		<official-title>To prohibit, for one year, the Administrator of the
		  Environmental Protection Agency from issuing regulations that result in
		  increased costs for small business concerns, and for other
		  purposes.</official-title>

		<section id="H15AF4DCC567B4B5485B3308AC62A47F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Small Businesses From Costly Regulations Act of
			 2010</short-title></quote>.</text>
		</section><section id="HD88FCFF4C5BF44F9B08F4A431D5B891E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H09A62EA33D314957AF1DB02F4800A7F7"><enum>(1)</enum><text display-inline="yes-display-inline">According to the Office of Advocacy of the
			 Small Business Administration, the costs imposed by Federal regulations
			 disproportionally affect small businesses as compared to larger firms.</text>
			</paragraph><paragraph id="HF9765E56580E4EBE929B9A7F81B7F8A2"><enum>(2)</enum><text display-inline="yes-display-inline">The cost per employee related to Federal
			 regulations for firms with fewer than 20 employees is $10,585, while the cost
			 per employee for firms with 500 or more employees is $7,755.</text>
			</paragraph><paragraph id="H05055C9FCF474B65A26095A65E4C6C94"><enum>(3)</enum><text display-inline="yes-display-inline">The cost per employee related to Federal
			 environmental regulations for firms with fewer than 20 employees is $1,584,
			 while the cost per employee for firms with 500 or more employees is
			 $883.</text>
			</paragraph></section><section id="H606B2637275B41DBA39B08213251BFAE"><enum>3.</enum><header>Prohibition on
			 certain regulations</header>
			<subsection id="HFC368F2E77E1438AAF9F7B45DB652810"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Administrator of the Environmental Protection
			 Agency may not issue a regulation that would result in increased costs for a
			 small business concern (as determined by the Administrator of the Small
			 Business Administration), unless the regulation is—</text>
				<paragraph id="H3675129ED9A9463793F717D76FD80B02"><enum>(1)</enum><text>in response to a
			 major disaster;</text>
				</paragraph><paragraph id="H614649DA7E5044D69CC9B0420C57A71B"><enum>(2)</enum><text>necessary to
			 prevent a major disaster; or</text>
				</paragraph><paragraph id="HF3548022186648608149212B8158F9BA"><enum>(3)</enum><text>necessary to
			 protect human life.</text>
				</paragraph></subsection><subsection id="H79E063327098473ABA618AED7B9C5630"><enum>(b)</enum><header>Period of
			 effect</header><text>The prohibition under subsection (a) shall only have
			 effect during the one-year period beginning on the date of enactment of this
			 Act.</text>
			</subsection><subsection id="H557F73DC781A419BA86BA04F27C67C44"><enum>(c)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H388FA828E13144D98A6413EEAC8F4DB0"><enum>(1)</enum><header>Major
			 disaster</header><text display-inline="yes-display-inline">The term <term>major
			 disaster</term> means a major disaster declared to exist by the President
			 pursuant to section 401 of the Robert T. Stafford Disaster Relief and Emergency
			 Assistance Act (42 U.S.C. 5170).</text>
				</paragraph><paragraph id="H5FD73486112C41AC879BCC4DA44D9479"><enum>(2)</enum><header>Small business
			 concern</header><text>The term <term>small business concern</term> has the
			 meaning given that term in section 3 of the Small Business Act (15 U.S.C.
			 632).</text>
