		<section id="HB3DCF1BE36A24E20B7F14726F5D7857E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Air Cargo Security Act of
			 2010</short-title></quote>.</text>
		</section><section id="H178D76DB70FC429E935FD4B5B656EC6C"><enum>2.</enum><header>Federal air cargo
			 screening program</header><text display-inline="no-display-inline">Section
			 44901 of title 49, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block id="H2E44C34417D34C399292EEC3B9A285ED" style="OLC">
				<subsection id="H97EC3325E11548458A9CB72DFC18634C"><enum>(l)</enum><header>Federal air
				cargo screening program</header>
					<paragraph id="HBA1C291535584B508E5416D1B9427985"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than one
				year after the date of enactment of this subsection, the Secretary of Homeland
				Security, acting through the Assistant Secretary of Homeland Security
				(Transportation Security Administration), shall establish and operate, at each
				airport in the United States that serves passengers, Federal air cargo
				screening centers for the screening of cargo transported on passenger aircraft
				operated by an air carrier or foreign air carrier in air transportation or
				intrastate air transportation.</text>
					</paragraph><paragraph id="HAF5443B9C72442EBB8D280C8296E943D"><enum>(2)</enum><header>Minimum
				standards</header><text>The Assistant Secretary shall establish standards for
				the equipment, technology, procedures, personnel, and methods utilized to
				conduct screening pursuant to this subsection. The standards shall provide a
				level of security commensurate with the level of security for the screening of
				passenger checked baggage.</text>
					</paragraph><paragraph id="H922F4116B66D4C919ABC8A11249F417B"><enum>(3)</enum><header>Coordination
				with other air cargo security programs</header><text>The Assistant Secretary
				shall ensure that the screening conducted pursuant to this subsection is
				coordinated with the Certified Cargo Screening Program and any other air cargo
				security program established under subsection (g).</text>
					</paragraph><paragraph id="HDA471D2FAFCE47E4888925F089050BD3"><enum>(4)</enum><header>Authority to
				contract</header><text>The Assistant Secretary is authorized to enter into
				contracts with nongovernmental entities (including air carriers and foreign air
				carriers) to conduct air cargo screening pursuant to this subsection.</text>
					</paragraph><paragraph id="HDC37898665BA4173A35A84D91E8A0816"><enum>(5)</enum><header>Air cargo
				screening fee</header>
						<subparagraph id="H50487012A4E345E39E1A25033F9E0D51"><enum>(A)</enum><header>In
				general</header><text>The Assistant Secretary shall impose and collect a
				uniform fee for air cargo screening pursuant to this subsection in an amount
				that the Assistant Secretary estimates will result in an aggregate collection
				of fees equal to the amount the Assistant Secretary estimates for the following
				costs:</text>
							<clause id="HDCB8E999C2FD48CE95B7464F7CABBE4F"><enum>(i)</enum><text>The salary,
				benefits, overtime, retirement, and other costs relating to screening
				personnel, the supervisors and managers of such personnel, and Federal law
				enforcement personnel deployed at Federal air cargo screening centers
				established under this subsection.</text>
							</clause><clause id="H683FBA1094044254A3A2C5B15BA99BC3"><enum>(ii)</enum><text>The costs of
				training personnel deployed at Federal air cargo screening centers established
				under this subsection and the acquisition, operation, and maintenance of
				equipment used by such personnel.</text>
							</clause><clause id="H1F99E251E24E41E9AF73418D4D3A0A2E"><enum>(iii)</enum><text>The costs of
				performing background investigations of personnel deployed at Federal air cargo
				screening centers established under this subsection.</text>
							</clause><clause id="H5DCDE85B0FF84D30B32DAD5E5B5D5FA5"><enum>(iv)</enum><text display-inline="yes-display-inline">The costs of capital improvements relating
				to air cargo screening at airports.</text>
