		<section id="H092A63A433104937B1FDB802387D1DF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Investment in Commercial Real Estate
			 Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H7790E8150DA74299A8F61A70BBCCA7BD" section-type="subsequent-section"><enum>2.</enum><header>Servicer safe
			 harbor</header>
			<subsection commented="no" id="H6F3C24CBA5804A93AE95A51E486F64DE"><enum>(a)</enum><header>Safe
			 Harbor</header>
				<paragraph commented="no" id="H4759E82DB51D4C0D94A7EF4966388CD6"><enum>(1)</enum><header>Loan
			 modifications and workout plans</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 and notwithstanding any investment contract between a servicer and a
			 securitization vehicle or investor, a servicer shall not be liable for entering
			 into a loan modification or workout plan with respect to any commercial
			 mortgage loan that meets all of the criteria set forth in paragraph (2)(B)
			 to—</text>
					<subparagraph commented="no" id="H65739FE1A0304660B2C3E2177FF9B8A5"><enum>(A)</enum><text>any person, based
			 on that person’s ownership of a commercial mortgage loan or any interest in a
			 pool of commercial mortgage loans or in securities that distribute payments out
			 of the principal, interest and other payments in loans on the pool;</text>
					</subparagraph><subparagraph commented="no" id="HB7C447818BFF44AB95D4D9B17A18F935"><enum>(B)</enum><text>any person who is
			 obligated to make payments determined in reference to any loan or any interest
			 referred to in subparagraph (A); or</text>
					</subparagraph><subparagraph commented="no" id="HA6180EF594004B7C8AABF0748BD9E926"><enum>(C)</enum><text>any person that
			 insures any loan or any interest referred to in subparagraph (A) under any law
			 or regulation of the United States or any law or regulation of any State or
			 political subdivision of any State.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H5FDE66767B7849498137497388A32529"><enum>(2)</enum><header>Ability to
			 modify mortgages</header>
					<subparagraph commented="no" id="HB3072D98D19B4E52B6539F15D69D0142"><enum>(A)</enum><header>Ability</header><text>Notwithstanding
			 any other provision of law, and notwithstanding any investment contract between
			 a servicer and a securitization vehicle or investor, a servicer—</text>
						<clause commented="no" id="H8F43D3FB5B07451E88CD9D803FE6F4ED"><enum>(i)</enum><text>shall not be
			 limited in the ability to modify mortgages, the number of mortgages that can be
			 modified, the frequency of loan modifications, or the range of permissible
			 modifications; and</text>
						</clause><clause commented="no" id="H03771D92EA494C8EA09F80D4F5EAD6A5"><enum>(ii)</enum><text>shall not be
			 obligated to repurchase loans from or otherwise make payments to the
			 securitization vehicle on account of a modification, workout, or other loss
			 mitigation plan for a commercial mortgage or a class of commercial mortgages
			 that constitute a part or all of the mortgages in the securitization
			 vehicle,</text>
						</clause><continuation-text commented="no" continuation-text-level="subparagraph">if any mortgage so modified meets
			 all of the criteria set forth in subparagraph (B).</continuation-text></subparagraph><subparagraph commented="no" id="HA0806871D6034E5E82F073450590B2B8"><enum>(B)</enum><header>Criteria</header><text>The
			 criteria under this subparagraph with respect to a mortgage are as
			 follows:</text>
						<clause commented="no" id="HC2945509D1B046C291DFD95E6BF8E03F"><enum>(i)</enum><text>Default on the
			 payment of such mortgage has occurred or is reasonably foreseeable.</text>
						</clause><clause commented="no" id="HFABC7B72FB924004BD88EF35EF22B683"><enum>(ii)</enum><text>The property
			 securing such mortgage is occupied by the mortgagor of such mortgage.</text>
						</clause><clause commented="no" id="H41E059719A144769B7581584622F889D"><enum>(iii)</enum><text>The servicer
			 reasonably and in good faith believes that the anticipated recovery on the
			 principal outstanding obligation of the mortgage under the particular
