		<official-title>To amend the Internal Revenue Code of 1986 to allow
		  Indian tribes to receive charitable contributions of apparently wholesome
		  food.</official-title>

		<section id="H1DABA73F3A2F4CFBBE8D24644AFABB49" section-type="section-one"><enum>1.</enum><header>Charitable contributions of
			 apparently wholesome food to Indian tribes</header>
			<subsection id="H6D1697B56FF04B569216AA569263104B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 170(e)(3) of
			 the Internal Revenue Code of 1986 is amended—</text>
				<paragraph id="H730336CCC4C04C749FA2C7EB21497BDF"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (E) as
			 subparagraph (F), and</text>
				</paragraph><paragraph id="H22BCE1EC2B074E87B8E5BA8C50B9F0DC"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (D) the
			 following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H57B9B1D5C4C94F24944F52C0B3A0046B" style="OLC">
						<subparagraph id="H6E120A1A82344154ACFE18A9A2C1BABA"><enum>(E)</enum><header>Special rule for
				Indian tribes</header>
							<clause id="H61E408CDB32844BF92460B585DF6B6AF"><enum>(i)</enum><header>In
				general</header><text>For purposes of this paragraph, an Indian tribe (as
				defined in section 7871(c)(3)(E)(ii)) shall be treated as an organization
				eligible to be a donee under subparagraph (A) with respect to apparently
				wholesome food (as defined in section 22(b)(2) of the Bill Emerson Good
				Samaritan Food Donation Act (42 U.S.C. 1791(b)(2)) (as in effect on the date of
				the enactment of this subparagraph)) only.</text>
							</clause><clause id="H18A9E4185BA741DB800B97FBE1DFB203"><enum>(ii)</enum><header>Use of
				property</header><text>For purposes of subparagraph (A)(i), if the use of the
				apparently wholesome food donated is related to the exercise of an essential
				governmental function of the Indian tribal government (within the meaning of
				section 7871), such use shall be treated as related to the purpose or function
				constituting the basis for the organization's
				exemption.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA9A32722093C46959D1CAB026174D3C5"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2009.</text>
