		<section id="HCB685D23FB414B259CFBBFC4E0385E36" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Patent Lawsuit Reform Act of 2010</short-title></quote>.</text>
		</section><section id="HA9D473B18C8843198119BED96315B360"><enum>2.</enum><header>False
			 marking</header>
			<subsection id="HC67A8764FFCC49E4BCFF36B537C87098"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 292 of title
			 35, United States Code, is amended—</text>
				<paragraph id="HB399198E138C496E88CA5ACCBECB3D66"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H23536B415D0E40A78B702DF27002CCFA"><enum>(A)</enum><text>in the second
			 undesignated paragraph, by striking <quote>any unpatented article</quote> and
			 inserting <quote>unpatented articles</quote>;</text>
					</subparagraph><subparagraph id="HE631350B30A34B1A91D3DA3E37027339"><enum>(B)</enum><text>in the third
			 undesignated paragraph, by striking <quote>any article</quote> and inserting
			 <quote>one or more articles</quote>; and</text>
					</subparagraph><subparagraph id="H0BC71BBCC65A486696FDD23169BB11ED"><enum>(C)</enum><text>, by striking
			 <quote>$500 for every such offense</quote> and inserting <quote>$500, in the
			 aggregate, for all offenses in connection with such articles</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph id="H04CAF28D677642BD8015B1F87F648795"><enum>(2)</enum><text>by amending
			 subsection (b) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H779FB4D438C244FB8DA653685534978E" style="OLC">
						<subsection id="H075AE401D5C64BA4AF30325EEB9157FC"><enum>(b)</enum><text display-inline="yes-display-inline">A person who has suffered a competitive
				injury as a result of a violation of this section may bring a civil action in
				the appropriate district court of the United States against the person
				violating this section for recovery of not more than $500 in damages to
				compensate for the
				injury.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8627FBCBF055455A96B7221A1EBD9D30"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to any case
			 pending on the date of the enactment of this Act, and to any case commenced on
			 or after such date of enactment.</text>
