		  Edward Byrne Memorial Justice Assistance Grant Program for providing certain
		  services to victims of sexual assault or rape, and for other

		<section id="H22FF27ACD81F41C1BE214B6D554D79F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Justice for Rape Victims and Improving
			 Use of DNA Evidence Act of 2010</short-title></quote>.</text>
		</section><section id="H8CA00433145D419DA94D6BF08A6341AE"><enum>2.</enum><header>Incentive funds
			 under the Byrne Grant Program for States and units of local government that
			 provide certain services to victims of sexual assault</header><text display-inline="no-display-inline">Section 505 of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (42 U.S.C. 3754) is amended by adding at the end the
			 following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HC713F30BDE2A4904885070D38C363745" style="OLC">
				<subsection id="H84F618FF1FB24C168F0429095EE513F9"><enum>(i)</enum><header>Incentive funds
				for providing certain services to victims of sexual assault and establishing
				rape kit databases</header>
					<paragraph id="HCE5A66DBC9BC404D85FF038623B1AEA6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The amounts allocated
				under this section to a State or unit of local government for a fiscal year
				(beginning with the first fiscal year that begins at least one year from the
				date of the enactment of this subsection) shall be increased by 10 percent if
				such State or unit of local government provides and certifies in accordance
				with such standards as the Attorney General may require, that the State or unit
				of local government had in effect, for the previous fiscal year, each of the
				following:</text>
						<subparagraph id="H19DD6B761BFB48DDAAB9F6E2402C08D6"><enum>(A)</enum><header>Examination and
				testing of rape kit</header><text>A process to provide to each victim of sexual
				assault, with respect to an act of sexual assault over which the State or unit
				of local government has jurisdiction, each of the following:</text>
							<clause id="HB98CBB6E93D94D8DB362E4C483BE7525"><enum>(i)</enum><text>Examination by a
				qualified sexual assault nurse examiner to collect a rape kit from such
				victim.</text>
							</clause><clause id="HC60F9989C211464B8B1E1BA8D3163CF5"><enum>(ii)</enum><text>Testing of any
				rape kit collected from such victim and the furnishing of any results from such
				test to the victim not later than 180 days after the date on which such testing
				was requested.</text>
							</clause></subparagraph><subparagraph id="H34E278F8D05346A0B067BE9D46000156"><enum>(B)</enum><header>Rape kit
				database</header><text display-inline="yes-display-inline">A database developed
				and maintained by such State or unit of local government related to rape kits
				collected, in connection with acts of sexual assault over which the State or
				unit of local government has jurisdiction, from victims of such acts that
				complies with the following requirements:</text>
							<clause id="H3400EF74E0844149A2BBFE05AC8038E1"><enum>(i)</enum><text>The database, for
				each rape kit collected from each victim of sexual assault, provides for the
				following:</text>
								<subclause id="H22526B63BE7E4C2BB15FF403F4587D94"><enum>(I)</enum><text display-inline="yes-display-inline">Identifies such rape kit by a unique
				identifying number.</text>
								</subclause><subclause id="H90DA55BF6FB94472B473C608F10DEA0B"><enum>(II)</enum><text>The database
				contains information on the date and location of each of the following:</text>
									<item id="HE38A721DDC6646F6992AA9A20389A6CF"><enum>(aa)</enum><text>The
				act of sexual assault for which such rape kit was collected.</text>
									</item><item id="H671BDF0DEDF547CFA68A28BBB29EE73F"><enum>(bb)</enum><text>The
				medical examination conducted from which such rape kit was collected.</text>
									</item><item id="H4B0D60B505B441F9B30DF6ADA53B6127"><enum>(cc)</enum><text>The
				testing of such rape kit.</text>
									</item></subclause><subclause id="HF657A5696C864DF793B5CD2D4645622E"><enum>(III)</enum><text>The database
