<section id="HDD0D523C93A249DCBC7EC9B4046CBDE4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airline Passenger Bill of Rights Act of 2009</short-title></quote>.</text></section>
<section id="H9B4301D42D1E40AE81449E026E003375"><enum>2.</enum><header>Airline customer service commitment</header>
<subsection id="H88700F29A46F4ED89222EEAE82E88BAF"><enum>(a)</enum><header>In general</header><text>Chapter 417 of title 49, United States Code, is amended by adding at the end the following:</text>

<subchapter id="HA3D3391C5A004699B100FE56E2CD18FD"><enum>IV</enum><header>Airline Customer Service</header>
<section id="H7AF5D135C62241BBB91D70E1011CA05D"><enum>41781.</enum><header>Air carrier and airport contingency plans for long on-board tarmac delays</header>
<subsection id="HC5EDCE55BC0245A3984029B471C7F4D2"><enum>(a)</enum><header>Definition of tarmac delay</header><text>The term <term>tarmac delay</term> means the holding of an aircraft on the ground before taking off or after landing with no opportunity for its passengers to deplane.</text></subsection>
<subsection id="HF199D6E85AA0421EBE8E90C5B5E95F00"><enum>(b)</enum><header>Submission of air carrier and airport plans</header><text>Not later than 60 days after the date of the enactment of the <short-title>Airline Passenger Bill of Rights Act of 2009</short-title>, each air carrier and airport operator shall submit, in accordance with the requirements under this section, a proposed contingency plan to the Secretary of Transportation for review and approval.</text></subsection>
<subsection commented="no" id="H90BDB8AE420E48279C5B60A2A568EFA"><enum>(c)</enum><header>Minimum standards</header><text>The Secretary of Transportation shall establish minimum standards for elements in contingency plans required to be submitted under this section to ensure that such plans effectively address long on-board tarmac delays and provide for the health and safety of passengers and crew.</text></subsection>
<subsection id="H8A65024B48FA462E008D3513A6C5E155"><enum>(d)</enum><header>Air carrier plans</header><text>The plan shall require each air carrier to implement at a minimum the following:</text>
<paragraph id="HF345E7E1FFDE468C9D8961E5AB525861"><enum>(1)</enum><header>Provision of essential services</header><text>Each air carrier shall provide for the essential needs of passengers on board an aircraft at an airport in any case in which the departure of a flight is delayed or disembarkation of passengers on an arriving flight that has landed is substantially delayed, including—</text>
<subparagraph id="H1D1AF90465954BF08850D79180759140"><enum>(A)</enum><text>adequate food and potable water;</text></subparagraph>
<subparagraph id="H20F43AD3C5914964B5B0A3B5E44B1400"><enum>(B)</enum><text>adequate restroom facilities;</text></subparagraph>
<subparagraph id="HC6F2F86E28BD49AFB0B3BE9DA72CCF35"><enum>(C)</enum><text>cabin ventilation and comfortable cabin temperatures; and</text></subparagraph>
<subparagraph id="H4CFA963060DE4944AD111CE3006315BB"><enum>(D)</enum><text>access to necessary medical treatment.</text></subparagraph></paragraph>
<paragraph id="H6D709C5B5AF1464190D999EBBCAFC2FA"><enum>(2)</enum><header>Right to deplane</header>
<subparagraph id="H8F8C876E97B4460C8F7D03D55121579E"><enum>(A)</enum><header>In general</header><text>Each air carrier shall submit a proposed contingency plan to the Secretary of Transportation that identifies a clear time frame under which passengers would be permitted to deplane a delayed aircraft. After the Secretary has reviewed and approved the proposed plan, the air carrier shall make the plan available to the public.</text></subparagraph>
<subparagraph id="H9028B807DB2245B2865D73EFB135A483"><enum>(B)</enum><header>Delays</header>
<clause id="H1B34FF4668E7446FA57229145D008D12"><enum>(i)</enum><header>In general</header><text>As part of the plan, except as provided under clause (iii), an air carrier shall provide passengers with the option of deplaning and returning to the terminal at which such deplaning could be safely completed, or deplaning at the terminal if—</text>
<subclause id="HC7EE3906369D41958ED802C760A42B11"><enum>(I)</enum><text>3 hours have elapsed after passengers have boarded the aircraft, the aircraft doors are closed, and the aircraft has not departed; or</text></subclause>
<subclause id="H1D50A373EB584AC1B6AA1E10F6008305"><enum>(II)</enum><text>3 hours have elapsed after the aircraft has landed and the passengers on the aircraft have been unable to deplane.</text></subclause></clause>
<clause id="HD74780C2DDE24DBC8C299F095F172979"><enum>(ii)</enum><header>Frequency</header><text>The option described in clause (i) shall be offered to passengers at a minimum not less often than once during each successive 3-hour period that the plane remains on the ground.</text></clause>
<clause id="HCC48B250D2FB4AE79B10D89157DDA385"><enum>(iii)</enum><header>Exceptions</header><text>This subparagraph shall not apply if—</text>
<subclause id="H1585A3F92E004061B2540090B0EBCD20"><enum>(I)</enum><text>the pilot of such aircraft reasonably determines that the aircraft will depart or be unloaded at the terminal not later than 30 minutes after the 3 hour delay; or</text></subclause>