							</clause><clause id="H2754FCAA0522486996E805A6A36B12ED"><enum>(v)</enum><text display-inline="yes-display-inline">Any other costs the Assistant Secretary
				considers necessary and appropriate.</text>
							</clause></subparagraph><subparagraph id="H1E2C975E8A2F4584ADD5444C54E528D0"><enum>(B)</enum><header>Imposition of
				fees</header>
							<clause id="H75A104F3CCF84761BB9261E9913161FC"><enum>(i)</enum><header>In
				general</header><text>The Assistant Secretary shall impose the fee under
				subparagraph (A) after publication of notice of such fee in the Federal
				Register and shall begin the collection of fees not later than one year after
				the date of enactment of this subsection.</text>
							</clause><clause id="HAFD1150E0D2247069429B829DD2DA3EE"><enum>(ii)</enum><header>Subsequent
				modification of fees</header><text>The Assistant Secretary may modify, after
				publication of notice of such modification in the Federal Register, the
				imposition or collection of fees under subparagraph (A).</text>
							</clause><clause id="H000589937E0E4049BB7DF0B139967B27"><enum>(iii)</enum><header>Limitation on
				collection</header><text>No fee may be collected pursuant to subparagraph (A)
				unless the fee is related to the payment of the costs specified in such
				subparagraph.</text>
							</clause></subparagraph><subparagraph id="HA3DB59D5E49D4CA59648E8BBBC961A95"><enum>(C)</enum><header>Administration
				of fees</header>
							<clause id="H6B3C24EE1DBB4668B8166660B6285990"><enum>(i)</enum><header>Deposit of
				amounts collected</header><text>Amounts collected from the fee imposed under
				subparagraph (A) shall be deposited in the Air Cargo Security Fund established
				under paragraph (6).</text>
							</clause><clause id="H5898A1F656754F2195FE675D3437EB89"><enum>(ii)</enum><header>Fees not
				subject to tax</header><text>For purposes of section 4261 of the Internal
				Revenue Code of 1986, a fee imposed under subparagraph (A) shall not be treated
				as an amount paid for taxable transportation.</text>
							</clause></subparagraph><subparagraph id="H59AE1CCB8E594B2F92028DE21390529E"><enum>(D)</enum><header>Receipts
				credited as offsetting collections</header><text>Notwithstanding section 3302
				of title 31, United States Code, any fee collected pursuant to subparagraph
				(A)—</text>
							<clause id="HFFA0A45064A64772A796146EE7FC8C45"><enum>(i)</enum><text>shall be credited
				as offsetting collections to the account that finances the activities and
				services for which the fee is imposed; and</text>
							</clause><clause id="HB4F991EA61C1449EB2AD14B391BC48B8"><enum>(ii)</enum><text>shall be
				available for expenditure without further appropriation only to pay the costs
				of activities and services for which the fee is imposed.</text>
							</clause></subparagraph><subparagraph id="H91CCC19A1B1C4DFCA629969732CED057"><enum>(E)</enum><header>Refunds</header><text>The
				Assistant Secretary may refund a fee paid pursuant to subparagraph (A) by
				mistake or in excess of that required.</text>
						</subparagraph></paragraph><paragraph id="H7BAEBF78D1304E09AFB2F9815117081E"><enum>(6)</enum><header>Air cargo
				security fund</header>
						<subparagraph id="H88F863CAB9CC41CDACAAD6B3CF9C3E2A"><enum>(A)</enum><header>Establishment</header><text>There
				is established in the Department of Homeland Security a fund to be known as the
				<quote>Air Cargo Security Fund</quote> consisting of amounts deposited under
				paragraph (5)(C)(i).</text>
						</subparagraph><subparagraph id="H1D3969A16FE94122BEE6306E55B5E79B"><enum>(B)</enum><header>Availability of
				amounts</header><text>Amounts in the Air Cargo Security Fund shall remain
				available until expended by the Assistant Secretary for the costs specified in
				paragraph (5)(A).</text>
						</subparagraph></paragraph><paragraph id="H22714BE8EA364AD3899017FAEF9DFD6C"><enum>(7)</enum><header>Screening
				defined</header><text>In this subsection, the term <quote>screening</quote> has
				the same meaning given the term under subsection
				(g)(5).</text>
