<official-title>To amend title 18, United States Code, to require the electronic recording of custodial interrogations in Federal criminal cases.</official-title>

<section id="H1126993B548242A79519F3075745AC9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Effective Law Enforcement Through Transparent Interrogations Act of 2010</short-title></quote>.</text></section> 
<section id="H9536E12DDE294F6EB64361A99904534E"><enum>2.</enum><header>Recording of Federal investigative interrogations</header> 
<subsection id="HBB0E8F4004D949F0AB275B7AFE7C1C6E"><enum>(a)</enum><header>In general</header><text>Chapter 223 of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H19A7CCCF8D8C4052AA52B59F84F44D65" style="USC"> 
<section id="HF56EFD840A974A6897A9075CF9C4321E"><enum>3512.</enum><header>Recording of Federal investigative interrogations</header> 
<subsection id="H1A402C2C2DB84BE085990A6DE81D84D1"><enum>(a)</enum><header>Generally required</header><text display-inline="yes-display-inline">Except as provided in this section, a statement by an individual during a custodial interrogation that is not electronically recorded, and all statements made thereafter by such individual during such interrogation, including statements that are electronically recorded, are inadmissible against such individual in a prosecution for a Federal felony.</text></subsection> 
<subsection id="H40A800A37E224EF996ACDCD4B1E12409"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) does not apply if the court determines an imminent threat of bodily injury or other exigent circumstance made the electronic recording of a custodial interrogation impracticable.</text></subsection> 
<subsection id="H4913F904D26E4C9FBD367ACB955A9E7E"><enum>(c)</enum><header>Availability to person interrogated</header><text>The Attorney General shall make available a copy of a electronic recording of a custodial interrogation to the individual who was subject to such interrogation.</text></subsection> 
<subsection id="H60876FF7925C4C10A7F813F8ABC4A351"><enum>(d)</enum><header>Handling and preservation of electronic recording</header> 
<paragraph id="HBD8ACE1F98724C72957B0E9CE654FB25"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall identify and catalogue any electronic recording of a custodial interrogation made pursuant to this section.</text></paragraph> 
<paragraph id="H9794C051986D47058F8859DB08374ABE"><enum>(2)</enum><header>Length of preservation</header><text display-inline="yes-display-inline">An electronic recording of a custodial interrogation catalogued under paragraph (1) shall not be destroyed or altered in any way until—</text> 
<subparagraph id="H2034551CE1BC4B6588BC6244FEB7ABCE"><enum>(A)</enum><text display-inline="yes-display-inline">all appeals, post-conviction, habeas corpus proceedings, and all other orders and judgements with respect to an individual who was subject to such interrogation are final;</text></subparagraph> 
<subparagraph id="HA122F3A087694077A037B8D530F82ABB"><enum>(B)</enum><text>the deadline by which such individual must file such proceedings or has expired; or</text></subparagraph> 
<subparagraph id="HD44A9C1DFAFF44619126823DF865531E"><enum>(C)</enum><text>the statute of limitations of the Federal felony, or any related offenses, for which such individual was subject to such interrogation has expired.</text> </subparagraph></paragraph> 
<paragraph id="H5F2C76C4F96E4EC582480D9D44885FB1" display-inline="no-display-inline"><enum>(3)</enum><header>Election of longer preservation</header><text display-inline="yes-display-inline">Upon petition by an individual, the court may order that a copy of an electronic recording of a custodial interrogation of such individual be preserved beyond the periods of time listed under paragraph (2).</text></paragraph></subsection> 
<subsection id="H0767A5AF24804F28A881B12D12E0391E"><enum>(e)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H4800988A41E347FEB79E51A179934703"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>custodial interrogation</quote> means an interview which occurs while an individual is in custody involving a law enforcement officer’s questioning that is reasonably likely to elicit incriminating responses;</text></paragraph> 
<paragraph id="HD64E69FDE290478BB29A83D678E920A5"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>electronic recording</quote> means an authentic, accurate, unaltered, and complete audio and visual record, including a motion picture, videotape, audio tape, or digital recording, beginning with the law enforcement officer’s advice of the individual’s constitutional rights and ending when the custodial interrogation has finished, but that—</text> 
<subparagraph id="H0424A61726B74E6FA475B88C0FCCCCDC"><enum>(A)</enum><text>an audio recording of a custodial interrogation may be considered an electronic recording when an audio and visual recording is not practicable; and</text></subparagraph> 
<subparagraph id="H8C1D972583F0475998D0FDBE5E3F8F57"><enum>(B)</enum><text>if a visual recording is made of a custodial interrogation, any camera used in making such recording shall be focused on both the law enforcement officer conducting such interrogation and the individual subject to such interrogation; </text></subparagraph></paragraph> 
<paragraph id="HAA829277257748F9BEEC186CDA0706EC"><enum>(3)</enum><text>the term <quote>law enforcement officer</quote> means an individual acting with public authority to investigate or prosecute a criminal offense; and</text></paragraph> 
<paragraph id="H52E560E9F15C4AF2A8D06095243AECCC"><enum>(4)</enum><text display-inline="yes-display-inline">the term <quote>statement</quote> means an oral, written, sign language, or nonverbal communication.</text></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H98F522C985EA42AE95674E099C1324DF"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 223 of title 18, United States Code, is amended by adding at the end the following new item:</text>

<subsection id="H4809ACAB0D324269BE270EC20A0FE6B7"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply in all proceedings commenced after the date of enactment of this Act and, insofar as is just and practicable, in all proceedings pending on such date of enactment.</text></subsection></section>