			 modification or workout plan or other loss mitigation action will exceed, on a
			 net present value basis, the anticipated recovery on the principal outstanding
			 obligation of the mortgage to be realized through foreclosure.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="H159B253E79B04404966655DB235A726D"><enum>(3)</enum><header>Applicability</header><text>This
			 subsection shall apply only with respect to modifications, workouts, and other
			 loss mitigation plans initiated before January 1, 2012.</text>
				</paragraph></subsection><subsection commented="no" id="H6D0A717A06ED44AB8EC2516A2D46F3EF"><enum>(b)</enum><header>Definition of
			 securitization vehicles</header><text>For purposes of this section, the term
			 <quote>securitization vehicle</quote> means a trust, corporation, partnership,
			 limited liability entity, special purpose entity, or other structure
			 that—</text>
				<paragraph commented="no" id="H7EC04B493BF34330950E95A843B7AA4E"><enum>(1)</enum><text>is the issuer, or
			 is created by the issuer, of mortgage pass-through certificates, participation
			 certificates, mortgage-backed securities, or other similar securities backed by
			 a pool of assets that includes commercial mortgage loans; and</text>
				</paragraph><paragraph commented="no" id="HB00387F5A58C4C3BB46321E2E9EBEA64"><enum>(2)</enum><text>holds such
			 mortgages.</text>
				</paragraph></subsection></section><section id="H00F39D8250194ACFA63CEF751EEC1FC1"><enum>3.</enum><header>Recovery period
			 for residential rental property and nonresidential real property</header>
			<subsection id="HE0923CF82A8F4E48A9A95B31C33ED55A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The table in
			 subsection (c) of section 168 of the Internal Revenue Code of 1986 (specifying
			 applicable recovery period) is amended—</text>
				<paragraph id="H566D264AA60044EA94785D3A1F4AD20D"><enum>(1)</enum><text>by striking
			 <quote>27.5 years</quote> and inserting <quote>20 years</quote>, and</text>
				</paragraph><paragraph id="HAAABFB3329A946919D5771811D9E142F"><enum>(2)</enum><text>by striking
			 <quote>39 years</quote> and inserting <quote>20 years</quote>.</text>
				</paragraph></subsection><subsection id="H6BA0883FC41B4A6F8301C513D238E237"><enum>(b)</enum><header>Depreciation
			 rules for residential rental property and non-residential real property for
			 purposes of earnings and profits</header><text display-inline="yes-display-inline">Paragraph (3) of section 312(k) of the
			 Internal Revenue Code of 1986 (relating to exception for tangible property) is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HE81340EE385B43A1B300C23C9194D32C" style="OLC">
					<subparagraph id="H30DC1DF5C8BA409AB6AEA70AC27FE928"><enum>(C)</enum><header>Treatment of
				residential rental property and nonresidential real property</header><text display-inline="yes-display-inline">In the case of any residential rental
				property or nonresidential real property (within the meaning of section
				168(c)), the adjustment to earnings and profits for depreciation for any
				taxable year shall be determined under the alternative depreciation method
				(within the meaning of section 168(g)(2)), except that the recovery period
				shall be 20
				years.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H845DA520A60941B09A01D990DBFFE25C"><enum>(c)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 312(k)(3) of the Internal Revenue Code of 1986 is amended by striking
			 ‘‘subparagraph (B),’’ and inserting ‘‘subparagraphs (B) and (C),’’.</text>
			</subsection><subsection id="H2D79943584E949F486B0FC92FF515AFE"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 property placed in service on or after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H277C96BB276D489D8D05B8DAD868CD54"><enum>4.</enum><header>Net operating
			 loss carryback increased to 5 years</header>
			<subsection id="HC0392C0E31D745BCA7CB82E92E8A7847"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Clause (i) of section
			 172(b)(1)(A) of the Internal Revenue Code of 1986 (relating to years to which
			 loss may be carried) is amended by striking <quote>2 years</quote> and
