		<section id="H71AAF9B7C9134130BC535B79F14DA3A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Jobs Through Environmental Safeguarding and Streamlining
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H617449C0BF6744FCB0D73DC898C6BC88"><enum>2.</enum><header>Surface
			 transportation project delivery pilot program</header>
			<subsection id="H2AF90F14715E4180B208EEF5883F1AE7"><enum>(a)</enum><header>Assumption of
			 responsibility</header>
				<paragraph id="H91FDF40D690945A0989467CBB74A3D66"><enum>(1)</enum><header>Additional
			 responsibility</header><text>Section 327(a)(2)(B)(ii)(I) of title 23, United
			 States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H570A51A028C04B218E3B450FFB0B2632" style="OLC">
						<subclause id="H7822CD7887504AAAAA01CABDE1E0C662"><enum>(I)</enum><text display-inline="yes-display-inline">responsibility for any conformity
				determination (other than a conformity determination for an individual project)
				required under section 176 of the Clean Air Act (42 U.S.C. 7506);
				or</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC0D071D93DD74CD8B69C9A76F1FC20AB"><enum>(2)</enum><header>Highway projects
			 involving more than one DOT modal administration</header><text>Section
			 327(a)(2) of such title is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6EBC672AE83040A5AFC1FDBF91EE3239" style="OLC">
						<subparagraph id="HB95120CD2322459F9DB76A31A91F4824"><enum>(F)</enum><header>Highway projects
				involving more than one DOT modal administration</header>
							<clause id="H2C8A9D18EDBD41A486246D8B356E80CB"><enum>(i)</enum><header>Treatment of
				projects</header><text>For purposes of subparagraph (A), a project shall be
				treated as a <quote>highway project</quote> if the Secretary determines that
				the Federal Highway Administration is the lead agency for the project.</text>
							</clause><clause id="HEB1A99169C7A42B08C12D0B6CACCA273"><enum>(ii)</enum><header>Assignment of
				authorities</header><text>In the case of a highway project that involves the
				Federal Highway Administration and another modal administration of the
				Department of Transportation, the authorities of the Secretary that may be
				assigned to a State under this subsection shall include the authorities of the
				Secretary that relate to the Federal Highway Administration and the other modal
				administration.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7151EF9081CF463589053892192EF9B2"><enum>(b)</enum><header>State
			 participation</header>
				<paragraph id="HD217816E2A184172A30D4101D0C3325F"><enum>(1)</enum><header>Number of
			 participating States</header><text>Section 327(b)(1) of such title is
			 amended—</text>
					<subparagraph id="H3B3C7BAF2C5D4F19938F5557737A7E5A"><enum>(A)</enum><text>in the paragraph
			 heading by striking <quote><header-in-text level="subsection" style="OLC">Number of participating States</header-in-text></quote> and
			 inserting <quote><header-in-text level="subsection" style="OLC">In
			 general</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HA3429AFEE561433A8748C8CCE17E92DE"><enum>(B)</enum><text>by striking
			 <quote>not more than 5</quote> and all that follows through
			 <quote>Texas)</quote> and inserting <quote>any State that meets the selection
			 criteria contained in paragraph (4)</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC5D87010AA3A4BABB68E93F6ADE40039"><enum>(2)</enum><header>Written
			 agreement</header><text>Section 327(c) of such title is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H069475D020D1448EBE9590F6810AF729" style="OLC">
						<subsection id="H6A20C6F2176447589E5326717168549A"><enum>(c)</enum><header>Written
				agreement</header>
							<paragraph id="H4D847F3B72FB4DF481DBDFDF953FECBA"><enum>(1)</enum><header>In
				general</header><text>A written agreement under this section shall—</text>
								<subparagraph id="HCC0B19CD142B4126AF6AF05781DDBB97"><enum>(A)</enum><text>be executed by the
				Governor or the top-ranking transportation official in the State who is charged
				with responsibility for highway construction;</text>
								</subparagraph><subparagraph id="H69CB3A7162454997838A72A00BFC3E30"><enum>(B)</enum><text>be in such form as
				the Secretary may prescribe;</text>
								</subparagraph><subparagraph id="H28417250ABDE478B97B1701B57AEC47A"><enum>(C)</enum><text>provide that the
				State—</text>
									<clause id="H0E5F5CCAA6894FB3A14CBA68CAF1493E"><enum>(i)</enum><text>agrees to assume
