		<section id="H193C7FA95245440F86F502E8FCB77C0B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nursing Home Patient Protection and
			 Standards Act</short-title></quote>.</text>
		</section><section commented="no" id="HEC09FBE5037C4D4F959CE46323B936E1" section-type="subsequent-section"><enum>2.</enum><header>Improving the rigor of
			 testing for surveyors</header>
			<subsection commented="no" id="HDDB90AAFD3ED4F86ABAE425FEF623866"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2)(E)(iii) of the Social
			 Security Act (42 U.S.C. 1395i–3(g)(2)(E)(iii)) is amended by adding the
			 following at the end: <quote>The testing program must be sufficiently rigorous
			 (as determined by the Secretary) to ensure that surveyors are adequately
			 prepared to survey and certify facilities in a consistent and accurate
			 manner.</quote></text>
			</subsection><subsection commented="no" id="HFEB59323888C4D369C1EFB3808F9A18E"><enum>(b)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919(g)(2)(E)(iii) of the Social
			 Security Act (42 U.S.C. 1396r(g)(2)(E)(iii)) is amended by adding the following
			 at the end: <quote>The testing program must be sufficiently rigorous (as
			 determined by the Secretary) to ensure that surveyors are adequately prepared
			 to survey and certify facilities in a consistent and accurate
			 manner.</quote></text>
			</subsection></section><section id="H18829D73BD894B9AA78357582D8F487E" section-type="subsequent-section"><enum>3.</enum><header>Ensuring adequate
			 staffing and training for State surveys of nursing homes</header>
			<subsection id="H8BCD599F9EED40059D316B85D832A8C5"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2)(E) of the Social
			 Security Act (42 U.S.C. 1395i–3(g)(2)(E)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HFB06632628954D9FB2F79CC38F298F0F" style="OLC">
					<clause id="H23E2F8E4848D4A2A8E72291A4A836ED3"><enum>(iv)</enum><header>Adequate
				qualified staff for survey teams</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
				advisory committee under subparagraph (F), shall establish requirements—</text>
						<subclause id="H0C844E1750284C3D98B668C25233D3BB"><enum>(I)</enum><text>for the
				qualifications and compensation of members of a survey team under this
				subsection; and</text>
						</subclause><subclause id="H72AF49DCEBC040A08D24BA1B3DFF09D9"><enum>(II)</enum><text>that a State
				employs an adequate number of individuals as members of survey teams to ensure
				adequate oversight of skilled nursing facilities.</text>
						</subclause></clause><clause id="H8CD351A88A894469B21C9B9D6D4D3CA5"><enum>(v)</enum><header>Continuing
				education</header><text display-inline="yes-display-inline">In addition to the
				training and testing program required under clause (iii), the Secretary shall
				require that State and Federal surveyors regularly complete an adequate amount
				(as determined by the Secretary) of continuing education courses that meet
				requirements determined by the Secretary for content and the rigor of the
				material covered by such courses. An individual shall not serve as a member of
				a survey team unless the individual is in compliance with the requirements of
				this
				clause.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD8F4051677974FA7B4E31A497B9512DE"><enum>(b)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919(g)(2)(E) of the Social
			 Security Act (42 U.S.C. 1396r(g)(2)(E)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H1BA5DE04C03D4EF2A592FCA31B94E2C0" style="OLC">
					<clause id="H7325C38EED4344BE9ED5AFCEF9F421C5"><enum>(iv)</enum><header>Adequate
				qualifed staff for survey teams</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
				advisory committee under subparagraph (F), shall establish requirements—</text>
						<subclause id="H3B067EE7B09F4D108D8B90BDF4F179D6"><enum>(I)</enum><text>for the
				qualifications and compensation of members of a survey team under this
				subsection; and</text>
						</subclause><subclause id="HEFCA88A705F14CF8B757C2723F352E45"><enum>(II)</enum><text>that a State
				employs an adequate number of individuals as members of survey teams to ensure
				adequate oversight of nursing facilities.</text>