			 inserting <quote>5 years</quote>.</text>
			</subsection><subsection id="H009FDD697A244A0EAF1B4C320BC82418"><enum>(b)</enum><header>Alternative
			 minimum tax</header><text>Subclause (II) of section 56(d)(1)(A)(i) of such Code
			 is amended by striking <quote>90 percent of </quote>.</text>
			</subsection><subsection id="H1CEB523F534540E2AA4F882B8DB7C750"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H264E8F84A4A74232803147BEB9E40665"><enum>(1)</enum><text>Section 172(b)(1)
			 of such Code is amended by striking subparagraphs (F), (G), (H), (I), and
			 (J).</text>
				</paragraph><paragraph id="H576F62E2253E4334A35F109B71B13CBD"><enum>(2)</enum><text>Section
			 56(d)(1)(A) of such Code is amended—</text>
					<subparagraph id="H3214CCA18C1C48E1B6E5CC897784FE64"><enum>(A)</enum><text>in clause (i)(I)
			 thereof by striking <quote>(other than the deduction described in clause
			 (ii)(I))</quote>, and</text>
					</subparagraph><subparagraph id="H9FD1D5C723C747168B74883C0685C8E3"><enum>(B)</enum><text>by amending clause
			 (ii) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H51348DB0C80848DA978B42FE3DE55488" style="OLC">
							<clause id="H3309E370C3F247EAB08A6AD2D07D2726"><enum>(ii)</enum><text display-inline="yes-display-inline">alternative minimum taxable income
				determined without regard to such deduction and the deduction under section 199
				reduced by the amount determined under clause
				(i),</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCBF4FE331E4544C284ED5C76C9D65648"><enum>(3)</enum><text>Section 56(d) of
			 such Code is amended by striking paragraph (3).</text>
				</paragraph></subsection><subsection id="HD657F99FE6F84BF6AC36FCBFCFDDAC48"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years ending after the date of the enactment of this Act.</text>
			</subsection></section><section id="H3C3FB9F0DF5C4E4581FB6E27BB12D99B"><enum>5.</enum><header>Dynamic
			 provisioning of investment and loan loss reserves</header>
			<subsection id="HB65F924F7D984179892668522D4F245D"><enum>(a)</enum><header>Implementation
			 requirement</header><text display-inline="yes-display-inline">The Federal
			 banking agencies shall implement a system of dynamic provisioning for
			 investment and loan loss reserves (hereafter in this section referred to as the
			 <quote>dynamic reserve system</quote>) that meets the requirements of this
			 section and is applicable to all depository institutions before January 1,
			 2011.</text>
			</subsection><subsection id="H8E3506BB70AD4A3C9B1925E947307F9F"><enum>(b)</enum><header>Total
			 provisioning</header><text display-inline="yes-display-inline">For each
			 depository institution during any accounting period, the total provision for
			 investment and loan loss reserves shall equal the sum of—</text>
				<paragraph id="HE9D2A71C2FB842369A933014253D4200"><enum>(1)</enum><text>the general
			 provision for investment and loan loss reserves, as determined under subsection
			 (c); and</text>
				</paragraph><paragraph id="HDC6BE89C646448BE8134DF40CA1FACC0"><enum>(2)</enum><text>the specific
			 provision for investment and loan loss reserves, as determined under subsection
			 (d).</text>
				</paragraph></subsection><subsection id="H3F50A8D3CBAC493DADEDDCCF60BB6AF4"><enum>(c)</enum><header>General
			 provision</header>
				<paragraph id="HE00E488FAD8140C28696778732BD5E98"><enum>(1)</enum><header>Categories</header><text display-inline="yes-display-inline">The Board of Governors of the Federal
			 Reserve System shall establish major categories of loans and investment to be
			 used by depository institutions for purposes of the dynamic reserve
			 system.</text>
				</paragraph><paragraph id="HEE38636E2ACC449F81E0BD66AFB8FC2A"><enum>(2)</enum><header>Publication of
			 average historical specific losses and write-downs</header>
					<subparagraph id="H5804A82921E24CD496F30929775D464F"><enum>(A)</enum><header>In
			 general</header><text>For each major category established pursuant to paragraph
			 (1), the Board shall calculate and publish the average historical specific
			 losses and write-downs as a percentage of total loans and investments over a
