		<official-title>To authorize the Secretary of the Interior to issue
		  permits for a microhydro project in nonwilderness areas within the boundaries
		  of Denali National Park and Preserve, to acquire land for Denali National Park
		  and Preserve from Doyon Tourism, Inc., and for other purposes.</official-title>

		<section id="HD5917218AF8C4D2886F5093DB6896006" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kantishna Hills Renewable Energy Act
			 of 2010</short-title></quote>.</text>
		</section><section id="H62343896D4F34B679E94F775DCE5E986" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HE9424B1D7A9349D5988E092239F59919"><enum>(1)</enum><header>Appurtenance</header><text>The
			 term <term>appurtenance</term> includes—</text>
				<subparagraph id="HEC28E87F7ABF4FE88B0B20825DBC3CDC"><enum>(A)</enum><text>transmissions
			 lines;</text>
				</subparagraph><subparagraph id="H0750D2E3037C4AD1950858EB3EBD1A40"><enum>(B)</enum><text>distribution
			 lines;</text>
				</subparagraph><subparagraph id="HCDCD53AA14B6495AB0F4F29A2F3FA0D2"><enum>(C)</enum><text>signs;</text>
				</subparagraph><subparagraph id="H250100C00712427B94657779813A09C4"><enum>(D)</enum><text>buried
			 communication;</text>
				</subparagraph><subparagraph id="H014D127285A443808091ADADA6A8DB3D"><enum>(E)</enum><text>maintenance roads;
			 and</text>
				</subparagraph><subparagraph id="H785C10EC752842F791170F54FCB83A1E"><enum>(F)</enum><text>electric
			 cables.</text>
				</subparagraph></paragraph><paragraph id="HC5222BD5904443098153680F7778986D"><enum>(2)</enum><header>Kantishna Hills
			 area</header><text>The term <term>Kantishna Hills area</term> means the area of
			 the Park located within 2 miles of Moose Creek, as indicated on the map.</text>
			</paragraph><paragraph id="H451BCBB000DD49399062CE852CF3FEB5"><enum>(3)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Doyon-Kantishna Land
			 Exchange Map</quote> and dated ____________.</text>
			</paragraph><paragraph id="HC3C0E97D046F4DD99C22BECA4EBD2918"><enum>(4)</enum><header>Microhydro
			 project</header>
				<subparagraph id="H66D19B4249524E7683B2F795BDCC1B6C"><enum>(A)</enum><header>In
			 general</header><text>The term <term>microhydro project</term> means a
			 hydroelectric power generating facility with a maximum power generation
			 capability of less than 100 kilowatts.</text>
				</subparagraph><subparagraph id="HBF244509EFA64889BA0F7E3A1CB56F63"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>microhydro project</term> includes—</text>
					<clause id="HA14CAE3B87BB453F97ABEA53C93098C4"><enum>(i)</enum><text>the
			 intake pipeline located on Eureka Creek, approximately <fraction>1/2</fraction>
			 mile upstream from the Park Road, as depicted on the map;</text>
					</clause><clause id="HBB619AD55AD34C4C836D87CE792F8EAB"><enum>(ii)</enum><text>each system
			 appurtenance of the microhydro project; and</text>
					</clause><clause id="HE5CAF4CD5C8C4455B2F733C1EBF174D2"><enum>(iii)</enum><text>any distribution
			 or transmission line required to serve the Kantishna Hills area.</text>
					</clause></subparagraph></paragraph><paragraph id="H96676B9AE8C14C71B15A47F59E884109"><enum>(5)</enum><header>Park</header><text>The
			 term <term>Park</term> means the Denali National Park and Preserve in the State
			 of Alaska.</text>
			</paragraph><paragraph id="HC9C6469C01C34060922BC4F07583C6FA"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="HA03D7975E98D444E8C152F93E36F95CD"><enum>3.</enum><header>Permit for
			 microhydro project</header>
			<subsection id="H2EE322D3C9524EB2A76EE8FF4ECAA689"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsection (b), not later than 180 days after
			 the date of enactment of this Act, the Secretary shall issue in nonwilderness
			 areas within the boundaries of the Park permits for the microhydro
			 project.</text>
			</subsection><subsection id="HEACF7793D1BA4A6FBEC7D5D16075D44B"><enum>(b)</enum><header>Terms and
			 conditions</header><text>Each permit under subsection (a) shall be—</text>
				<paragraph id="H097D1BC7E0EA44C38B52742CB9F0421E"><enum>(1)</enum><text>issued in
			 accordance with such terms and conditions as are generally applicable to
			 rights-of-way within units of the National Park System; and</text>
				</paragraph><paragraph id="H533B35831A4D47658E65D53A979F22A4"><enum>(2)</enum><text>subject to such
			 other reasonable terms and conditions as the Secretary determines to be
			 necessary to protect the purposes and values of the Park.</text>
				</paragraph></subsection></section><section id="H191F7F93B9B44F8DAA9573403055A3A4"><enum>4.</enum><header>Land
			 exchange</header>
			<subsection id="H75DD93CB63BF4FC4BF4381157F076306"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsection (d), the Secretary shall exchange
			 the approximately 18 acres of land within the boundary of the Park, as
			 generally depicted on the map, for the approximately 18 acres of land owned by
			 Doyon Tourism, Inc., as generally depicted on the map.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H06D1B7CD81074FF5A7BD5510322C7D72"><enum>(b)</enum><header>Map
			 availability</header><text>The map shall be on file and available for public
			 inspection in the appropriate offices of the National Park Service.</text>
			</subsection><subsection id="H1BA7F272C3734A5EA8FD3E01B9F7731D"><enum>(c)</enum><header>Timing</header><text>The
			 Secretary shall seek to complete the exchange under this section by not later
			 than February 1, 2015.</text>
			</subsection><subsection id="H33AB37C0206747D09D0101CF6DB99626"><enum>(d)</enum><header>Applicable laws;
			 terms and conditions</header><text>The exchange under this section shall be
			 subject to—</text>
				<paragraph id="H3838DDBA8E054042BF0B08F92BCF905C"><enum>(1)</enum><text>the laws
			 (including regulations) and policies applicable to exchanges of land
			 administered by the National Park Service, including the laws and policies
			 concerning land appraisals and equalization of values; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43370302C65948D3BC633655993F8BBC"><enum>(2)</enum><text>such terms and
			 conditions as the Secretary considers to be appropriate.</text>
				</paragraph></subsection><subsection id="H3FEA5D48A09B45E7B02536EE41E74F49"><enum>(e)</enum><header>Equalization of
			 values</header><text>If the tracts proposed for exchange under this section are
			 determined not to be equal in value, an equalization of values may be achieved
			 by adjusting the quantity of acres described in subsection (a).</text>
			</subsection><subsection id="H1C2EAE3771BB4577A00B69DCCBFE6911"><enum>(f)</enum><header>Administration</header><text>The
			 land acquired by the Secretary pursuant to the exchange under this section
			 shall be administered as part of the Park.</text>