						</subclause></clause><clause id="H762EF5CEFCDC45ABB462CE802EC157CF"><enum>(v)</enum><header>Continuing
				education</header><text display-inline="yes-display-inline">In addition to the
				training and testing program required under clause (iii), the Secretary shall
				require that State and Federal surveyors regularly complete an adequate amount

			</subsection></section><section id="H3E91C9786F9C43CB80E1BAEF6F2603DC"><enum>4.</enum><header>Ensuring the
			 independence and impartiality of surveyors</header>
			<subsection commented="no" id="H1F13C6572A0846F5BA943C53C465F059"><enum>(a)</enum><header>Whistle blower
			 protections</header>
				<paragraph commented="no" id="H44A0C11FB9814BD094760BC732B4A388"><enum>(1)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g) of the Social Security Act
			 (42 U.S.C. 1395i–3(g)) is amended by adding the following at the end:</text>
					<quoted-block display-inline="no-display-inline" id="H70199D46671344778CE36F7D74619017" style="OLC">
						<paragraph commented="no" id="HDF9D0CFC682E4938B004334788662DA0"><enum>(6)</enum><header>Reporting of
				inaccuracies</header>
							<subparagraph commented="no" id="H7FD1025914054F3F82D4E75DF0A6E2BF"><enum>(A)</enum><header>Reporting
				requirement</header><text display-inline="yes-display-inline">A covered
				individual shall report to the Secretary any instance in which the individual
				suspects that—</text>
								<clause commented="no" id="HDCB180265E3F4A659B6B1F7759BCFCDA"><enum>(i)</enum><text>a survey under
				this subsection fails to report or under reports an issue in a facility that
				could impact the safety or quality of care of the residents in such facility;
				or</text>
								</clause><clause commented="no" id="H76B450EBE1774A25BC70A86BA38C9DC0"><enum>(ii)</enum><text display-inline="yes-display-inline">a member of the survey team or an employee
				of the State survey agency was inappropriately induced (through the offering of
				monetary awards or through undue pressure) to alter the results of the
				survey.</text>
								</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H0700F36192244140B1E38C445B27E2D1"><enum>(B)</enum><header>Responses to
				report</header><text display-inline="yes-display-inline">If the Secretary
				receives a report under
				<internal-xref idref="H110F59837FDA48BAB96BD7E04CE895A8" legis-path="(6)(A)">subparagraph (A)</internal-xref>, the Secretary shall take
				appropriate action, as determined by the Secretary, to ensure the accuracy of
				the survey.</text>
							</subparagraph><subparagraph commented="no" id="H10F7C1B76A824B71BEE3D09EFBE17A9C"><enum>(C)</enum><header>Whistle blower
				protections</header><text>With respect to a covered individual, a State may
				not—</text>
								<clause commented="no" id="HE1FEA859D5284F898E7BA5BA11560182"><enum>(i)</enum><text>discharge, demote,
				suspend, threaten, harass, or deny a promotion or other employment-related
				benefit to such individual, or in any other manner discriminate against an
				individual in the terms and conditions of employment because the individual
				submitted a report under subparagraph (A); or</text>
								</clause><clause commented="no" id="H36484B4D76654519A8351F7E342C2114"><enum>(ii)</enum><text display-inline="yes-display-inline">file a complaint or a report against the
				individual with the appropriate State professional disciplinary agency because
				the individual submitted a report under subparagraph (A).</text>
								</clause></subparagraph><subparagraph commented="no" id="HEAB9AF3820E8455CAB30E631650F34B4"><enum>(D)</enum><header>Remedy for
				violations</header><text display-inline="yes-display-inline">If the Secretary
				finds that a State has violated the prohibitions under
				<internal-xref idref="H10F7C1B76A824B71BEE3D09EFBE17A9C" legis-path="(6)(C)">subparagraph (C)</internal-xref>, the Secretary shall
				provide for an appropriate remedy.</text>
							</subparagraph><subparagraph commented="no" id="H23B9DF6FE16B49CDBB30172D1018FA6B"><enum>(E)</enum><header>Requirement to
				post notice</header><text display-inline="yes-display-inline">Each State shall
				post conspicuously in an appropriate location a sign (in a form specified by
				the Secretary) specifying the rights of covered individuals under this section.