			 period determined by the Board.</text>
					</subparagraph><subparagraph id="H6D12DAA5EB294503B856ECFE4253BFB8"><enum>(B)</enum><header>Limits on
			 period</header><text>The period determined by the Board under subparagraph (A)
			 may not be less than 10 years and shall include at least 1 full business
			 cycle.</text>
					</subparagraph></paragraph><paragraph id="HCBC20D9DB2F6416A9F2C634535963061"><enum>(3)</enum><header>Minimum
			 percentage</header><text display-inline="yes-display-inline">For each major
			 category established pursuant to paragraph (1), the Board shall establish a
			 minimum percentage that shall be the larger of—</text>
					<subparagraph id="H286D7C2EB3994FC4AD6E271264F4E0D9"><enum>(A)</enum><text>the average
			 historical specific losses and write-downs, in such category, as a percentage
			 of total loans and investments, in such category, of all United States
			 depository institutions over the period determined by the Board; or</text>
					</subparagraph><subparagraph id="HD43408293B4A418FACF28327C93A93F1"><enum>(B)</enum><text>a percentage
			 determined by the Board.</text>
					</subparagraph></paragraph><paragraph id="H37EAEDBFDAC14DE1AA601FEAC44A4DDB"><enum>(4)</enum><header>Provision</header>
					<subparagraph id="H0531A5B2EC914E718AD32D4101FABDBA"><enum>(A)</enum><header>In
			 general</header><text>During each accounting period, each depository
			 institution shall make a general provision to the investment and loan loss
			 reserves of the institution for each major category established pursuant to
			 paragraph (1).</text>
					</subparagraph><subparagraph id="H6CE16F2CD9E9436C87CB27E175EAEE05"><enum>(B)</enum><header>Measure of
			 provision</header><text display-inline="yes-display-inline">The general
			 provision to the investment and loan loss reserves of a depository institution
			 under subparagraph (A) for each major category shall consist of the sum
			 of—</text>
						<clause id="H357EB77F7BD64CA9853F852127254FD3"><enum>(i)</enum><text>the
			 product of—</text>
							<subclause id="HDEDDACABE1E04F8BABBD70DA0CBE5D2B"><enum>(I)</enum><text>the total amount
			 of the loans and investment in such category in such depository institution at
			 the beginning of the accounting period; and</text>
							</subclause><subclause id="HE050136458E348678DB9944ADB4A5FCC"><enum>(II)</enum><text>the average
			 historical specific credit losses and write-downs in such category as a
			 percentage of total loans and investments in such category of all depository
			 institutions over the period determined by the Board minus the amount of any
			 specific provisions made by such depository institution during such accounting
			 period with respect to such category; and</text>
							</subclause></clause><clause id="H7A04DEAC8E794A7DB54D8D8DBD654648"><enum>(ii)</enum><text>the
			 product of—</text>
							<subclause id="H8BF527D410F64C7FBCD53820CA37C318"><enum>(I)</enum><text display-inline="yes-display-inline">the difference between the total amount of
			 the loans and investment in such category in such depository institution at the
			 end of the accounting period and the total amount of the loans and investment
			 in such category in such depository institution at the beginning of the
			 accounting period; and</text>
							</subclause><subclause id="H5E4DAF331EC14A32A05825260D4949D8"><enum>(II)</enum><text>the minimum
			 percentage determined by the Board under paragraph (3) for such
			 category.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="HC9A781E82FEB4F03A6CF60D02657D4D1"><enum>(d)</enum><header>Specific
			 provisions for general categories of investments and loans</header>
				<paragraph id="HE4809B17C6AE4B35992BC1C9E9F832CE"><enum>(1)</enum><header>Establishment of
			 categories</header><text display-inline="yes-display-inline">The Board shall
			 establish the general categories of investments and loans for all depository
			 institutions.</text>
				</paragraph><paragraph id="HD531D0AAEE18411CB5BA599EB8D77104"><enum>(2)</enum><header>Calculation of
			 historical specific provisions and average among of credit
