		<section id="H2B451E0C93434840806A01781CA66B13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Homebuyer Enhanced Fee Disclosure Act
			 of 2010</short-title></quote>.</text>
		</section><section id="H1FEDE968791F49288528D1CC33CB1B1E"><enum>2.</enum><header>Congressional
			 findings</header><text display-inline="no-display-inline">The Congress finds
			 that transfer fee covenants represent an important economic tool with the
			 potential to make homeownership more affordable and benefit local communities
			 by positively restructuring the economics of real estate transactions by
			 apportioning certain infrastructure and overhead costs over time.</text>
		</section><section id="H0B4DDBAEE2634845B44ACBA2A3AB099A" section-type="subsequent-section"><enum>3.</enum><header>Recordation of
			 transfer fees</header>
			<subsection id="H6D0C981DAED94C23B566DEDDEC14CCFC"><enum>(a)</enum><header>Recordation
			 requirement</header><text display-inline="yes-display-inline">A transfer fee
			 covenant recorded on or after the date of the enactment of this Act shall be
			 void and unenforceable unless, at the time the document containing the transfer
			 fee covenant is submitted for recording, a notice described in subsection (b)
			 is contemporaneously submitted for recording in the office of the applicable
			 county recorder.</text>
			</subsection><subsection id="H3A9FF26047B74B17B59C1C0A79820823"><enum>(b)</enum><header>Notice
			 requirements</header><text>Notice required under subsection (a) shall—</text>
				<paragraph id="H4F3482D8E54B4983A29E506632A6D6E5"><enum>(1)</enum><text>be titled, in
			 boldface type, <quote>Payment of Transfer Fee Required</quote>;</text>
				</paragraph><paragraph id="H87AF7BDA4140452295C79CB5A2EAFD57"><enum>(2)</enum><text>include statements
			 of—</text>
					<subparagraph id="HE2FB0420AECB4E35A86AA70C8095E9BC"><enum>(A)</enum><text>the name or names
			 of the owner or owners of the affected property;</text>
					</subparagraph><subparagraph id="HA0273986EE994ED490C8E62B073E7486"><enum>(B)</enum><text>the legal
			 description of the affected property;</text>
					</subparagraph><subparagraph id="H66E86B119DA64704885E18D395C045E2"><enum>(C)</enum><text>the dollar amount
			 or, if applicable, the percentage of sales price constituting the transfer fee
			 required to be paid under the transfer fee covenant;</text>
					</subparagraph><subparagraph id="H75B7D0EDBD6645B68763DDCE4325B952"><enum>(D)</enum><text>the method and
			 manner of payment of the transfer fee;</text>
					</subparagraph><subparagraph id="H638B1CCACFAA49509776511EC1B8E384"><enum>(E)</enum><text>in the case of
			 affected property that is residential property, actual dollar-cost examples of
			 the amount of the transfer fee for property priced at $250,000, $500,000, and
			 $750,000; and</text>
					</subparagraph><subparagraph id="H9839FDD8C476449D8A08393D7EAAD29A"><enum>(F)</enum><text>if applicable, the
			 date on which or circumstances under which the transfer fee covenant
			 expires.</text>
					</subparagraph></paragraph></subsection><subsection id="H09F3AC37B05B4DD08CEC3A1798B5E8AA"><enum>(c)</enum><header>Presumption of
			 validity</header><text>A transfer fee covenant that imposes a transfer fee of
			 not more than 1 percent of the gross sales price for the affected property,
			 effective for a term of not more than 99 years, and which complies with the
			 requirements under subsections (a) and (b) shall be presumed to be
			 valid.</text>
			</subsection><subsection id="HA6F5EE27BC1A455992B912AE457DDCC2"><enum>(d)</enum><header>Limitation</header><text>No
			 property shall be subject to more than one transfer fee covenant.</text>
			</subsection></section><section id="HAD6BE1B6F1E44D4E961788A5E4040E38"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this section, the following
			 definitions shall apply:</text>
			<paragraph id="HB7D88FCA5E2C4A8C874BE0CCC791DBEA"><enum>(1)</enum><header>Affected
			 property</header><text>The term <quote>affected property</quote> means, with
			 respect to a transfer fee covenant, the real property that is encumbered by the
			 transfer fee covenant.</text>
			</paragraph><paragraph id="HF97DF9153698471C933907163591596C"><enum>(2)</enum><header>Applicable
			 county recorder</header><text>The term <quote>applicable county
			 recorder</quote> means, with respect to affected property, the recorder of the
			 county in which the affected property is located.</text>
			</paragraph><paragraph id="HCA3691785F694871888EE1BD7BA03801"><enum>(3)</enum><header>Transfer
			 fee</header><text display-inline="yes-display-inline">The term <quote>transfer
			 fee</quote> means a fee, charge or payment imposed by a covenant, restriction,
			 or similar document filed in the applicable county recorder’s office and
			 required to be paid in connection with or as a result of a transfer of title to
			 affected property, but does not include fees, charges, payments, or other
			 obligations that—</text>
				<subparagraph id="H8C5C0EEC263B4607A2CDAB61F1EB34EC"><enum>(A)</enum><text>are imposed by a
			 court judgment, order, or decree;</text>
				</subparagraph><subparagraph id="H74AC104D02B449A3B6B0FB3CB57A186D"><enum>(B)</enum><text>are imposed by or
			 payable to the Federal Government or a State or local government;</text>
				</subparagraph><subparagraph id="H2B32E9FB77434E10A8EA574628804A83"><enum>(C)</enum><text>arise out of a
			 mechanic’s lien;</text>
				</subparagraph><subparagraph id="H7DB1EF06F96446269C6975D1245839DC"><enum>(D)</enum><text>arise from an
			 option to purchase, or for waiver of the right to purchase, the affected
			 property;</text>
				</subparagraph><subparagraph id="H2457B4D783F84DF6BE774A2A7F5EEFD2"><enum>(E)</enum><text>are payable to a
			 homeowners association, condominium association, or similar entity for the
			 benefit of the owners; and</text>
				</subparagraph><subparagraph id="HE2AB5DFE976F47F9B6E27A3BF6D225B9"><enum>(F)</enum><text>are imposed by or
			 payable to lenders or purchasers of loans.</text>
				</subparagraph></paragraph><paragraph id="H7B3356E80D444CA2A133E1731D8FB806"><enum>(4)</enum><header>Transfer fee
			 covenant</header><text>The term <quote>transfer fee covenant</quote> means a
			 covenant, restriction, or agreement filed with the office of the applicable
			 county recorder that—</text>
				<subparagraph id="H203CBC3F07F742BCBFA2EFE0618399C1"><enum>(A)</enum><text>affects real
			 property; and</text>
				</subparagraph><subparagraph id="H3AE764F03CD94C2F9C2B5E6EF80056F0"><enum>(B)</enum><text>obligates a future
			 buyer or seller of the affected real property, other than a person who is a
			 party to the covenant, restriction, or agreement, to pay a transfer fee.</text>
				</subparagraph></paragraph></section></legis-body>
