		<official-title>To amend the Internal Revenue Code of 1986 to extend for
		  1 year the deduction for expenses of elementary and secondary school teachers
		  and to allow such deduction with respect to home school
		  expenses.</official-title>

		<section id="HEB3C3EA88E7D417AA038C15C3743E071" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Home School Equity Act for Tax Relief of
			 2010</short-title></quote>.</text>
		</section><section id="HFD5350B506964EA899F1517EDA3C2271"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H5508AEB150934626B5F49AE9DD176A22"><enum>(1)</enum><text display-inline="yes-display-inline">Over 1.5 million children, or about 3
			 percent of school-aged children, are home schooled in the United States each
			 year according to U.S. Department of Education’s National Center for Education
			 Statistics (NCES).</text>
			</paragraph><paragraph id="H32832966CED8489BACC6F33CF5872A8C"><enum>(2)</enum><text>The number of home
			 schooled children is increasing every year.</text>
			</paragraph><paragraph id="H05A0656AF47E44C68597ADAC79A8FFCA"><enum>(3)</enum><text>Many home
			 schooling families spend thousands of dollars on books, supplies, and other
			 teaching materials.</text>
			</paragraph><paragraph id="H2A60246A7D6843F0A674B0D6D6BEF099"><enum>(4)</enum><text>The median amount
			 of money spent annually on educational materials is about $400 to $599 per
			 home-educated student.</text>
			</paragraph><paragraph id="H02B7C85BD26E4CC6B8EB054160409AC2"><enum>(5)</enum><text>Home schooled
			 students have almost identical achievement statistics as students who are
			 products of the public school system.</text>
			</paragraph><paragraph id="H1CC5F118F9814A2CACFB84AE0B1EF3C0"><enum>(6)</enum><text>Home schooled
			 students perform at continually higher levels on nationalized tests like the
			 ACT and SAT.</text>
			</paragraph><paragraph id="HF0B0C0D441C144A990CCF84E6D38AA11"><enum>(7)</enum><text>Home schooling
			 families are typically larger than the average United States family with 3 or
			 more children.</text>
			</paragraph><paragraph id="H085D1C33D9F44EF194B8A2CA3A02136C"><enum>(8)</enum><text>In many
			 communities, home schooling is the only alternative to failing public
			 schools.</text>
			</paragraph><paragraph id="H1DAF1B61F2A0420D86344891DDCDBAFD"><enum>(9)</enum><text>Home school
			 students perform at exceptionally high levels regardless of level of
			 regulation, family income, and style of home schooling.</text>
			</paragraph><paragraph id="H7B11372BC228474D9F787E2828BE89F2"><enum>(10)</enum><text>Home schoolers
			 are allowed a tax deduction for school supply expenses in the States where home
			 schools are treated as private schools, but are not allowed this deduction in
			 States where home schools are given a different designation.</text>
			</paragraph></section><section id="H7BFA2424601747678CC492BFDB54CF10"><enum>3.</enum><header>Modification of
			 deduction for certain expenses of elementary and secondary school
			 teachers</header>
			<subsection id="H621302A01FE7434DB4C0D610736DE683"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Subparagraph (D) of section 62(a)(2) of the
			 Internal Revenue Code of 1986 is amended by striking <quote>or 2009</quote> and
			 inserting <quote>2009, or 2010</quote>.</text>
			</subsection><subsection id="HD0FF1F63AB8D430894C96F4EE8D07335"><enum>(b)</enum><header>Home schools
			 included</header><text>Subparagraph (B) of section 62(d)(1) of such Code is
			 amended—</text>
				<paragraph id="HED1C26447E334C23AAB201BA5B6ADDD8"><enum>(1)</enum><text>by striking
			 <quote>The term</quote> and inserting the
			 following:</text>

						<text>For purposes of this
			 paragraph—</text><clause id="H790F72F576384FF69C5F3D14D3C2F1F7"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The
				term</text>
						</clause><after-quoted-block>,
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF78288E4B7B44EE3A66D43F4EC8EF51C"><enum>(2)</enum><text>by adding at the
			 end the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="H861D29A6AB3C478FA11DD2B17DEF11A1" style="OLC">
						<clause id="H23BF386908FD4677AEB0A9AA243ABF61"><enum>(ii)</enum><header>Home
				schools</header><text display-inline="yes-display-inline">The term
				<quote>school</quote> includes any home school which provides elementary or
				secondary education if such school is treated as a home school or private
				school under State
				law.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H53778488FA0A445BB4F76496D8DD6C92"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2009.</text>