<subclause id="H6A853EFACDE44ABDA6DA926FC65BCA00"><enum>(II)</enum><text>the pilot of such aircraft reasonably determines that permitting a passenger to deplane would jeopardize passenger safety or security.</text></subclause></clause></subparagraph>
<subparagraph id="HBA1349ABA7C24F918DBF8E78E9C4E577"><enum>(C)</enum><header>Application to diverted flights</header><text>This section applies to aircraft without regard to whether they have been diverted to an airport other than the original destination.</text></subparagraph>
<subparagraph id="H191B5533BCE84890967B1D4127860036"><enum>(D)</enum><header>Reports</header><text>Not later than 30 days after any flight experiences a tarmac delay lasting at least 3 hours, the air carrier responsible for such flight shall submit a written description of the incident and its resolution to the Aviation Consumer Protection Office of the Department of Transportation.</text></subparagraph></paragraph></subsection>
<subsection id="H00E595AC57764630AE4400E92CB44B11"><enum>(e)</enum><header>Airport plans</header><text>Each airport operator shall submit a proposed contingency plan under subsection (b) that contains a description of—</text>
<paragraph id="H1971E5776FB24C48945236B6CD5884EA"><enum>(1)</enum><text>how the airport operator will provide for the deplanement of passengers following a long tarmac delay; and</text></paragraph>
<paragraph id="H1FA03AE6EA5B424C88BCF9A524579F40"><enum>(2)</enum><text>how, to the maximum extent practicable, the airport operator will provide for the sharing of facilities and make gates available at the airport for use by aircraft experiencing such delays.</text></paragraph></subsection>
<subsection id="HB4D8835C45AA4F03AA6C7282CF153F45"><enum>(f)</enum><header>Updates</header><text>The Secretary shall require periodic reviews and updates of the plans as necessary.</text></subsection>
<subsection id="HE7375CE924E24A3FAA7C54679E83A79E"><enum>(g)</enum><header>Approval</header>
<paragraph id="H6AAB39208BE84433A0E58D83435B0028"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of the enactment of this section, the Secretary of Transportation shall—</text>
<subparagraph id="HCA54FD8508354EDB8CA670D3BC4B4EEA"><enum>(A)</enum><text>review the initial contingency plans submitted under subsection (b); and</text></subparagraph>
<subparagraph id="HDF0A2B9CADD94C59ACCC7D7B079BBFFD"><enum>(B)</enum><text>approve plans that closely adhere to the standards described in subsections (d) or (e), whichever is applicable.</text></subparagraph></paragraph>
<paragraph id="HD1D8E59BAE634D30B06705BC93324B99"><enum>(2)</enum><header>Updates</header><text>Not later than 60 days after the submission of an update under subsection (f) or an initial contingency plan by a new air carrier or airport, the Secretary shall—</text>
<subparagraph id="HE9975C3999EF445DB5C4CB2F08B1003F"><enum>(A)</enum><text>review the plan; and</text></subparagraph>
<subparagraph id="H1DF530D439664CCAA742EB4676DFFEA8"><enum>(B)</enum><text>approve the plan if it closely adheres to the standards described in subsections (d) or (e), which ever is applicable.</text></subparagraph></paragraph></subsection>
<subsection id="H6275ABB381BF4BD9903467AEA137D1DE"><enum>(h)</enum><header>Civil penalties</header><text>The Secretary may assess a civil penalty under section 46301 against any air carrier or airport operator that does not submit, obtain approval of, or adhere to a contingency plan submitted under this section.</text></subsection>
<subsection id="HE3F0575BFE0D44998B02D90066E727B"><enum>(i)</enum><header>Public access</header><text>Each air carrier and airport operator required to submit a contingency plan under this section shall ensure public access to an approved plan under this section by—</text>
<paragraph id="H03343914E16E4B2AB663262902C847A1"><enum>(1)</enum><text>including the plan on the Internet Web site of the carrier or airport; or</text></paragraph>
<paragraph id="H9D9CA0A2B95C4006948982C2D52D59A6"><enum>(2)</enum><text>disseminating the plan by other means, as determined by the Secretary.</text></paragraph></subsection></section>
<section id="HF32DEB62ADBA4670820087D380AFDB52"><enum>41782.</enum><header>Air passenger complaints hotline and information</header>
<subsection id="H0747320D5577484E8B85A359FFAF00EA"><enum>(a)</enum><header>Air passenger complaints hotline telephone number</header><text>The Secretary of Transportation shall establish a consumer complaints hotline telephone number for the use of air passengers.</text></subsection>
<subsection id="H479A06EE4F614ED386302332B1FF8276"><enum>(b)</enum><header>Public notice</header><text>The Secretary shall notify the public of the telephone number established under subsection (a).</text></subsection>
<subsection id="HE3B73C3DAF7A4A94B7949F6D9D0026B0"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section, which sums shall remain available until expended.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H52D97F2D47FB4980B4534282367E0051"><enum>(b)</enum><header>Conforming amendment</header><text>The chapter analysis for chapter 417 of title 49, United States Code, is amended by adding at the end the following:</text>
