC383"><enum>(5)</enum><header>Secretarial
				Duties</header><text>The Secretary shall—</text>
								<subparagraph id="HD91076F3F1AA48C08256B071BA147B15"><enum>(A)</enum><text>review the school
				crime statistics submitted under
				<internal-xref idref="H08A00B45209947EFB704B6466A7AE506" legis-path="9532.(b)(2)(A)(ii)(II)">paragraph
				(1)(B)(ii)</internal-xref>;</text>
								</subparagraph><subparagraph id="H4874D52346B6455AAD6339FC3698B588"><enum>(B)</enum><text>report to Congress
				on the school crime statistics; and</text>
								</subparagraph><subparagraph id="HB45E415CC8E3435B9A9A3FFFE85646BB"><enum>(C)</enum><text>make such
				information publicly available.</text>
								</subparagraph></paragraph><paragraph id="HA9CD145499C5471E9EBFBE65D08FBA4E"><enum>(6)</enum><header>Identification
				of individuals</header><text>The school crime statistics collected and
				published under
				<internal-xref idref="HE13DC8FAADE04BC5943793FEB3186A14" legis-path="9532.(c)(1)">paragraph (1)</internal-xref> may not identify victims
				of crimes or persons accused of crimes.</text>
							</paragraph><paragraph id="HC816DB69871342E5A567C6C1E85B1C45"><enum>(7)</enum><header>Inadmissibility
				of Evidence</header><text>Notwithstanding any other provision of law, evidence
				regarding compliance or noncompliance with this subsection shall not be
				admissible as evidence in any proceeding of any court, agency, board, or other
				entity, except with respect to an action to enforce this subsection.</text>
							</paragraph></subsection><subsection id="HD5F7F13B1D0D4CF1A47F916FBEC283A0"><enum>(d)</enum><header>FBI
				information</header>
							<paragraph id="HE07659B105434BA1930752F53B9C27E5"><enum>(1)</enum><header>Report on
				indicators of school crime and safety</header><text>The Secretary shall request
				the Director of the Federal Bureau of Investigation to make available for
				inclusion in the annual report on Indicators of School Crime and Safety,
				produced jointly by the National Center for Education Statistics and the Bureau
				of Justice Statistics of the Department of Justice, any data or other
				information the Federal Bureau of Investigation has available through the
				Uniform Crime Reporting System or National Incident-Based Reporting System on
				the occurrence and incidence of school-related crime in elementary schools and
				secondary schools.</text>
							</paragraph><paragraph id="HD69DD67F62F1476CBE7EEBE771B1E4AA"><enum>(2)</enum><header>Availability to
				States</header><text>The Secretary shall make available any data or other
				information it receives from the Federal Bureau of Investigation under
				<internal-xref idref="HE07659B105434BA1930752F53B9C27E5" legis-path="9532.(d)(1)">paragraph (1)</internal-xref> to the States for
				consideration when determining which schools do not have a safe climate for
				academic achievement for purposes of subsection (a).</text>
							</paragraph></subsection><subsection id="HB9468E34E65E472E9436E6EAA9241F0E"><enum>(e)</enum><header>Evaluations by
				states</header><text>As a condition of receiving funds under part A of title I,
				each State shall, on an ongoing basis, using verifiable documentation, monitor
				and evaluate the extent to which local educational agencies are in compliance
				with this section.</text>
						</subsection><subsection commented="no" id="HBDBDC123A09A4167A30F42D14E418EDA"><enum>(f)</enum><header>Certification</header><text>As
				a condition of receiving funds under part A of title I, a State shall certify
				in writing to the Secretary that the data and crime statistics used are
				verifiable and that the State is in compliance with this section.</text>
						</subsection><subsection id="H390594CB287143DFA34F97404EF3F8B2"><enum>(g)</enum><header>Best
				practices</header><text>The Secretary shall provide to States guidance on best
				practices for implementing and monitoring the policies required by this
				section.</text>
						</subsection><subsection id="HB78E8D2068D54745898BAFD6F815A116"><enum>(h)</enum><header>Handbook for
				school crime, offense, and incident reporting</header>