				Such sign shall include a statement that a covered individual may file a
				complaint with the Secretary against the State for violating the provisions of
				this paragraph and information with respect to the manner of filing such a
				complaint. <italic></italic></text>
							</subparagraph><subparagraph commented="no" id="H4F178AA962FD422F8592B7589D84194A"><enum>(F)</enum><header>Covered
				individual defined</header><text display-inline="yes-display-inline">For
				purposes of this paragraph, the term <term>covered individual</term> means an
				individual—</text>
								<clause commented="no" id="H0CD51E1332AB473CAD4E82F15257406A"><enum>(i)</enum><text>who is a member of
				a State survey team under this subsection; or</text>
								</clause><clause commented="no" id="H28AE6FE47A6C4B378631B0F788CCCB7C"><enum>(ii)</enum><text>who is an
				employee of the State department or agency that conducts surveys under this
				section.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H75F616F05C424F97A48DA756D56C714E"><enum>(2)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919(g) of the Social Security Act
			 (42 U.S.C. 1396r(g)) is amended by adding the following at the end:</text>
					<quoted-block display-inline="no-display-inline" id="H50C9FBC6662A481B80C655F45F78FEF1" style="OLC">
						<paragraph commented="no" id="H6E1860824CB84AD6B7A861A31BC59433"><enum>(6)</enum><header>Reporting of
				inaccuracies</header>
							<subparagraph commented="no" id="H110F59837FDA48BAB96BD7E04CE895A8"><enum>(A)</enum><header>Reporting
				requirement</header><text display-inline="yes-display-inline">A covered
				individual shall report to the Secretary any instance in which the individual

				survey.</text>
								</clause></subparagraph><subparagraph id="H684EE888D0D048C2AE74E3DCCABA4672"><enum>(B)</enum><header>Response to
				reports</header><text display-inline="yes-display-inline">If the Secretary
				receives a report under
				<internal-xref idref="H110F59837FDA48BAB96BD7E04CE895A8" legis-path="(6)(A)">subparagraph (A)</internal-xref>, the Secretary shall take
				appropriate action, as determined by the Secretary, to ensure the accuracy of
				the survey.</text>
							</subparagraph><subparagraph commented="no" id="HA5D06A8A76694C8EA0402889FF01C0A1"><enum>(C)</enum><header>Whistle blower
				protections</header><text>With respect to a covered individual, a State may
				not—</text>
								<clause commented="no" id="HFF3D1E6FC30B4184B056F47B5B7FD3FB"><enum>(i)</enum><text>discharge, demote,
				suspend, threaten, harass, or deny a promotion or other employment-related
				benefit to such individual, or in any other manner discriminate against an
				individual in the terms and conditions of employment because the individual
				submitted a report under subparagraph (A); or</text>
								</clause><clause commented="no" id="HD723BF91CBA04987AA19FB3CB2927BEC"><enum>(ii)</enum><text display-inline="yes-display-inline">file a complaint or a report against the
				individual with the appropriate State professional disciplinary agency because
				the individual submitted a report under subparagraph (A).</text>
								</clause></subparagraph><subparagraph commented="no" id="HDB11A96861C649B8B0907D1906AD2769"><enum>(D)</enum><header>Penalties for
				retaliation</header><text display-inline="yes-display-inline">If the Secretary
				finds that a State has violated the prohibitions under
				<internal-xref idref="HA5D06A8A76694C8EA0402889FF01C0A1" legis-path="(6)(C)">subparagraph (C)</internal-xref>, the Secretary shall
				provide for a reduction of the payment otherwise made to the State under
				section 1903(a)(7), with respect to a quarter, equal to 5 percent. A State that
				is dissatisfied with the Secretary’s findings under this subparagraph may
				obtain reconsideration and review of the findings under section 1116 in the
				same manner as a State may seek reconsideration and review under that section
				of the Secretary’s determination under section 1116(a)(1).</text>
							</subparagraph><subparagraph commented="no" id="HEF28618DF4FE40C0AD13589D26A33674"><enum>(E)</enum><header>Requirement to
				post notice</header><text display-inline="yes-display-inline">Each State shall
				post conspicuously in an appropriate location a sign (in a form specified by
				the Secretary) specifying the rights of covered individuals under this section.
