		<legis-type>A BILL</legis-type>
		<official-title>To amend the Trade Act of 1974 to authorize the United
		  States Trade Representative to take discretionary action if a foreign country
		  is engaging in unreasonable acts, policies, or practices relating to the
		  environment, and for other purposes.</official-title>

		<section id="HAC10F99E373D413EAF8B961BCA1AB21B" section-type="section-one"><enum>1.</enum><header>Environmental protection in
			 trade relations</header><text display-inline="no-display-inline">Section
			 301(d)(3)(B) of the Trade Act of 1974 (19 U.S.C. 2411(d)(3)(B)) is
			 amended—</text>
			<paragraph id="H14FF13F53EAE40A4A519D26D3CA449D7"><enum>(1)</enum><text>in clause (ii), by
			 striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="H5FDE6A6BB5C940DB83D0B910B2B4EA58"><enum>(2)</enum><text>in clause
			 (iii)(V), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
			</paragraph><paragraph id="H38A436FDFD1A4989BC5073876F80B397"><enum>(3)</enum><text>by adding at the
			 end the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H6D688DF91100414E858D3BA80E09819B" style="OLC">
					<clause id="H8B6301C8C8304631AA5D04E1FA38E887"><enum>(iv)</enum><text>constitutes a
				persistent pattern of conduct that—</text>
						<subclause id="H2E3DEC618DA9476B8A9945047EDB4EFB"><enum>(I)</enum><text>fails to
				effectively enforce the environmental laws of a foreign country;</text>
						</subclause><subclause id="HDB4B971E9F29457083D4D59582684115"><enum>(II)</enum><text>waives or
				otherwise derogates from the environmental laws of a foreign country or weakens
				the protections afforded by such laws;</text>
						</subclause><subclause id="H59266598780044BBB344B8D8E8ADC046"><enum>(III)</enum><text>fails to provide
				for judicial or administrative proceedings giving access to remedies for
				violations of the environmental laws of a foreign country; or</text>
						</subclause><subclause id="H5047442EF6AD41DB90365634187ADE8A"><enum>(IV)</enum><text>fails to provide
				appropriate and effective sanctions or remedies for violations of the
				environmental laws of a foreign
				country.</text>