			 losses</header><text>The Board shall calculate, publish and make available to
			 the public—</text>
					<subparagraph id="H543AE29C397940C7B9CF42A80BC3236E"><enum>(A)</enum><text display-inline="yes-display-inline">the average historical specific provisions
			 for each category of investment and loans in all depository institutions over a
			 period of such number of years as the Board may determine to be appropriate,
			 subject to paragraph (3); and</text>
					</subparagraph><subparagraph id="H13C838D026964EFE999E197411188AD5"><enum>(B)</enum><text display-inline="yes-display-inline">the average historical amount of credit
			 losses and write-downs for each major category of investment and loans in all
			 depository institutions over a period of such number of years as the Board may
			 determine to be appropriate, subject to paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="H0AA68F38D39A4C0E8894E1EA745BC4C4"><enum>(3)</enum><header>Period of years
			 shall encompass business cycle</header><text>The period of years determined
			 under subparagraphs (A) and (B) of paragraph (2) shall be of such duration as
			 to at least comprise a complete business cycle.</text>
				</paragraph></subsection><subsection id="H9536F67AC4B04B19AE969629CB6FBD20"><enum>(e)</enum><header>Other
			 requirements and authority</header><text display-inline="yes-display-inline">The Board may establish a cap on the
			 accumulation of general provision for investment and loan losses at any
			 depository institution expressed as percent of total investment and loans at
			 such depository institution.</text>
			</subsection><subsection id="HEF2A76949A1F403C8BCA2CD34335B604"><enum>(f)</enum><header>Basel accord
			 supersedes this section</header><text display-inline="yes-display-inline">If
			 the Basel Committee on Banking Supervision agrees upon an alternative method
			 for dynamic provisioning before December 31, 2010, the Board may implement such
			 an agreement in lieu of implementing the requirements of subsections (c) and
			 (d).</text>
			</subsection><subsection id="HBBFB3E1E426C485BB93BB4F08A65B48D"><enum>(g)</enum><header>Definitions</header><text>For
			 purposes of this section, the following definitions shall apply:</text>
				<paragraph id="HB55CFCAD05624BCFAAAB166A612C66B9"><enum>(1)</enum><header>Board</header><text>The
			 term <quote>Board</quote> means the Board of Governors of the Federal Reserve
			 System.</text>
				</paragraph><paragraph id="HFE51FF32BD0543D0ACCACA8F285507BE"><enum>(2)</enum><header>Other banking
			 definitions</header><text>The terms <quote>depository institution</quote> and
			 <quote>Federal banking agencies</quote> have the same meaning as in section 3
			 of the Federal Deposit Insurance Act.</text>
				</paragraph></subsection></section><section id="H476B7F10ECAD4CD6A939156C40A66DB7"><enum>6.</enum><header>Report to the
			 Congress on non-renewals of commercial mortgage loans</header>
			<subsection id="H7E12B8FCE65A4F209419601AFA0C63E6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each qualified
			 financial institution shall, before the end of the 30-day period beginning at
			 the end of each calendar quarter beginning after the date of the enactment of
			 this Act, submit to the Board with respect to such calendar quarter the
			 aggregate amount of permanent commercial mortgage loans that—</text>
				<paragraph id="H328D395D5DA54F4793E84B0CA4287FBD"><enum>(1)</enum><text display-inline="yes-display-inline">matured during the quarter, but did not
			 fully amortize;</text>
				</paragraph><paragraph id="HF28D34F8C0354B9699BD89A8F2B93600"><enum>(2)</enum><text display-inline="yes-display-inline">were current prior to maturity;</text>
				</paragraph><paragraph id="H1D0C08ECACD842B6BDAA48828BE89CB6"><enum>(3)</enum><text display-inline="yes-display-inline">had adequate cash flows from the mortgaged
			 properties to continue paying interest and principal payments in a timely
			 manner if such loans were renewed on substantially the same terms and
			 conditions; and</text>
