		<section id="H1C0230BBD51F4E2EA615761237AADE2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sacramento-San Joaquin Delta National
			 Heritage Area Establishment Act</short-title></quote>.</text>
		</section><section id="H792A262584CC4B469A1274AA173AFAD9"><enum>2.</enum><header>Sacramento-San
			 Joaquin Delta National Heritage Area</header>
			<subsection id="HA5DC59F10311435686F87224604A38C8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H9D17A4340D5E4D72AB150008FBC403D5"><enum>(1)</enum><header>Heritage
			 Area</header><text>The term <term>Heritage Area</term> means the Sacramento-San
			 Joaquin Delta Heritage Area established by this section.</text>
				</paragraph><paragraph id="H002309EAC8114D5FA847956DB0FF7C84"><enum>(2)</enum><header>Heritage Area
			 management plan</header><text>The term <term>Heritage Area management
			 plan</term> means the plan developed and adopted by the management entity under
			 this section.</text>
				</paragraph><paragraph id="H8C359E13598F459AB24F0F26D62DB37F"><enum>(3)</enum><header>Management
			 entity</header><text>The term <term>management entity</term> means the
			 management entity for the Heritage Area designated by subsection (b)(4).</text>
				</paragraph><paragraph id="H8154BE1BBE7B48A68F6B5D7E454F59A5"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></subsection><subsection id="H274DA8E3EFD2449098C5B73B03F67B48"><enum>(b)</enum><header>Sacramento-San
			 Joaquin Delta Heritage Area</header>
				<paragraph id="H5EA16748C80E4AEE826C24A840A3EB00"><enum>(1)</enum><header>Establishment</header><text>There
			 is established the <quote>Sacramento-San Joaquin Delta Heritage Area</quote> in
			 the State of California.</text>
				</paragraph><paragraph id="H1C5704F5B863489685DF4DDBF6F2BA17"><enum>(2)</enum><header>Boundaries</header><text>The
			 boundaries of the Heritage Area shall be in the counties of Contra Costa,
			 Sacramento, San Joaquin, Solano, and Yolo in the State of California, as
			 generally depicted on the map entitled <quote>Sacramento-San Joaquin Delta
			 National Heritage Area Proposed Boundary</quote>, numbered T27/105,030, and
			 dated September 2010.</text>
				</paragraph><paragraph id="HD1245B19ACE44A8CA8A7AACE6FBF4862"><enum>(3)</enum><header>Availability of
			 map</header><text>The map described in paragraph (2) shall be on file and
			 available for public inspection in the appropriate offices of the National Park
			 Service and the Delta Protection Commission.</text>
				</paragraph><paragraph id="H70C92F329F7C4FF9AD2F2E1E90BFE213"><enum>(4)</enum><header>Management
			 entity</header><text>The management entity for the Heritage Area shall be the
			 Delta Protection Commission established by section 29735 of the California
			 Public Resources Code.</text>
				</paragraph><paragraph id="H1D3223CD9DE241B296BA9B81230B83EE"><enum>(5)</enum><header>Administration;
			 Management plan</header>
					<subparagraph id="H467CC0AFE57D4201AA32EF811ABAEA5B"><enum>(A)</enum><header>Administration</header><text>For
			 purposes of carrying out the Heritage Area management plan, the Secretary,
			 acting through the management entity, may use amounts made available under this
			 section in accordance with section 8001(c) of the Omnibus Public Land
			 Management Act of 2009 (Public Law 111–11; 123 Stat. 991).</text>
					</subparagraph><subparagraph id="H8EF4E7609A5942E1BD381BAC28B7DFCE"><enum>(B)</enum><header>Management
			 plan</header>
						<clause id="HD5E018022F79463896EAE6F42CD68E90"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the management entity shall
			 submit to the Secretary for approval a proposed management plan for the
			 Heritage Area in accordance with section 8001(d) of the Omnibus Public Land
			 Management Act of 2009 (Public Law 111–11; 123 Stat. 991).</text>
						</clause><clause id="HB42E12A593C744FABA2D32C2A31AD591"><enum>(ii)</enum><header>Restrictions</header><text>The
			 Heritage Area management plan submitted under this paragraph shall—</text>
							<subclause id="H13AD6A98B4FB4182B73B558EDCA8B153"><enum>(I)</enum><text>ensure
			 participation by appropriate Federal, State, tribal, and local agencies,
			 including the Delta Stewardship Council, special districts, natural and
			 historical resource protection and agricultural organizations, educational