				contains information on the real-time physical location of such rape kit,
				including street address, locality, and State.</text>
								</subclause><subclause id="HDAB2961C011545568598484D95F406A0"><enum>(IV)</enum><text>The database
				contains information on the results of any testing of such rape kit.</text>
								</subclause></clause><clause id="H029708FC17274AD58B879D336BA4B713"><enum>(ii)</enum><text display-inline="yes-display-inline">Information contained in the database, with
				respect to a rape kit, may be made available only as follows:</text>
								<subclause id="HAF10D2B0A92343C8965F9D97861C70E3"><enum>(I)</enum><text display-inline="yes-display-inline">On a publically available Internet site but
				only to the extent that such information does not include any personally
				identifiable information (including the name of the victim associated with a
				unique identifying number).</text>
								</subclause><subclause id="H25715FDB24744B4599DF37F7B8A2AD4C"><enum>(II)</enum><text display-inline="yes-display-inline">To criminal justice agencies for law
				enforcement identification purposes.</text>
								</subclause><subclause id="H9EECE3543BDB49F19B4298E192F9932D"><enum>(III)</enum><text>In judicial
				proceedings, if otherwise admissible pursuant to applicable statutes or
				rules.</text>
								</subclause><subclause id="HC704342F818949AF8F8B5FCEB202E55A"><enum>(IV)</enum><text>To a physican or
				nurse who is treating a victim of sexual assault from whom the rape kit was
				collected for injuries resulting from the sexual assault of such victim or with
				respect to the collection of such rape kit, but only insofar as the information
				relates to such treatment.</text>
								</subclause><subclause id="HCD49B690414B4CD1AEA87A4C6286E369"><enum>(V)</enum><text>To the victim of
				sexual assault from whom the rape kit was collected, if the information made
				available is limited to information relating to the rape kit collected from
				such victim.</text>
								</subclause></clause><clause id="HE5DE753DF9D44676BD08F12429B9A7E4"><enum>(iii)</enum><text>Information
				contained in such database shall be searchable by any of the criteria specified
				in clause (i), subject to the availability of such information under clause
				(ii).</text>
							</clause><clause id="HBBF8359E20D04B03910E7CD3FCAE1CFB"><enum>(iv)</enum><text>Access for
				purposes of data entry and editing (including updating) of such database shall
				be limited to appropriate individuals of a State or local law enforcement
				agency.</text>
							</clause></subparagraph></paragraph><paragraph id="H6070DA41A8D343A6928AADDC9C8D47C4"><enum>(2)</enum><header>Funding</header>
						<subparagraph id="HF9506DB8F4E84E6D9440F1FB5602CD46"><enum>(A)</enum><header>Ratable
				reduction for insufficient funds</header><text display-inline="yes-display-inline">If there are insufficient funds for a
				fiscal year to allocate to each State or unit of local government the amount of
				incentive funds that such State or unit of local government is otherwise
				eligible to receive under this subsection, the Attorney General shall ratably
				reduce the allotment to all States and units of local government based on the
				proportionate share each State or unit of local government received under this
				section (before the application of this subsection) for the preceding fiscal
				year.</text>
						</subparagraph><subparagraph id="H490A2737EBA44218833164B1F29ABB6E"><enum>(B)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">In addition to
				funds made available under section 508, there is authorized to be appropriated
				for incentive funds under this subsection such sums as may be necessary for
				each of the fiscal years 2011 through 2015.</text>
						</subparagraph></paragraph><paragraph id="HC7FBB96D9E7948F3919F00C57361533B"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection:</text>
						<subparagraph id="H644CC840BA884CF0ABBAA5EAE7749D6E"><enum>(A)</enum><text>The term
				<term>sexual assault</term> has the meaning given such term in section 40002(a)
				of the Violence Against Women Act of 1994 (42 U.S.C. 13925a(a)).</text>