				all or part of the responsibilities of the Secretary described in subsection
				(a);</text>
									</clause><clause id="HBD92752BAC774364B4C405E77A3E03AB"><enum>(ii)</enum><text>agrees to carry
				out those responsibilities using the best available science;</text>
									</clause><clause commented="no" id="H33175E4FD7B345AA9B710A4E1EE1DFC6"><enum>(iii)</enum><text>expressly
				consents, on behalf of the State, to accept the jurisdiction of the Federal
				courts for the compliance, discharge, and enforcement of any responsibility of
				the Secretary assumed by the State;</text>
									</clause><clause id="H3F4705459A1B4FB3A02986845181CAC4"><enum>(iv)</enum><text>certifies that
				State laws (including regulations) are in effect that—</text>
										<subclause id="HD6CE49ED182643E4B977F7A5AFEDC729"><enum>(I)</enum><text>authorize the
				State to take the actions necessary to carry out the responsibilities being
				assumed; and</text>
										</subclause><subclause id="HDEFCA8691FFE418793A977EECE9A37C3"><enum>(II)</enum><text>are comparable to
				section 552 of title 5, including providing that any decision regarding the
				public availability of a document under those State laws is reviewable by a
				court of competent jurisdiction; and</text>
										</subclause></clause></subparagraph><subparagraph id="H8413C55D004242F984F8126AB18CC193"><enum>(D)</enum><text>agrees to maintain
				the financial resources necessary to carry out the responsibilities being
				assumed.</text>
								</subparagraph></paragraph><paragraph id="HEECA22B7B4714C3393D5C9AF7AA0BE64"><enum>(2)</enum><header>Excluded
				projects</header><text>A written agreement with a State under this section may
				include a list of projects in the State that are excluded from the program. The
				list shall be updated annually by mutual agreement between the Secretary and
				the State.</text>
							</paragraph><paragraph id="H2DA0145809514C00AD71AE6B67D60269"><enum>(3)</enum><header>Term</header><text>A
				written agreement with a State under this section shall—</text>
								<subparagraph id="H6646C15846264D47BAC418DAD6D127F8"><enum>(A)</enum><text>have a term of not
				more than 5 years; and</text>
								</subparagraph><subparagraph id="H20F2D11D75304698847BCC81656833FF"><enum>(B)</enum><text>be
				renewable.</text>
								</subparagraph></paragraph><paragraph id="H0B3F8DD8A9DB4D64B778DFC07299C50A"><enum>(4)</enum><header>Use of project
				delivery methods</header><text>A written agreement with a State under this
				section may not impose on the State a limitation on the use of a project
				delivery method if the limitation would not otherwise apply to the State under
				this title or another provision of law. In this paragraph, the term
				<quote>project delivery method</quote> includes the authority of a State to
				acquire rights-of-way and conduct final design work for a project with State
				funds on an at-risk basis prior to completion of the environmental review
				process for the
				project.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3A6E2BF99EFE48F3AACB31C8B8DFAE62"><enum>(3)</enum><header>Audits and
			 monitoring</header><text>Section 327(g) of such title is amended—</text>
					<subparagraph id="H8253EE21473D4863B5121D864F37EB79"><enum>(A)</enum><text>in the subsection
			 heading by inserting <quote><header-in-text level="subsection" style="OLC">and
			 monitoring</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Audits</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H7BB29F4E4417435F97EB3791A25F5C1F"><enum>(B)</enum><text>by redesignating
			 paragraph (2) as paragraph (3);</text>
					</subparagraph><subparagraph id="H50119133BD5F4A619AB84EAEB81E6FF8"><enum>(C)</enum><text>by inserting after
			 paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HE2AE387127B14A0FB00C04DAB68100B9" style="OLC">
							<paragraph id="H79BEC0EDF3EE40D181D9657EB71EC543"><enum>(2)</enum><header>Monitoring</header><text display-inline="yes-display-inline">If a State has been participating in the
				program pursuant to a written agreement under subsection (c) for a period of 10
				consecutive years, the Secretary may monitor compliance by the State with the
				agreement instead of conducting audits under paragraph (1). If a State, while
				participating in the monitoring program under this section, repeatedly fails to
				comply with all aspects of the written agreement under subsection (c), the