			 institutions, businesses, recreational organizations, community residents, and
			 private property owners; and</text>
							</subclause><subclause id="HDB069C94D7A2477FABFE4B92C1E8CDFD"><enum>(II)</enum><text>not be approved
			 until the Secretary has received certification from the Delta Protection
			 Commission that the Delta Stewardship Council has reviewed the Heritage Area
			 management plan for consistency with the plan adopted by the Delta Stewardship
			 Council pursuant to State law.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H3BBC133CA09E4A1C92449DE149C14084"><enum>(6)</enum><header>Relationship to
			 other Federal agencies; Private property</header>
					<subparagraph id="H77907D3264364C1FA3AC9D6A1AFA0A5C"><enum>(A)</enum><header>Relationship to
			 other Federal agencies</header><text>The provisions of section 8001(e) of the
			 Omnibus Public Land Management Act of 2009 (Public Law 111–11; 123 Stat. 991)
			 shall apply to the Heritage Area.</text>
					</subparagraph><subparagraph id="H5A5C27F703194ABBA77CEFAF591A93C5"><enum>(B)</enum><header>Private
			 property</header>
						<clause id="H519736B2BA8847FC8992E67025AC7DDA"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the provisions of section 8001(f)
			 of the Omnibus Public Land Management Act of 2009 (Public Law 111–11; 123 Stat.
			 991) shall apply to the Heritage Area.</text>
						</clause><clause id="H76D0C4D0EB9C4818891AC2193C7EFF75"><enum>(ii)</enum><header>Opt
			 out</header><text>An owner of private property within the Heritage Area may opt
			 out of participating in any plan, project, program, or activity carried out
			 within the Heritage Area under this section, if the property owner provides
			 written notice to the management entity.</text>
						</clause></subparagraph></paragraph><paragraph id="H4013A60F06EA4DEFB1AB97AF551596B9"><enum>(7)</enum><header>Evaluation;
			 report</header><text>The provisions of section 8001(g) of the Omnibus Public
			 Land Management Act of 2009 (Public Law 111–11; 123 Stat. 991) shall apply to
			 the Heritage Area.</text>
				</paragraph><paragraph id="H21F242397ED94693B9D833EBF1463DB8"><enum>(8)</enum><header>Effect of
			 designation</header><text>Nothing in this section—</text>
					<subparagraph id="H805DAB0166814362A6219F0A0302C48D"><enum>(A)</enum><text>precludes the
			 management entity from using Federal funds made available under other laws for
			 the purposes for which those funds were authorized; or</text>
					</subparagraph><subparagraph id="H1A33680D9FC6495B8B959D1389F443EA"><enum>(B)</enum><text>affects any water
			 rights or contracts.</text>
					</subparagraph></paragraph><paragraph id="HD923F932F9A046B1A5741E0B67F18491"><enum>(9)</enum><header>Authorization of
			 appropriations</header>
					<subparagraph id="H7ECB4AB3F4DD4D29B14C94BF1684D574"><enum>(A)</enum><header>In
			 general</header><text>There is authorized to be appropriated to carry out this
			 section $20,000,000, of which not more than $2,000,000 may be made available
			 for any fiscal year.</text>
					</subparagraph><subparagraph id="HB016D4D571CB4253A301476078E05EF7"><enum>(B)</enum><header>Cost-sharing
			 requirement</header><text>The Federal share of the total cost of any activity
			 under this section shall be determined by the Secretary, but shall be not more
			 than 50 percent.</text>
					</subparagraph><subparagraph id="H747463F68DA349D683191F386AD76302"><enum>(C)</enum><header>Non-Federal
			 share</header><text>The non-Federal share of the total cost of any activity
			 under this section may be in the form of—</text>
						<clause id="HF915C582A4E74B499D1CADEDF64C33D2"><enum>(i)</enum><text>in-kind
			 contributions of goods or services; or</text>
						</clause><clause id="H2FEC50AEA3B5462CB1DD2C051E517067"><enum>(ii)</enum><text>State or local
			 government fees, taxes, or assessments.</text>
						</clause></subparagraph></paragraph><paragraph id="HAD4600BF777948A39131C15C1ED42DCC"><enum>(10)</enum><header>Termination of
			 authority</header><text>If a proposed management plan has not been submitted to
			 the Secretary by the date that is 5 years after the date of enactment of this
			 title, the Heritage Area designation shall be rescinded.</text>
				</paragraph></subsection></section></legis-body>