						</subparagraph><subparagraph id="H7080E850E1354E49A40D34AB6F7BAFB8"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>victim of sexual
				assault</term> means an individual who seeks medical treatment or care for an
				injury sustained as a result of sexual assault and reports such injury to a
				local or State law enforcement officer or agency.</text>
						</subparagraph><subparagraph id="H25B9A5752B814D33AF06909B618C5F63"><enum>(C)</enum><text>The term
				<term>rape kit</term> means DNA evidence obtained related to sexual
				assault.</text>
						</subparagraph><subparagraph id="HA51E6BD9768F4240B65A892A5BF1ED7E"><enum>(D)</enum><text>The term
				<term>qualified sexual assault nurse examiner</term> means a nurse that has
				obtained certification from a hospital, governmental entity, or an appopriate
				institution of higher education (as defined in section 102 of the Higher
				Education Act of 1965 (20 U.S.C. 1002)), for the collection of rape kits from
				victims of sexual assault.</text>
						</subparagraph><subparagraph id="HEFDD798F78EA460592C6FEDEAFEFC6D0"><enum>(E)</enum><text display-inline="yes-display-inline">The term <term>tested</term> means, with
				respect to a rape kit, that such rape kit has undergone forensic
				analysis.</text>
						</subparagraph><subparagraph id="H8C94B06D0517413791D21E6A81AE1443"><enum>(F)</enum><text>The term
				<term>unique identifying number</term> means a series of letters, numbers, or a
				combination thereof, that a law enforcement agency assigns to a rape kit
				that—</text>
							<clause id="HD27FA159D8DC43799E4B1D44C0F72F94"><enum>(i)</enum><text>such agency
				receives in connection with an act of sexual assault; and</text>
							</clause><clause id="H02A0FF1C7A6D4B95A19E5A5A30F891DF"><enum>(ii)</enum><text>is used in place
				of the name of a victim of sexual assault in the database established under
				this subsection except if the person accessing the database is the victim of
				sexual assault or a member of a law enforcement
				agency.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HDDC1E22267AF4851A18FBDBEDF579418"><enum>3.</enum><header>Study and report
			 on DNA backlog</header><text display-inline="no-display-inline">Subsection (g)
			 of section 2 of the DNA Analysis Backlog Elimination Act of 2000 (42 U.S.C.
			 14135(g)) is amended—</text>
			<paragraph id="H6E3F7F127E104E41AD8A69C091261A8D"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), and
			 (3) as subparagraphs (A), (B), and (C), respectively;</text>
			</paragraph><paragraph id="HDE442B645C6F40039A1D1AAB16828092"><enum>(2)</enum><text>by moving
			 subparagraphs (A), (B), and (C) (as so redesignated by paragraph (1) of this
			 section) two ems to the right;</text>
			</paragraph><paragraph id="H0C017B4C7C1B4630B659ADF36D6E9967"><enum>(3)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(g)
			 <header-in-text level="subsection" style="OLC">Reports to
			 Congress—</header-in-text></enum-in-header></header-in-text>Not</quote> and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H840171EF762743D5A2FCCFDAF442B867" style="OLC">
					<subsection id="H68F6A6E088064A4795C3A31314A43E9C"><enum>(g)</enum><header>Reports to
				Congress</header>
						<paragraph id="H5DC7F5C86B4447FB81DD64513F2715B5"><enum>(1)</enum><header>In
				general</header><text>Not</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HDC2CAA81423F468A887DC0A003D54B2E"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H431F1510842D4F0B9D01BD356F280161" style="OLC">
					<paragraph id="HA1E2C909EBB94C0AB845EEE78DD730F8"><enum>(2)</enum><header>Study and report
				to Congress on DNA backlog</header>
						<subparagraph id="HCBD6E38BB1DF4BE2AF5D1A41864F2D35"><enum>(A)</enum><header>Study</header><text>The
				Attorney General shall conduct a study to determine the extent of the backlog
				in the United States relating to the analysis of DNA samples collected from
				crime scenes, victims, suspects, arrestees, and convicted offenders. Such study
				shall determine the following:</text>
							<clause id="H4186987DE5974B25A0736F6B3F625E61"><enum>(i)</enum><text>The number of each
				of the following:</text>