				</paragraph><paragraph id="H8F4C99B928F649EEBE5693A178F5088D"><enum>(4)</enum><text display-inline="yes-display-inline">as a result of a suggestion or urging of,
			 or a requirement by, a Federal regulator that the institution reduce its
			 exposure to commercial mortgage loans or the determination by the institution
			 to require a reduction in the loan-to-value ratio upon any renewal of such
			 loans, either—</text>
					<subparagraph id="H61FC827F61FB4C04A4B8F6F6DEFABABE"><enum>(A)</enum><text display-inline="yes-display-inline">were not renewed at maturity under
			 substantially the same terms and conditions; or</text>
					</subparagraph><subparagraph id="HEF86C862F1D04F4DA943FFA02CBCE9C7"><enum>(B)</enum><text>were renewed at a
			 lower principal balance.</text>
					</subparagraph></paragraph></subsection><subsection id="HFA81C65D617242B98CCA8CE4EBEA70BF"><enum>(b)</enum><header>Publication of
			 report</header>
				<paragraph id="H0DC9474B7FA744B0A98B4F36858AFEBC"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 60
			 days after the end of each calendar quarter for which information is submitted
			 pursuant to subsection (a), the Board shall publish a report of the—</text>
					<subparagraph id="H2891CE71218F47239CC8E7055835DEE2"><enum>(A)</enum><text>the total amount
			 of all permanent commercial mortgage loans described in subsection (a) reported
			 to the Board under such subsection with respect to such quarter; and</text>
					</subparagraph><subparagraph id="H734D585C6575469EB4663CBCCCDC6378"><enum>(B)</enum><text display-inline="yes-display-inline">the ratio, expressed as a percentage, which
			 such loans in each of the following categories bear to the average permanent
			 amount of all commercial mortgage loans outstanding in each such
			 category:</text>
						<clause id="HAFD494FD581A4914BF073E450AA198C1"><enum>(i)</enum><text>The
			 United States as a whole.</text>
						</clause><clause id="HE47F1F2457D74401B9E9BF6F7C6F24D7"><enum>(ii)</enum><text>Each State (as
			 defined in section 3 of the Federal Deposit Insurance Act).</text>
						</clause><clause id="H3960EFAAD65F44E0954B62CD29FA6E98"><enum>(iii)</enum><text>Each type of
			 qualified financial institution.</text>
						</clause><clause id="H27B5AC5C13364C4BBEB29AD5D3ABD417"><enum>(iv)</enum><text>Each depository
			 institution holding company (as determined on a consolidated basis).</text>
						</clause><clause id="HC337C99A4F6F4035B5A6DD6DD8A1EE2E"><enum>(v)</enum><text>Each
			 qualified financial institution that is not controlled by or under common
			 control with a depository institution holding company.</text>
						</clause></subparagraph></paragraph><paragraph id="H7713E15CB4E54C1E8C583F500A2B510A"><enum>(2)</enum><header>Report to the
			 Congress</header><text>Each report published under paragraph (1) shall be
			 submitted by the Board to the Committee on Financial Services of the House of
			 Representatives, the Committee on Banking, Housing, and Urban Affairs of the
			 Senate, and the Joint Economic Committee of the Congress by the time of such
			 publication.</text>
				</paragraph><paragraph id="HE6E4FCB9805749E0902E62BF7E94FB98"><enum>(3)</enum><header>Public
			 availability</header><text>Each report published under paragraph (1) shall be
			 publicly available on the website maintained by the Board.</text>
				</paragraph></subsection><subsection id="H1F5591856A6A4163ACBE323CC36AFB41"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section, the following definitions shall apply:</text>
				<paragraph id="HAFF364175198462C921258E9ABAE814D"><enum>(1)</enum><header>Incorporated
			 definitions</header>
					<subparagraph id="HDC57A90357BE4F5D83FA8973D0B2C9D9"><enum>(A)</enum><header>Section
			 5</header><text>The terms <quote>Board</quote> and <quote>depository
			 institution</quote> have the same meaning as in section 5.</text>
					</subparagraph><subparagraph id="H81C99C34A2AD41B9871C35EF067F92FE"><enum>(B)</enum><header>Depository
			 institution holding company; subsidiary</header><text>The terms
			 <quote>depository institution holding company</quote> and
			 <quote>subsidiary</quote> have the same meanings as in section 3(w) of the