							<paragraph id="H00905879A4B84F38A3D777BB5C30B7FB"><enum>(1)</enum><header>In
				general</header><text>Not later than 6 months after the date of enactment of
				the SAVE Act, the Secretary shall publish a handbook for school crime, offense,
				and incident reporting, modeled after the Handbook for Campus Crime Reporting
				published by the Office of Postsecondary Education of the Department of
				Education, to—</text>
								<subparagraph id="HCCB68008EE80448B8058F8470C7357CD"><enum>(A)</enum><text>provide clear
				guidance to States and local educational agencies on specifically which crimes,
				offenses, and incidents must be reported to meet the reporting and crime
				disclosure requirements of this section;</text>
								</subparagraph><subparagraph id="H069069C69DE448B8A0218B95F640ECA6"><enum>(B)</enum><text>provide assistance
				to States and local educational agencies and explanations in a step-by-step and
				readable manner with respect to the reporting requirements;</text>
								</subparagraph><subparagraph id="H1AFC8BA79EB64ED0970206A119E17815"><enum>(C)</enum><text>provide contact
				information at the Department of Education if further assistance is necessary;
				and</text>
								</subparagraph><subparagraph id="H550AD1D96E8845A2897B3E44A38E28ED"><enum>(D)</enum><text>recommendations of
				the Secretary on using consistent national definitions for the crimes,
				offenses, and incidents which are required to be reported pursuant to this
				section.</text>
								</subparagraph></paragraph></subsection><subsection id="H44324F9C147F41C582C0937CBCAB7645"><enum>(i)</enum><header>Periodic
				evaluation</header><text>The Inspector General of the Department of Education
				shall conduct an independent annual evaluation of the extent to which States
				are in compliance with this section. Each annual evaluation shall cover a
				sample of States selected on a rotating basis.</text>
						</subsection><subsection id="HC38E97CDE6B5474997F87F4C15536F81"><enum>(j)</enum><header>Rules of
				construction</header><text>Nothing in this section shall be construed
				to—</text>
							<paragraph id="HAFEDD20604964CCBABC7822F5C510D75"><enum>(1)</enum><text>authorize the
				Secretary to require particular policies, procedures, or practices by schools
				and local educational agencies with respect to crimes committed at school, on
				school grounds, or at school-sponsored activities;</text>
							</paragraph><paragraph id="HE257B5A839B24634A32234D0B5CBF1A2"><enum>(2)</enum><text>confer a private
				right of action upon any person to enforce this section;</text>
							</paragraph><paragraph id="H30A44F4BF7034FCFBA302659FBF156FA"><enum>(3)</enum><text>require the
				reporting or disclosure of privileged information;</text>
							</paragraph><paragraph id="HEEC3DA074B724D76BFB70AA5A41A8B9E"><enum>(4)</enum><text>create a cause of
				action against any school or any employee of a school for any civil liability
				or establish any standard of care; or</text>
							</paragraph><paragraph id="HDBD22E61A649427F85C81C3AC51C599A"><enum>(5)</enum><text>permit a school,
				or an officer, employee, or agent of a school, participating in any program
				under this Act to retaliate, intimidate, threaten, coerce, or otherwise
				discriminate against any individual with respect to the implementation of any
				provision of this section.</text>
							</paragraph></subsection><subsection id="H372943D0E747422DA5CA5B0332E3C12F"><enum>(k)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H308FBB23297F4B89B279C5E685AE8ACF"><enum>(1)</enum><header>Bullying</header><text display-inline="yes-display-inline">The term <term>bullying</term> means
				conduct that—</text>
								<subparagraph id="HB1D12C2A2D404BB99A65D00628843415"><enum>(A)</enum><text>adversely affects
				the ability of one or more students to participate in or benefit from a
				school’s educational programs or activities by placing the student (or
				students) in reasonable fear of physical harm; and</text>
								</subparagraph><subparagraph id="H54C164C19B5549608B32B5549DDC9F9D"><enum>(B)</enum><text>includes conduct