				Secretary shall commence the auditing process. The Secretary shall develop
				procedures for conducting monitoring under this
				paragraph.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H0A8EEAB857C54109B5CD4C35396592A7"><enum>(D)</enum><text>in paragraph (3)
			 (as redesignated by subparagraph (B) of this paragraph) by inserting after
			 <quote>paragraph (1)</quote> the following: <quote>, and the results of
			 monitoring conducted under paragraph (2),</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H8C1B7856F4674D4F946A0894C1BB9ABD"><enum>(c)</enum><header>Report to
			 Congress</header><text>Section 327(h) of such title is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1C37B6A78E304ED98EDBE8C1FAB16E4B" style="OLC">
					<subsection id="H55FA5F9F344642809F065A9172C586D0"><enum>(h)</enum><header>Report to
				Congress</header>
						<paragraph id="H0C5506ACF33C4567B87CE68DFC2FA027"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				the Jobs Through Environmental Safeguarding and Streamlining Act of 2010, and
				every 4 years thereafter, the Secretary shall submit to Congress, and make
				available to the public, a report on the results of the program.</text>
						</paragraph><paragraph id="HF9D62A10A903459A94B502A56EBA4080"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">For each reporting period, the report shall
				contain, at a minimum, the following:</text>
							<subparagraph id="H136B8B5CE6B545D1872B8BF0EC725A03"><enum>(A)</enum><text>An assessment of
				whether delays were reduced and project delivery was enhanced as a result of
				the program.</text>
							</subparagraph><subparagraph id="HA92CB4CF0EA749F0A3014B905F809F39"><enum>(B)</enum><text>An assessment of
				whether there were cost savings for States participating in the program and the
				Department of Transportation as a result of the program.</text>
							</subparagraph><subparagraph id="H5E9F2A9D78D64CF7BB17DC0C36CE5B23"><enum>(C)</enum><text>An assessment of
				whether environmental concerns were protected and considered in States
				participating in the program at a level consistent with nonparticipating
				States.</text>
							</subparagraph><subparagraph id="HE5D0BA727CB543678519662D108B58CA"><enum>(D)</enum><text>Recommendations
				for changes (if any) that could be made to enhance or improve the
				program.</text>
							</subparagraph><subparagraph id="HEBE645B0AE3A4A7EB13820C9176BC009"><enum>(E)</enum><text>An assessment of
				the impact and effectiveness of an environmental document quality control
				program of the transportation department of any State participating in the
				program.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF43426EE774D49779BCE84ABA44281B6"><enum>(d)</enum><header>Termination
			 date</header><text>Section 327(i)(1) of such title is amended by striking
			 <quote>date of enactment of this section</quote> and inserting <quote>date of
			 enactment of the Jobs Through Environmental Safeguarding and Streamlining Act
			 of 2010</quote>.</text>
			</subsection><subsection id="HAB457393A3D64811B4C0F174FCA840E0"><enum>(e)</enum><header>Demonstration
			 program</header><text display-inline="yes-display-inline">Section 327 of such
			 title is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE8CE3A70158B4905A3B14BDF4765EE63" style="OLC">
					<subsection commented="no" id="HF97E184057DF49889E3D95F42AFBE0A8"><enum>(j)</enum><header>Use of State
				environmental review laws for low impact projects</header>
						<paragraph commented="no" id="H9000A894742242B8BF116DFBDBD5D903"><enum>(1)</enum><header>Demonstration
				program</header><text display-inline="yes-display-inline">Subject to the
				requirements of this subsection, the Secretary shall carry out a demonstration
				program to permit eligible States that assume responsibilities of the Secretary
				under subsection (a)(2) to carry out the responsibilities through the
				implementation of the environmental laws of the State instead of Federal
				environmental laws.</text>
						</paragraph><paragraph commented="no" id="H2C92C4C678834A64B9BE4EB38752609A"><enum>(2)</enum><header>Limitation on
				State authority</header>
							<subparagraph commented="no" id="HCE1BF114B6ED4CC5BA4CF46DF4743766"><enum>(A)</enum><header>Limitation</header><text>The
				authority of a State under the demonstration program shall be limited to
				conducting the Secretary’s responsibilities for environmental reviews,
				consultation, and other requirements with respect to low impact