				Such sign shall include a statement that a covered individual may file a
				complaint with the Secretary against the State for violating the provisions of

								</clause><clause commented="no" id="HCBFE38CBF65B442A862E7290D05A3CA7"><enum>(ii)</enum><text>who is an
				employee of the State department or agency that conducts surveys under this
				section.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBAFA9DAA45D9401FBA6B509877AA4CBF"><enum>(b)</enum><header>Penalties for
			 inappropriately influencing a surveyor</header>
				<paragraph display-inline="no-display-inline" id="HB93D4FBBAC5E42BDAAD14FC9B644B1BD"><enum>(1)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2)(E) of the Social
			 Security Act (42 U.S.C. 1395i–3(g)(2)(E)), as amended by
			 <internal-xref idref="H8BCD599F9EED40059D316B85D832A8C5" legis-path="2.(a)">section 3(a)</internal-xref>, is further amended by adding
			 the following at the end:</text>
					<quoted-block display-inline="no-display-inline" id="H64C35F9B73C045BB9AB952DA6D5B5AEA" style="OLC">
						<clause id="HA5247C09D40D4C578537FAA7EB12F411"><enum>(vi)</enum><header>Penalties for
				inappropriately influencing a surveyor</header><text display-inline="yes-display-inline">Any individual (including an employee of a
				skilled nursing facility or any affiliated corporate entity, a representative
				of the skilled nursing facility industry, a member of a State survey team, an
				employee of the State department or agency that conducts surveys under this
				section, or an elected official) who attempts to inappropriately influence, as
				determined by the Secretary through regulations, the results of a survey under
				this subsection or the actions of a member of a survey team or an employee of a
				survey agency under this subsection shall be subject to a civil money penalty
				not to exceed $10,000. The provisions of section 1128A (other than subsections
				(a) and (b)) shall apply to a civil money penalty under the previous sentence
				in the same manner as such provisions apply to a penalty or proceeding under
				section 1128A(a).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H069D9B1A9A3A448889D647515376C3A0"><enum>(2)</enum><header>Medicaid</header><text>Section
			 1919(g)(2)(E) of the Social Security Act (42 U.S.C. 1396r(g)(2)(E)), as amended
			 by <internal-xref idref="HD8F4051677974FA7B4E31A497B9512DE" legis-path="2.(b)">section 3(b)</internal-xref>, is further amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H13007FBA5AE74F53BC0BC7B4350DA431" style="OLC">
						<clause id="HD1A61978C3824CA5880DB248D5525BF9"><enum>(vi)</enum><header>Penalties for
				inappropriately influencing a surveyor</header><text display-inline="yes-display-inline">Any individual (including an employee of a
				nursing facility or any affiliated corporate entity, a representative of the
				nursing facility industry, a member of a State survey team, an employee of the
				State department or agency that conducts surveys under this section, or an
				elected official) who attempts to inappropriately influence, as determined by
				the Secretary through regulations, the results of a survey under this
				subsection or the actions of a member of a survey team or an employee of a
				survey agency under this subsection shall be subject to a civil money penalty

				</paragraph><paragraph id="H969DF22E3C5749ABB411C7241EE41DA4"><enum>(3)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H6ED19F7FDB58478CB6C77BCD97E493D9"><enum>(A)</enum><text>Section
			 1819(f)(2)(B)(iii)(I)(c) of the Social Security Act is amended by inserting
			 <quote>, a civil monetary penalty described in section 1919(g)(2)(E)(vi) of not
			 less than $10,000</quote> after <quote>of not less than $5,000</quote>.</text>
					</subparagraph><subparagraph id="HF5FA1BAD5B1A4D439DF2052318F6C647"><enum>(B)</enum><text display-inline="yes-display-inline">Section 1919(f)(2)(B)(iii)(I)(c) of the
			 Social Security Act is amended by inserting <quote>, a civil monetary penalty
			 described in (g)(2)(E)(vi) of not less than $10,000</quote> after <quote>of not
			 less than $5,000</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H1CB4CE264DB84C68998C081B5E07F9CE"><enum>5.</enum><header>Advisory
			 committee</header>
			<subsection id="H4A212342B53841DC8199B68CEB066678"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2) of the Social Security
			 Act (42 U.S.C. 1395i–3(g)(2)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF16D0BA2CD8C49258838E62291DC29D8" style="OLC">
					<subparagraph id="H84256D7951D34E91A7E81046276CFDB9"><enum>(F)</enum><header>Advisory
				Committee</header>
						<clause id="HE28F3D7123D240F3B64805D8135AEB52"><enum>(i)</enum><header>Establishment</header><text>The
