		  and appeals to certain individuals.</official-title>

		<section id="H1E4973AC93A843939E58CE6ADC1A6D26" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair and Impartial Recruitment Act of
			 2010</short-title></quote>.</text>
		</section><section id="H07E4C409735B4378ADBAC79EBCBCF64A"><enum>2.</enum><header>Waiver and
			 appeals process for disqualified individuals</header><text display-inline="no-display-inline">Section 44936 of title 49, United States
			 Code, is amended—</text>
			<paragraph id="H71A7F750E2EA4E44A78D488DE655053E"><enum>(1)</enum><text>in subsection
			 (a)(2) by striking <quote>the Under Secretary requires is conducted</quote> and
			 inserting the following <quote>the Assistant Secretary requires is conducted
			 and upon the Assistant Secretary’s request, a copy of the investigation report
			 is provided to the Assistant Secretary.</quote>;</text>
			</paragraph><paragraph id="HAE8F361FC6D44BD6A267BDAE67AB906D"><enum>(2)</enum><text>by redesignating
			 subsections (d) and (e) as subsection (e) and (f), respectively; and</text>
			</paragraph><paragraph id="H826CA98E1E5940B294DB81C110B6CF07"><enum>(3)</enum><text>by inserting after
			 subsection (c) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB7B2233F435A40CDB0E69A5946C8C426" style="OLC">
					<subsection id="H1D21515D38024172B6E7F4C05BB3A761"><enum>(d)</enum><header>Waiver and
				appeals process established</header>
						<paragraph id="H72824FED348C4DAB9D5F6694DBC2E0C7"><enum>(1)</enum><header>Waiver
				process</header>
							<subparagraph id="H262E6EC9F0CF4647B12E4BE66A9967A9"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than one
				year after the date of enactment of the Fair and Impartial Recruitment Act of
				2010, the Assistant Secretary shall issue regulations to establish a waiver
				process to allow an employer to hire an individual disqualified for employment
				under subsection (b)(1)(B).</text>
							</subparagraph><subparagraph id="HB4FA2B10691C4BEF86AD617058060713"><enum>(B)</enum><header>Waiver
				application</header><text>To request such a waiver an individual shall apply to
				the Assistant Secretary who shall issue a waiver to an individual—</text>
								<clause id="H9C59A14117D94CDCA9AD0C522C6EA887"><enum>(i)</enum><text>after the
				Assistant Secretary considers the circumstances of any disqualifying act or
				offense, any restitution made by the individual, Federal and State mitigation
				remedies, and other factors that lead the Assistant Secretary to conclude that
				the individual does not pose a terrorism risk warranting denial of employment;
				and</text>
								</clause><clause id="HCC4C6EDD3AB04EA78001B40DA50CD0A9"><enum>(ii)</enum><text>without regard to
				whether that individual would otherwise be disqualified under subsection
				(b)(1)(B) if the individual’s employer establishes alternate security
				arrangements acceptable to the Assistant Secretary.</text>
								</clause></subparagraph></paragraph><paragraph id="HC1FBDE31392145599CED918C680CD497"><enum>(2)</enum><header>Appeals
				Process</header><text display-inline="yes-display-inline">Not later than one
				year after the date of enactment of the Fair and Impartial Recruitment Act of
				2010, the Assistant Secretary shall establish an appeals process for an
				individual disqualified for employment under subsection (b)(1)(B) that includes
				notice and an opportunity for a hearing before an impartial third party.</text>
						</paragraph><paragraph id="H2B29719C31C544168579A77C3794EDCB"><enum>(3)</enum><header>Savings
				clause</header><text>An airport operator shall not be required to issue an
				airport credential providing unescorted access to a secured identification
				display area to any individual based solely on the waiver or appeal process
				established pursuant to this subsection.</text>
						</paragraph><paragraph id="H53F5E8750D03464D9E9D4A851A0A00E4"><enum>(4)</enum><header>Limitation on
				liability</header><text>No cause of action, suit, action, or other proceeding
				may arise from any denial of a request of a waiver, or from a subsequent
				disqualification for employment pursuant to subsection (b)(1)(B) if the cause
				of action, suit, action or proceeding is based solely on the fact that the
				applicant was granted a waiver or appeal under this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H7CC57DA34E7B45FA81A8417BD6D6699C"><enum>3.</enum><header>Technical and
			 conforming amendments</header><text display-inline="no-display-inline">Section
			 44936 of title 49, United States Code, is amended—</text>
			<paragraph id="H29C9B87FCA344A908A8E63651188348E"><enum>(1)</enum><text>by striking
			 <quote>Under Secretary of Transportation for Security</quote> the first place
			 it appears and inserting <quote>Assistant Secretary (Transportation Security
			 Administration)</quote>;</text>
			</paragraph><paragraph id="H3C96C67913904DCCB67E724FEBC4A376"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided in paragraph (1), by
			 striking <quote>Under Secretary of Transportation for Security </quote> and
			 <quote>Under Secretary</quote> each place they appear and inserting
			 <quote>Assistant Secretary </quote>; and</text>
			</paragraph><paragraph id="H6CDC3FE5C9014F579586C5CF035D7349"><enum>(3)</enum><text>in subsection
			 (c)(1) by striking <quote>Under Secretary’s designee</quote> and inserting
			 <quote>Assistant Secretary’s designee</quote>.</text>