				that is based on—</text>
									<clause id="H71E7AECAC4C7491CB02885DEF6BB3DED"><enum>(i)</enum><text>a
				student’s actual or perceived—</text>
										<subclause id="HEE12CECA649643BE88B0BAA4588A3C09"><enum>(I)</enum><text>race;</text>
										</subclause><subclause id="H35C2F6BC9E16464C929FCE00A33CCDEF"><enum>(II)</enum><text>color;</text>
										</subclause><subclause id="H7CA2DD0FB3344B4182DF399E2C639C10"><enum>(III)</enum><text>national
				origin;</text>
										</subclause><subclause id="HEC94A838385546FFBDA15700C2902A67"><enum>(IV)</enum><text>sex;</text>
										</subclause><subclause id="H6BEE924C65524F46B725769CCFA47900"><enum>(V)</enum><text>disability;</text>
										</subclause><subclause id="H57447C97C08B4C2EA99BE5FDF3CCE616"><enum>(VI)</enum><text>sexual
				orientation;</text>
										</subclause><subclause id="HE932B1348BB34265B7897A48109F84F9"><enum>(VII)</enum><text>gender identity;
				or</text>
										</subclause><subclause id="H68980353CAD84BAD9187561D7EEB5A0D"><enum>(VIII)</enum><text>religion;</text>
										</subclause></clause><clause id="HD98395EB575644FB9EB22659E34B1B2B"><enum>(ii)</enum><text>any other
				distinguishing characteristics that may be defined by a State or local
				educational agency; or</text>
									</clause><clause id="H6D3C8AB7180E485CB4279023789069F1"><enum>(iii)</enum><text>association with
				a person or group with one or more of the actual or perceived characteristics
				listed in clause (i) or (ii).</text>
									</clause></subparagraph></paragraph><paragraph id="H593443790A82493C868B769B138F8DCA"><enum>(2)</enum><header>Cyberbullying</header><text>The
				term <term>cyberbulling</term> means using the Internet, a cell phone (such as
				by text messaging), a video game system, or other technology to send or post
				text or images intended to hurt or embarrass another
				individual.</text>
							</paragraph></subsection></section><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</subsection><subsection id="H55EF26A348254659A922F8BE1E831066"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents at the beginning of such Act is
			 amended by striking the item relating to section 9532 and inserting the
			 following:</text>

			 amended—</text>
			<paragraph id="H756E0432F78248DBBA2303CC20093621"><enum>(1)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="H455715F56A6C41948A27E3C9DAD7E424"><enum>(A)</enum><text>in paragraph (1)
			 by striking <quote>; and</quote> at the end;</text>
				</subparagraph><subparagraph id="HF9A3A3F5AFA3487F9AC849D21EDB120F"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
					<clause id="H1B29E31B07324C449714F85897FA1433"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by inserting <quote>or any modifications
			 allowed under subsection (b) that result in removals or long-term suspensions

				school served by such local education agency, an event or activity under the
				control and supervision of the school or local educational agency, or on a
				school bus under the control and supervision of the school or local educational
				agency, including—</text>
							<subparagraph id="H17979F88C7694121B671B6CEF14E9CC3"><enum>(A)</enum><text>the name of the
				school concerned;</text>
							</subparagraph><subparagraph id="H6C8191AA31E4463CBA5D1B5ABD46E29B"><enum>(B)</enum><text>the number of
				persons, including students and non-students, involved; and</text>
							</subparagraph><subparagraph id="HE3E58C1A26D546CEB62183F25EB42AF8"><enum>(C)</enum><text>the type of
				firearms concerned; and</text>
							</subparagraph></paragraph><paragraph id="HF8799FB2CEAE4E0D8F8EE3413280F1D5"><enum>(4)</enum><text>a certification
				that the information in the application is accurate and
				complete.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HAD1AD2AAAE244F7AAACA947BC16866FD"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H67C39499F8684840A258401396CB2AB0" style="OLC">
					<subsection id="H230DF083043F495FB35EA93A9F19AEF2"><enum>(i)</enum><header>Evaluations by
				states</header><text>Each State receiving Federal funds under any title of this