				projects.</text>
							</subparagraph><subparagraph commented="no" id="H9BE430F530694D418684F85316A848F7"><enum>(B)</enum><header>Low impact
				project defined</header><text>In this subsection, the term <quote>low impact
				project</quote> means a highway project that meets such criteria as may be
				established by the Secretary by regulation.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H79758863996545E28F4E9FCC472FEBBC"><enum>(3)</enum><header>Eligible
				States</header><text>The Secretary may permit a State to participate in the
				demonstration program only if the Secretary determines, after reviewing the
				environmental laws of the State, and such other materials as the Secretary may
				require, that—</text>
							<subparagraph commented="no" id="HC688DA8EF9BC41428AAEF981E010AD2D"><enum>(A)</enum><text>the environmental
				laws of the State provide a substantially equivalent level of environmental
				protection as applicable Federal laws; and</text>
							</subparagraph><subparagraph commented="no" id="H36BA0E65AAF4471288FD9D0C640BBD0C"><enum>(B)</enum><text>participation by
				the State in the demonstration program will not diminish protection of the
				environment.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H6D9A10E98A2348E586B7D428CC868C56"><enum>(4)</enum><header>Concurrence of
				other agencies</header><text>The Secretary may permit a State to participate in
				the demonstration program only with the concurrence of the Council on
				Environmental Quality, the Administrator of the Environmental Protection
				Agency, the Secretary of the Interior, the Secretary of Commerce, and the heads
				of other appropriate Federal environmental and natural resource agencies, as
				identified by the Secretary.</text>
						</paragraph><paragraph id="H59C56D4308BF4962AD4329057A9E2E5E"><enum>(5)</enum><header>Audits and
				monitoring</header><text>A State participating in the demonstration program
				shall continue to be subject to the requirements of subsection (g), including
				requirements relating to the public availability of audits and monitoring
				results.</text>
						</paragraph><paragraph commented="no" id="HA5EB423B6F144D5599C4332D3B120DC0"><enum>(6)</enum><header>Modification of
				written agreement</header><text>The Secretary shall provide for the
				participation of a State in the demonstration program by modifying the written
				agreement entered into by the Secretary with the State under subsection
				(c).</text>
						</paragraph><paragraph commented="no" id="HF192E591836C4BE6AF462EAB95404B0F"><enum>(7)</enum><header>Termination of
				State participation</header><text>The Secretary may terminate the participation
				of a State in the demonstration program in accordance with the procedures
				specified in subsection (i)(2).</text>
						</paragraph><paragraph commented="no" id="H92CD9C638B0949C18472B28FAD554252"><enum>(8)</enum><header>Report to
				Congress</header>
							<subparagraph id="H63E91A1A85F44664A84584EDDD72DD3E"><enum>(A)</enum><header>In
				general</header><text>Not later than one year after the date on which the first
				State is selected for participation in the demonstration program, and annually
				thereafter, the Secretary shall submit to Congress, and make available to the
				public, a report on the results of the demonstration program.</text>
							</subparagraph><subparagraph id="H844498D0E902444C83AFB7ABBC0E936A"><enum>(B)</enum><header>Contents</header><text>For
				each reporting period, the report shall contain, at a minimum, the
				following:</text>
								<clause id="HFD5C87FF4B12494F954165099EF0C57E"><enum>(i)</enum><text>A
				list identifying how many projects have been completed under the demonstration
				program.</text>
								</clause><clause id="H5FB8B4B0957B43BC87737986AEB9D4E7"><enum>(ii)</enum><text>An assessment of
				whether delays were reduced and project delivery was enhanced as a result of
				the demonstration program.</text>
								</clause><clause id="H180704C4FA444250ADE27D3C0591DF9F"><enum>(iii)</enum><text>An assessment of
				whether there have been any adverse impacts or risks to the environment as a
				result of the demonstration program.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="H1938B199AEDB43AA9F4B0F6D29A6F566"><enum>(9)</enum><header>Sunset
				date</header><text>The demonstration program shall terminate on the date that
				is 6 years after the date of enactment of this
				subsection.</text>