								<subclause id="H1BC1E6F8237F4364BCB5745385FB5D29"><enum>(I)</enum><text display-inline="yes-display-inline">DNA samples that have been prepared to be
				sent to a public or private crime laboratory for forensic analysis but have not
				been sent to such laboratory.</text>
								</subclause><subclause id="HB0439C0351C24DC9862F3C108E36FEFE"><enum>(II)</enum><text display-inline="yes-display-inline">Investigations for which DNA samples
				described in subclause (I) have been collected.</text>
								</subclause><subclause id="HA8555369DDF7482F9E663CE43BAB7CD9"><enum>(III)</enum><text>DNA samples that
				have been received by a public or private crime laboratory for forensic
				analysis but have not yet been tested at such laboratory.</text>
								</subclause><subclause id="H51B27EB4F5324ADF9D8E041916829CFB"><enum>(IV)</enum><text>Investigations
				for which DNA samples described in subclause (III) have been collected.</text>
								</subclause></clause><clause id="H5EA695B5965645E89D48F2B5813D5F59"><enum>(ii)</enum><text>For each DNA
				sample and for each investigation for which such samples exist, the average
				duration of the following periods:</text>
								<subclause id="H33080B6F3D584898AEE753D9506D2588"><enum>(I)</enum><text>The period
				beginning on the date that is 30 days after the date each sample is collected
				from victims of sexual assault and ending on the date each sample is sent to a
				public or private crime laboratory to be tested.</text>
								</subclause><subclause id="H37507ECEE3694FA591D6D262D92FD098"><enum>(II)</enum><text display-inline="yes-display-inline">The period beginning on the date that is 30
				days after the date each sample is received by a public or private crime
				laboratory and ending on the date each sample is tested at each such
				laboratory.</text>
								</subclause></clause></subparagraph><subparagraph id="H5C5CB3237D07472AB36EA3E1EA5160E9"><enum>(B)</enum><header>Report</header><text>Not
				later than two years after the date of the enactment of this Act and for each
				year thereafter, the Attorney General shall submit to Congress a report
				containing—</text>
							<clause id="H557F2F66CD1C4048BB466D61FE325D8D"><enum>(i)</enum><text>the results of the
				study conducted under subparagraph (A);</text>
							</clause><clause id="H00D48C3413A04569869FEFB10D95FF03"><enum>(ii)</enum><text>a
				statistical analysis of the data contained in such study, disaggregated by
				jurisdiction, criminal offense, type of DNA evidence tested, if available, and
				any other category of information the Attorney General may require; and</text>
							</clause><clause id="HD760F368A742425B802220E30355D3EE"><enum>(iii)</enum><text>recommendations
				on how to reduce—</text>
								<subclause id="H599E2026C6C4441282A3F2E032257757"><enum>(I)</enum><text>the number of DNA
				samples and investigations that are subject to the conditions described in
				subparagraph (A)(i); and</text>
								</subclause><subclause id="H2CEA7E8DC2004A3DA909F03B0110884B"><enum>(II)</enum><text>the average
				duration of the periods described in subparagraph (A)(ii).</text>
								</subclause></clause></subparagraph><subparagraph id="HC9349379E3934AA186FEBF497402C089"><enum>(C)</enum><header>Definitions</header><text>For
				purposes of this paragraph:</text>
							<clause id="H057B86BACD45492B81D1BAC513F6816B"><enum>(i)</enum><text>The term <term>DNA
				sample</term> means evidence containing human DNA collected by Federal, State,
				local, or tribal law enforcement agencies.</text>
							</clause><clause id="H47A4DBE0052E426E8A68EA31AB5C3F6A"><enum>(ii)</enum><text>The term
				<term>investigation</term> includes any investigatory action taken by a
				Federal, State, tribal, or local law enforcement agency relating to an act of
				sexual assault after such agency receives a report of such act.</text>
							</clause><clause id="H14D61A8BA4184AD48703418941F5E20F"><enum>(iii)</enum><text>The term
				<term>tested</term> means, with respect to a DNA sample that such sample has
				undergone forensic analysis.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