				Secretary shall establish an advisory committee on surveys under this
				paragraph.</text>
						</clause><clause id="H185A679390074CAAA8A4AE07866A9CAC"><enum>(ii)</enum><header>Membership</header><text>The
				membership of the advisory committee under
				<internal-xref idref="HE28F3D7123D240F3B64805D8135AEB52" legis-path="(G)(i)">clause (i)</internal-xref> shall include advocates for
				residents of skilled nursing facilities, members of survey teams under this
				subsection, and nursing home administrators, directors of nursing, registered
				nurses, and other skilled nursing facility stakeholders.</text>
						</clause><clause id="H478A704D6C5A43C89BC54A2572DBD697"><enum>(iii)</enum><header>Recommended
				standards</header><text>The advisory committee under
				<internal-xref idref="HE28F3D7123D240F3B64805D8135AEB52" legis-path="(G)(i)">clause (i)</internal-xref> shall make recommendations to
				the Secretary on standards for—</text>
							<subclause id="HAEA051411386420CB2F7859093A4186B"><enum>(I)</enum><text>the adequate
				staffing of survey teams under this subsection;</text>
							</subclause><subclause id="HA66571EF9EA1437B898F67448C113FBE"><enum>(II)</enum><text>the training of
				members of such teams; and</text>
							</subclause><subclause id="HCA43FFDEAC4F494DA1975D8F3C98CBF3"><enum>(III)</enum><text>disclosing any
				contact between such members and individuals associated with skilled nursing
				facilities, and limiting such contact to prevent inappropriate influence of
				such members by such individuals.</text>
							</subclause></clause><clause id="HD8B49452B9E142888839C35FFD0C77E5"><enum>(iv)</enum><header>Other
				recommendations</header><text>The advisory committee under
				<internal-xref idref="HE28F3D7123D240F3B64805D8135AEB52" legis-path="(G)(i)">clause (i)</internal-xref> may also make recommendations to
				the Secretary on any other issue that would improve the survey process under
				this
				paragraph.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H87376D96FBD14F669ECA43931E82B1AF"><enum>(b)</enum><header>Medicaid</header><text display-inline="yes-display-inline">Section 1919(g)(2) of the Social Security
			 Act (42 U.S.C. 1396r(g)(2)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H8402C8F3D0F9461B948736B12A8728C8" style="OLC">
					<subparagraph id="HE2EFC0A7EF7846648CB332AEDE1A68BB"><enum>(F)</enum><header>Advisory
				Committee</header>
						<clause id="H5AEEC77DCB10460B802FEF290F7ACD9B"><enum>(i)</enum><header>Establishment</header><text>The
				Secretary shall establish an advisory committee on surveys under this
				paragraph.</text>
						</clause><clause id="H6267A545C9794117BB1195A6B6883A65"><enum>(ii)</enum><header>Membership</header><text display-inline="yes-display-inline">The membership of the advisory committee
				under
				<internal-xref idref="H5AEEC77DCB10460B802FEF290F7ACD9B" legis-path="(G)(i)">clause (i)</internal-xref> shall include advocates for
				residents of nursing facilities, members of survey teams under this subsection,
				and nursing home administrators.</text>
						</clause><clause id="H94A068ED86774D009AF0FFE347EFD827"><enum>(iii)</enum><header>Recommended
				standards</header><text>The advisory committee under
				<internal-xref idref="H5AEEC77DCB10460B802FEF290F7ACD9B" legis-path="(G)(i)">clause (i)</internal-xref> shall make recommendations to
				the Secretary on standards for—</text>
							<subclause id="H3833265D65E148D5925C04063C440EE9"><enum>(I)</enum><text>the adequate
				staffing of survey teams under this subsection;</text>
							</subclause><subclause id="H44ECD17F0C6E444DB3A9CC92F981C07C"><enum>(II)</enum><text>the training of
				members of such teams; and</text>
							</subclause><subclause id="H28387138F1244459AB63D6B718BE10FB"><enum>(III)</enum><text>disclosing any
				contact between such members and individuals associated with nursing
				facilities, and limiting such contact to prevent inappropriate influence of
				such members by such individuals.</text>
							</subclause></clause><clause id="H238023AD911B4EBD891CCF127DC4CF70"><enum>(iv)</enum><header>Other
				recommendations</header><text>The advisory committee under
				<internal-xref idref="H5AEEC77DCB10460B802FEF290F7ACD9B" legis-path="(G)(i)">clause (i)</internal-xref> may also make recommendations to
				the Secretary on any other issue that would improve the survey process under
				this
				paragraph.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 surveys</header>
			<subsection id="H5EB6F4495FFE4B8EBB2079A68A148612"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1819(g)(2)(D) of the Social
			 Security Act (42 U.S.C. 1395i–3(g)(2)(D)) is amended—</text>