				Act shall, on an ongoing basis, evaluate the extent to which local educational
				agencies are in compliance with this section. The evaluation shall include an
				assessment of the accuracy of the information provided under subsection (d). A
				local educational agency that intentionally fails to report complete and
				accurate information under subsection (d) shall be determined to be
				noncompliant with this section and shall not, during any period of
				noncompliance, receive any funds made available to the State under any title of
				this Act.</text>
					</subsection><subsection id="HF9AD4A728D794F1788A476045E0B5D79"><enum>(j)</enum><header>Periodic
				evaluation</header><text>The Inspector General of the Department of Education
				shall conduct an independent annual evaluation of the extent to which States
				are in compliance with this section. Each annual evaluation shall cover a
				sample of States selected on a rotating
				basis.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0E62FC8104F1449CADE1D92B40C3E483"><enum>6.</enum><header>National
			 programs</header>
			<subsection id="HA043516ABA144F98BAA69E47B4F55A2E"><enum>(a)</enum><header>School climate
			 survey</header><text display-inline="yes-display-inline">Section 4121(a) of the
			 Elementary and Secondary Education Act of 1965 (42 U.S.C. 7131) is
			 amended—</text>
				<paragraph id="H31BB62D247134A61AB3E86902B8B5639"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1)—</text>
					<subparagraph id="H2C5F65B53F9C4B8296C1C9271C703B20"><enum>(A)</enum><text>by inserting
			 <quote>bullying and cyberbullying and</quote> after <quote>prevent</quote>; and</text>
					</subparagraph><subparagraph id="H702CF51CA36B4195BF3C4643FBB66F80"><enum>(B)</enum><text>by inserting
			 <quote>, including emergency preparedness,</quote> after
			 <quote>safety</quote>;</text>
					</subparagraph></paragraph><paragraph id="HB236E46DFB9545138561D660EDF5BA3C"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H1FCF47D1C3D34E4B8D550766427EDBCF"><enum>(A)</enum><text>by inserting
			 <quote>students, </quote> after <quote>parents,</quote>; and</text>
					</subparagraph><subparagraph id="H19F92782905E4518B8E1C0B4B8C4C7CC"><enum>(B)</enum><text>by inserting
			 <quote>, bullying and cyberbullying prevention, and emergency
			 preparedness</quote> after <quote>violence prevention</quote>;</text>
					</subparagraph></paragraph><paragraph id="H30CCC68CE8284342B01173E042CCFD97"><enum>(3)</enum><text>in paragraph (8)
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H5E08451DB4C240B69EC99E26D66A1B3F"><enum>(4)</enum><text>by redesignating
			 paragraph (9) as paragraph (10); and</text>
				</paragraph><paragraph id="HCA1BE57C5FB149D3B68BE5098C6C9514"><enum>(5)</enum><text>by inserting after
			 paragraph (8) the following:</text>
					<quoted-block id="HEC2572E890484C16B37D1C11418D90C6" style="OLC">
						<paragraph id="H9A9051D729574E8A886717BA67DB8883"><enum>(9)</enum><text>the administration
				of a schoolwide climate survey of students, parents, and school personnel
				that—</text>
							<subparagraph id="H78D6A16BC23847B9AA6CB33155B1F72F"><enum>(A)</enum><text>should be used as
				a pre- or post- intervention measure to—</text>
								<clause id="HE2B087EABEF84B73B4A3E512F8DDBE93"><enum>(i)</enum><text>promote student
				participation and the recognition of the student voice;</text>
								</clause><clause id="HAA40CC5941A243E795D89C88C4DB2329"><enum>(ii)</enum><text>build authentic
				school-home-community partnerships;</text>
								</clause><clause id="HBB896EA0851747EE90FAFA5009CF56A2"><enum>(iii)</enum><text>promote an
				authentic learning community;</text>
								</clause><clause id="H386DDA6E169E42A79D2B56D06CABCEA3"><enum>(iv)</enum><text>prevent bullying
				and cyberbullying, and</text>
								</clause><clause id="H4EA94AE3FA3F44AB9692A71363DDF4C2"><enum>(iv)</enum><text>create a
				collaborative plan for school improvement; and</text>
								</clause></subparagraph><subparagraph id="HEE005DC3A1C34E869A1108354119B8DF"><enum>(B)</enum><text>should
				measure—</text>
								<clause id="H84D2E118F93746BBA37E8EBA74EDF4E7"><enum>(i)</enum><text>the degree to