			 Federal Deposit Insurance Act.</text>
					</subparagraph></paragraph><paragraph id="H799A407F3ABE416BB4E6CC122734FFDC"><enum>(2)</enum><header>Qualified
			 financial institution</header><text display-inline="yes-display-inline">The
			 term <quote>qualified financial institution</quote> means any depository
			 institution and any subsidiary of a depository institution or a depository
			 institution holding company that makes permanent commercial mortgage loans or
			 holds permanent commercial mortgage loans, directly or indirectly.</text>
				</paragraph><paragraph id="HC87EE611DD0349FBA607BD3A62FA48C8"><enum>(3)</enum><header>State</header><text>The
			 term <quote>State</quote> has the same meaning as in section 3 of the Federal
			 Deposit Insurance Act.</text>
				</paragraph></subsection><subsection id="HF9EEBB89C3FD4CA6A65B52B4E193FBC1"><enum>(d)</enum><header>Sunset</header><text>This
			 section shall not apply after March 31, 2013.</text>
			</subsection></section><section id="H749BBBB7E7F1499194FBDFB7AFFAB06F"><enum>7.</enum><header>Study about
			 Federal regulators</header>
			<subsection id="H50E4880309364A6685E94261F90ABB38"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Treasury shall conduct a study to determine—</text>
				<paragraph id="H24814BE396504C779CB350EB435A3214"><enum>(1)</enum><text display-inline="yes-display-inline">whether Federal banking agencies (as
			 defined in section 5) and the Securities and Exchange Commission may have
			 exacerbated both—</text>
					<subparagraph id="H72EEAFB3ABF94C338471A7FE4B8671F9"><enum>(A)</enum><text>the excessive
			 expansion of commercial mortgage credit on overly generous terms that
			 contributed to a commercial real estate price bubble between 2004 and 2007;
			 and</text>
					</subparagraph><subparagraph id="H7EB93E88FA284BD89ED113E82D9B90D9"><enum>(B)</enum><text display-inline="yes-display-inline">the rapid contraction in the availability
			 of commercial mortgage credit on reasonable terms after the commercial real
			 estate price bubble burst through pro-cyclical evaluations of the value of
			 collateral by appraisers, depository institutions and other financial
			 institutions, and Federal banking agencies and the Securities and Exchange
			 Commission;</text>
					</subparagraph></paragraph><paragraph id="HC3E005E6DF874874A42B70BAC1161D8A"><enum>(2)</enum><text display-inline="yes-display-inline">whether modifications in formulation and
			 use of appraisals by appraisers, depository institutions and other financial
			 institutions, and Federal banking agencies and the Securities and Exchange
			 Commission, including providing greater weight to the cash flows associated
			 with mortgaged properties, along with any other modifications in regulatory
			 practices by Federal banking agencies and the Securities and Exchange
			 Commission, that the Secretary may deem appropriate would reduce this
			 pro-cyclical bias and provide a more even flow of commercial mortgage credit on
			 reasonable terms throughout the business cycle; and</text>
				</paragraph><paragraph id="HDAF36AF85F44494396658DF120DE7604"><enum>(3)</enum><text>what, if any,
			 changes to—</text>
					<subparagraph id="H7E44F11AD1FD4F9E9FAF1A4A2BA25909"><enum>(A)</enum><text>Federal laws or
			 regulations; and</text>
					</subparagraph><subparagraph id="H961498AF6A2D4B2AA1DD3915A5493E2E"><enum>(B)</enum><text>State laws or
			 regulations,</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">would be
			 necessary to accomplish these modifications.</continuation-text></paragraph></subsection><subsection id="HA4677C6DD683450D8F4E0C49C66A30F7"><enum>(b)</enum><header>Submittal to the
			 Congress</header><text display-inline="yes-display-inline">A report on the
			 study required under subsection (a) shall be submitted by the Secretary of the
			 Treasury to the Committee on Financial Services of the House of
			 Representatives, the Committee on Banking, Housing, and Urban Affairs of the
			 Senate, and the Joint Economic Committee of the Congress before the end of the
			 6-month period beginning on the date of the enactment of this Act.</text>