				which collaborative leadership and a professional learning community exist,
				including—</text>
									<subclause id="H6B2F4278C08741EE8745FA9457DB4F11"><enum>(I)</enum><text>the degree to
				which school administrators are effective in communicating with different role
				groups and in setting high performance expectations for teachers and
				students;</text>
									</subclause><subclause id="HB347CD059F724140BB33B28FD5B99070"><enum>(II)</enum><text>the establishment
				of an effective school leadership team; and</text>
									</subclause><subclause id="H3B8B31B6FB834B8AA875DF6F27EDE4DA"><enum>(III)</enum><text>the amount and
				quality of involvement of parents and community members in the school;</text>
									</subclause></clause><clause id="H63A6E9EE935049399860A74AFE035A46"><enum>(ii)</enum><text>the
				personalization of the school environment, including—</text>
									<subclause id="HFA43916F01534B5F8AEF4F54A9D424C8"><enum>(I)</enum><text>the quality of the
				interpersonal and professional relationships between teachers and
				students;</text>
									</subclause><subclause id="HF61336B6064645DA89A9D24DA440DE05"><enum>(II)</enum><text>student
				self-discipline and tolerance for others, including incidents of bullying and
				cyberbullying; and</text>
									</subclause><subclause id="H9E5C99F373E04BE8920DB021F208765B"><enum>(III)</enum><text>students’ care
				and respect for one another and their mutual cooperation; and</text>
									</subclause></clause><clause id="H09373FD1F2E04525A650DE3AD2CFBD3E"><enum>(iii)</enum><text>the strength of
				the curriculum, instruction, and assessment, including—</text>
									<subclause id="HFB7B564039014911BB810439F0275E8D"><enum>(I)</enum><text>student attention
				to task and concern for achievement at school;</text>
									</subclause><subclause id="H0F0CA745DDB74A47AEB12BAB73C0F929"><enum>(II)</enum><text>the
				identification of a set of essential knowledge and skills in core academic
				areas in which students must demonstrate achievement in order to advance to the
				next level; and</text>
									</subclause><subclause id="HD24B4FBDCE06469BB6354A19C3507F73"><enum>(III)</enum><text>the promotion of
				service programs and student activities as integral to an education, providing
				opportunities that support and extend academic learning for all students;
				and</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFB03AF32FA2E443BAD50A60E19008A94"><enum>(b)</enum><header>Funding
			 priority; Definitions</header><text>Section 4121 of the Elementary and
			 Secondary Education Act of 1965 (42 U.S.C. 7131) is amended by adding at the
			 end the following:</text>
				<quoted-block id="H823E56A19FFC470E9A7B6B65297C95CD" style="OLC">
					<subsection id="HBB54C4D770AF43E192ACAA9F0AFD86C6"><enum>(c)</enum><header>Priority</header><text>In
				determining which entities are to receive grants, contracts, and cooperative
				agreements under subsection (a), the Secretary shall consider the extent to
				which the proposed grant, contract, or cooperative agreement will benefit
				schools determined under section 9532(b) to not have a safe climate for
				academic achievement and shall give extra weight to proposals that will benefit
				such schools.</text>
					</subsection><subsection id="H81B6F5EB510C4FD99B8DED79ADD2ED81"><enum>(d)</enum><header>Definitions</header><text>In
				this section, the terms <term>bullying</term> and <term>cyberbullying</term>
				have the meanings given such terms in section
				9532(k).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H302946C720E44529BC0B93C7668837A4"><enum>7.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the amount authorized and appropriated for part A of title I of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311 et seq.)
			 should be increased by such sums as may be necessary for States to carry out
			 the requirements of section 9532 of such Act.</text>
		</section><section id="HA0D9C134CF554209A0B52A6C155A3BB2"><enum>8.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect not later than 12 months after
			 the date of the enactment of this Act.</text>
